Santander Consumer USA egregious accounting practices & horibble customer service

My auto loan was owned and serviced with HSBC Auto Finance Company (without incident) until March of 2010 at which time Santander became the servicing agent. My Loan was handed to them with only 4 pymts left on the loan. My payments were made promptly with HSBC. Even though I did not receive information as to where to send my payments, I proactively went online to Santander's website to make my first payment online to ensure that I was not late in making my payment; however, Santander began charging my account with late fees. I contacted the Customer Service to have the matter resolved and this is when the nightmare began. I have presented them with evidence upon evidence indicating my promptness in making my payments and they somehow turn my evidence against me because as one of the Customer Service Representatives (CSRs) stated, "because they can without the customer's consent." I have tried to have these matters resolved without litigation, but there appears to be no other solution. I paid overpaid my loan in July 2010 (and have proof of that) to bring my balance to $0.00 to rid myself of business with Santander. Yet, somehow they have managed to place balances on my account - one day the balance is the amount I paid off, the next day it's $1174.#. Today, the balance on my account read: $324.#. Thank God for HSBC for even thou Santander ran amuck with my account, I received my Certificate of Title from HSBC in the mail today. HSBC upheld their agreement with me and honored it. I still however, feel that FTC or BBB or whomever can, need to have Santander dissolved in business. It is the worst example of Consumer Lending I have ever known. There should REALLY be LEGAL ACTION (S) brought against them - maybe then they would be consummate in their customer service. I'm still concerned about the negative information that was most likely given to credit reporting agencies re: to my account due to their extreme display of malice and vindictiveness. A class action suit should be sought and brought against Santander Consumer USA for misaligning the credit-worthiness of their customers and punitive damages sought for the aggravation and distress their CSRs cause.

Santander Consumer USA thieves

I'm a Sovereign costumer for 2 years. I had everything well in my account for 2 years. Until one day I had a fee problem. They charge me $35 dollars for each payment I did I that day. So, the total was $280. I didn't knew that I had insufficient money, and only in that day the rob me almost $300 and the payments I did were $100.

I tried to fix with my branch manager and nothing. Call the costumer service, that is horrible. She just looked to my account and said that everything was legal and they couldn't help me.

Then I talked to the costumer service manager who told me nothing could be done. And I told her, I was going to close my account and all my family because It wasn't anymore a money issue, it was about a "robot" bank that forgot that they have people behind that accounts. My money market had money and I had a clean record. So, if that don't mean nothing I don't want a bank like that.

Don't open a account. They are thiefs and people that only see money. They don't care about their costumer.

Santander Consumer USA harrassing calls and inaccurate balances

Santander took over for Drive Financial who originally had my car loan. Drive Financial was bad enough but Santander calls me one day after a payment is due to ask when my payment is going to be made. They call on average of 14 times a day. They call on two lines at work and my cell phone. If I wasn't the one answering the phone at work, I would be in a lot of trouble for getting that many calls.

They also have increased the balance on the account even when the payments were on time. The balance on the statement does not reflect nearly as many payments as I have actually made. When I inquired as to why, customer service told me I would be able to get a print out of all transactions on the account. I requested it three times. I have NEVER received one report. I believe they are overcharging interest and adding fees that are not legal, but I can't prove it without their breakdown.

These people MUSt be stopped. they break all the rules and get away with it!

They do not get away with it IF WE stand up as individuals first to resolve our individual problems, but most importantly get together as a collective and file a class action lawsuit for Unfair Credit Reporting, Unfair Debt Collection practices, and Unethical banking. I had a problem with Santander reporting my account being late when it was not. When I called, I was told that I didn't have a valid argument even though I cited the FCR policies that related to me. Finally, although they acknowledged their error, they referred me to the credit reporting complaint division who did nothing. I had to file a dispute with all three bureaus to have it corrected, when it would have been simple enough for them to just remove the error. Why don't we contact an attorney and call for those who have had problems and either put them out of business, hit them in their pockets, or at the least force them to abide by the federal policies that are SUPPOSED to govern their operation.

