Xicom Technologies of New Delhi, India Scams Elance User out of $10,000

Well this is something we’ve never had to do before, but we have also never been scammed out of $10, 000 from a a company outside of the United States. At this point we feel like this is the only recourse we have. So this is our story of how we contracted out Elancer, Xicom Technologies, and how they managed to swindle $10, 000 right out from under us, and Elance did nothing. How did it happen? We’re going to explain, so it does not happen to you too!
About a year ago, our company set out to find a developer on Elance who could develop a web site solution for us to bring to market. We did a lot of searching and came across Xicom Technologies from New Delhi, India. They were one of the most expensive developers on Elance, but that was ok. We understand that you get what you pay for. We checked their profile, their portfolio, feedback, earnings, etc. Everything checked out. Xicom had great feedback, and had brought in over $3 million on Elance and had big time experience in PHP and MySQL development….we figured this must be the perfect company to work on our project.
The relationship went ok for a month or so, aside from the regular communication problems with the company. It was not uncommon to spend 3 hours talking to their developers over AIM about details, and then have them tell us to “Please email the details to us”. That was very frustrating. Overall though, this did not feel like a scam and we were willing to be patient with what was supposed to be a great, Elance approved company.
Unfortunately, this story does not end well though. Xicom obviously knew much more about Elance than we did, and ended up scamming us easily, with Elance watching the entire time. I’m going to post all the details in additional posts, but long story short, they worked for a year, and then when they got too busy and could no longer handle our project, they sabotaged the code they had written, leaving us with absolutely nothing. Elance’s policies protected them because they also took advantage of a loophole in Elance’s feedback system allowing them to do this to our company, without us even having the option to leave public feedback!!!
The ironic thing is, we utilized Elance for this job because we thought there was a level of protection, but we still managed to get scammed and Elance wouldn’t even step up and help. Sound interesting? Well it is…. VERY interesting.
How could something like this happen? Simple really…Xicom is a BIG TIME player on Elance and pretty much calls their own shots. Since starting this project we have watched their feedback fall considerably, and then pop right back up after having the real feedback removed by the Elance staff. Our feedback was also removed, due to a loophole in the Elance agreement that Xicom has become very familiar with.
When you’re posting a job on Elance, there are things called “Milestones” that supposedly determine what is done, and when during your project. Being a new Elance user, we had no idea what this meant, so each month when Xicom submitted a new set of “terms” to us, we didn’t pay attention to the fact that the “End Date” for the “milestone” was always the same — The START date of the project. This may not sound like a big deal, but now that we know better, it is HUGE. On Elance, you have only 30 days after the final milestone to leave feedback. So even though we worked on this project for over a year, the ability for us to leave feedback was cut off just 30 days into the project because of Xicom’s ability to circumvent the Elance feedback system, by rigging the dates on the projects milestones.
We argued the point with Elance, and were eventually allowed to leave feedback. We figured they realized how big this issue was but we were totally mistaken. Just 3 days after we left the feedback, it was removed by Elance in “accordance with their terms”. What terms? The terms that say feedback can only be left 30 days after the final milestone…. even though our project ran for a year, and the last activity was just days before, the final milestone data was months old because of Xicom’s ability manipulate these dates to benefit and protect THEM.
Consumers need to beware of what can happen to them if they use Xicom on Elance. Currently our only recourse in the US Courts is with Elance themselves. Xicom, being outside of the country is essentially “untouchable”.
We’ve got lots of screenshots, chat logs, emails, and PMB saves that we will be posting in the coming days. We really hope something comes of this before we have to go further but it doesn’t seem like that’s going to happen.

Dear Sir,
Whatever this author has written is total rubbish and not even a single statement is true. Xicom had filed arbitration against this company through net-ARB (Case No. 1293213) and enclosed below is their final award which proves that Xicom had not cheated them therefore, this complaint is totally invalid and should be removed ASAP.

Explanation to the Parties:
I find that (1) Mr. Miller was not cheated by Xicom, and (2) Mr. Miller genuinely thinks he was.
The evidence shows that most functions seem to work. Any issues pointed out by Mr. Miller were quickly explained by Xicom as being configuration issues and clear instructions given by Xicom about how to produce the desired result. I assume those instructions were correct since Mr. Miller did not report back saying they were not.
Mr. Miller suggests Xicom sabotaged the software delivery, or that they did all this work afterward in order to win in arbitration.
Sabotage seems unlikely for a number of reasons and there is not a shred of evidence to support it. As for doing the work afterward that they failed to complete beforehand just for arbitration, we hear that allegation a lot in arbitrations but speaking from years of software development experience myself, it is nearly impossible to pull that off, especially when there is no longer any input from the customer. If a provider understood the job that well, there would never have been a problem to begin with.
We will never be certain what happened at final delivery, but it likely involved a mix of bad files, poor communication, and as we witnessed here, Mr. Miller's unfamiliarity with the system along with an insufficient and sometimes erroneous understanding of programming and programming issues. As examples -
*** Broken links are a common problem when launching a new site, particularly on a new third-party server. They are easily found and easily fixed.
*** Mr. Miller complained at one point that two web pages Xicom provided links to with .php extensions had no actual php code, when it is impossible to know that at the client side since php is resolved by the server and only the html output is transmitted over the internet.
*** Having the "'Country" selection come up 'United States' by default is a very small issue from a software point of view, not a major one as Mr. Miller stated. It can be found and fixed in about 5 minutes by any professional programmer.
I am going to rule for Xicom. The Final Award section of this decision will be forwarded to Elance.

