All Delivered / The OAS Failure to deliver paid goods

On Feb. 9, 2011 I purchased 10, 000 door hangers to be distributed in my area. I received them 3 weeks later. They sat on my desk for 2 weeks waiting to be delivered. Their rep Emily told me they were having issues securing a delivery team. A week later she later explained they were going to send me their own in-house team, since they were in the area. A week later 3 delivery people showed up to deliver them then asked where the rest of the door hangers were. All Delivered only shipped 3000 to me, which I did not realize. They told me they would check with HQ and find out where the rest were, in the mean time they would start the delivery . They did not get back with me, so I contacted Emily the folling business day. She told me they had in fact been sent to the hotel they had been staying at and were delivered in our area. A week later I asked for the GPS reports to confirm the drop. The initial reports I received were for a delivery in another state. The second set of reports were for another state. The third set of reports were in my area, but a fraction of hangers were dropped and 1.5 hours were spent delivering them. I repeatedly asked for a full report. Emily would respond to every 3rd request. Her response was always ‘ should have them tomorrow’ or ‘the director was working on it’. Her last communication to me was 4/22/11 that she was waiting for the list from her co-worker. I have sent multiple emails to her after that have not received a response as of 6/1/11. We are a franchise company and this was a huge oppertunity for them...money wasted using this company.

In follow up to All Delivered's response:
We were never offered 1000 advertisements until after I filed a complaint with the BBB. Someone from All Delivered left me a messages to get the issue resolved several months ago. I left 3 messages with them and never received a call back. We would gladly accept the 1000 door hangers.

Regarding All Delivered's response:

If you are in a contract with a company & your equipment isn't able to do what you have been contracted for, then the fault is with you.
How can you claim to have GPS tracking & state, "If it's not GPS, it's not delivered", and then squabble over the product being delivered when your GPS units claim otherwise? And then to hide behind a contract that in essence says you don't have to deliver, or have GPS tracking?
Something is very wrong here.

This response by All Delivered seems absurd & confirms so many other complaints on this site about All Delivered's lack of professionalism.

After having reviewed the above mentioned complaint, Al Delivered would like to offer the following response.

It is true that All Delivered had some issues with securing a delivery team in Virginia for this particular customer's order. Ultimately, we sent a 3-man team from our corporate office in Oceanside, California out to Virginia to complete this project. Once our team arrived in Virginia, they contracted the customer and picked up the initial 3, 000 door hangers for distribution. These door hangers were sent ahead of time so that when the team arrived, they would be able to begin distributing immediately. The remaining 7, 000 door hangers were sent to the hotel where our team was staying.

After arriving in Virginia and contacting the customer to pick up the initial 3, 000 door hangers, our team began delivering the door hangers in the areas the customer requested. It is apparent from review that there were some issues in regards to the GPS devices used by our home team in that they were not working or accurately reporting in the distribution. However, all 10, 000 door hangers were in fact delivered in the requested area despite the GPS report only showing 1.5 hours of data. The customer believes that because she did not receive the kind of response she was expecting, that the door hangers were simply dropped or thrown away and that we did not do the work. This is simply not true. All Delivered would not bear the expense of sending a 3-man team from Oceanside, California to Virginia (almost three-thousand miles away) and only work 1.5 hours and throw a customer's flyers away.

Under the terms of the Delivery Agreement and Order that this customer signed, 100% accuracy is not guaranteed and as such, we provided her with whatever GPS information that was obtained during the project. While we have explained this to the customer on several occasions, she has taken the position that we did not do the work.

We have offered this customer an additional 1, 000 advertisements to be delivered and she has declined. We feel that we have met all of the terms of the Agreement signed by this customer and have closed our file. Should this customer wish to work with our office again, she is more than welcome.

My name is Valerie F. Leonard. I am a former candidate for Alderman of the 24th Ward in Chicago. I am filing this complaint on behalf of Citizens to Elect Valerie F. Leonard.

Our Municipal Election was held on February 22, 2011. During the final month of our Municipal Election campaign, I began to seek cost effective alternatives to the US Postal Service to deliver 10, 000 flyers. A member of my team suggested that I contract with a door to door delivery service. I contacted three national organizations that specialized in door to door delivery, and priced their services. I contacted All Delivered on or about Friday, February 4, 2011 based on the information on their website. They indicated that they could deliver 10, 000 flyers for 9 cents a piece, and that they tracked deliveries using a GPS system, so that the client could be sure the flyers would be delivered. I completed an inquiry form on their website, http://www.alldelivered.com/contact.html. I have copied and pasted a listing of some of the representations they made on their website (current as of March 4, 2011)

1. We pre-count your printed Advertisements and place them in stacks of 100 to keep careful track of the quantities during the delivery process.

