Bank of America they are either incompetent or criminal

I went through mediation with bofa and their law firm, potestivo to secure a home loan modification. I was granted a trial mod with the home retention dept. I completed the trial mod exactly as ordered, but was later denied a permanent modification. I was told by my "negotiator" (Andre) that I was $600 short in income per month to qualify. 3 months ago, when I started the mod my income was right on. My financial situation has not changed since the trial was granted. He said that there were "no guarantees, " and that I was told that my "final modification would 'probably' be the same as my trial - key word probably". But, hey, I could begin another "brand new" trial modification with making homes affordable, and pay a trial payment of $1, 160.00 instead of the $820 payments that had been agreed to in mediation. $340 more per month than my previous trial payments. So let me get this straight-i have to make more $ to pay less, but if I make less $ I have to pay more. The home retention program is based on your net income, but the mha program is based on your gross income. A third grader could figure out that this doesn't make any sense.

It is a huge scam and we, the taxpayers have given the bank the tools to manipulate this economic crisis for their own benefit. I have been led around like a dog on a leash by this bank. I have faxed them close to 1000 documents over the past 1 1/2 years, duplicates over and over because they claim they don't have them. They are either incompetent or criminal. They are not helping customers with modifications. Look online at the complaints about bofa and home loan modifications.

Bank of America insuficient funds fees

Had a check that was supposed to be held by the recipient run through prematurely. The Bank paid the bigger check and cleaned out my account, causing an isuficiency of funds for the rest of my sceduled payments, the charged me a fee for each one. They returned checks for $19, $14, and $30, While paying checks for $500, $517, and $219 plus others. I paid 8 $35 fees. I was told that there was no help to be given for these fees. It took 2 weeks to correct with our incomes. I also paid a $35 fees for being in the red for 5 days, even though I had taken care of the original checks that put us there and their fees were causing the extend insufieciency. They are sickly sweet on the phone, but totally unwilling to help or refund fees.

Bank of America unfair credit bureau reporting late payment

During the Summer of 2011 I was unemployed. I have had a mortgage loan on a property in Grand Junction Colorado.
I had been paying the same payment since Spring of 2008 and have never been late.
In August of last year I received a letter from BOA with a check for the amount of the payment I had made in July.
I contacted BOA and was told that the had me the check for my payment because I had paid the incorrect amount. They had upped my payment do to an adjustment they had decided to make on the escrow portion of my payment to the tune of $82.00 a month for a total of $984.00 a year.
I was connected to a specialist and I explained my situation that I was unemployed and could not afford the additional $82.00 due to my employment status. The representative offered me a lesser increase of $34.00 to my total payment which I agreed to pay.
I then immediately deposited the check they sent me and sent a new check for the new amount to BOA and have continued to pay this amount since.
In November I reviewed my credit with the Creditkeeper review service and found that BOA had reported my July payment as 30 days late which lowered my credit rating score by as much as 40-50 pts.
I called BOA and they have refused to correct the reporting even though the issue of the July payment even though I had made my payment in good faith and had never had a late payment on the history of the mortgage.
I feel this is extremely unfair way to treat a customer and I would like any advise of what can be done. I have filed a dispute through Credit Keeper but It is still showing on my recent credit report.

Bank of America stealing money/erroneuosly threatening foreclosure

I strongly advise everyone not to deal with bank of america! I had my home financed through these thieves, thank goodness I have refinanced with a decent bank. Bank of america "claimed" that I was 3 months behind on my mortgage and threatened to foreclose on my home. They repeatedly sent me duplicate notices in the mail (I think I recieved about 8 of them in one week) stating that I was 3 payments behind on my mortgage and if I didn't pay all 3 payments within 30 days; they would foreclose. I contacted them several times by phone explaining that there had to be a mistake, but they didn't seem to give a damn. I even printed off all of my cancelled checks that had been sent/paid to them for that year and mailed them to the bank of america proving they had made a huge mistake - once again; they didn't really care. They said if I didn't pay them 3 payments - they would proceed with foreclosure. I had no choice so I had to put off paying a whole lot of other bills that month and sent them approx. $3000.00. About six months later, I got a check back from them for the exact amount I paid them! What a bunch of ###s! Those thieves made me worried sick over nothing and played with my money for 6 months with no apology or interest on the money they forced me to over-pay them. I pray that this bank will someday be shut down and all of it's management figures be put out on the street! Do not deal with ''the ### of america"!

Bank of America insufficient funds

I am very upset with how I was handled with Bank of America regarding insufficient fees that should have not incurred. We have been Bank of America customers for over 15 years, and was not handled correctly. Last night I had an alert that my account has a low balance threshold with $58.00 transferred $400.00 to make sure everything was covered and paid. This morning I was charged 2x$35.00 because they said that the funds I transferred from another account did not post until this morning. I was given a tutorial and the 3rd degree that I was wrong and their decision stands. How awful on how this bank has become with employees that are not good listeners. What happened. We are changing banks that caters to little people like us. Maybe they would have listened if we have millions!

