i would like to bring some attention to a travesty which is happening to me. my home went into foreclosure due to a change in my income. i'm still in the home an capable of reinstating my loan. i was provided a reinstatement calculation letter on the amount i was to pay and the date in which i was to have these funds to BAC Home Servicing LP. Here is an excerpt from the reinstatement calculations letter i recieved:

"The Net Total Due reflects the waiver of Foreclosure Attorney/Trustee Fees and/or Title fees (included within Foreclosure Expenses) incurred in processing the foreclosure. This waiver is to assist you in bringing your loan current and is available if you pay the full Net Total Due. However, if you only pay a portion of the Net Total Due or require other assistance in bringing your loan current, these fees will not be waived. You then will be required to pay the Total Due."

i sent my reinstatement payment via certified funds to BAC Home Loan Servicing LP in two seperate cashiers checks on two different days prior to the date on the reinstatement caulculation letter. BAC Home Loan Servicing LP received the 1st payment yet somehow claimed that they never received the 2nd payment. USPS confirmed delivery yet my 2nd reinstatement payment has yet to be found.

BAC Home Servicing LP returned my 1st check to me stating that i neglected to send them the total amount in one check. However the directions provided with the reinstatement calculation letter states, the 'waiver is to assist you in bringing your loan current and is available if you pay the full Net Total Due. Why won't Bank of America help me save me home? i sent 75% of what i owed them to reinstate my mortgage prior to the date due. i have every intension on bringing my mortgage current by my efforts to send them the amount owed in certified funds. For the life of me I do not understand why Bank of America is sabbotaging my efforts to save my home. Why won't Bank of America apply certified funds to my account which would help me bring my mortgage current? Why would Bank of America send my certified checks back to me thus reducing the response time in which I have to bring my mortgage current? Is it because Bank of America is really not interested in helping distressed homeowners but more interested in ripping off distressed homeowners by placing us in lose lose situations where we accrue additional fee's and in many case places the home reinstatement out of reach? Is Bank of America out to make a profit at the expense of American families and homeowners?

No one should expect a loan modification from Bank of America. It is a trick to make you default and take your home. They make much more money that way. They could care less if you are dying, got an operation, lost your job or any other unexpected inconvenience that might happen in your life. Do not fall for their traps. This is called F-R-A-U-D! They need to be exterminated like a bad roach infestation that has corrupted this country's economy. They are committing "widespread" fraud. When you "lead" millions of people to believe that you are going to help them and even make them miss payments in order to get a loan modification, that is called fraud: http://en.wikipedia.org/wiki/Fraud.

They did the same thing to me but I finally got my modification after a year and a half but they messed up the closing and now are trying to foreclose on a mortgage of $67000 on a home now valued at $23000. Have been working with them for 6 months and issues still NOT resolved. Legal Services i Gainesville FL say that Bank of America is one of the WORST companies in America!

BAC IS NOT HERE TO HELP AS THEIR INFAMOUS MOTTO SAYS! THEY ARE HERE TO CONFUSE INTIMIDATE AND ULTIMATLY FORECLOSE ON AS MANY PROPERTIES AS THEY CAN.GET EDUCATED GO TO YOUR COUNTY LAND AND RECORDS AND PULL YOUR DEED OF TRUST.YOU CAN GET COPIES FOR LIKE 25 CENTS A PAGE.GET ALL ASSIGNMENTS ALSO .THEN GET YOUR LOAN AUDITED BY AN ATTORNEY.MORE THAN LIKELY THEY HAVE BROKE THE LAW! THEN YOU CALL THE SHOTS NOT THEM AND WATCH AND SEE HOW QUICK THEY WANT TO OFFER YOU A MODIFY THEN.ALSO ALL THAT LOST PAPERWORK YOU SENT SUDDENLY APPEARS! I am currently experiencing the same thing.. they asked for documents, sent it on time.. the when I call to follow they siad I should be receiving something via fedex in 30 days. and then when I did not receive in 30 days, I called again, and they said my application was cancelled because they could not contact me! BS! they call me almost everyday to ask for payment and I do talk to them and now they are telling me they could not get a hold of me! I've been calling them and they are giving me mixed information. One is telling me that my application is under review and then another is teliing me that is has been cancelled. I don't know hwta else to do! I do believe that they are doing this on purpose!

I spoke to a lawyer and he explained that BAC makes more money if the house is forclosed. BAC is NOT Bank of America who owns the note. BAC is just the servicing company that Bank of America hires to manage the loan. If you try for a modification, each rep will tell you something different to do or a different place to send certain documents. When you follow up, you'll find that they have no records of such documents and you'll have to start all over. Once they finally acknowledge that they have your info they will tell you it is being reviewed and to call back in 30 days. When you call back, they have no record of any documents or review. They don't get paid as much if you pay the terms of your loan! They want you to forclose because it benefits them more so they intentially shuffle stuff around and don't communicate internally. This is by design. I would encourage anyone having difficulty with them to file as many complaints to the Federal Trade Commision as possible. It is easy and you can do it in 5 minutes by going to this link on the FTC's website:

bank of america is worst bank .it was interesting, goverment gave all the banks 73 million dollar to do loan modification, where that money go.nobody from goverment didnt say anything. I lost my house, because bank of america denird loam modification, they said attorney office sent documents late, which is not real reason.All I can say, they lying to people, they want take all houses to foreclosures.My name is Hratch Terbarsegyan, I am the one of victim lost house in California Fresno,