I spoke with one of their account representatives, Katherine Cleary (on or about February 7, 2011), who indicated that she could not give me the nine cents per flyer price indicated on their website, as the area I wanted to have flyers delivered in did not qualify for the 9 cents a flyer discount. We agreed to a price of 14 cents a flyer. I originally asked that the delivery be done over the weekend prior to our Municipal Election. I suggested the 19th or 20th of February (to give lead time in the event things didn’t go as planned). Ms. Cleary suggested that the day prior to the election would be more feasible. Against my better judgment, I agreed to the February 21st delivery date. Ms. Cleary indicated that I should sign a contract and make payment to their bank account before she could arrange for the flyers to be picked up from my printer and delivered. She asked for a map of the 24th Ward, and the contact information of the printer, which I supplied. My campaign paid for the service by making a deposit into the All Delivered bank account on February 15th, 1011. The contract was signed electronically on February 18th. I will provide proof of deposit and a copy of the contract upon request.

Ms. Cleary indicated that the flyers could be picked up from the printer by Saturday, February 19, 2011. I sent Ms. Cleary an e-mail on February 20th indicating that the flyers had not been picked up from the printer. She indicated to me that the team would be finding a hotel that evening, and picking up the flyers on Monday, February 21st. When I spoke with Ms. Cleary on the phone she assured me that the team could still deliver on Monday. She also indicated that if they weren’t done on Monday they could deliver on Tuesday, the day of election. I told Ms. Cleary in no uncertain terms that if the delivery could not be made on Monday, I wanted my money back.

I expressed concern that my campaign lost $2, 400 working with All Delivered--$1, 400 we paid them for an aborted delivery and $1, 000 on flyers that were never delivered. Ms. Cleary indicated that their driver, who was not from Chicago, was not able to handle snow, and that he was in the snow storm. She also indicated that All Delivered was not in control of the fact that it snowed and that they cannot be held responsible. I indicated that she told me that her team was familiar with Chicago. I agreed that they are not responsible for the snow but our contract called for the delivery of 10, 000 flyers on February 21st. For the record, I was out in the so-called snow storm, and we got less than one inch of snow accumulation on February 21st.

When I returned home that night, I had a voice mail from Ms. Cleary indicating that her team did go out to deliver flyers the night of February 21st. She indicated that the team started on the outer edges of the Ward and worked their way in. I told Ms. Cleary that I live on one border of the Ward, and distributed (a different set of )flyers on another border of the Ward, and I saw no one from her team out delivering our flyers. There were no flyers delivered by the All-Delivered team on my block. I also told Ms. Cleary that I called a number of other people who lived on other borders of the Ward, and none of them reported seeing any of our flyers that All Delivered supposedly delivered.

I got an e-mail from All-Delivered’s Customer Service Department indicating that they had a staff of 10 people to make the deliveries, but only 2 people could actually make any deliveries the night of February 21st due to a “severe winter storm” the day our flyers were scheduled to be delivered. Customer Service also indicated that one of the drivers, who was also a supervisor, who had the GPS tracking equipment, was missing. Yet, they were able to estimate that 3, 000 of 10, 000 flyers were delivered. They went on to remind me that the neighborhood in which the driver was operating was unsafe, and while they could understand my concern for my investment, they were more concerned with their missing driver, who had the equipment that would ascertain how many flyers were delivered.

I submitted the following complaint to the California Attorney General's Office.

I respectfully request that the Attorney General’s Office conduct an investigation of the facts surrounding this complaint, and compel All Delivered to refund Citizens to Elect Valerie F. Leonard $1, 400 we paid them to deliver 10, 000 flyers, and reimburse the campaign for the $1, 000 that we paid for the flyers. Our agreement was to have them deliver 10, 000 flyers on Monday, February 21, 2011. Anything less than that is unacceptable. All-Delivered represented that they had people who were familiar with Chicago. This should include our terrain, the neighborhoods and the weather. I reiterate—we got less than 1 inch snow accumulation on February 21st. The weather was not so severe that one should be stranded and never heard from again. If this team had picked up the flyers from the printer over the weekend prior to February 21st to sort out the flyers in time for a Monday delivery, there would be no need for them to be driving in the dark on the night before the election. Ten people should be able to deliver 10, 000 flyers in 3 hours or less time, if the team was organized. Instead, I’m being told that only 2 of the 10 were prepared to make deliveries because of the inclement weather, and a supervisor, who is from out of town, was driving in an unknown, unsafe neighborhood alone. Citizens to Elect Valerie F. Leonard should not have to pay for All Delivered’s lack of capacity to conduct business in Chicago.

The Attorney General's Office sent a letter indicating that they cannot help me because the entity complaining is corporate and not and individual consumer. They recommended that I contact an attorney if I want to pursue legal action further.

I think Valerie is full of you know what, I have used all delivered before never have any problem with them and we advertise a lot, never once gave us any trouble, I think she is making a big deal .

Again, the response by All Delivered confirms clients concerns about their professionalism & their inability to take responsibility for their poor service.
If the contract itself, which basically excuses them for not doing the job for any reason, is not enough to steer you away from this company, these comments should be.

We have a contract that our clients sign. The contract is very simple to read and spells out everything they need to know about the delivery process. As far as our workers go, they also sign a contract. They are given clear instructions about what they are to do and not to do. In those cases where people say they have not been paid or paid in full, they have not turned in the required paperwork or even a correct mailing address, despite the fact that we make every effort to train them to use our paperwork the GPS units. It is no surprise that those who submit incomplete or illegible information, or bad contact information, cannot get paid. People who turn in the required paperwork and return the GPS units are paid. We have found that the majority of complaints come from people who have breached the terms and conditions of their contract by throwing away print, not delivering according to instructions, and are just irritated that we will not let them get away with it.