They have terrorized my daughter and as a single parent trying to make ends meet in this economically challenged time, their tactics are not helpful. They constantly call my home, where she does not live, and harass me and my husband. The auto she has a loan for should be paid off in about a year but with all of their outragous fees she still owes nearly what she took the loan out for. How is a person suppose to catch up when they are behind in the first place. There should be a law against what they can charge and their tactics.

Santander Consumer USA unfair practices

I also had a car loan from road loans, who then became drive financial and finally santander consumer. They are horrible! First of all I became disabled at work so I fell behind on my payments. They said they would work with me, but neglected to state that there was a $10.95 late fee per day! My original contract with road loans said nothing about that and I haven't received an updated statement of terms for this company.

I was paying $300 every 2 weeks to catch up. With the late fees I was 55 days behind and made a $630 payment which now I am only 23 days behind. But all the late fee's bring me up to almost $1500. It will take years to catch up to the amount due. Of this $630 payment, $109 went to the principal and the other $531 went to interest! This is a rip off and must be illegal to say the least. This company is incredible with the harassment every day to get their money. I would not recommend dealing with them at all! If anyone has a class action suit - count me in!

Santander Consumer USA lies and calls all the time

Santander just called me telling me they want the car or I have to pay right now they then told me that they can garnish my wages if you google it you will see is what I was told so I did 41. South Carolina Wage Garnishment

Wage attachment is prohibited in South Carolina. SCCLA 37-5-104.

wow looks like a lie a huge one there lol. They will tell you anything they can to get money I don't get how this comp even has anything but bad pr I want to see them go down I am going to go to every car dealer ship and let them read all the complaints then as think any of the folks here would ever get a car from you more then once knowing you use a comp like this. Make them think about how they will not get anyone to buy more then one car from them and with me driving a billboard that tells how bad they are want to be what will happen even more?

Hey santander when you read this run over to your books and look at who has a blue 2008 billboard that says don't use this comp they screw you all the time.

dont forget, february 4th 2011 is offical start of 'vandalise your local santander branch until they go bust'. this corrupt organisation is robbing savers ( including me ) all over the world of their money. if only we knew where their policy makers lived we could go around and put them down, but we dont. instead the best we can do is demolish their public facing property.

Santander Consumer USA negligence

Situation: Santander Consumer took over HSBC. With HSBC, when you call for a payment deferment, they will tell you yes or no. Santander took over the company. I called in for a deferment and they verbally told me "ok you’re all set". A month later I get a bill for the past month with a late fee. It was not differed. So I called to complain, and they said they have to repeat the process to fix the problem. It got deferred; however they didn’t remove the late fee. So I called and spoke to JIM ROY SCOTT, accounts manager, who refused to remove the late fee after apologizing for the negligence. Who also refused to give me the number to complaints (only given me a P.O. box number, says that there is not a number to complaints). The late fee is $17.06. Small right, but lets multiply this, if this was to happen to ONE MILLION clients, the company takes $17, 060, 000.00 (17 Million) from the public. Justice must be served!

Santander Consumer USA harassment calls

This company calls me every five days I have retained an attorney to file bankruptcy. I called Santander to relinquish the vehicle and request that they pick it up. They told me they could not pick up the vehicle until I gave them a case #. I keep getting calls on my work and cell phones and I keep telling them the same thing and have given them my attorney info. I'm keeping a log of every time they call me and I give them the attorney info because obviously they don't train their employees about the law and protection consumers have from the FDC. Let em keep calling, I hope they have to pay a fine for every call. Here is the letter I will be sending them:

I was with Citi Bank and got told by this Santanders Co. that I had to make my patments to them.Did not no paper work of the switch.It has been a nightmare, And having to file bankructy, But they will not get my can.Only had to do this due to health, reasons.And you can not reason with thim in anyway, just rude people that answer the phones for them..

