Capital One frozen credit card

pplied for a Capital One card. I was approved and received the card. The card was activated and I had a number of charges. Then without warning, they froze my credit card. When I called them they said that they needed additional information by Canadian Gov't law to ensure that I am who I say I am. Thats fine but the credit card should not have been issued until they received this additional information. The credit card was useless for at least 4 weeks until the information came n the mail. Then I spent another two weeks asking how Capital One was going to make me a happy customer. Finally I cancelled the account. CAp One was going to offer me a $50 credit if I opened up a new credit card account with them. That is low. After weeks of not getting an answer, this is the best they can do. Switched over to TD Canada rust VISA and I am totally satisfied. They went out of their way to ensure I received my card.

Capital One late charges during near death illness

After months of my relative unable to read or pay bills and placed in a nursing home due to a life threatening illness. I contacted these ### in March 2011 with a letter notifying them of the circumstances for non-payment. No response from them at all! My relative out of the hospital, rehab and then a nursing home contacts their customer service only a few weeks later after recieving a threatening letterJuly 2011 from CAPITAL ONE.
In the discussion reinterrated the conditions for non-payment and inquired as to a possible forgiveness for the added on late charges and fees while she was dying with this illness. They "CLIFFORD" refused to work with her other than demanding payment and continued throwing at the relative "CONTRACTUAL AGREEMENT". Evedently they don't give a RAT's [censored] whether you live or die because they will screw you into your grave. I would not get involved withg these dung eating imbreads! Remember them when the economy levels out if it ever does because of these trashy people handing out credit cards like it was monopoly money. I find it uncanny how many trailer trash have been forgiven by these same people who's intent was to not pay them back yet someone with a ligetimate illness is screwed over by them. I BELIEVE IN A BOYCOTT (an act of voluntarily abstaining from using, buying, or dealing with a person or organization) of ### in business with no ethics of doing the right thing.

Capital One unfair practices

As of May 1, 2011 I had a zero balance with Capital One, this was my small business credit card so it was rarely used. By mid-May I needed to do some upgrades and small investments so I made several purchases and apparently went $100 over my limit. By the next week (bear in mind, this was a week after the purchases were made, no payment was due and I wasn't even close to receiving the first statement in months) I was receiving non-stop phone calls about Capital One collecting on a debt while I was at work. How is this a debt? Have I not yet paid or do you somehow foresee that I will not pay in the future? Why don't you simply send me the statement in a month (it's just normal practices) and then see what happens? Try it, it may work. This is the most unethical practice I have ever encountered. Of all the thousands of "collectors" that have called me continuously, I have spoken to four of them and asked them to "make it make sense" and no one could with the exception of one who stated that she had no idea why Capital One was harassing me and she would stop the phone calls. The phone calls did stop for about two weeks, which I was truly grateful. Capital One maintains that they are calling to collect the over the limit fee, but was it not Capital One that allowed this payment to go through in the first place WITH the addition of an over the limit fee? So what is the point of the harassing phone calls? I have since tried to cancel my card with them, to no avail. The next time I call I have decided that if they want to take the time to harass me, I will do the same! I will just as mean and ugly as they have been. Although I don't condone such immaturity, there is such great satisfaction for me! Thanks for listening.

No. They gave you a credit card with a fixed limit. It was YOU who went over the limit and thought it was no big deal.

Your complaint has no merit and rates right up there with someone purposely late paying their car loan and then complaining that the Collections Agency had the nerve to repo the vehicle back.

Capital One keeping money for interest

My concern is Orchard Bank debits my bank account and then I have to call them to get the amount applied to my account. On the 23rd of April 2009, the bank received a check from me in the amount of $160 that they have not applied to my aaccount, as of May 7, 2009. The bank said that it may take 15 to 30 days to get this posted to my account, remember this is May 7, 2009 approximately 18 days later. This is not the first time this has happened to me. It seems to me that the bank may be using customers funds to boost their bank balance and increase their earnings using customers money. If this were to be the case this would violate both federal and state banking laws. It most certainly would paint a better picture of the banks financial situation if this were to be the case. Customers should be compensated for the payments that have not been posted to their accounts in a timely manner. Why should the bank be allowed to treat customers in this manner. This situation needs to investigated by the proper authorities.

Capital One harrassing phone calls

Harrassing calls twice daily' Monday-Friday for now months. A 800 number w/ a recording stating "it's my last chance to avoid legal action", and to call Mark Dickerson, at [protected] and enter his mgr code: 2710277. Mark is never at his desk, nor does he return my calls. His recording states you have reached the legal dept. at Capital One; and to leave a message, or for immediate help, call mgr. code 2710283 . I am not a Capital One customer nor have I ever been. This call originates in Virgina and is computer generated everyday 11:35 am and 5:40pm.

I have a mortgage with Capital One. I have never been late on a payment (ever). However, I get collection calls every month if the mortgage payment isnet received by them on the 1st of the month. I have a 15 day grace period to pay it and always pay it on time. They call my office, my cell nad my house everyday demanding payment. What is this all about?

Capital One hardship

Since last May we have had a very hard time financially due to medical issues. The bills are still coming in and we are overwhelmed. I have since then been in their hardship plan. However, there are suppose to be other ways to be able to pay down your debt, without just the waiver of the late fee, that is all they offer to me. I want to get my bill paid off without being turned over to collection agency, I deal enough already with them on my medical bills, but they won't work me on the other offers they do offer. I've heard that they can reduce your balance owed and other issues, but I only get told I qualify just for this waiver, which isn't much. I'll never get this bill paid and it is really making me upset, because I have to many other bills to deal with than making arrangements of what I can afford to pay which isn't much, and getting a waiver of late fee. Please help me.

