Banner Health - Broken left hip femur neck displace and patient 78 years old should be complete new joint not just pinning

February 25, 2020
Arizona Medical Review Board

My wife Yvonne M. Birds broke the femur neck of her left leg bone while walking to our car after leaving the Berger King restaurant to get into our vehicle parked in a poorly marked handicap parking spot at the business. The incident happened on March 8, 2019 when she tripped and fell over a wrongly placed cement tire stop in that handicap spot. She was 78 years old at time of the incident. My wife and I feel that because the hip repair was unsuccessful a second surgery will be forthcoming. Yvonne was taken to Banner University Hospital in Tucson where she received quick emergency surgery which pinned the brake together. After her initial hip pinning repair, she is unable to walk without the aid of a "Walker" to steady herself. The brake looked very bad in my laymen opinion from the first x-ray. The broken area showed the ends of the "ball" and "femur bone" to be "smashed together and very much out of alignment in comparison to her other hip. To pin the brake together was a very bad opinion by the operating surgeon. Yvonne's age definitely pointed to an artificial total hip joint and because the brake was offset. Proper medical practice should have been discussed prior the surgery considering the severity of the brake and the age of the patient. The incident happened about noon on Friday March 8, 2019 and the surgery was done early Saturday the next morning which gives me the opinion that little conferencing was done to discuss the best options for Yvonne's broken hip. All of this points to a medical malpractice investigation. My wife is suffering more every day with other complications growing from this badly deformed left hip. We have been unsuccessful in obtaining an orthopedic surgeon in state or out of state to perform the complete hip joint replacement. We therefore went back to Banner University Hospital for help on this situation. The Banner Medical Review Board has taken my wife's case for review. Three communication from them tells us that the case is taking more time to review. Their last communication advise us the case is now being reviewed with the highest office of Banner University Medical Center. The Banner University Medical Review Board came back with their ruling just a few days ago stating that they will not pay for a new hip joint surgery. They will not say anything about other information from the Banner review board I can only surmise that the review board is complete. Dr. Dohm has performed a medical procedure on my wife, Yvonne M. Birds, of a hip pinning on a broken hip neck joint with a displaced brake and on an elderly person without regard to a possible bad outcome. The left hip joint should have been a complete new joint which could have healed in a month. Her pain and suffering is on going. Our contact with the Banner University Medical Review Board started with a phone call on the middle of November 2019. Now she needs a complete new artificial hip joint as soon as possible.

Sincerely,

George J. Birds Jr, and Yvonne Birds

Yvonne Birds needs legal help for the broken hip. The neck of the left femur bone was greatly displaced and her age of 78 should have indicated to Dr. Dohm at Banner South in Tucson that only a complete hip joint should be preformed. Instead, he performed a "pinning" of the brake. A year and half later she received a completely new hip joint. Pain and suffering have been serious for her for these many months as well as after the new hip joint was installed. Edema of both legs have continued and have been a serious problem for her. Unable to walk without a "walker" she is very limited on her movements. Recovering from no use of the legs for so many months with a badly shaped femur left leg bone, muscles and tendons are having to be retrained. Legal options are limited to business liability and malpractice medical for the business hazard for the trip and fall as well as Medical Malpractice for not following the standard of medical procedure's to correct the broken hip. Legal Attorney help is needed as soon as possible. George J Birds Jr. geobirds81040@gmail.com [protected]