Arrived in Puerto Vallarta Mexico on October 5th 2011. Had used my Bank Of America Debit card on several occassions at ONE atm (Banamex) within a month I saw multiple daily withdrawls happening on my account from atm machines in Sofia Bulgaria. While on the phone with BofA's fraud unit, there was a withdrawl from the same bank atm in Sofia Bulgaria. While I was on the phone with BofA and sitting at home in Puerto Vallarta! In total over 3, 000 dollars was drained.
Bof A replaced the amount, and re issued a new debit card. Soon after signing their fraud affadavit, I recieved a fax stating that since I was in posession of my card (which I was) then the activity in Bulgaria must be legitimate. I went ballistic, and they agreed to take a closer look. Have had this account for over 12 years, never had an ATM skimming problem, this was the first. But I was insulted that Bank Of America essentially pointed a finger at Me, the victim!

Bank of America fees

Today I went to several Bank of America’s because I received a refund check from my medical supply company. I do not bank at Bank of America so I just wanted to receive the $50 check amount. First my GPS brought me to a Kroger Branch. Only to find out the Kroger Branches do not cash checks for non-acct holders ... really? I found another branch 5 miles away and went there only to find out that since I had a check issued by a bank and not a personal check, Bank of America would charge $6 fee to cash the check. WTH? That is outrages, what extra handling does this bank do for a check drawn on a company bank vs a personal check. The process is the same. This bank is ### the home of the bank fee bank. All businesses and their customers be warned, your customers may not be able to have your checks honored at the bank they are written on without incurring a fee. I get personal checks cashed their monthly as I receive a support check from my ex. Every time they go into the song and dance how I should open an account with them. Thank you, Bank of America for giving me more ammunition for your monthly sales pitch how I loathe your company. I will tell everyone I know not to bank with you and if I find people who do I will encourage them to switch away from Bank of America. I hope the exodus from Bank of America continues until they bankrupt themselves!

Obviously Bank of America doesn’t value base business growth (google it). If they did their actions would be different. They would recognize that every opportunity that an existing customer provides to them to have a non-customer walk into their establishment, regardless if the means to get the non-customer there is a business account or a personal account, this interaction is a gift, and should be treated as such. This is their time to wow the non-customer and potentially have a shot a gaining a portion of their portfolio. However, Bank of America chooses to change the conversation from “what Bank of America can do for you” to “what Bank of America will charge you”. It is a shame that we have all become so accustomed to the lack of customer service that we easily justify it because it is the status quo.

I didn't take it to the normal branch I go to because I travel because of job and I was trying to cash a check drawn on bank of America ..
If they normally cash personal checks for no fee for non acct holders how can they justify charging a fee for a business account? What different type of handling does a business check require over a personal check that a $6 fee would justify. Again, I didn't take it to my bank because of travel. Unless you can provide a explain the extra expense on processing a business check vs a personal check with something beyond "because all banks do" then your comment offer no value.

Recently a few direct deposits were held up in pay-roll and I had a few bills on the way to the payment centers. After a 1-day lapse, I was charged (18) $ 35.00 fees for the issue. $ 630.00 total. I emailed and also spoke with Bank of America about reducing the fees and they promptly said there is nothing they could do, as the manager said the same. I mentioned I would cancel all five accounts and they responded there is nothing they could do and please go to the local branch to cancel. For a company so large and they should have some relief for issues their customers encounter. For now they have 2 less.

They have changed their policies to "real time." The change apparently happened last year and I only now know the imlications. Now they can charge you for a pending fee. My account showed positive balances yet they charged me two fees. They told me I cannot trust the online banking function that is supposed to be in their "real time."
They failed the government's stress test. I presume the 34 BILLION dollars that they must obtain in order to stay in business is leading to their changing policies.

BOA steals from the poor

When my daughters were juniors in high school opened each one account with my name added on both accounts. They have kept the same accounts now for 6 years. One of my twins was charged fees for overdraft which then escalated into a total of 350.00 in fees. To add injury to insult, they transferred 150 out of my other twins account into the one that was overdrawn with that 150 still leaving a negative balance of $305 after they again added on overdraft fees. Quite a racket they have. Told them that I nor my daughter gave them permission to transfer from one twin to other twins account to which they replied since I was on both accounts they could do so without permission. Be careful this doesn't happen to you. Thereby, wasting $150 and leaving the other twin with only $25 in the bank which luckily we caught on to before she too would overdraw and start getting fees. Went straight down and closed accounts. DO NOT USE THIS BANK!

I had a credit card account with Bank of Ammerica I had not used and had no activity on for 1 year. Another company that I do business with (Ancestry.com)charges a fee one time a year and charged this inactive account. I called Ancestry and had the fees reversed and was charged late fees and interest by Bank of America for the reversed amount. I now owe 48.31 which is all fees for this reversed amount. I tried to cancel this account last year but somehow they kept my account open. I called Bank Of America to resolve the late fees for this reversed amount and they would not credit my account for them.