Capital One refusal to reaffirm by loan

Hi, I want to also voice my issues with Capital One Auto -- they are horrible and I cannot stress enough to other consumers never to sign an auto loan with this organization as you will find yourself having the biggest nightmare of your life!

I took out a car loan with them in July, 2008 when I purchased my car from CarMax in Pompano Beach, FL. I have made each and every car payment before due in full and have my bank records to prove it. About two years after taking out my car loan with Capital One Auto, I lost my high paying job and had to file Chapter 7 bankruptcy. However, I reaffirmed my Capital One Loan (excluded it from the bankruptcy proceedings) and my bankruptcy was discharged as such.

Since the inception of my bankruptcy proceedings, I was in contact with Capital One Auto letting them know that I was not including my car loan in the bankruptcy and continued to make each payment on time, in full. To date, I continue to make every payment on time, in full.

Capital One Auto refuses, both verbally and in writing, to acknowledge and accept my reaffirmation and has instead reported to all three credit bureaus that my car loan with them was discharged due to bankruptcy and account closed. I have even enlisted the services of an attorney who sent them a very detailed account of every payment made on time, copy of my statement of reaffirmation, and communicating the negative damage they are inflicting on my credit reports because of this incorrect reporting on their part.

They never responded to my attorney's letter. When I send them a letter, and believe me I have sent many of them, I receive a form letter back from them, basically denying any wrongdoing and confirming that my loan is at a $0 balance and discharged at time of bankruptcy. I have included copy after copy of the Statement of Intent with each letter and they still maintain the position that "I have not reaffirmed my loan with Capital One Auto".

The definition of reaffirm, is to acknowledge the allegiance to a country, obligation, etc. which I have done repeatedly.

I also registered a BBB complaint with the Richmond VA and to date, their representatives continue to assert that I have never reaffirmed my loan!

My attorney has advised that my only option is to file a civil case and that could cost thousands of dollars!

To top it off, I receive monthly account statements showing the remaining balance on my car loan from them, showing last payment made (on time!) and next payment due and the amount. The principal continues to decrease with each new statement.

I also sent them a letter telling them that I would like to surrender the car to them if they will not correct their reporting of my loan to the credit bureaus. They do not even respond to these letters!

So, at this point I am between a rock and a hard place. This company will not acknowledge, nor correctly report my loan to the credit bureaus, and I can't help but wonder if I send in the remaining amount due, just to get rid of this headache, whether they will send me the car title, or just take the car back!

Please do yourself a favor, and never sign for an auto loan with Capital One Auto -- it will be the biggest headache of your life!

Your post was very informative. I do have just a couple of questions, given my particular situation.

1. Since I filed my Chapter 7 without an attorney, but did have the Statement of Affirmation included as filed at the time of discharge, did the court now have to ensure that this Statement of Intention was signed by the finance company before approving the discharge?
2. If I stop making payments, and Capital 1 repossesses the car, can they add any adverse information to my credit reports, such as repro, etc.?

my main complaint is that they won't work with you when trying to catch up on payments.many calls to tell me they are going to come and repo my car. I'm self-employed and i am also a diabetic so sometimes i'm sick and can't work.I told them I would send some over the reg. payment but they said okay but the past due is still due.when we are trying to make up payments why can' they help.

I am in the very beginning stages of a chapter 7. For the first time in my life I have lost control of my fiances, and this is a last resort to gain some ground again. I was reading some of the other statements about re-affirmations, and was wondering id anyone could give me some facts (NOT opinions) about Capital 1 reaffirmation loans. The Bk was and is more than I thought. I was eligible for a 1 month deferment on my Auto loan, so I took advantage i order to come up with part of the lawyers fee to get things rolling. I guess my question is will this hurt my chances? Has anyone gotten the approval form Capital 1 EVEN THOUGH the payment at the time was deferred to the end of the loan?

The statement of intent is just you informing your creditors of what you want to do. What needed to be filed is a reaffirmation agreement. Unfortunately, creditors may not contact anyone involved in an active bankruptcy without the consent of the debtor's atty. With you not having an atty, there was no way to get you the reaff agreement without you calling and requesting it. The court does not care if you reaffirm debts or not. They can't force a creditor to reaffirm any debt. Also since your loan was not reaffirmed, if you surrender the vehicle back to Capital 1, they can not report anything more than discharged in ch 7 bk and repossessed. The repossession part on the cbr alerts other creditors that you no longer have this bill. Capital One can not pursue you for any deficiency balances or fees. Hope this helps.