Santander is a pretty difficult company. They do have a right to contact you as often as they wish until you have the case number...at which point you're under the protection of the court. If your loan is owned by Santander, they do not need to follow FDCPA guidelines as these guidelines only apply to third parties. That being said, most companies will deal with the attorney even before a case number is established as contacting you incessantly for a non existent case number is a waste of time. In this case you did do the right thing by sending a cease and desist letter...which does apply to them.

OMG, I am so glad I am not the only one. I have a loan through them and in our contract(we were with Soverign who santander bought) states that our car payments are due on the 21st and are considered late after the first of the following month. Depending on when I get paid It will be a few days late. Well they call me harrasing me. I have never missed a payment before and have never gone past a week of paying them. They then stated some crap about I will get a 5 dollar late charge for every day that it is late. When I told the guy he was full of crap and that that wasnt in my contract he said yes it is and Im telling you about. I said send it to me in writing then. Never got anything. I have also asked them to just draft it out of my account and they never do. They charge you $10 to make a payment over the phone and internet. Im not paying that, i dont have money to give away. My sister worked for the buissness services and she said they do that so they can make some quota and get bonuses at the end of the month.

the fair debt collections act is actually only for 3rd parties trying to collect... not the actual person for who you owe the debt to. you can view the fair debt collections act online for free and it states that.

Retaining a lawyer with the intention to file bankruptcy IS NOT actually filing for bankruptcy. Until you actually file & provide them with a case#, they can & will continue their collection process.

At this point in time, they don’t have to speak to your lawyer because the paperwork has not been filed. Say you don’t pay the attorney the entire amount; will they still be filing your bankruptcy case?

You need to talk to these people and make some kind of arrangements. It would be a shame if your car is repossessed before you are able to file the bankruptcy.

Santander Consumer USA fraud, id theft, bank info stolen!

An employee of santander has stolen my bank routing number and account number when mailed to their po box at: p. o box 660633 dallas, tx [protected].

I have only made 2 payments to them via check since they took over the servicing of hsbc auto and my info has been compromised.

This person has made their own checks with my routing number and account number but the name brittney dotie and a duncanville tx address, and has cashed one for $465 at old navy in plano tx, and then a smaller one at krogers in fort worth texas, then she also went to burlington coat factory in dallas tx for $355.

If anybody else has had their identity stolen by "brittney dotie" email me back please, and we can make sure this person is stopped.

I have pictures and there is a surveillance video.

I am thinking about getting a lawyer or something but not sure exactly how far to take this. if anybody has any advice i'd love to hear it. thank you.

I reported to the police and the FBI but because the amount was not thousands of dollars in my particular case, they are not doing anything about it, just relying on my bank to return my money and the person who is committing this theft is going to continue to work for Santander and likely collect other peoples info as well. This is crazy seems how they now just took over CITI's auto porfolio. Crazy.

I had my money order altered. I investigated it with Western Union they sent me a photocopy of the cashes money order. It had pay to the order of “Drive.” Which I didn’t write and was deposited at a Chase Bank. Come to find out Drive is a subsidiary company of Santander. Someone from their company changed my payment and deposited it in another account not in my name then kept informing me they couldn’t find the payment and I was late and even threatened repossession. This just happened last year I am looking for legal action now please let me know how your case turned out.

Is there a law suit going on? How can I get into the class action law suit? I just sent them a western union money order with their company name on it and Santander is saying they never received it but we traced the western union check and it has the name "mecliria" "Lecliria Mathis". Very hard to read as the print starts with like N, M, or H. The a's look weird and the signature looks like the name starts with an L. They cashed it and only have a phone number. We called and they texted back and we let them now we are goon. After them for fraud and cashing our check. So western union cashiers checks aren't even safe.

