I recently had a very disappointing experience at your bad boy brampton, ontario, canada store. I paid in full for a gas stove to be picked up at a later date, but the gas connection installer who your sales rep referred to me told that the connection could not be installed because of the placing of the gas meter and the kitchen being on the opposite end of the house so I went back to the store for a refund only to be told that the money will not be refunded and it is no small amount - about 800 dollars! What kind of a store policy is this where you take the customers' money but are not willing to give it back, I have never seen such a bad dealing. For lack of a better word, this is like money grab. The store does not clearly state its policy and the cashier is supposed to inform if there is such a policy in place, every other store does it, I guess everybody just wanted their commission at the cost of abusing their customer. I hope you would look into this matter and resolve the issue. If it cannot be resolved I am willing to take it to a step higher to business bureaus or whoever can help with this situation.

Thanks for supporting me English, I am hoping that these posts somehow awaken their conscience and motivates them to act in a honest manner. I sure there must be a lot of upset customers out there who have been cheated or thugged in similar way. Put out one face for selling your wares and when the deal is done act as fly by night operators. Lastman's Bad Boys- he name says it all . Everybody should think twice before entering their store to make any purchase.

I would have costed me more than the price of the stove itself to have the pipework done. The ceiling in the basement would have to be opened up and side wall would have to be broken into. Those things apart, that is a totally different matter, what matters most is the store staff 's handling of the situation and the store's unclear or rather don't ask don't tell attitude and not informing the customer about the sales deal. Much time has passed since this episode and I would like as many people to read this as possible so that they become aware of the store's deliberate attemps to keep the customers form getting their rightfully entitled money back.

The reason why I asked for some details about what would be involved and the Costs of getting your Homes Gas pipework upgraded is that as I mentioned previously - I feel that finding out that your Homes Gas pipework is not suitable for the Stove to be installed AND that the Works / Costs to upgrade the pipework would be prohibitively expensive might be grounds to ask a Small Claims Court to overturn the Retailers `No Refund Policy` - especially as You were initially informed about this by the Gas Engineer / Gas Contractor recommended by the Retailer.

Dependant obviously upon the Magistrate / Small Claims Court Adjudicator`s viewpoint - I think that I might have either paid the small Court fee [small in the UK] to find out their viewpoint or if possible paid a small fixed fee [again reasonable in the UK] to see a `Community Lawyer` to ask their opinion.

It may be the case where they feel that You should have had your Homes Gas pipework investigated prior to any purchase of a Gas Appliance and that the onus to ensure that the Stove could be installed to your Homes Gas pipework is entirely on You.

Anyway - as You mentioned that this is now well in the past - I still think that You were treated disgracefully by the Retailer / `Bad Boy` - what an apt name for this Company regarding the `Bad` way they behave towards some Customers !

I am pleased to post my thoughts and opinions about this Company - they have treated You disgracefully !

May I ask You to send Me a private message and let Me know [rather than post it here] - what would be involved to upgrade your Home`s Gas supply to make it adequate to supply the new Gas Stove - would it involve a lot of disruption to your Home in terms of Flooring that would have to be lifted etc. - and have You had a quote for doing an upgrade of the Gas pipework ?

Perhaps You do not have the Stove any longer ?

As I asked You might want to private message with these details - there is no point in letting the Store know.

As I detailed in my message to the purchaser above in MY [well educated] Opinion because He / She could not have known that the Gas supply in their Home was inadequate for the addition of this Gas Stove until the Gas Engineer who was recommended by YOU / Your Company informed them of this I am sure that they would have a Legal case against your Company which would lead to your Sales policies being overturned in this case.

IF their Home Gas supply had been adequate for the addition of the Stove they would have proceeded and had it installed as planned.- BUT it is NOT adequate for the installation of the Stove - So that means No Stove installation.

Now that they have been informed by a Gas Engineer that your Company recommended that probably a large section of the Gas supply would have to be reinstalled in a larger diameter pipe which no doubt would involve quite a lot of disruption to their Home [?] - and a large expense which obviously they did not expect - your Sales policies should NOT be `enforceable`.

The fact that your Company does not actually employ the Gas Engineer does not exonerate your Company from the Customer deciding that based on His technical findings they simply cannot have the Gas supply upgraded and therefore the Gas Stove is useless to them - your recommended Gas Engineer has stated that the Gas Stove CANNOT be installed to the existing Gas supply.

Here in the U.K. your Company would NOT be able to legally `enforce` your Sales policies and deny the Customer a refund - a small claims court would award in their favour - IN THE CIRCUMSTANCES THAT I AM AWARE OF JUST FROM READING THESE MESSAGES.

My `educated comments` here are from knowledge that I have as a qualified Gas Engineer with the highest qualifications available in the U.K. [and therefore the World] and I also have Legal qualifications in the Civil / Consumer Law sector.

I realise that this complaint is quite old now - but I would urge the Customer / Complainant to take your Company to a small claims court - as the USA and Canada have a legal system that is wholly based on British Law I feel sure that you will have the Small claims court process in your Country.

You / your Company should be ashamed of yourselves for treating a Customer in this way - I hope that your reputation suffers because of these `Sales policies` !

In my opinion there is NO WAY that this is Legal !

Although I am in England / the UK I am sure that You cannot legally be treated in this way.

The Purchase and subsequent Installation of a Gas Appliance where the Gas Engineer / Installer is recommended to You by the Store that is selling the Appliance is a process where as You found out the Technical / Gas System Survey of your property is what governs whether you can have a particular Gas Appliance installed.

The Store recommend the Gas Engineer / Installer for the Appliance - that Gas Engineer / Gas Installer has stated that something about your Gas Supply / Meter position / Size & Length of Supply Pipework is incorrect for supplying the New Stove in the position where You want it located.

It may be the case that the Gas Supply Pipework within your property is inadequately sized to supply the New Stove`s Gas requirements and all or part of it may need to be replaced with a larger sized / diameter pipe from the Gas Meter - sometimes this has to be done to prevent volume / pressure loss within the pipework on long runs with many 90 degree bends / elbows.

If that is the case ? and If You either do NOT want the disruption of getting this work done - or do NOT want the extra Expense of the work ? - The Gas Engineers report / Technical Survey findings are a perfectly reasonable reason for You to NOT want the Gas Stove.

IF You had decided to purchase the Gas Stove and use your own Gas Engineer who then found that there was a lot of work required to replace the Gas Supply in order to install the New Stove You would probably NOT have recourse to a Full Refund for the Stove.

BUT - The Store recommended the Gas Engineer - You knew nothing about the Gas Supply in your Home possibly being inadequate to supply the New Stove until you were informed by the Gas Engineer - NOW You should state that you cannot afford to get the remedial work to the Gas Supply done - so the Stove is no good to You.