HI. I understand that your statement of intent is to reaffirm, however that intent has to be followed up by an action. In order to properly reaffirm a debt in bankruptcy, a reaffirmation agreement has to be signed by the finance company, debtor and debtor's atty. The reaffirmation agreement is then filed with court prior to discharge, and the court decides (in some districts) if this a viable debt for you yo re-obligate yourself to. If the court does not object to your reaffirmation agreement, then your debt is then removed from the bankruptcy process. The problem is that atty's do not fully understand this concept, explain this correctly, or they choose not to sign the reaff agreement because they are signing that they agree that you can afford this debt. Most atty's do not want to attest to that. (Many atty's that handle bks are not bk attys and only know very basic bk law) How do I know this. I work in bankruptcy, specifically dealing with auto loans. The only way for the finance companies to protect their interest, is this reaffirmation agreement. Without it, the debtor can simply state "this was included in my bk" when they no longer desire to make the payments. (yes, this has happened). As far as continuing payments, as long as you continue to make the payments, you can continue to drive the vehicle, but it is still part of your bk. You are making voluntary payments. At anytime you can decide to return the collateral without owing any deficiency balances. If you pay the account in full, you should still receive the title, but it will not update on your credit. Bk accounts can't report credit. I hope this helps. I do not work for Capital One.

Capital One fraud

COAF refused to send Title to my new state of residence, said they lost it, so eventually I lost the car because it wasn't registered, got towed, then repossessed by COAF, who sold it at auction for much more than they reported to me when they demanded nearly $25, 000 in deficiency balance. I think they do this to a lot of people, actually, after they've already written off a big amount in bad debt, then make a bundle on it at auction (Manheim) and force consumers to pay much more than they should have to to restore their credit. I have a lawsuit against them in federal court, them and Geico, which company, in cahoots with COAF, canceled my policy without notice. I think COAF also collected from Geico for the car (it was stolen and damaged in the midst of all this).

Teamed up with Geico to steal my car. Geico canceled me without notice, then COAF refused to send title to my new state of residence. Sued. Lost. Whistle blowers in El Paso sent me documents showing that the car was sold with a phony title and not really sold at all, just stockpiled like a stolen car and sold later after a small amount had been deducted from my deficiency balance. Actually, I believe, and the evidence shows, that Geico paid COAF under the table for my car after it was legitimately stolen, then made it disappear with phony titles, false pick up sites, etc. I think this is what they do with the repos. Couldn't get my evidence in at trial, but the Defendants got all kinds of lies introduced as evidence. You can't beat them I guess. They also stole my U.S. Mail and invaded my email account, and the judge wouldn't let me send out a subpoena that would have proven the latter. Car thieves is what they are, aided and abetted by Manheim Auction and the State of Texas. They will repo your car at the slightest provocation because they can triple their money this way. Beware.

Or perhaps there is a way you could join my suit to make it a class action. I'm sure this scam I've uncovered is being perpetrated against many unfortunate consumers. I'm demanding in addition to damages an audit of Capital One and Manheim auction so that people can be reimbursed, but a class action might do the same thing.

Go for it. There are clearly many others like us who have been scammed by this so-called company. I now have testimony, and will soon have documentation if the federal judge approves my sending subpoenas out of state, that they took my repossessed car and sold it at auction in what looks like at least a triple behind-the-scenes deal to make plenty then told me they made practically nothing, using the first fraudulent sale of $2, 600 on a car they say I still owe them nearly $25, 000 on. All this only because they refused to send the Title to my new state of residence. Yes, by all means, get a lawyer and initiate a class action suit. Your lawyer can look up my case in NM federal court: Nancy Lewis v. Capital One and Geico. Let me know if I can help in any way. What did they do to you anyway?

No, COAF allegedly lost the Title and didn't send it to New Mexico as the State requested, having me turn in my South Carolina plates and get temporary for 30 days. I went to the DMV and they said that unless SC was a state that allowed a vehicle owner to apply for a lost title, COAF would have to. SC was not one of those states, so advised COAF of that and they did nothing. Wouldn't even respond. Not fixable without COAF's cooperation, but since fraud was involved in my getting the loan in the first place and I wasn't really the rich ### I was fraudulently portrayed as being, they decided to just dump me this way, repo the car and make more on it that way anyway.

Here is the issue. A statement of intent is just that- a statement of what you intend to do. There is an action that needs to follow. That action is a reaffirmation agreement. When the Bankruptcy laws changed, it gave 2 options, reaffirm (keep out of the bk), surrender, or redeem (essentially refi). If you do not have the reaffirmation agreement signed by the customer and creditor and filed with the court, your car or whatever is part of the debts discharged in the bankruptcy. You are essentially making voluntary payments to get a title. It will not build your credit. A lot of people are mislead by this fact. I work in this industry and answer this particular question daily.

My story is Jan 2011, I was home from work, just relaxing when a tow truck came and took my car. The driver told me that I hadn't made a payment since Sept 2010. Which was a lie, I have bank statements showing otherwise and the money was taken out of my account. My attorney sent them a letter with copies of the statements, never heard back. I now have to sue them. They never notified me about the payments, or even gave me the option to pay the car off. After they stold my car every time that I called I got a different person with a different response, it was terrible.

Well, to say the least I have tried to work things out with Capital One Auto for approximately one year now.
I purchased a used vehicle from Car Max and the auto loan that was offered by them was Capital One Auto. This occurred in July, 2009. Approximately, a year or so later, I lost my high paying job and had no choice but to change my Chapter 13 to a Chapter 7 cause I could no longer continue to make my monthly repayment.

When I drew up the Chapter 7 bankruptcy, I completed a Statement of Intention, indicating my intent not to include my auto loan in the bankruptcy. When my bankruptcy was discharged, it was approved with the car loan, not included in the debts forgiven via the Statement of Intention.

I had called Capital One prior to the discharge and advised them that my loan was not going to be included in the bankruptcy, etc. I also provided them with a copy of the statement of intent.

