In June of 2006, I found a champagne colored Sunlighter spa in the showroom of the Round Rock A-Tex Family Fun Center, and agreed to purchase the tub on a 12 month lay-a-way. I made monthly payments for almost a year, always seeing my beautiful tub in the showroom with the "Sold" sign on it each visit, until I went in April or May 2007, the tub was gone. "It was recalled by the manufacturer," the manager, Shaun, reported, "the champagne color was cracking. Wait until the new colors come out to pick a new one," he added. When I contacted the manufacturer, they reported that there were no such problems and the tub was not recalled. The store owner, Chris Secard, informed me that the tub was sold to someone else to make room for inventory. The champagne color is not available anymore. He pointed out that the contract says that the company has the right to make changes to the product offered based on availability. I don't want another color, so I asked for my money back. "Sorry, no refunds, it's in the contract," he added. "You will just have to pick another color." I had to take these thieves to the Better Business Bureau to get my money back! DO NOT BUY FROM THEM!

This review misstates the facts of the situation on several key points. Mrs. Brading purchased their hot tub using our layaway plan. She was given a printed copy of the terms of this agreement at the time of the sale, which she signed. Item #8 of this agreement states “A-Tex reserves the right to substitute product of equal or greater value due to changes in inventory, suppliers, or manufacturers (i.e. patterns, colors, finishes).” This is exactly what occurred in this situation. During the time (over a year) that Mr. & Mrs. Brading were making layaway payments, the hot tub manufacturer discontinued the shell color that they had originally selected. The review states that Mr. Brading went to the BBB and used them to get a refund on the hot tub. This is not the case. In fact, Mr. Brading continued to make monthly payments on his layaway plan until he paid the hot tub off, at which point he selected a different shell color and took delivery of his hot tub. The entire transaction was completed exactly under the terms of the layaway agreement that Mr. & Mrs. Brading entered into at the time of purchase. In fact, they ultimately received a newer model hot tub than the one they originally had put a deposit on. This hot tub is currently installed at their residence and is, to the best of our knowledge, being enjoyed by Mr. & Mrs. Brading to this very day.

I took the owner, Chris Secard, to arbitration thru the Better B usiness Bureau. Even after he lost, he still refused to give me my refund. Now he is stalling for nearly two months so his lawyer can look at the arbitrators decision.

Ask yourself, "Is this the kind of business I want to deal with?"