Regarding GPS units, we know that occasionally they may malfunction. However, in those cases we instruct people to take pictures with their cellphones and stay in touch with their project managers. We have found that in very few cases where a worker has said that their GPS unit did not work, the number of pieces which they allege to have delivered far exceeds the amount even our most seasoned workers have been able to distribute in the same amount of time. Therefore it is not unreasonable to determine that their numbers are suspect and improvable when it appears as though personnel are attempting to hide the truth behind “so called” malfunctioning GPS units. We make every effort to help our clients and workers understand everything in the delivery process. If they choose to ignore or defy the system, the consequences are on them, not on us.

Regarding the comment by “youknowhow I am” about the driver who went missing, I find it quite insensitive. The driver is/was reliable and worked incredibly hard. If you did research behind the matter you would find that a missing person’s report was filed by the driver’s family.

I worked for this company locally and out of state, they do not care about there clients or the team doing the actual work. The driver they are probably talking about is not reliable lazy and they find any excuse to cover what the do wrong its never there fault as you can see. They are a scam they NEVER deliver all the fliers cause they don't keep you in that one location long enough to deliver all the fliers and lie to there clients and as for the GPS tracked that's a load of crap cause half the time the GPS's are not working and I learned that a hard way cause they owed me $2000 dollars and I only saw about $700 cause they said the GPS did track but I didn't understand how that was my fault...This company is so unfair and I hope they get shut down and Mel and Liz go to jail for all the fraud they are doing to the workers and clients.

We are sorry that Businessman314 feels that All Delivered lacks consideration for our customers. That statement is untrue. We do care about both our customers and Delivery Personnel. It is important to our company to attempt to meet the needs of our clients and distribution team. The blatant disregard and lack of compassion for the well being for the member of our team who was in an accident is disturbing.

In response to the comment made by Businessman314 regarding his feelings toward the Delivery Agreement, we would like to repeat the information again: “Delivery of print media and other materials on Requested Delivery Date(s) is not guaranteed. Company shall not be liable for failure to perform if it is as a result of any cause beyond the reasonable control of Company, such as, without limitation, inclement weather conditions, hazardous delivery conditions…” The important phrase which should be acknowledged is as follows: "as a result of any cause beyond the reasonable control of Company." All Delivered works hard to meet the needs of our Customers, yet we can not control every aspect of the world. If there is a snow storm a reasonable person would expect delays. We attempt to work with our clients to meet their needs, while keeping our team safe.

What strikes me as foul is the blatant cynicism in the rebuttal by All Delivered. Their rebuttal lacks any consideration for their customers. Maybe something a little more professional sounding would do, instead of making silly references to slavery and the electoral defeat of the complainant.
If the promised service could not be completed for ANY reason, this customer should have her money refunded, no questions asked, no matter what is said in the contract. That is what SERVICE is all about and it's seriously lacking in our country today. I would never sign that contract because it allows All Delivered to keep my money even if the job is not completed--and it may not be completed for any reason they decide. As far as the icy roads and sidewalks are concerned, the US Postal Service can deliver in that kind of weather. Why not All Delivered?
I looked at AD's website and came across this complaint in the process of finding a company that can deliver flyers nationwide for my company. All Delivered's obvious ignorance of customer service will lead me elsewhere.

This is in rebuttal to the complaint posted by “Citizens to Elect Valerie F. Leonard” on 03/27/11 regarding “Breach of Contract, Failure to Deliver.”

As accurately stated, Ms. Leonard was a former candidate for Alderman of the 24th Ward of Chicago, IL. Ms. Leonard lost the election and now appears to be seeking someone to blame for her political defeat.

All Delivered is based out of Oceanside, CA. We perform deliveries in cities across the U.S. Our in-house delivery teams are professional contractors and we also contract additional, local contractors as a cost-effective method to assist in out of state deliveries.

What Ms. Leonard quotes as appearing on our website www.alldelivered.com is accurate. However, the advertised price of 9 cents per flyer is clearly shown on our website for selected areas, which are primarily local delivery. We are in Oceanside, CA, and Ms. Leonard is in Chicago, IL. As we pay our door hanger contractors more than 9 cents per flyer to deliver to out of state locations, it is logical that we must charge our customer more than that for out of state delivery. Ms. Leonard was told this when she initially spoke with our Account Executive, Katherine Cleary. Ms. Leonard agreed to the 14 cents per door hanger delivery price. She signed our contract for that price. We do not know what point she is trying to make regarding this in her complaint.

Ms. Leonard accuses us of “breach of contract.” She would do well to read her contract which clearly states on page 1 “Customer agrees that this Delivery Order and Agreement are non-cancelable and non-refundable.”

Ms. Leonard was aware, as it is clearly shown on the Delivery Order that a deposit is required to schedule delivery and payment in full is required prior to delivery. Again, we do not know what point she is trying to make regarding this. We have no dispute that she signed the contractor and made payment.

