Islam is more than just a religion – it is a complete way of life and to follow it is to follow a definitive code of conduct. Not only does Islamic legislation relate to belief and worship, but for a Muslim, ALLAH (SWT) has also divinely ordained the economic and social aspects of his or her life. Therefore, it is imperative for a Muslim, regardless of his place of residence, that not only does he live in accordance with the law of the land in which he resides, but that he abides by the dictates of Islamic law, (Shariah law) as well.

The council does not observe the Shariah law on Child Custody as we all know that the mother has custody of a child until it reaches the age of 7 and then the custody is transferred to the father.

How can the Sharee council give a divorce to someone who was never my wife?

It is true that sharee council dewsburry is only giving divorces to women to earn money and I am victim of this council, my wife took divorce from sharee council while I was living in Pakistan and sharee council did not bother about any thing I told them about actual matter and sharee council did not tell me any detail about case. I contact many different religious scholars who told me that divorce is not done yet and you and your wife is still in relation by religion.

Baroness Cox presented the Arbitration and Mediation Services (Equality) Bill in October 2012 in the House of Lords that would (1) limit the activities of Shar'i courts, (2) require them to uphold laws concerning women's rights and (3) make it a criminal offense (punishable by five years in prison) falsely to claim or imply that Shar'i courts have legal standing.
The Arbitration and Mediation Services (Equality) Bill [HL] is a private member’s bill introduced by Baroness Cox (Crossbench). The Bill received its first reading in the House of Lords on 1 June 2015 and is scheduled to receive its second reading on 23 October 2015.

The Arbitration and Mediation Services (Equality) Bill [HL] makes provisions regarding the application of equalities legislation to arbitration and mediation services, and also in regard to the protection of victims of domestic abuse. The Bill seeks to prevent providers of arbitration services from doing anything that constitutes discrimination, harassment or victimisation on the grounds of sex. It would do so by inserting a new subsection into the Equalities Act 2010 and into the Arbitration Act 1996. It would also provide clarification that discrimination includes, but is not restricted to, treating evidence from men as being of greater value than that of women, or vice versa. The Family Law Act 1996 would also be amended to allow courts to set aside any order based on a mediation settlement agreement, or other negotiation agreement, if the court believes on the basis of evidence that one party’s consent was not genuine. The Bill would also place an obligation on public authorities to inform those who are married according only to certain religious practices, or those in polygamous households, that they may be without legal protection.

With this in mind Dewsbury Shariah Council is now taking the findings of the civil court and accepting them as true without doing their own research on any matters. As divorce is quicker and easier in the civil courts, it is now even easier to get an Islamic divorce and true to say Dewsbury is the easiest place in the UK and that is why people travel from all over the UK to get divorced here.

Every marriage will go through a rocky patch now and again, and most couples can resolve their differences by talking to each other and understanding how each other feels. However, divorce should always be the last resort for any couple. It is a Muslim spouse’s duty to do everything possible to save the marriage, and for all other Muslims to do their utmost to help save the marriage. There are numerous agencies that will give advice and help to a couple in difficulties – the family members, the wider family members, the local community, the local religious leaders, the local Shariah Council, the Mediation Service, the Muslim Women’s Helpline, the Marriage Guidance Council, Relate, child-care officers, etc. The husbands and wives generally have to seek this help for themselves, but sometimes a solicitor will put clients in touch with suitable agencies. In good Islamic practice, before any effort is made to seek a divorce, all efforts possible should have been made to solve the problems and reconcile the spouses.
The Dewsbury Sharee Council is an arbitrator and not a mediation service and it wants to attract women to file for divorce by offering a quickie divorce service compared to the other Shariah councils in the UK. It has become very popular due to the fact divorces are granted on a guaranteed basis in a very short space of time. By being popular, demand has grown year by year and the income received by the council has grown year by year. The people running this organisation have become rich on other peoples misery.

The Islamic Shariah council in Leyton is the oldest in the UK and the largest, Birmingham Shariah Council both support reconcilliation and attempts are made by their counsellors through mediation. They also advise on the Shariah method for child custody and contact and build this into the reconcilliation process as not to separate the family even if the couple separate. Both these councils use the children as a tool to safeguard the marriage of the couple.
However, it seems that many women are now turning to the Dewsbury Sharee Council as it is very easy to get a Islamic divorce, the easiest place to get an Islamic divorce in the UK.