They reported to the major credit bureaus that my bankruptcy discharged the auto loan debt and that the loan was closed; and that my payments were not current.

I have made every payment since July, 2009 on time for the full amount and have the bank records to prove it. I sent a copy of this payment record, Statement of Intent, plus my original loan paperwork (as they also listed a co-signer on my credit reports -- which was not true), but they continued with their denial of the facts. Also, since the inception of my loan, I receive each month a statement of account from them showing my remaining balance, the payment that was received, and the next due date and payment amount.

In January of this year, I had our company attorney get involved and send all major credit bureaus plus Capital One an extensive letter with all the documentation. The credit bureaus all deleted the Capital One Loan information off of my credit report. However, Capital One never responded to my attorney's letter.

My attorney advised that the next step was to file a civil law suit against them; unfortunately, since he estimated the cost would be more than what I could afford, I could not pursue further.

I've written letters, called them, etc. and they refuse to correct their report to the credit bureaus. My intent is to get rid of the car, pay off the loan, and get a different car -- but I can't do so if I can't prove to other lenders that I have had a car loan for the last two years that I have always paid on time.

Needless to say, they lack any business ethics and care whatsoever about their customers. I am desperate to resolve this issue but don't know what to do next to resolve this.

Is there perhaps a attorney that would be willing to help all of us that have been abused by Capital One Auto?

Capital One bad customer service

The only, only reason to have a Capital One credit card is that they do not charge foreign exchange fees. Otherwise, their card is nothing and customer service even worse. I just came back from Italy and found out that my hotel in Florence had placed an unauthorized charge on the bill after I had checked out with a zero balance. The hotel claimed to know nothing about the charge (therefore, there was nothing to remove), so I asked Cap One to do a chargeback. I had to submit documents 3 times! They asked for the credit card receipt (doh! Why would a receipt be generated for a fraudulent charge?) and said they would close out the inquiry if I didn't provide it! What a JOKE! Did these guys graduate from the third grade?

Capital One chasing justice

continual calling, even thought I explained the situation to them. That I was now going through a Credit Bureau. That because they closed the doors to where I work, and I knew I couldn't afford my bills, I took the only avenue open to me, and that was going to a Credit Council Bureau. They said they did not recognize them (upon their next phone call), which I later found out to be false. They called 4 more times. Thrice more I explained. Then I told them I was through an agency, and hung up on them. I called the Credit Bureau I was dealing with. I explained again to the next caller the letter had been sent out. They said I could expect calls daily, as they didn't recognize the Credit Bureau. They continue to call, I hang up.

Hello,

Ask the credit bureau your dealing with to send you a cease and desist letter so that you can sign and then send over to capital one or the collection agency that is now calling. That should stop the calls for a bit at least.

Capital One terrible service

My bank used to be to North Fork Bank and before that was Greenpoint Savings Bank, now it is Capital One. Service in my bank used to be great, they catered to the neighborhood, but now everything has changed. They upgrade the banks look, but downgraded customer service. They completely change most of the employees. They do not have have a full time branch manager or he is just never there. They are looking to get you with every $35.00 service fee, they can possible get you for and if you call up to complain, they say that this is our policy, if you do not like it, do not bank with us. Greed is Good

Capital One Bank credit card division is imo a borderline predatory company, so I have little doubt that any brick and morter bank of the same name will be much better.

Capital One rates and terms

DO NOT do business with this company. Capital One should change their motto to ' Take what you can. Give nothin' back ! " We have been Capital One customers for over a decade. Until about two years ago all went well. We have superb credit scores and have NEVER been late on a payment. Our initial rate was 6.9%, but two years ago it suddenly jumped to 12.9%. No explaination other than they had the right to change terms. Today's statement shows a rate increase to 16.9%, again with no explaination other than " we have the right ..." This company expects me to keep my part of the agreement or they'll penalize me, but they can do as they damn well please. My choices are 1) Suck it up and bend over or 2) close the account and move on. SOME isn't enough---- they want ALL OR NOTHING. And nothing is exactly what they'll get.