We sent our contract to Ms. Leonard on February 10th and did not receive it back until February 18th, which ran us dangerously close to the day of the election itself and left us only one day, the day before the election, to complete distribution. Ms. Leonard’s signed contract states that delivery was requested for February 21st, the day before the election.

We sent our home delivery team to meet with the Chicago team. We had hoped to be able to pick up the print ahead of time on February 19th. Unfortunately, traffic and the inclement weather delayed our team’s arrival until the evening of the 20th. They picked up the print during an icy storm on February 21st and met with the Chicago team and proceeded to deliver for Ms. Leonard’s campaign.

Our contract states: “Delivery of print media and other materials on Requested Delivery Date(s) is not guaranteed. Company shall not be liable for failure to perform if it is as a result of any cause beyond the reasonable control of Company, such as, without limitation, inclement weather conditions, hazardous delivery conditions…”

Ms. Leonard says that the weather was not an issue, stating that “we got less than one inch of snow accumulation on February 21st.” She said that she was out distributing flyers, but then, her own campaign was at stake. However, since slavery was abolished in 1863, we have no way of forcing people, especially independent contractors, to work in rain, snow, and sleet.

We are certain Ms. Leonard’s skills as a meteorologist or determining weather conditions do not exceed that of the IDOT, the Chicago Police Department or ABC 7 News in Chicago as noted by this report from John Garcia:

“February 21, 2011 (CHICAGO) (WLS) -- Icy roads created dangerous driving conditions Monday night with spinouts and crashes reported in the city and suburbs.
In addition, a winter weather advisory is in effect for Cook County and areas to the north of Chicago until 6 a.m. Tuesday. ABC7 meteorologist Jerry Taft said the Chicago area could get 1-2 inches of snow.

Lake Shore Drive was shut down for a while due to multiple collisions Monday night. Problems were also reported on the Eisenhower Extension, just south of Elgin O'Hare, where there was another multiple car crash in Itasca.

Police were busy responding to crashes on nearly every highway. Both the city and state said they had full complements of salt trucks out.

‘Shortly before 9 o'clock, we put orders out for a full group of trucks and plows and salt-spreading equipment in the north, northwest and west suburbs with half a group in the south and southwest suburbs. We are really seeing a mix of everything, the whole gamut from sleet and freezing rain to snow, ’ said Guy Tridgell, IDOT spokesperson.

Illinois State Police sent out an advisory to warn drivers to take extreme caution on the roads. They said drivers should avoid any sudden braking or quick lane changes.

Also Monday night, emergency crews responded when a plane skidded off the runway at Executive Airport in Wheeling.

Overnight, a new winter storm slammed into parts of the upper Midwest, dumping snow at a rate of up to 3 inches an hour in some places…

On Monday morning, some freezing temperatures and light freezing drizzle created treacherous driving conditions across the northern suburbs, leading to several accidents.”

The inch of snow was not the problem. The area had snow accumulation and icy road conditions, which made for hazardous delivery.

Ms. Leonard says, “The weather was not so severe that one should be stranded and never heard from again.” During this delivery, one of our contractors had a weather related car accident and still continued to deliver. But then his GPS went dark and he has not been heard from since. The Chicago Police Department called us and we supplied them with all of our information. Our contractor is still missing. He was in a neighborhood known to be dangerous so it’s anybody’s guess what happened. Trouble can strike anywhere, particularly in dangerous neighborhoods. Ward 24 is one of them.

CLR©, shows crime statistics for Chicago Zip Code 60623, Ward 24, on their website www.clrsearch.com. Using a base of 100 for the national average, the Personal Crime Risk which represents the combined risk of rape, murder, assault, and robbery, is listed as 116 for Illinois and 312 for the Ward 24 area of Chicago. As can be seen, Ms. Leonard’s target neighborhood was not safe.

This is possible loss of a human life. It is a tragedy beyond any door hanger delivery issues. For Ms. Leonard to dismiss this personal or reduce them to a tool for her political aggrandizement is a foul, unfeeling, and egregious action. The people of the 24th ward should count themselves lucky she lost, for this type of person has no business holding office where the welfare of others is in her care.

Most distressing to us is Ms. Leonard’s comment: “while they could understand my concern for my investment, they were more concerned with their missing driver…” This man is still missing and his family is beside themselves with worry. We are not the kind of company who cares more about money than we do about people. We are more than happy to answer any inquiries, pending, of course, permission from the Chicago Police Department and from the man’s family. From the tone of her post, it is clear Ms. Leonard has more concern for her political career than for the value of a human life.

We believe it says something about the dedication of our delivery people in that they actually delivered under adverse conditions. Ms. Leonard is welcome again to check our special website to review the GPS Tracking reports that verify that her door hangers were delivered.

All Delivered / The OAS Breach of Contract, Failure to Deliver

My name is Valerie F. Leonard. I am a former candidate for Alderman of the 24th Ward in Chicago. I am filing this complaint on behalf of Citizens to Elect Valerie F. Leonard.

