Chantal Boucher and I (Mark Herkimer) saw on Craig's List your apartment for rent posted on November 13th 2012 the add read as follows.
Great 2 bedroom apt in quiet, peaceful setting with mature and respectful neighbors, pets considered, heat and hot water included with individual thermostat control, yard space for BBQ and patio area, no one below or above you, free storage bin in laundry room, off street parking, freshly painted, lots of closets, newer kitchen, diagonal from highland lake lifeguard area with natural drinking spring water at the property, nature all around you, front courtyard, avail december 7, [protected].
We looked at the apartment with what we understood was avaiable the 7th of December. That would have worked out perfect since we were closing on the sale of our house on that excact date. According to Paula (Your building Manager) who we spoke to, said that another couple was moving in another one of your apartments that she would have our apartment cleaned, painted, living room carpet changed, the bedroom carpets cleaned, the bathroom floor changed, the bath room sink changed, pantry shelves to be installed, shower to be calked, and the slider door changed out. All of wich was not done when the move in date came.
The bath room floor was not done, the slider was not done, the wall around the slider was not painted, the carpets were not cleaned, the living room carpet had not been removed to install linolium flooring, the rest of the apartment was not cleaned and the ceiling light was not changed in the entry, pantry shelves were not installed, radiators were missing soo many parts cant count all of them, . The remaining work Paula told us we would have to move in and then at a later date she would have the work done.
At this time we were living in a motel, renting a U-Haul with it sitting with our belongings in it and a storage unit with the rest of our belongings in it costing us a lot of money per day. We had no choice but to take another apartment with someone else that was ready for us to move in. We could not afford to keep paying all the added expenses accruing by the apartment not being ready to move in.
While all this was going on Chantal's mother came down with stage two cancer and we had to get the move done with so she could consitrate on being with her mother not anything else.
Paula also stated to us that she emailed us regarding our responsibility having to turn on the power, again this was not true. i checked my email at work and my personal email and there was no email regarding any of our requirements to do so. It was obvious to us that she wanted us to have the power turned on so your contractors could use our utilities to perform their maintenance of this apartment, which would have meant all work done would have been our expense. This is unjustifiable and unprofessional, as my attorney also agrees too, this request of us.
Chantal and I gave Paula a check for $1600 which was for the rent from December 7th to the 31st and for one month security. Since the check was accepted that meant that the move in date of the 7th was also accepted.
Since there was no lease given to us, I understood it was a month by month rent. I do understand we forfit the rent amount for the month of December, however we would like the security amount of $925.00 back since the original agreement was broken by Paula.