Capital One loan modification scam

Please, please don't fall for this or take out a loan at Cap One! Or at least check them out thoroughly on the web, they are even worse than I am experiencing; I fear the worst is yet to come. I am on disability for some years and my finances have gone down down down. Buying a different car than the very old one I had was pretty much a necessity due to my location and situation. However, I had pretty much given up due to my credit score and bad loans/scams that are around for people like me. But, I eventually found (or he found me) a smooth Saturn salesman (no, they are not "different" from any other dealer and their cars are just GM cars, like Chevy Cavaliers, etc, in new clothes) who seemed very sympathetic to my plight. I told him my loan requirements and payment limit. I also told him of my credit problems. He assured me that he could put me in a good demo on my terms. I had hope as I had believed what I had heard from uninformed Saturn owners who had no issues and Saturn had great PR until they were found out. I had no reason to believe I was totally being scammed, although of course I am skeptical of car salespeople (I have dealt with good ones, though). To make a very long and horrid story short, the only loan they could get for me was with Capital One and it was 72 mos at 18%! My former self would NEVER have ever done that but you had to be there and have what was done to me done to you, it was like confessing at the end of torture, although I do take full responsibility... I also did a quick new budget to see if I could handle it and I could, but I'd be car poor but what was new. I needed it for many, many reasons. I made the best decision I could at the time. Fast forward almost 3 years...incoming money reduced due to government cuts and increased Medicare costs, plus my own worsening health and needing more healthcare and medications. I was spending all my time juggling money to make the payments. Finally, I just could not make the payments anymore, it was a choice between food and healthcare or a car. I canceled my insurance, called Cap One and told them to come get it. There is no good public trans here and I am limited in walking/waiting in the heat; cabs are a joke, but I could hire private people to take me where I needed to go. Cheaper than this horrid car payment! Then I found out that Cap One would auction the car, at wholesale (although I have since read that our state law says they have to get as close to retail for it as they can), which, after a quick look at CraigsList, seemed like I'd owe $8k. I spent a month in hell without a car (I learned a lot, next time, if there is one, I will do it differently). Cap One didn't want my car, of course, they'd rather get more money from me in the end, I now realize. Their seeming understanding and "kindness" were only for loan sharking, which this loan already was. This went on for a few months and I got really behind. They finally made a plan for me to pay my back payments, which I would have to borrow (I had to make two payments a month) from a friend or get the best I could. I managed two months' worth but then of course I was in worse shape than before. So I figured it would get repossessed and I'd deal with it somehow, but the stress was incredible. I kept asking if there was any program for people like me, etc and they fed me little bits of info over the months; this issue could have been planned for and settled much sooner, and I'd not be in the position I am in now, but no, they wanted to get everything out of a sick, poor person they could. I was honest and forthcoming at all times and in constant communication. I heard of this "Hardship Program" little by little (first it sounded bad, and like it would not help me, then it started sounding better and better until I was told that my interest rate could go down to 1%! And my past due payments would be added to the end of the loan and my credit not affected (kind of the least of my worries at this point!). So I became hopeful. You have to understand how they kept me on a hook for so long, and how back and forth I went with keeping or not keeping the car, drove me nuts. Recently they turned me over to the Hardship dept. But also sent me a threatening letter that the total amt was due NOW. I finally got the Hardship offer of a modification to the loan (they do not refinance, or so they tell me, although I'm seeing on the web where they might, I have much more research to do). The offer was 16% interest, $1, 000 in back payments pushed to the end, to make me current, BUT, my term would be extended 18mos! The total monthly payment reduction would be only $50. Eeesh. Not good. After approval, they gave me NO time to decide. I did a very realistic budget and it was just not enough reduction. Plus, it was horrid! I'd wind up paying more in the end! I didn't want to do it if I couldn't maintain it, they might as well come and get it and I'd do what I could, stress and all be damned. I called my acct mgr and begged, pleaded, cried, etc, but no luck. I told her that I only needed a $60 further reduction (prefer interest reduction to higher term!) to make this all good for both of us. I know they don't want the car back. There is no way for them to get the remaining balance from me, but they can make my life more hellish than it already is and I'd likely have to get a lawyer. I see, from my research, that they will likely come after me with a vengeance, even knowing my circumstances and even tho I've almost paid off the orig loan by now, except in reality, very little was principle. I guess they think I'm hiding millions away in my mattress! I finally talked to her mgr, who was extremely rude (mind you I was almost suicidal at this point), she threatened me with revoking approval for the modification, and told me how GREAT they were for doing this for me and that I should be SO grateful to them! Hey, having paid enough to have almost paid off the orig loan, I'm not feeling like I am trying to badly screw anybody, esp with a loan like this (which should be outlawed, BTW). So, after that, I had a day to decide whether to take the modification or not, I had to get the paper in the Fed Ex as it was Fri. I needed more time to make a good decision. If I took the modification, they could repossess if I was ever 30 days late, no more back and forth like this time. If I didn't take it, I'd be sent to Collections and they might work out payments to make up my back payments, while still having to pay regular payment, which I couldn't afford, but they would not just take it after 30 days late, it would be like this time, more back and forth and silliness. Or repossession would be other option. I was in a box. I can make a little money and not lose my disability so I've been looking for work at home stuff; very hard, most are a scam, will take a while, esp with my issues. I asked her for a little more time. NO. So, today, I made the decision to take this modification, to buy me some time. I recently had enough of a windfall to probably be able to make the next payment, maybe two, depending what comes (you know how budgets can be!) AND get my meds and a small amt of food. Hopefully I can come up with at least $60, hopefully more, in ongoing additional income or charity until I can get out of this. It is a BAD BAD deal in the end. I will be very poor with no chance to save and in danger of the unexpected. I am SO close to the line. But Cap One would rather make MORE money from me, no matter what the consequences to me. This type of thing is what makes the poor poorer and stay poor. It is classless loan sharking and they are no better than the payday loan people down the street. Again, please read all the stuff you can find about them on the 'net before you do business, there are many problems with them, esp at the end of the loan and if you pay on the principle (they surely don't want THAT to happen!). If you get in trouble, do a lot of research to see what your remedies might be and know that no matter what Cap One says, they are a) not telling you everything you need to know, b) lying, c) only purpose is to make huge interest and they will do that in the guise of 'helping' you. And of course, I urge everyone not to take such loans. In hindsight, I wish I hadn't, although it could have worked out and you had to be there. If I was psychic and knew what I now know, I would have known for sure not to have taken the loan in the first place but I am not. Hindsight is great. To deal with Cap One is to dance with the devil for a long long time, unless you are very well fixed for money and tragedy stays away from your door. I have always hated credit and this is why. Your cushy life can be taken at any time. And for longer than your savings or retirement will last. I paid cash for last new car, and previous used car, in better times. And I truly advise you to save and do just that, esp in these uncertain times. You don't need that luxury car! You need only what you need, which is what I thought I was getting, and I was, but for the loan. All I can say is thank goodness I bought a looooooooooooooong bumper to bumper extended warranty, but I so far have not been able to afford the $100 deductible to get a couple small things fixed, which would be $200 probably. So if you do get under water on a loan, make sure you get a BUMPER TO BUMPER extended warranty, NOT a Drive Train warranty (it only covers a very few things, NOT your alternator or catalytic converter, etc. I hope my story helps someone.

