Advanced Placementunethical behavior and took our money and breach of contract

We entered into what we believed to be a valid contract. In this contract Marc Resasco of ADVANCED PLACEMENT LLC and he was supposed to find us DPT‘s and we were to pay him $10, 000. There was a $5000 retainer and $5000 upon placement. He had us make out a check to a different company called Med ! Management LLC, which was already suspicious. But After we sent the check he sent us names of candidates and said he set up interviews. There were supposed to be three he confirmed and all were no shows which makes us believe they were never set up in the first place. Then he set up a fourth and we contacted the candidate and the candidate said I specifically told him I was not interested since it was too far from my home. However Marc insisted that he was coming for an interview. After a month went by we asked him for our money back because the 5000 was simply a retainer for the rest of the 5000 to be paid after he placed a candidate. He said he's not giving the money back. Not only did he say that he said that if we posted anything anywhere he would sue us for defamation and libel and slander. He kept saying that his attorney would contact our attorney and that never happened and that was likely a stall tactic.
We have emails to prove all of this.

He did not perform his end of the contract. There were no false complaints made. We caught him in a lie with the fourth candidate.
The contract doesn't call for him getting paid for his efforts. He only gets paid if he places a candidate and he didn't plain and simple. He owes us our deposit back. It is unjust enrichment for him to keep our money. Please be aware that he had another company where he did the exact same thing to others and there are online complaints. He closed that company.

we have researched all his companies an they are all revoked including the one we entered into a supposed contract with and also the one we made the check to.