I have always had to deal with fees from Bank of America, but this latest fee is absolutely ridiculous. I called into customer service about a problem with my account recently. While I was on hold The recording said that when your account has been overdrawn of course you receive an overdraft fee of $35.00 no matter what was overdrawn. BUT, HERE IS THE NEW CATCH. If your account stays overdrawn for at least 5 days You will receive additional fees of $35.00. So now if I was to Overdrawn for $0.01 then It would cost $35.01, but after 5 days it would cost $70.01. Now if somebody doesn't find a way to do something about this. I believe that this kind of disregard for people to have the right to live without these kind of problems WILL CAUSE a MELTDOWN of the SYSTEM. Eventually Nobody is gonna care about using a bank. I want to invest in personal safes. Because people will eventually purchase weapons and safes and only pay with cash and then watch those fat cats lose the ability to stand and watch them crumble. Why do people let the system push you around. Read up on how the Federal Reserve Bank started and the history of how our Free country went into debt to the Federal Reserve bank. But WE THE PEOPLE HAVE THE POWER TO CHANGE THAT. YOU, YES YOU, HAVE THE FREEDOM TO CHOOSE NOT TO PAY THESE TYPES OF FEESWHO CARES IF IT RUINS YOUR IMAGINARY CREDIT NUMBER., which by the way was just raised so even if your credit was perfect 700, it is no longer. That's why the rates keep screwing you over. STAND UP to these people. YOU HAVE THE POWER. LEARN HOW THEIR SYSTEMS WORK. IGNORE THE ROBOCALLS. Bring the power bank to the people. #$!% the BANKS!

The bank is using a new system. Due to this, I've had a ridiculous amount of overdraft fees. It appears that the reps working in call center do not know how to use it either, bc I called yesterday to check on my account and to see if anything was pending, and they told me it had cleared. I deposit money into the account yesterday(which it is still a pending deposit) and this morning I come in with 6 overdrafts! That will be 6 seperate overdraft charges...$210.00! This is how the bank is making their money! by ripping us off! We are barely getting back on our feet, and all this happens! They are taking the little bit of money we do have to pay their non-experienced reps!

My fiance and I opened a joint checking acct online and received our debit cards w pins shortly after. I went to activate my atm debit card at an atm, and the atm ate my card and the receipt said to call your financial institution. After calling and being transfered about 6 times, I found myself with a rude non-professional bank of america risk employee by the name of "jay", this individual informed me that my acct has been closed, when asked about the reason this piece of ### told me that he did not need to give me a reason because i was no longer a b.o.a customer...I was completely mortified WHAT! B.o.a had approved my joint acct, sent me atm cards w pins and accepted my $75 deposit to open this acct to find out it has been closed by boa. I have a existing relationship with citibank and have been a customer for 5 years, the only reason i was looking for a different bank was to avoid the $10/month charges that my bank has implented. B.o.a has so convienently charged me a $40 "research fee" and said that they would send me a ck for $35...very unprofessional...rediculous fess..better off staying away from this bank

During the last month, I had 3 large unfortunate things happen to me in which I had to transfer money from my savings to my checking to make several repairs on my home and car. Because I made more than 3 transfers/withdraws of money from my savings to my checking in a 30 day period, I was charged a $9 fee. When I complained, I was told the fee was disclosed in the extremely large packet of information that I received when I opened my account. I argued that when emergencies happen, and I need my money, I am not worried about looking through massive amounts of paper to see if there is a fee involved.

They did not care. They would not reverse the stupid $9 fee. I cannot believe that a company as large as BOA would stoop so low as to steal this money from hard working people.

I told them I was going to start researching other banks so that I could transfer my accounts out. BOA is a rip off. Do not bank with them. They are only out to take your money any way they can.

Horrible just horrible banking customer service. I was charged hidden overdraft fees 3 times when I was told each time overdraft was canceled. Apparently this is how Bank of Fail works:

overdraft is on = $35 overdraft fee
overdraft is off = $35 returned item fee

Not to mention the fat and disgusting "workers" and "manager" at each branch here. 95% of them are mexican and some otehr mixeds ###, looks like no white people left here.

I haven't seen such thing from a single bank in Europe. As soon as my negative charge clears I am canceling my account.

First time I have ever posted a complaint, but I have been pushed too far by BOA. I just opened a new business, employing 15 people. Doing my part to help the economy. 90% of my sales are credit or debit cards. BOA will hold my credit card deposits for 2-3 days, waiting for a bunch of checks to come thru. They then post the checks and the very next posting will be my credit card deposits. This enables BOA to charge me $35 on each item. Not only do they hit me with an NSF fee, but they return the checks causing me to pay the vendors a $25 return fee. So, I am spending $60 per check in fees to bank at BOA. I never write a check thst I know the previous days credit card sales can not cover. Again, BOA will hold my deposits for 2-3 days so they can nail me with fees. This has to be illegal and something needs to be done to stop them. I live in an area of less than 1000 people and I have found over a dozen of local businesses that are having the same experience I am. This should qualify as a class action suit. Banks like this pushed this country to the brink of a collapse, had to be bailed out by us, the tax payer, and how do they say thanks? They sit up at night finding new ways to screw the very same taxpayer. Somebody, PLEASE start an effort to start a class action suit and get congress to launch an investigation.

Bank of America unfair fees

I had a period of time when my account was overdrawn, therefore, when I made a deposit, I fully understood that part of it had to be held. However, I made a deposit from my account in another bank on 1/4/12 that cleared on 01/6/12. Bank of America initially said that most of my deposit would be held until 01/11/12 and then CHANGED it to 01/13/12. We had just moved back to Georgia and could not afford to wait two extra days for our funds. So when I made a purchase, BoA cleared it AND charged me overdraft fees! I complained and they said - sorry - if there is a hold, that means anything that comes through until the hold is released is NSF! I made another deposit three days ago and was told more than $400 would be held and available on 1/24/12 after 5 pm. Fine, I even checked it AGAIN today to be sure. SURPRISE! I went to check through at Walmart - NO MONEY. Horribly embarassed, I came home, chedked the account only to find that they decided to hold it an additional day. THIS IS OUTRAGEOUS! How can they legally get away with this? I plan to close this account as soon as the funds are FINALLY credited and live on a cash-only basis.