The Capital One Auto Hardship program is in itself a fraud. In order to qualify a payment is required. Wait what? I went to these people because I can't make a payment. In order to qualify you have to be gainfully employed. Wait what? I went to these because I'm unemployed. The program is useless and no more than a gimmick probably in place to satisfy some government regulation to offer a loan assistance as a "gesture" before all out repossession. It is a scam.

Capital One not refunding money or providing services

It all began with travel plans for a trip to Australia. In discovering that my bank, Wells Fargo, charges "foreign transaction fees" in the use of their card abroad, I did some internet searching and discovered that "Capital One" was recommended for a travel credit card because they don't charge "foreign transaction fees" for purchases abroad. Being an individual against credit cards, I went against my better judgement and applied for a Capital One Card. Since I don't already have a credit card, they approved me on January 17th, 2011 for a "secured Master Card" requiring a $200 deposit. I went ahead and transferred from my bank $250 so that I would have that amount to use for foreign transactions. Not hearing from Capital One for a month and a half, I became concerned. Finally I get a letter from Capital One to my home address stating that they put a temporary hold on my Capital One Account to make sure no one is using my Capital one credit card without permission. However, Capital One had not yet sent me a card. I received phone calls from their “fraud” department requiring me to submit a utility bill to prove who I am. Since I'm about to embark upon a journey abroad, I was renting a room from a friend pre-travel. Since I did not have a utility bill, as it was all inclusive in my rent. The agent then said I had to send my bank statement or my W2 forms. Invasive? Certainly. That they needed my Bank Account Statement or W2 form was none of Capital One’s business. If they were giving me a loan that might be different, but a secured card is me giving them money to loan back to me. I thought this was ridiculous. I told the agent this, he agreed, but claimed it was their policy.
He then claimed I could circumvent this by driving to any bank, preferably where my bank is, and have them do a visual identity check. I had to leave early from work to do this before the bank closed. Wells Fargo said they would not do that for other banks. I called back the agent who then said if I faxed my drivers license, passport, and/or social security card, it would remove the hold and Capital One would send me the card. I drove an additional 10 miles to a fax outlet, paid them $3 to fax Capital One a copy of my passport, drivers license, and social security card. The next day, Capital One stated these documents were received, but were not worthy of identity proof. Really? A US Passport? Drivers license? Social security card? They then stated they required a bank statement or W2 form. I stated I only wanted this account because Capital One doesn’t charge foreign transaction fees, and I would be leaving soon for a trip to Australia. He said he found a “Chase bank” at 3306 Centennial Blvd in Colorado Springs who was willing to do a visual ID check. He even had a representative named “Krista” who said she would do it. So ONCE AGAIN, I leave work early, to drive 10 miles to this said bank, to make sure I arrive before the bank closes. The representative at Chase wasn’t informed that I did not have a bank account with Chase. Just like with Wells Fargo, they will not do a visual identity verification for another bank unless I was one of their clients. Again, Capital One had cost me “time away from work”, “expenses in gas and time driving, wear/tear on my vehicle, for useless trips. As this was the third trip they had caused me to drive when gas prices are at a stunning $3.30-3.50/gallon now? As my current rate of pay at the time was $26 an hour anyone could do the math to see that Capital One has already cost me more time than this card was worth.
Figuring if this is representative of the hassle that Capital One is going to give me in using their card, I don’t want the service. I told them to send me back my money. The representative said he didn’t know how and couldn’t. Really? Capital One representatives are not informed on how to do reversals? Send me back my money to the account it came from? If me, an average Joe can do it with credit card transactions I accept from clients through Quickbooks, I guarantee their agents could do it immediately. The agent suggested I dispute the charge with my bank to get my money back. I did this, and Capital One refused to release the funds as it is a valid authorized deduction. A couple of days later I receive the card stating I now owe “$29.00” for a membership fee. Really? Capital One charging me a membership fee for a service I cannot use? I call Capital One and they still state I cannot use the account or get a refund without sending my Bank Statement. I fax them my statement. It takes them 3 days to get back to me. I called their “Fraud” department. The Agent said they had received my bank statement, but my representative had to call me back to verify the account. On March 16th, I Faxed a letter to their office and mailed copies requesting full refund of money. I finally get in touch with them and on 3/17/11 I speak to their agent Shyr. She asks personal info again from me. She had the nerve to ask for my pin number for my debit card with Wells Fargo. Excuse me? She claims they cannot verify my bank information with Wells Fargo. She put me on hold for 20 minutes. Finally Capital One gets “Olivia” from Wells Fargo on the line. They warn me that the 3rd party on line exchanging sensitive information, I accepted for certain private information. Upon mentioning the claim # I did with Wells Fargo, Olivia ouldn’t pull up on her display, and then connected us 3-party with Chris at Wells Fargo claims. He notated the conversation and updated my claim. He was witness to “Shyr” stating they would return the money that day. I was put on hold for another 15 minutes while “Shyr” transferred me to “Kyle” of Capital One’s Retention / Account Closure department. He was very apologetic with my Capital One experience and said he submitted the transaction to refund my money. He stated it would take 5-7 business days to appear in my account. No refund was received by 3/28/11. So I contacted Capital One inquiring where is my money on 3/29/11. Agent "Joseph" said the previous Capital One representative should not have said 5 business days, For Joseph said it will take 2 billing cycles to return money. I told him this was not acceptable. Capital One had my money for over 45 days with no services delivered but hassle and waste of my time. I need my money back. I Told them I’m going to file complaints with state attorney office, Better Business Bureau, The Department of finance, etc. He promised that my funds would be returned electronically Friday at the latest on Monday that the account representatives are refunding my money now. On May 31st, I received a Refund check in the mail for $250. Relieved I Deposited it. I then receive on April 5th notice from my bank that Capital One put a stop payment on the refund check and now Capital One was charging me a return item fee. On 4/7/11 I called Capital One to find what was up. I spoke to Supervisor Lor and explained the situation – she said she doesn’t see a stop payment request so was investigating the matter. Nothing showing up in her computer. She took my direct deposit information and said she would get it straightened up but no action resulted by 4/21/11. Capital One has now stolen my money and has held it hostage for over three months and have not delivered product, services, only hassles and headaches. To all fellow travellers and individuals thinking about using Capital One - Avoid them at all costs. They are thieves. This article will be updated if and when action is taken to repair the damages done by Capital One - or if the fact that their action of holding my money hostage leaves me stranded while travelling abroad. I see a lawsuit in the making.