Our Municipal Election was held on February 22, 2011. During the final month of our Municipal Election campaign, I began to seek cost effective alternatives to the US Postal Service to deliver 10, 000 flyers. A member of my team suggested that I contract with a door to door delivery service. I contacted three national organizations that specialized in door to door delivery, and priced their services. I contacted All Delivered on or about Friday, February 4, 2011 based on the information on their website. They indicated that they could deliver 10, 000 flyers for 9 cents a piece, and that they tracked deliveries using a GPS system, so that the client could be sure the flyers would be delivered. I completed an inquiry form on their website, http://www.alldelivered.com/contact.html. I have copied and pasted a listing of some of the representations they made on their website (current as of March 4, 2011)

I spoke with one of their account representatives, Katherine Cleary (on or about February 7, 2011), who indicated that she could not give me the nine cents per flyer price indicated on their website, as the area I wanted to have flyers delivered in did not qualify for the 9 cents a flyer discount. We agreed to a price of 14 cents a flyer. I originally asked that the delivery be done over the weekend prior to our Municipal Election. I suggested the 19th or 20th of February (to give lead time in the event things didn’t go as planned). Ms. Cleary suggested that the day prior to the election would be more feasible. Against my better judgment, I agreed to the February 21st delivery date. Ms. Cleary indicated that I should sign a contract and make payment to their bank account before she could arrange for the flyers to be picked up from my printer and delivered. She asked for a map of the 24th Ward, and the contact information of the printer, which I supplied. My campaign paid for the service by making a deposit into the All Delivered bank account on February 15th, 1011. The contract was signed electronically on February 18th. I will provide proof of deposit and a copy of the contract upon request.

Ms. Cleary indicated that the flyers could be picked up from the printer by Saturday, February 19, 2011. I sent Ms. Cleary an e-mail on February 20th indicating that the flyers had not been picked up from the printer. She indicated to me that the team would be finding a hotel that evening, and picking up the flyers on Monday, February 21st. When I spoke with Ms. Cleary on the phone she assured me that the team could still deliver on Monday. She also indicated that if they weren’t done on Monday they could deliver on Tuesday, the day of election. I told Ms. Cleary in no uncertain terms that if the delivery could not be made on Monday, I wanted my money back.

I expressed concern that my campaign lost $2, 400 working with All Delivered--$1, 400 we paid them for an aborted delivery and $1, 000 on flyers that were never delivered. Ms. Cleary indicated that their driver, who was not from Chicago, was not able to handle snow, and that he was in the snow storm. She also indicated that All Delivered was not in control of the fact that it snowed and that they cannot be held responsible. I indicated that she told me that her team was familiar with Chicago. I agreed that they are not responsible for the snow but our contract called for the delivery of 10, 000 flyers on February 21st. For the record, I was out in the so-called snow storm, and we got less than one inch of snow accumulation on February 21st.

When I returned home that night, I had a voice mail from Ms. Cleary indicating that her team did go out to deliver flyers the night of February 21st. She indicated that the team started on the outer edges of the Ward and worked their way in. I told Ms. Cleary that I live on one border of the Ward, and distributed (a different set of )flyers on another border of the Ward, and I saw no one from her team out delivering our flyers. There were no flyers delivered by the All-Delivered team on my block. I also told Ms. Cleary that I called a number of other people who lived on other borders of the Ward, and none of them reported seeing any of our flyers that All Delivered supposedly delivered.

I got an e-mail from All-Delivered’s Customer Service Department indicating that they had a staff of 10 people to make the deliveries, but only 2 people could actually make any deliveries the night of February 21st due to a “severe winter storm” the day our flyers were scheduled to be delivered. Customer Service also indicated that one of the drivers, who was also a supervisor, who had the GPS tracking equipment, was missing. Yet, they were able to estimate that 3, 000 of 10, 000 flyers were delivered. They went on to remind me that the neighborhood in which the driver was operating was unsafe, and while they could understand my concern for my investment, they were more concerned with their missing driver, who had the equipment that would ascertain how many flyers were delivered.

I submitted a complaint to the Attorney General's Office as follows:

I respectfully request that the Attorney General’s Office conduct an investigation of the facts surrounding this complaint, and compel All Delivered to refund Citizens to Elect Valerie F. Leonard $1, 400 we paid them to deliver 10, 000 flyers, and reimburse the campaign for the $1, 000 that we paid for the flyers. Our agreement was to have them deliver 10, 000 flyers on Monday, February 21, 2011. Anything less than that is unacceptable. All-Delivered represented that they had people who were familiar with Chicago. This should include our terrain, the neighborhoods and the weather. I reiterate—we got less than 1 inch snow accumulation on February 21st. The weather was not so severe that one should be stranded and never heard from again. If this team had picked up the flyers from the printer over the weekend prior to February 21st to sort out the flyers in time for a Monday delivery, there would be no need for them to be driving in the dark on the night before the election. Ten people should be able to deliver 10, 000 flyers in 3 hours or less time, if the team was organized. Instead, I’m being told that only 2 of the 10 were prepared to make deliveries because of the inclement weather, and a supervisor, who is from out of town, was driving in an unknown, unsafe neighborhood alone. Citizens to Elect Valerie F. Leonard should not have to pay for All Delivered’s lack of capacity to conduct business in Chicago.