I have had a Bank America credit card for years and have no problems
with your company. My son is a student at Penn State and we opened him
up a checking account with your bank. He and I have had no experience
with atm cards. He overdrafted his card for $69.57 and your bank
charged his account $405.00. You never contacted him or myself until
two weeks had past even though you had a telephone number on us. Do you
not think $405.00 is a bit overboard for a $69.57 mistake? No one
informed us of these fees and we were never contacted about the
overdraft through email or telephone. Why would you give money on a
card that holds a negative balance except to scam unknowing student and
patrons out of their hard working dollars. This is no way to make
customers loyal to your bank or any of your other services: mortgages,
money markets, and or credit cards. I am a 52 year old and I have never
experienced this type of embezzlement. I went to the bank near my home
in Margate yet the bank associate, Marina Breslin never contacted me
back about the progress of this case. She emailed her boss and she was
supposed to call my cell. As I was never notified of the overdraft I
was never contacted about the result of my contact with her. I see this
as a scam directed at students unfamiliar with atm cards. This morning
this unethical practice by your bank was the lead story on KYW news. I
am going to foward this email to them and every other news organization
that will listen to my story. $405.00 on a $69.57 overdraft is insane.
Your agents never made us aware of this practice and we are appalled at
your practice of taking innocent student's money. I paid the bank the
$70.00 they paid out but I will fight you for the $405.00 fee.
The best way you can help reward present customers and get new
customers is to not steal your way to profitability.I will await a
reply form you, as I am still awaiting a reply from Ms Breslin. Your
apathy toward your customers breeds contempt for your bank and makes
anyone experiencing this practice hate your bank.

I'm in the process of closing my BOA account. Their fees are excessive, and their customer service is a joke! I just opened a checking and savings with a credit union, and it will be nice to say goodbye to Bend Over America! They just settled a $410 million law suite over their clever ways of posing transactions in their own favor.

Bank of America is just horrible, my wife and I had accounts through them and got them moved ASAP once weird charges started showing up. Unfriendly customer service...just a bad banking experienc over all.

Bank of America bank of america steals child support

Bank of America charged me $140.00 in fees on 1/9, and they posted my support check ($758.00) on 1/10. When I complained they wrote that after reviewing my case they would issue a $35.00 credit, it's just utterly ridiculous! If they were in the right then how do they justify the $35.00 credit, was it a gift? I also love the sarcasm, "esteemed customer" and pointing out that my savings account was at zero! I'm a divorced mother of two working 24 hours a week while taking the prerequisites for nursing and my child support was over a month behind! I don't think the banks in general are in any position to make sarcastic remarks about managing ones finances! I have written to them several times to no avail! They claim they are justified and wrote the following, "Please be advised the $758 credit from CT Child Support is an Automated Clearing House (ACH) transaction. After reviewing the ACH transaction details our records show that the credit was scheduled by the initiator to post on 1/10/2012." Why would CT Support Enforcement make me wait till the 10th to receive money belonging to me? How convenient for BOA! According to CT Support Enforcement's automated service the money was deposited on 1/6. Now after paying bills I'm left with $40.00 in my account till next Friday, and I can't buy gas, groceries or anything else! The best part is that of the checks they "covered, " not one of them totaled $35.00. Bank of America's policies are the sad result of corporate greed!

Trolling isn't bad, it's a way for the socially unaccepted to find meaning in their lives. @ maggiemct, I'm fairly certain no one on this site works for a bank...or anywhere else for that matter. Fortunately I was able to find useful suggestions on a site that was truly intended for posting consumer complaints. Um by useful I mean, explaining something more then how one should keep a check register. Oh no...more ad hominem! Now I've opened myself up to more witty comments from Your Mom Knows Best lol!

You should have been more responsible, you also should be grateful theey refunded your fees as you obviously write fraudulent checks (meaning thee funds were not in your account when you wrote theem) and by theem covering theose checks theat were written fraudulently theey saved you thee 25.00 per check for returned check Fees.

Erroneous negative reviews and complaints like theis bug thee crap out if me. I have had direct deposit of my paychecks withe BOA for 5 years and theey have been delivered on payday every two weeks for five years so theey absolutely do not hold onto funds for 4 days. If a deposit is released o. A Friday (6th) it won't get processes until thee following Monday (9th) and post to your account at midnight thee following business day (10th)

Perhaps you should spend some of thee time you are berating otheers for pointing out thee obvious examining your bills and why you are so draped you can't buy groceries but obviously have thee Internet, or a phone plan expensive enough to allow you access to it.

Bank of America bank of america's mistake almost caused me to loose my home

on June 18, 2010, I received a court summons regarding my property taxes. It stated that my property had been sold at tax sale for an amount totaling 6, 211.73. It also came to my attention after much research that Bank of America Hoam Loans had been paying taxes on the wrong property which are escrowed from my monthly payment, even after I faxed a delinquent tax notice and attempted, in good faith, to correct the matter in May of 2007. Bank of America confirmed having received the fax via a letter dated May 27, 2007, but never corrected the matter. They continued to pay my taxes on the wrong property, which resulted in my property being sold to a bank. I even visited the Office of Tax and Revenue and had to have a representative explain the steps that BOA needed to take to prevent my property from being forclosed, but it took over 20 phone calls to get someone to finally understand that I could lose my home because of this error.