They finally refunded my base money (not the invoices I've mailed them for my time in this nightmare) but it took 6-7 months to get it back. We should file a lawsuit against them. Any questions email me at leafworks @ yahoo . com

I am so sorry for your problem with Capitol One.
I have been out of town for a month and a half so the mail has been piling up. I came to a letter (date 5-7-12) from Capitol One stating they are refunding me a billing fee and a check will be issued in the next two months. “Hmm, that seems kind of weird” I said to myself. I have no Capitol One credit card, savings or bank account of any kind. A few pieces of mail later I came to the check (dated 5-10-12) for $24.95.
The letter stated to send any correspondence to with my 16-digit acct number, SSN and a copy of the letter. So now I said to myself “ohhh HELL NO!”
I would never cash a check knowing the money isn’t mine so why did they send it to me? Maybe to lock me into some sort financial contract because they thought I would cash their check. Hmmm, something to contact the Federal Trade Commission / Bureau of Consumer Protection about.
Remember a paper trail is your best defense against Corporate GREED.

i sent them the security deposit and actually had use of the card for about a year. thee problems arose shortly after i was issued a new card (gold mastercard) and that card was cancelled. capitol one stated that the card was cancelled because i failed to provide proof of identity at Canada post when i received the card (Canada post will not deliver the credit card unless you can provide proof of ID/proof of address) i was then told that i needed to reapply, i did, they rejected the application, i asked for my security deposit minus the $90 out standing, they then informed me that the card i had wasn't a secured MasterCard, i told them that i distinctly remember walking to the bank to get the money order and sending it to them prior to them issuing the card etc etc etc long story short they still have not mailed me a check and are still trying to strong arm me out of the $90..

Capital One credit cards mailed to the wrong clients

On April 7 2011 I went to get my mail at home and was socked to find out that I got five (5) letter from Capital One, all letters were address to me and my address, after opening each letter I found the letter stating that Capital One was mailing out new credit cards with chips to those who did not have chip credit cards and I would have to activate it or them, after opening all envelopes I found myself with FIVE CREDIT CARDS!, I called Capital One to ask why they mailed me five (5) Credit cards and to my surprise they were OTHER PEOPLES CREDIT CARDS WITH THERE ACCOUNT BUT THE LETTER WAS TO MY NAME AND ADDRESS!.

They passed me along to the Fraud department where the representative took the info down, I asked why I was not sent my credit cards yet and if what happened to these people happened to me did FIVE PEOPLE GET MY CREDIT CARDS LIKE I GOT THERES !, and was my credit check for there info. I was not happy and very worried, the fraud representative said he can only pass me on to the accounting department to speak to a supervisor and that I would have to wait FIVE business days to get my new cards but I could not use my old card which did not expire yet. I advised him this was not far because this was CAPITAL ONES MISTAKE and I should not have to go though the hassle of this, the representative said he could not help me I would have to speak to the supervisor in the accounting department, he passed me along and I had to explain the situation all over again. WOW ! I advised him that any criminal minded person would have taken advantage of this and Capital One would not know and the customer would not know either until it was to late, the supervisor told me he was pleased that I call it in and thank me I asked if he would do something for me since I was honest enough to call and REPORT THERE BIG MISTAKE!, the supervisor told me all he could do was put a rush on the delivery on my card...BIG DEAL THEY SHOULD HAVE DONE THAT B4!. I advised that I could go to the media to and let them know what DUM MISTAKE THIS WAS ON CAPITAL ONE MASTER CARDS PART this was. The so called supervisor seem to be grateful but would not do anything to help me, really. I advised him this kind of mis halfe should never happened ...I mean if they mailed me one (1) by mistake it is understandable BUT FIVE (5)< credit cards..WOW. So now when you see the commercial for Capital One and it says " what is in your wallet?" One can say someone elses Credit card thanks to Capital One...