The Attorney General's Office responded within about a week indicating that they could not help me, as they represent consumers in complaints, and not businesses. They recommended that I retain an attorney to pursue legal action.

This is in rebuttal to the complaint posted by “Citizens to Elect Valerie F. Leonard” on 03/27/11 regarding “Breach of Contract, Failure to Deliver.”

As accurately stated, Ms. Leonard was a former candidate for Alderman of the 24th Ward of Chicago, IL. Ms. Leonard lost the election and now appears to be seeking someone to blame for her political defeat.

All Delivered is based out of Oceanside, CA. We perform deliveries in cities across the U.S. Our in-house delivery teams are professional contractors and we also contract additional, local contractors as a cost-effective method to assist in out of state deliveries.

What Ms. Leonard quotes as appearing on our website www.alldelivered.com is accurate. However, the advertised price of 9 cents per flyer is clearly shown on our website for selected areas, which are primarily local delivery. We are in Oceanside, CA, and Ms. Leonard is in Chicago, IL. As we pay our door hanger contractors more than 9 cents per flyer to deliver to out of state locations, it is logical that we must charge our customer more than that for out of state delivery. Ms. Leonard was told this when she initially spoke with our Account Executive, Katherine Cleary. Ms. Leonard agreed to the 14 cents per door hanger delivery price. She signed our contract for that price. We do not know what point she is trying to make regarding this in her complaint.

Ms. Leonard accuses us of “breach of contract.” She would do well to read her contract which clearly states on page 1 “Customer agrees that this Delivery Order and Agreement are non-cancelable and non-refundable.”

Ms. Leonard was aware, as it is clearly shown on the Delivery Order that a deposit is required to schedule delivery and payment in full is required prior to delivery. Again, we do not know what point she is trying to make regarding this. We have no dispute that she signed the contract and made payment.

We sent our contract to Ms. Leonard on February 10th and did not receive it back until February 18th, which ran us dangerously close to the day of the election itself and left us only one day, the day before the election, to complete distribution. Ms. Leonard’s signed contract states that delivery was requested for February 21st, the day before the election.

We sent our home delivery team to meet with the Chicago team. We had hoped to be able to pick up the print ahead of time on February 19th. Unfortunately, traffic and the inclement weather delayed our team’s arrival until the evening of the 20th. They picked up the print during an icy storm on February 21st and met with the Chicago team and proceeded to deliver for Ms. Leonard’s campaign.

Our contract states: “Delivery of print media and other materials on Requested Delivery Date(s) is not guaranteed. Company shall not be liable for failure to perform if it is as a result of any cause beyond the reasonable control of Company, such as, without limitation, inclement weather conditions, hazardous delivery conditions…”

Ms. Leonard says that the weather was not an issue, stating that “we got less than one inch of snow accumulation on February 21st.” She said that she was out distributing flyers, but then, her own campaign was at stake. However, since slavery was abolished in 1863, we have no way of forcing people, especially independent contractors, to work in rain, snow, and sleet.

We are certain Ms. Leonard’s skills as a meteorologist or determining weather conditions do not exceed that of the IDOT, the Chicago Police Department or ABC 7 News in Chicago as noted by this report from John Garcia:

“February 21, 2011 (CHICAGO) (WLS) -- Icy roads created dangerous driving conditions Monday night with spinouts and crashes reported in the city and suburbs.
In addition, a winter weather advisory is in effect for Cook County and areas to the north of Chicago until 6 a.m. Tuesday. ABC7 meteorologist Jerry Taft said the Chicago area could get 1-2 inches of snow.

Lake Shore Drive was shut down for a while due to multiple collisions Monday night. Problems were also reported on the Eisenhower Extension, just south of Elgin O'Hare, where there was another multiple car crash in Itasca.

Police were busy responding to crashes on nearly every highway. Both the city and state said they had full complements of salt trucks out.

‘Shortly before 9 o'clock, we put orders out for a full group of trucks and plows and salt-spreading equipment in the north, northwest and west suburbs with half a group in the south and southwest suburbs. We are really seeing a mix of everything, the whole gamut from sleet and freezing rain to snow, ’ said Guy Tridgell, IDOT spokesperson.

Illinois State Police sent out an advisory to warn drivers to take extreme caution on the roads. They said drivers should avoid any sudden braking or quick lane changes.

Also Monday night, emergency crews responded when a plane skidded off the runway at Executive Airport in Wheeling.

Overnight, a new winter storm slammed into parts of the upper Midwest, dumping snow at a rate of up to 3 inches an hour in some places…

On Monday morning, some freezing temperatures and light freezing drizzle created treacherous driving conditions across the northern suburbs, leading to several accidents.”

The inch of snow was not the problem. The area had snow accumulation and icy road conditions, which made for hazardous delivery.

Ms. Leonard says, “The weather was not so severe that one should be stranded and never heard from again.” During this delivery, one of our contractors had a weather related car accident and still continued to deliver. But then his GPS went dark and he has not been heard from since. The Chicago Police Department called us and we supplied them with all of our information. Our contractor is still missing. He was in a neighborhood known to be dangerous so it’s anybody’s guess what happened. Trouble can strike anywhere, particularly in dangerous neighborhoods. Ward 24 is one of them.

