ASHLY furniture home store / fraudulant downpayment entrapping
I selected a set of furniture in this shop and since my credit was not approved, I accepted to pay for it in cash $2000.- .
the sales consultant Ms. Charu Bhasin told me that you can pay a pre-payment and pay the remaining later. I was not sure to be able to provide the remaining amount soon. So I refused to pay down-payment. But she assured me that Delivery date will be after doing the complete payment not before it. So I got a piece of mind not to be in pressure to pay the remaining so soon. but after two weeks, this sale consultant called me and said that you have to pay the remaining amount as soon as possible because your order has been placed and your furniture will arrive in shop soon. so you have to pay the rest, otherwise your furniture will remain in shop and you have to pay extra warehouse charges or your order will be cancelled and you have to pay $ 524.- as re-stocking charges. while she had assured me that I will not be under pressure to do the payment in a deadline and order will be placed after complete payment according to the contract terms. While there is no contractual term to specify any deadline for complete payment, vendor insists on client to pay the remained amount or re-stocking charges in a deadline.
Actually this type of selling is mainly similar to a rubbery . while the contract terms indicates “full payment” as the “purchasing” condition, vendor has issued the purchase order without client’s agreement and has breached the contract .
So I would like to refund my $500.- downpayment without accepting any charges.
Getting client’s down payment by fraudulant mis-representation and then pushing him to do the total payment in a deadline, is a sales technique that ASHLY FURNITURE has selected to promote his sales volume.
I have never observed such a fraudulent sales method in canada. while there are so prestigous retailors such as BAY, WALMART, FUTURSHOP, etc. who revert their sales after a specific period without an excuse, ASHLY sells his products by such FRAUDULANT methods