| Xicom is very unprofessional company. It appears that they have deliberately cheated this customer with the help their familiarity with the Elance system. |

| We had the same problem, the sales person demanded for money nonstop to start the work immediately. Then, once they got paid next 7 days nothing happened. And then, the downloading of the things from server they did not even need began for days. Now once we asked for a refund, they stopped talking to us. |

| I have been working with the Xicom team for the past 5 months and I am 100% satisfied with the quality of work that they provide. Their Project Managers and Programmers are dedicated to getting the job done correctly and up to the highest quality standards. I found that many weeks of work they were working more hours than they were billing just to be certain that the quality standards and deadlines were met. I will be using their team for bigger projects in the future. Genuine, intelligent people who are easy to talk to and work with... A++++ |

I'm glad I searched the net and came across to this post. I have to agree that Gulino Barnes is truly unprofessional, insensible and has no sense of responsibility. He simply lost our contract worth $11, 500 because his ego was too big to even acknowledge the mistake he had done and kept trying to justify it.
We had agreed that our website will be compatible with IE7+ and 4 rounds of revision for every design will be done. He had agreed and told me all is good. The contract that he sent and of course was signed by him had changed and modified the above terms without prior discussions or our written agreement. He had changed it to IE8 and 3 rounds of revision.
This was previously discussed and he had agreed. We are very reasonable and could have compromised if we were kept in the loop. Changing things after it has been agreed to is FRAUD. Simply it was a matter of principle. These notes were brought to my attention by our legal department when they were comparing the agreement with my notes. We were about to sign the contract when we realized this. I asked him for explanation and he kept trying to justify it. Basically dig the whole deeper and deeper.
I would never do business with this company and will ensure to let everyone know about my experience. He simply wasted good 2 weeks of our precious time. |

| We are one of the biggest in online pharma industry and have been dealing with Xicom from last 5 years. They developed our entire application and are maintaining it since inspection. The project managers and business analysts consulted us and made sure that they developed the application perfect not only from technological point of view but also from the business aspect. When we were in initial phase and just had an idea, we were lucky enough to reach Xicom as they converted a mere two line idea into a fully-functional business model. I am amazed to see the above comments by some people and really have no reason to support them. Xicom, keep the good work going and we highly recommend Xicom to anyone who has aspiration to succeed in the online business space. |

Thanks so much for your post! I contracted Xicom through Elance for my upcoming ecommerce project. The sales guy (Anupam) suggested we start with "Business Analyst" services to determine the architecture etc which I agreed to for $5000 (since it was a big project). The development costs would have been extra. This guy Anupam kept talking about how they built "auction.com" from scratch and their 25 professionals support the site day and night. I was sold to his sweet talk and agreed to pay $5000 in advance (he said their dedicated services - don't know what they mean - require 100% advance). But I was hoping they have asked me to put the payment in Escrow account, but I was surprised to receive an invoice for 100% work completion and demanding immediate payment be released from Escrow! Well, I refused since Escrow protects both seller and buyer! This guy anupam came back and said they can't agree to it so I offered him an alternative - get me 2 good client references - one from auction.com and another from similar client. And the next moment I received a cancellation request saying I had defaulted on the payment and so they are cancelling it!!! Cheeky very cheeky!
PS I took all those precuations because I had read this thread and couple of other bad reviews on google! Beware of this agency and if you have to, ask for cross references before committing anything and NEVER agree for advance payment - Escrow is there for just that purpose, use it!!! |

We were about to undergo using Xicom until this and a couple of other posts were found. I thank you kindly for saving us from any dramas that could have occurred. The similarity with the story above this one and our own is astounding although we hadnt read anything here.
Will avoid them at all costs. |

| I have been using Xicom from last 5 years and am very happy with the services and quality of work they are providing. Apart from this they have been submitting the assigned task before time. Team Xicom is very good at its communication part . i don't know about others but I'll recommend you all to go for this company in future. |