CLR©, shows crime statistics for Chicago Zip Code 60623, Ward 24, on their website www.clrsearch.com. Using a base of 100 for the national average, the Personal Crime Risk which represents the combined risk of rape, murder, assault, and robbery, is listed as 116 for Illinois and 312 for the Ward 24 area of Chicago. As can be seen, Ms. Leonard’s target neighborhood was not safe.

This is possible loss of a human life. It is a tragedy beyond any door hanger delivery issues. For Ms. Leonard to dismiss this personal or reduce them to a tool for her political aggrandizement is a foul, unfeeling, and egregious action. The people of the 24th ward should count themselves lucky she lost, for this type of person has no business holding office where the welfare of others is in her care.

Most distressing to us is Ms. Leonard’s comment: “while they could understand my concern for my investment, they were more concerned with their missing driver…” This man is still missing and his family is beside themselves with worry. We are not the kind of company who cares more about money than we do about people. We are more than happy to answer any inquiries, pending, of course, permission from the Chicago Police Department and from the man’s family. From the tone of her post, it is clear Ms. Leonard has more concern for her political career than for the value of a human life.

We believe it says something about the dedication of our delivery people in that they actually delivered under adverse conditions. Ms. Leonard is welcome again to check our special website to review the GPS Tracking reports that verify that her door hangers were delivered.

BEWARE SCAMMERS. LOSE YOUR MONEY HERE!

My company decided to use All Delivered or "Outdoor Advertising Specialist" to do some drop offs for us to businesses.
We wanted them to print envelopes, stuff them with our inserts, and deliver 10, 000 of them. 3333 for 3 deliveries, once a month.

They delayed three to four weeks before delivering due to some "printing issues".
When they decided to deliver, they sent us gps tracking #'s so that we can track their progress.
They had a few guys work for about two hours.

Told us they delivered about 3000 that day. Really? In two hours?
Between Black Moutain and Camino Ruiz,
And the corner of El Camino Real in Carlsbad?
Are there even that many businesses in those areas?

Went to the company to ask about the deliveries.
After no one taking responsibility, cant find a manager or owner.
We talked to some sales guy.

They said "here are business cards of about 40% of the businesses that we went to.". There were about 200 business cards.
That means they went to 500 businesses. 500 businesses in those areas seem a little more believable, but still a stretch.

They said well, they misquoted the pricing. We should have paid this much more, blah blah blah.
Not what was on the contract.

We asked them to refund our money.
Nope.
Can we have our envelopes and inserts?
OK, here is 5000 inserts and 20 envelopes.
What happened to the rest of them?
We delivered them.
Without envelopes?
Well...we dont have them.
Shouldnt there be at least 5000 envelopes if there are 5000 inserts?
Well...thats all there is.

We are now taking legal action.
You too can get into this mess for a low price of $2000!

As a former employee ( subcontractor ) of all delivered I must agree with the complainant. All delivered is a scam and Mel is a thief ( con man )I started delivering flyers and saw the amounts supposed to be delivered and the actual amount of flyers differed greatly. I once heard Liz say that their clients were stupid people who never even read the contracts because the contracts state that all delivered will try it's best to deliver all the materials not that they have to. I started working in the office on out of town delivers . My job was to recruit people to deliver flyers all over the country by posting adds on Craig's list. After several months of this it became obvious that Mel was not only robbing his clients but also not paying the people I was recruiting. After confronting him with these allegations he tried to do what he always does - talk bullcrap.He said that the checks had been mailed but hadn't gotten there yet, he actually told me that it can take 3 weeks for mail to get from California to Florida . Needless to say we parted company as I could not be involved with fraud . Don't believe a word this company says all delivered is ALL LIES

This company is a scam, in our opinion. We are based in Illinois and had a contract with All Delivered and they did not deliver as contracted. When you call there, Management will not talk to you. They ignore your calls and they do not do what they promised. We were advertising and were giving 10% of the sale to the American Cancer Society. These low life people did not respond in any way to make things right. We are taking legal action on these thieves. We should all get together and file a class action law suite against them. We need to notify the Internet fraud department, to stop them from false advertising. This is fraud in our opinion and they need to be stopped and our money needs to be reimbursed to us.

This complaint seems very conducive with many other complaints made about All Delivered.
Take a look at the way they speak about their clients in this rebuttal & using that information alone, consider if this is a company you would choose to work with?

All Delivered is responding to the complaint posted on 03/09/11 by “CompanySandiego” regarding “did not delivered as promised.” We have waited to respond to this complaint out of consideration of our customer who posted the complaint and with whom we have been working with to resolve their issues. However, we now have no choice but to protect our company reputation by posting this rebuttal to their complaint. We want to be sure our current and future customers know that All Delivered handles all customer concerns promptly and courteously.