Santander employee stole £4800 from my account this week, have reported it to my Local Police Commissioner in Devon UK but doubt if he will do anything because he suffers from Lazyitus.
Have closed down my account with immediate effect because of lack of trust. Contacted the CEO Patricia Ana Botin but no response.
The fact I have closed down my account with Santander will prevent me from making a formal complaint to the FSA or the Santander Bank Board of Governers but I am stuck between a Rock & Hardplace.
Santander ARE obviously ABOVE the Law and its not until you read blogs like this that we realise how widespread this is.No wonder these Bankers pay themselves millions in Bonus because they are untouchable and they don't give a damn for their Customers.
Bank Customers in Cypress are lucky because they are losing only 10% of their funds. I LOST ALL MINE.
In actual fact, I didn't lose it, it was stolen

My girlfriends identity was stolen after making a payment to Santander. The ONLY time she gives out or has given out her card information was to make this payment. Next thing she knew her account was in the negative and $550 was missing from her account. The charges made were to the Philippines and Thailand...one website they used was called Ensogo.com.ph they're version of living social site. If anyone is filing a class action lawsuit we would definitely like to jump on board. Please contact us.

Here's one for you:
My husband passed away 2 years ago. I've been making payments ever since. The loan was in his name only, the registration in both names. I fell behind, car got repo'd. Well, I have the money to pay to get it out, have since it got yanked, and they won't return the car to me since I'm not on the loan and they want an executor of estate document. There is no document, he had no will, no estate really, and everything came to me. I even offered to pay the loan off completely, and they still won't return it. The car is worth at least twice what I owe on it at auction, so guess what, 3 days after it got repo'd, even though they told me I had 15 days to get it back, it's at auction. I'm currently trying to get with the State Attorney General's office to see about getting them hit with fraud. I've talked to a couple lawyers, and they've told me that by them accepting my payments for the last 2 years, they've accepted me as the loan holder. The account I was paying from is in my name only, so they can't even say they thought he was paying it. They knew when he passed, and told me to continue to make payments so I can get the title transferred to my name once it's paid off. They even have the death cert and everything.

I say lawsuit, lawsuit, lawsuit!.. My husband is Military and while deployed he was with Hsbc for one vehicle and the other with Citi Fin. During his deployment he usually does what they call a split pay where he get's a certain amount sent to him and the rest goes to me. That way I don't have to spend extra money to western union cash to him. Anyway, Disbursing got his check confused and was sending me the 50.00 split pay that he was supposed to get and he was getting the rest and having to mail it home to me. At that time I called both HSBC and CITI FIN. and they did a two month deferment on both and then because because HSBC recognized the fact that he was military asked if we would like to adjust his payments for our vehicle. I thought wow how nice lol... So they close to cut his payment in half and sent us new a new contract. It was our understanding that they were pretty much refying our vehicle loan. So then I thought now if they would do that wonder if Citi Fin. would? Yes they would and they did. It was making life so much easier on me especially with the hubby gone. He was set to be deployed for a full year so when he returned a year later I had just gotten the letter that a new company had taken over our loan. Then a few months later we got a letter that they took over for Citi Fin too. Unfortunately our accounts for both vehicles are currently with "SUCKTANDER" as my husband refers to them. Yet at the bottom of the letters it indicated that umm were were like past due thousands of dollars! I couldn't figure out why we make a payment every month and on time. Next thing I know tons of harrassment and threats of reposession! So I finally talked to someone I could understand while on the the phone with them. they explained that we were past due because our contracts with HSBC and CITI Fin.. were no longer acceptable. I said how do you figure. They sold the original contracts to SUCKTANDER! I said that shouldn't make a difference the accounts are still the same! They said no we don't honor the modifications and that made you behind the difference on both vehicles for the past year and then some! I said are you kidding me? They said nope and if you don't bring both vehicles current by the 15th of August 2010 we will start the reposession process. I thought wow REALLY? Well Guess what? That conversation was on the 12th of August! My car reposessed on the 13th! So we brought it current per the account manager and were able to get the car out of the impound yard. I was told that the tow company fee's would be moved to the end of my contract but they aren't they are floating month to month looming over every payment I make and of course those fee's weren't cheap and now threats of repo because I make a payment but now my tow fees are behind and that according to the crappy customer service rep it is apparently plenty of reason to reposess! Let's not forget the time I made a payment over the phone and they were more than happy to take that check over the phone since they don't take cards over the phone! lol.. low budget! Anyway, to make matters worse I only authorized them to take that one single payment and they took 3! I called and was like you know how am I supposed to feed my family if you are going to steal from me? They said well, we thouht based on the past reposession and when we called to verify funds that since you had it we'd just take a couple extra payments. Funny those extra payments have never showed up on either of my accounts... Yet, I still owe! I think a lawsuit of any kind or one due to the harrassment and continual discrepencies and misinformation and along with the check info being stolen! I too have had my checks compromised! Good luck everyone SUCKTANDER isn't worried about those valued cutomers they claim to be. They are money hungry and want all they can get there hands on. No matter who it's going to benefit!