It took me several weeks to get an answer from Bank of America. I called customer service and requested that they transfer me to a tax representative. On several occasions, I was told that they would not transfer me to a tax representative and that I was responsible for paying the correct taxes, not Bank of America.

On June 28th, 2010, I realixed that attourney's fees were taken out of my escrow account to cover the legal costs of the plaintiff - Capital Source Bank Aeon Financial, LLC to be paid to Malik J. Tuma from the Tax Lien Law Group. This caused my mortgage payment to increase from the sum of 1, 118.73 to 1399.43.t one point, BOA attempted to pay the delinquent amount including attourney's fees and back taxes from my escrow account causing my escrow to go into negative. Bank of America fixed that problem after several angry phone calls to Mr. Araniva.

Presently, my mortgage is increasing again because I have a negative escrow. Bank of America assessed my taxes to be less than they currently are because they assessed the wrong property and I still owe the money that they paid out for my 2008, 2009, and 2010 taxes even after getting credits from the DC Office of Tax and Revenue. I have paid my mortgage on time since I opened my account with Bank of America. I have also spoken to numerous tax representative who have stated that they believe Bank of America should absorb all costs, including all taxes paid to the District of Columbia. I have requested via letters and phone calls that Bank of America absorb all costs associated with their error so that my escrow can transition into being positive. I have also requested phone calls bank both from Mr. Araniva and the V.P. Michael Bentley, but have not received any calls regarding my negative escrow. Now my mortgage is going to continue going up, making it more difficult for me to make my mortgage payments...It was not my error to begin with. Bank of America should have taken immediate action to begin with, but failed to do so in a timely manner because of their negligence in changing the property parcel and lot number like I requested them to do back in May of 2007.

Bank of America credit ruined due to unfair treatment

We had a credit card through bank of america and due to my husband losing his job, our perfect credit history suffered and first the first time in our lives we were past due on our payments. My husband made an agreement with boa and made payments according to this agreement and they went ahead and turned our account over to collections. My credit report shows that after a short period of missed payments, the agreed upon payments were being made consistently. I don't understand how they continue to get away with this.

Bank of America unacceptable customer service

Critical incident report
John magnisalis is the banking center manager of this bank of america location. I drove to this location to use the atm for an account balance and mistakenly left my debit card in the machine. Normally, I do not go to this banking center because of the poor customer service that is everpresent. I was running errands in this part of town, and wanted to get my checking balance. Of course, it was not long before I realized that I had not taken my card out of the machine and I drove back to the coppell location. When I arrived at the bank, the manager of the bank, john magnisalis listened to my situation and said that it would be about 20 minutes before I would be able to see a personal banker.In the lobby, there was another man who was waiting in line to see a personal banker as well. I sat in the lobby for 1 hour waiting for another debit card to replace the one that I had left in the atm machine. The one personal banker who was assisting a client assisted him for over an hour! The manager was just walking around and finally assisted the gentleman that was in line before me. Another woman was actually taken before me who had been waiting only 10 minutes and the manager also assisted her but acknowledged that I had been waiting and was in line before her. He assisted her anyway and I had to wait 15 more minutes. Finally, mr. Magnisalis assisted me and it took only 5 minutes for him to replace my card and give me a new debit card. I let him know that the reason that I did not bank at that location anymore was because of the poor customer service that I had experienced in the past.In general, the tellers are not friendly and the overall good feeling that is welcoming in most bank of americas is just not there in that coppell location! Mr. Magnisalis told me that he had heard that complaint before from other people. I also told him that I had changed my bank to the kinwest/macarthur location in irving because the bank is so friendly and has superior customer service. At that location, there are people greeting me at the door and the tellers know and address me by name.

Bank of America service fees

Whom It May Concern:

Yet another reason to not get another account at BoA.
On Friday of last week, I received my refund of my overpayment of my escrow account.
I purchased this home in June of 2011 and told BoA that my taxes would be less than $100, as I am a disabled veteran in the State of [*], and they provide a large discount for property taxes. BoA stated that they wouldn't be able to do anything about it until my tax bill came due, and they had proof of it. No problem, I'm used to corporations feeling that they are superior to everyone, and that no one they deal with has a shred of decency or honesty...particularly bankers, as they tend to spend time around other bankers and see such traits. BoA further stated that they wouldn't send my tax payment to the county until they received the bill.
In October, I received my tax statement (showing I owed $61.00 in taxes...that is not a misprint, it is sixty-one) and dutifully sent it to BoA (expecting them to receive it three days after I sent it...after all, BoA states the same thing about anything THEY send). Apparently, in my ignorance, I didn't send it certified mail. In December, my wife sent an email asking if BoA had received the tax statement, and paid the taxes. BoA claimed they did not receive the statements, but without ANY documentation of any kind, decided to send the full amount in my escrow ($3800+) to the county. They further stated that if I wanted the overage to be returned, I would have to deal with the county.
So, I called the county. They stated that if they received an overage, they would cash the check, apply whatever is required to my tax bill, and then send a letter to BoA asking them what to do with the overage. BoA would then fill out a form, send it back to the County, and request the overage be sent to them. The County would then send the money back to BoA (presumably, BoA would not receive it, but just in case they did), BoA would then eventually issue me a check.
That scenario was entirely unacceptable, so I called BoA, and spoke to a gentleman named [*], who took ownership of the problem. He corrected my tax bill, he corrected my escrow to reflect the correct amount of my taxes, and managed to get the refund check to me on Friday, Dec 23.
So now, I took the check to the local BoA branch. After having to prove my identify through four pieces of ID, my wife and I got the check cashed. Only to be told, that because we don't have a checking account with BoA, we would be charged six dollars. Now six dollars isn't going to break me, but let me point something out to you. BoA has my mortgage of $195, 000 (not by my choice, but BoA bought it from someone else, and presumably felt they could make a profit off of it). The interest rate on the mortgage is five percent. Over the life of the mortgage, BoA will PROFIT nearly $100, 000. Further, we have a credit card with BoA. Its interest rate about 9%. We use that regularly, and rarely pay off the monthly balance. On top of all that, you kept my additional tax payment (of $3800) in escrow for six months...not paying interest to me on it. So here's what's bugging me. You can take the six dollar service fee, and stuff it so far up your ###, that it comes out your throat. You can further be assured, that in the interest of full disclosure, I will contact every person I know, pass by, or can contact through email, telephone, telegraph, carrier pigeon, smoke signal, or hieroglyphics, and let them know my opinion of Bank of America.