This complaint was posted by Sunbelt of San Diego Coast, a Sunbelt Network franchisee, located at 6540 Lusk Boulevard, Suite 175, San Diego, CA 92121, Phone: [protected]. The above information is public and can be found on the Sunbelt Business Network website, www.sunbeltnetwork.com. We are able to identify the poster as one of the Associates of this company, as they have complained to the Better Business Bureau under the name of one of their Associates, Lin Le, using language identical to their complaint on this site. Incidentally, the BBB has closed that complaint, as they are satisfied that All Delivered has addressed the disputed issues appropriately. Additionally, the same false claims made in their complaint were made by Hal Janke, President of Sunbelt of San Diego Coast, in person when visiting our offices on 03/04/11. We are sure Sunbelt of San Diego decided to hide behind “CompanySandiego” to avoid the consequences of public exposure.

We’ve delivered thousands of advertisements for businesses from coast to coast who have been very happy with our services. But, you cannot please everyone every time. Mr. Janke had some issues with his business to business advertisement distribution and we tried to work it out with him when he brought those issues up to us. However, he refused our offers at that time, spreading and presenting these inaccuracies to the public through whatever forums he was able to find. On 03/04/11 he demanded and took back the balance of the print materials that were to be delivered. This obviously left us unable to complete deliveries. Then he made this complaint that we “did not delivered.”

Glenn Baxley, Associate Broker of Sunbelt of San Diego Coast, signed a non-cancelable, non-refundable Delivery Order and Agreement on 01/06/11. Our regular, scheduled delivery services were priced out of Sunbelt of San Diego Coast’s budget, so we offered a lower price with flexible delivery services. Flexible delivery starts anywhere from 1 to 6 weeks after signing of our contract and leaves the delivery schedule to All Delivered’s discretion. Mr. Baxley agreed and accepted these terms on our Delivery Order.

When Hal Janke, Toni Miller, Operations Manager of Sunbelt of San Diego Coast, and Glenn Baxley dropped off their printed advertisements for distribution, they claimed to be Christian businessmen and openly prayed for the success of their advertising campaign in our warehouse.

After signing a Delivery Order which was priced only for providing envelopes and stuffing them, they asked that the envelopes be printed. At a loss to our company, we accommodated them and printed envelopes for distribution. Our company policy requires full payment 14 days prior to the start of delivery. Sunbelt associates made several payments and were to drop off the balance, but they did not do so. This delayed start of delivery to beyond the normal 6 week window.

We offer GPS Tracking for our door hanger and flyer deliveries, but not normally for business to business advertisement distribution. This is because our delivery people must enter each business and may wait several minutes to give the advertisement to the appropriate individual, and some business delivery locations may be far apart from one another. GPS Tracking, therefore, may not show the kind of movement it would during door to door residential delivery runs which can be confusing to our customers. In this case, however, we provided GPS tracking to satisfy Hal Janke and his Associates’ concerns regarding actually delivery taking place. On the delivery days we gave them the information to track their deliveries live on our special website and then provided tracking information in report form.

Even though Sunbelt of San Diego Coast still had a balance due, we began deliveries for them anyway to avoid further delays. We delivered the first run of 3, 300 of their advertisements on 02/22/11 and another 1, 500 on 03/03/11 in the Encinitas, Mira Mesa, Miramar and Carlsbad areas. Our GPS tracking reports verify these deliveries.

On 03/04/11, Hal Janke came to our offices and spoke to our Marketing Director, who is referred to in their complaint as “some sales guy”. Using profane language unbecoming a “Christian” businessman, Mr. Janke made the same false claims made in their complaint and demanded a full refund and return of the rest of his materials. We even gave Glenn Baxley and Hal Janke several envelopes containing business cards from some of the businesses we delivered to. We tried to work it out, but Mr. Janke was insistent. We had no choice but to return his materials, which meant, of course, that we could not complete the rest of his deliveries. We retained the generic business to business printed envelopes, as Sunbelt had not paid for printed envelopes.

Customers don’t always get the response they anticipate from their advertising campaigns. This happens even more frequently in today’s difficult economy. We believe this was the case with Sunbelt of San Diego Coast. But this does not mean we did not deliver.

After his visit and exchanging several emails with Hal Janke, this complaint was posted by “CompanySanDiego.”

“You too can get into this mess for a low price of $2000!” says their complaint. We find that unusual, as Sunbelt of San Diego Coast’s discounted price on their contract was well under $2, 000. When they posted the complaint, they had not even finished paying their bill.

We politely asked Mr. Janke to remove this post, as this may constitute libelous action against our company and we do not wish Sunbelt of San Diego Coast to suffer legal consequences. Also, in one of the emails we received, Mr. Janke stated he would be taking his grievances to the Better Business Bureau and various internet and media sites and taking legal action if we did not meet his demands by 03/28/11. Again, he makes a false statement, as did not wait and registered his complaint with the BBB on 03/09/11.

We sent an email to Mr. Janke and his Associates, again letting them know we are willing to complete their deliveries. We are currently working out details with Glenn Baxley to complete their deliveries. We are willing to give this customer the services they contracted us to perform, and ask that they end this dispute in an amicable manner.

We have posted this information so that the public can see that not every complaint is true and not every customer can be satisfied every time. We hope readers will consider our response to this complaint. We have delivered over 10, 000, 000 advertisements throughout the US for happy and satisfied customers.
