Calo Nursery and Landscape / Delivered damaged goods - no return policy

On 7/21 I purchased a concrete fountain from Calo Nursery - 3701 West Highway 98 - Pc, Fl 850.785.2340 - I paid 561.75 which included delivery and set up - during the delivery the forklift dropped their forks on my driveway and cracked the whole 10'x11.5' section all the way through the 4" thick slab of concrete - after the delivery I noticed the fountain was cracked and leaking - I called immediately July 22nd and told them about the problem I was told they would order me another bowl, which would take a week and I was ok with that - I called them and left messages on August 6th - 7th - 8th and finally on Monday the 10th spoke to Jamie the man I purchased the fountain from - He told me that the mans truck that they ordered the bottom bowl from was broken down and it would be the end of the week before it came in - I said that was not acceptable and that not calling me back as he said he would was not the proper way to do business - He assured me that he would have the bowl to me on Wednesday the 12th and deliver and set up the new bowl at 3:30 pm - I called him at 4pm and was told he was on his way at 4:45 he showed up - looked at the fountain and saw the crack said it must have happened during delivery - which from the looks of the mold around the crack, it was way older than a few weeks - He then stated he didn't have the new bowl and had another at the lot - but it was also cracked - I told him that I just wanted my money back and their insurance information for the cracked driveway - I was informed that they have a no return policy - which I disputed telling him it wasn't like I just bought something that I didn't like and was retuning it - that is was defective and being I had them deliver and set it up - should not be held to his No Return Policy - He said it looked like he would have to give me my money back and have his concrete man contact me to see about the driveway - he said would call me Thursday August 13th I never received a call from him - I called him back on Friday the 14th and told I was upset that he never called as promised and neither did his concrete man - I told him just come pick up the fountain give me my money back and provide me with his insurance company's information. He stated he had no help to pick it up until Monday the 17th and he would be here to get it and refund me my money - well it is 5:30 pm I have called several times and left messages - I have not gotten a call back and no one has showed to rectify this problem...

As far as I can see - went there today they have the exact fountain there set up - no cracks or leaks - lol think they did a bait and switch on me - LOL thats ok jokes on them - a few clicks of a mouce and they wont have a business :)

    I am now realizing they sold this to me knowing it was damaged.