Bank of America untimely notifications & bill pay issues!

I am so upset with this bank. It is becoming a serious issue. No matter how much I try to stand by this bank, it seems to burn me each time. I have been trying to stay steady with my bank account, and trying to be responsible, but to no avail they always pull something. For one, I feel as though with technology the way it is there is no reason why if my account went negative should I get an alert 4 days later alerting me of a fee which I could have avoided had the alert came within a timely fashion (the moment it occurred). I'd rather have too much money in the account and be covered than not enough and be docked! And the FEES were only caused by a late notification, because I cant stay on the website 24/7 monitoring my money...and for the fact that they decided to send out online bill payments by check, instead of immediate withdraw electronically which I prefer. Now all my bills will bounce because of numerous fees being added on, and I can never catch up with my bills because I am constantly paying the bank that is supposed to be making things easier for me. This is ridiculous! The only reason I have not left BOA is because their bill pay has all of my creditors, else I would have already left for my local credit union!

I would like them to address the issue of their notification system being delayed, and perhaps making it notify you of pending and processing fees the moment they occur, and with enough notification to prevent it before the end of business day when we will be charged. I would also like to see a better notification of when bill pay will send out the payment via check vs electronic while I am scheduling my payments. I should be able to choose which I prefer. It is my understanding that electronic transfer puts the power of our money in our hands when our funds are released, and when checks go out it puts the power in the hands of the payees of when they want to cash it, which screws up personal financial planning. And let's face it, its hard to be perfect in this time of economic hardship, and balancing your paycheck is hard when everyone is eating your money. I put my entire paycheck into BOA, and never have any cash on me, when my account hits all of these fees, it puts me and my son at risk with no money till next pay. I have been with BOA for a long time now, I want my money back!

Bank of America falsely accused of fraud

I receive a letter from a company telling me i won a sweepstake they for $5, 000.00 went to the bank and deposited the teller informed me it was a good check deposit the check i recieved a letter 4 weeks later telling the check was fake that i was reponsible for depositing. as a result of that they put me on checksystem i can even open a bank account anywhere i can even get a job if they backgound check i don't think that fair what they did to me i have 3 kids to support the whole sutuation stress me out much i don't know where to turn.

Bank of America cheating people

Bank of America is now our mortgage lender. We didn’t choose them, they bought our loan from another lender that was struggling in the mortgage crash. Since taking over our loan they have demanded several thousand dollars, threatening foreclosure saying we missed one payment over a year ago hoping we wouldn’t be able to present evidence of payment.

Well, we did present the evidence but they ordered us to pay anyway. (6, 500 dollars) about a year and a half they did it again. once again I got the canceled checks to prove they were wrong and I ended up paying another $2500 and then $4500 to resolve the dispute. About two months later they tried again, this time I went to a local Bank of America branch and told them to keep their #%$^N house!

I then had an attorney contact them and it kinda went away (I’m sure they will try again). Now they are refusing to endorse an insurance check to replace our roof that was damaged in a hail storm. They want us to endorse the check and give it to them. I believe that is not only Fraudulent to us, but It might be insurance fraud as well. Bank of America has lied to us on several occasions, misled us on several occasions, and as I said cheated/defrauded us on more than one occasion.

Doing research, I found out Bank of America does this type of fraud to many or all of it’s customers. So much that a mass law suite led by a firm from Georgia is trying. It appears there are many thousands of customers claiming fraud are involved in the law suit. Message here is, “Stay the hell away from this crooked bank/mortgage lender” Unbelievable that a company could operate this way and the government, banking regulators and the legal system in general let this happen. Shame on Bank of America for cheating people.

I agree Bank of America is cheating alot of people. How do we get hooked up the this frim in Georiga. Bank Of America wouldn't help us two years ago then they should have. Said we didn't qualify for a loan modification, now after they foreslosed on us they want to offer us what they should have in 2010. Costing us 144, 000.00. We dont want to sign with them but not sure what happens if we don't take their offer. Even their own attorney said she didn't know why they didn't help us then.