They charge $29 a month in over-the-limit fees and an outrageous amount of annual interest and they expect me to try to keep up with payments. Well...I got discouraged...Ì wasn't working for quite some time and what's the use in making a small payment when it doesn't even make a dent in bringing my balance down...the fees and charges and interest and whatever else they can tag on sucks it all up. Well...all that to say...they have put me in collection.
If only they would have kept an open mind when I tried calling them (on more than one occasion I may add) to see if some arrangement could be made to either freeze the fees so that I could bring my balance owing down or just do something to help me, they just don't want to hear it...I just gave up...another thing is the unacceptable hours they would call me, don't call me in the evenings...period!
I wish I would have never gotten their credit card!

Capital One misleading and fraud

I received a capital one gold card with a limit of $500 (red flag number one) a gold card set at $500 anyways I got my first bill $487.00 paid $100.00 and everything was fine. Then my second bill $587 and I paid the bill off in FULL now get this they told me that I had no available credit and everything is on hold for 30 days because I paid more than my limit. I explained to them I paid my bill as a good person should but they didn't care. They even told me I should have only paid $400 and I said "really" and who would be responsibile for the interest on the unpaid balance and they said "I would" well needless to say I simply cancelled the card. Capital who promises to help your credit is nothing more then a money grab with no moral fibre. DO NOT GET A CAPITAL ONE CARD

Capital One greedy company

I had a Capital One credit card. I started getting irritated with the company when I first paid off my card, and then was charged additional interest on my statement. I called them and said that interest keeps accruing unless you call them first and tell them when you are sending your check in and what the balance would be on the date the check should arrive. They took the interest off becauase they said I was a good customer. Then, they keep sending you their balance transfer checks pretty much weekly, then they called and left a message on my answering mine offering me a lower interest rate. The final straw was when I got a letter in the mail saying that I just couldn't cancel my account (I cut the card up and mailed it in along with a letter) because I had to send them more info including my SSN, DOB, phone number etc. I called them again and was transferred to a "supervisor." He made small talk and then said he wanted to make sure I understood their offers. I told him right offf the bat to close my account and hung up. What a bunch of overgreedy people this company employs. It'll be a cold day in hell again before these sheisters are in my wallet again.

Capital One predatory billing practices

capital one for years has been one of the worst credit card companies for predatory billing practices rate hikes and despicable collection practices and terrible customer service. also a guaranteed credit card through them the money to secure the card mysteriously disappears and now I see an articleby the head of the new consumer protection agency praising the ceo of capital one nigel for his understanding ### his company is one who created the banking mess and has caused severe financial turmoil in families in america. good advertising campaigns do not make a terrible company into a good company.

Capital One late payments

I cosigned on an auto loan for our son 2 1 / 2 years ago. He was layed off 2 months later. We have tried to help with the payments which are large but we had fallen behind and tried making arrangements with capital one. We thought we had made arrangements made twice and then we start getting the calls and i try to explain and of course they do not listen and so we make more arrangements and the whole thing starts over. We have repeatedly been lied to. Our son is back to work and we called capital one in january to make payment arrangements, i had them on speaker phone with our son and my husband listening, and made arrangements to have weekly payments taken out of my sons checking account since january and we paid the late fees that were due and now they are calling for late fees again.

Capital One fraud alert on the first day

I applied about a week ago for a Capital One Credit card when I received a pre-screened offer in the mail. I was approved and received my card in the mail today. I called and activated it and was told I could begin using the card immediately. I made two small purchases with no problem. As I attempted to make a third purchase at Verizon Wireless, the sales associate told me my card was declined. This struck me as odd, due to the fact I had only made $15.00 in purchases and my available limit was $300.00. I called Capital One and the account manager told me that a "Fraud Alert" had been put on my account. She then proceeded to tell me that in order for the Alert to be lifted from my account I needed to provide Capital One with copies of: My social security card, drivers license, birth certificate, proof of address and proof of income. I mean seriously, do these people do any kind of personal info check or verification BEFORE they issue someone a credit card? Unsatisfied with her answer, I called another account manager with Capital One, and was told the exact opposite of what the first person told me. Later in the evening I looked at my account online and found that there in fact was no sign of any security alert or fraud alert on my account. I tried to chat online with a rep. The rep that I chatted with apparently could only type one word per minute and told me that the info I provided him was incorrect and that he could not find any account associated with my social security number or address I provided him. Extremely pissed at this point, I called Capital One AGAIN and was told that my account was due to be closed because I had made " Too many inquiries about my account's status" and that " I was acting suspicious by asking those kind of questions about my account." I told the rep to close my account and take my name off of the mailing list. Furthermore, I will be closing my Capital One Bank account, as will my entire family. This company has got to be one of the most incompetent and unprofessional companies I have EVER dealt with in my life. They just bait people by sending them credit offers in the mail and issuing them credit cards only to deny them any use of those cards. And by them canceling my account it will undoubtably effect my credit score negatively. IF YOU GET AN OFFER FROM CAPITAL ONE, YOU'RE BETTER OFF BURNING IT, as you will save time and frustration.