Bank of America phone tapping

Bank of America is completely un-trust worthy. They want to record the phone conversations but when informed the other party is doing the same. They will not permit it. Why, because they are un-trust worthy!
The fact that they request permission from the party they called; is clear proof of consent to the recording of the conversation, if they claim it is not then under CA law, they have committed an illegal wire tap.
If they record any part of the conversion before all parties give consent again under CA law, they have committed an illegal wire tap.
When the party they called gives consent, all parties have the legal right to record the phone conversation under CA law and US law.
When informed of the recording by all parties Bank of America agents try to make it sound as if the called party is refusing consent.
When forced to admit the truth, the agent’s reply is, “Bank of America does not wish to engage in any recorded conversations”. They end the phone call. You can bet that is not what is written down about the loan account. A record of the truth will not happen with these types of dishonest
Companies, they are such absurd liars.
It is a shame Bank of America can buy up loans without the permission of all parties.
It is time for the public to know the true nature of Bank of America and others like them.

Since you did not take any time to research the any of the laws, then you do not understand it is illegal to record phone conversations for "any reason". It may be done base on consent and depends on location. In one party state any party wishing to record may do so without the consent or knowledge of any other party having said conversion. In a two party state, all parties must give consent. In CA there is an implied consent, where as you are informed of the recording and continued the conversion. Implied also can be if the recording device transmits an audio beep that all parties can hear during the conversion. Now, call across state lines, opps, you are now in the realm of the FED laws. As to the statement you made about editing the recording, try it without leaving a trace, but wait would not all parties have a recording to compare to each other’s.
Just one last question, a simple yes or no.
Do you work of a company to record phone conversions?

Do you ever think about the employees that have to take your call from though call center. You call in about a problem do you know they have call time handle to finish that call in 3 minutes or less and solve your problems. If you do not wont to hear the what they tell you then don't used the credit card. Because those employee need to have a job and your complaint get them fired. They are human too so if you call into a call center it is not Bank of America it is a company that maintain your credit card for Bank of America and by they way Bank of America did not take over any companies they just take their company back. You was always dealing with Bank of America.

Bank of America fraudsters

I have been banking with Bank of America for years. I've had several
checking accounts with them as well as a couple of credit cards (one
personal and one business). I'm in California and am a home loan
officer by trade. Needless to say, the real estate market here has been
in the dumps for the last few years and I haven't made very much money
in the last 3 years. When all my income dried up, I managed to keep
paying all my bills and maintaining excellent credit for 2 years.
Finally in July of last year (2009), I just couldn't keep it up. I had
to stop paying my credit cards. This resulted in Bank of America
charging off the account back around April of this year.
I have
been squeaking by right now on about $700-1100/month. I'm even
collecting food stamps and my daughter and I are currently on Medi-Cal.
So my checking account rarely had more than a few hundred dollars in it
at any one time. I managed to put together a deal that netted me about
$2, 900 and I deposited it into my checking account and immediately used
it to start paying some bills, including my rent for July (I'm behind
right now). I deposited the check on Friday and on Monday there was an
$1, 144 debit in my account! They took everything except the checks that has already cleared and they left me with a
measly $100 in my account! This has caused me an extreme
financial hardship. My rent check was also written against this account
for $860. Now my rent check won't clear and my daughter and I
potentially could be living on the streets!

I
know in England, where our law of setoff descends from, they are not
allowed to take the money to satisfy a "non-priority" unsecured debt if
it causes hardship to the consumer in paying their "priority" bills
such as utilities, mortgage, rent, etc. - basic necessities to live
kind of stuff. Here in the United States though, the BIG Banks can do whatever they want even if it means putting families with children out on the streets!

Change has to start at the top. I don't work for BofA so I don't know for sure but I would imagine that the CEO doesn't take the time to stop and talk to people in the halls or while waiting for the elevator. If hes not doing that then the executives probably aren't either and without leadership setting an example to follow, management isn't talking to their teams and so on and so forth. If you have a company that communicates with one another stricktly in a business manner and the people aren't getting to know one another as people then how could they possibly be getting to know their customers? If they don't know their customers, how could they ever begin to understand them? BofA is laying off 30, 000 employees because they need to trim the fat. Most of these jobs are coming from the branch level. The one place within the company where BofA representatives actually might stand a chance of knowing their customer.

1. Better, more accessable personal finance education programs. (Costs could be absorbed through mktg expense rather than grants and other govt funding)
2. Instead of having the collections department constantly call, demand, and try to trick people into paying debt which they can't afford to do in a lot of cases. Train the collectors in ways to work with those in debt. Some new programs may have to be created by the banks but in the grand scheme of things working with customers to help them pay down debt rather than having to charge off bad debt or have consumers filing bankruptcy is a much better alternative. The key for everyone is working together and communicating. It will be up to the customers to be honest with the bank but the banks are going to have to do a lot more listening and give it a rest with their demands. If I were in a position where I had to choose between paying a credit card or feeding my childeren, I would choose the obvious. Thats the situation for alot of families today with unemployment as high as it is. Things are tough and nobody seems willing to stop and understand anyone elses situation, everyone is concerned with themselves and the banks are all about the bottom line. I understand that they need to make money to stay in business but i'm sure they would do just fine if the money that isn't coming in at all right now started to come in slowly. If the executives have to give up multi-million dollar bonuses then so be it for a year or two. Most of the people that owe debts and can't pay have given up jobs, cars, houses, sometimes even eating meals everyday.

The OP's tone was that they tried to take care of the debt but had so little money coming in that they could barely afford to eat. Ellen, your comment was, In some countries they arrest you for not paying your debt. The tone you decided to take is the same as the BofA jerkoffs. You basically told this person "You don't matter" "Only the money matters". You are entitled to your opinion, you are also entiled to burn in hell. If more people and more companies cared more about people and focused more on being proactive about reaching out to help people then the economy could be repaired sooner rather than later. Debts could get settled before charged off, bailouts wouldn't need to be given, and you people you adopt such a "you created your problem, you fix it attitude" could lighten up and say "my situation is good, lets make yours good too".

Its in very poor taste. I work for a major corporation. I don't blow off steam by trash talking my customers. If you were the head of a major corporation, would you expect people to use your service or buy your product after making fun of them and talking down to them? NO, you wouldn't. If you really liked someone, would you tell them"Your ugly and you smell terrible" and then expect them to say "Yes" when you ask them out? NO, you wouldn't. Pretty much the same thing in my book. So, to your point Ellen. When they decided that it was ok to talk down to their customers and made the decision that even paying customers with great credit were beneath them. They also decided that it was nolonger business and made it very personal. Especially to those of us who have been within earshot of their comments.

Look. I understand what you have all said, but I live in Charlotte. I eat lunch in the city club where the BofA execs eat often. I overhear many conversations and am quite frankly disgusted with what I hear. Those guys laugh about how they screw customers. They make jokes about laying off their employees but still getting to keep their tax breaks they were given for hiring them in the first place. They treat it screwing customers as a game of I'll screw you over and if you don't like it then I'll screw you harder. Shareholders without a ton of shares don't see it, and shareholders with a lot of shares don't care as long as they are continuing to make money.

For the people who intentionally or irresponsibly didn't pay their debts thats true but, for the OP they tried and got behind. The banks have a large part in that with faulty lending practices, corruption, and lets not forget that it was banks like BofA that have alot to do with the economy taking the dowturn that it has and caused people to lose jobs and not be able to pay debts.

Ellen67, you must work for BofA. I'm assuming you aren't one of the ones who lost there job during the recent layoffs. You seem to have no sympathy for the person who posted this complaint. Lets not forget that it was the corrupt dealings of the large banks that screwed up the economy in the first place and caused good people like the kind soul who posted this complaint to lose their higher income. I have no sympathy for the banks who did many wrong things and then got bailed out, then did more wrong and are now srewing their customers as a result. If you sympathise with the banks, you fix them and give them the money they need to get going again and let me know once you've accomplished that. The same goes for all of you that sympathise with the banks. I would, but I live in Charlotte. I have eaten lunch at the city club where the BofA execs eat and I overhear there conversations. They aren't concerned about you or their employees. Only themselves and their paycheck. Its not business to them, Its a game of I'll screw you and if you don't like it then too bad, I'll screw you harder. I know a lot of corporate execs that really do care about their employees and customers and are truely, deeply affected by layoffs, quality issues, and anything else that is negatively impacting people but I can attest that these large banks absolutly do not care about anything but taking your money and laughing about it over drinks that are paid for by the money they took from you or given to them in the form of tax breaks that they negotiated to keep after laying off 5000 people.

Bank of America transfer fee

A couple of weeks ago, my husband activated a new credit card. During that call, he was offered the option to transfer a credit card balance at which point he handed the phone to me. I decided based on the information presented to me by Cory Clark that it made sense for us to transfer $5000 to his credit card; however it was not disclosed to me that there was a $200 fee. We intend to pay off the balance before the end of year and had we kept the balance with American Express, we would have incurred lower fees in interest. I would have never agreed to this had I known there was a fee. I even asked if there were fees associated with an early pay off and was told there were no fees associated to the transfer.

I spoke to three different people at BofA tonight and no one is willing to reverse the fee. I have been a customer for 20 years - we have two mortgages with your institution, two savings accounts, two checking accounts one of which is a Prima account, and both of our children have savings accounts. We decided to stand by them during the debit card fee debacle, but I will take my business elsewhere if this fee is not reversed. I feel taken advantage of and deceived and am questioning their business ethics.

Bank of America account closure with no notification

I have been banking with BOA for over 10 years and have the American Express card by BOA. I usually pay off our card each month because I use it for everything to accumulate points. With no advance warning my credit card was declined and when I called they stated it was closed due to but there was no reason why and i can call the account closure department. I have called and gone into local branches and no one can seem to help me other than directing me to call the account closures department. That department is simply a recording stating they are with other customers and stresses twice at the beginning and at the end that it is the BOA is not required to explain the reason for the closure. So basically they say leave your name and number and we will call you within 24 to 48 hours but it is their policy and they are not required to tell us anything. The worst thing is I have over 160, 000 points that I wAS saving and I cannot even access my points account because the card was closed and was told when I called that the points are usually forfieted when accounts are closed! REALY! I am moving the rest of my account to another bank and so will the rest of my family but I feel like something has to be done about this unfair business practice. Is this what i get for being a loyal customer

I can care less about giving them my business or banking with them. I am talking about them just closing my account so i loose my points which if i transferred would come out to $1500. Where is the consumer protection they can just do that with every customer who has over a certain amount of points and that would make it ok? of course not and I am not the first person this happens to just like the over draft fee which they got sued for and lost $410M looks like they might have another case on their hands soon