I am also filing a complaint against Santander. i write down the payoff amount DAILY and it changes EVERY SINGLE TIME. it goes up most of the time, sometimes it goes down. They took over from Triad, and its just ridiculous.

OMG, I am dealing with all the same issues everyone else is and these people are idiots! Noone seems to know a damn thing about what they are talking about and everytime I talk to someone, it is a different story. I too have had both of my checking accounts compromised. I am so glad to hear that I am not the only one out there having these issues. I too plan on joining in on the class action lawsuit. These people have no right being in business and treating consumers the way they do!

I am so glad I found this. I havent experienced this yet but since yall mentioned it I will be sending in money orders and not giving them any information over the phone. If you are 5 days late they will start harrasing you for your bank information. Also when Isigned up for automatic withdrawls, they have the form on the back of the return recipt, they never did it. When i called them about it. They say i need to fax it and not put it on that for, thenwhy have it there?

Santander Consumer USA bad service

I have paid with my debit/credit card online for the past 2 yrs, this includes a $5 dollar transaction fee, which is fien with me. After santander took over I have issues paying with my card online.

I either have to call in ($10.95) transaction fee or give my direct bank account information (i'd be crazy to do that) if I want to pay online

I have a feeling the error is not just an error and I don't find it coincidental that all these complaints are up here and then this occurs too.

This is a perfect example of what you hear about a comapany trying to compile more fees for their own benefit by canceling out one payment option w/ a $5 dollar fee and directing people to the online payment option that has a $10.95 dollar fee.

If that is not the case, then you think they would fix what is making them look bad. When I spoke to the rep on the live chat, I told her that the site was giving me and error though I had not mentioned what the error was. She responded with "is it giving you error 56?" I sadi yes... Now how would she up and offer that right ofrf the bat if many, many more peopel did not make the same complaint to the company? If they know about why has it not been fixed?

Santander Consumer USA forgery, theft

I attempted to pay off my car loan santander 2 weeks ago. The amount owed was $13, 451. I send a check for the amount as my monthly payment. The check was cashed before the due date. The amount on the check had been altered and initialed by an employee to the amount of $1, 345.00 and cashed in that amount. Soooo... The car wasn't paid off as i'd hoped nor was I notified about the check alteration. I only found about the check alteration by going to my bank, investigating my balance and the actual check. I had the check printed. I called santander 'customer service' and complained. I was put on hold for an eternity (one long-distance call). I called back (2nd long distance call) and was transferred to someone else. This person found a 'copy' of the check somehow and argued with me about the amount and denied there anything wrong with it and that the payment would stand as it was. He added that the total amount due was now $13, 261.00 because a 'revolving interest' charge had been tacked on even though the payment had been made on time and the check was altered. He told me I should fax my concerns to the 'asu' department, whatever that is. So, I got all of my documentation together, wrote a note describing my issues in great detail and faxed and mailed (certified mail, another $6.00 spent on this idiocy) the documentation to the 'asu' department as advised. I also filed a complaint the the texas attorney general's office and sent the same information to them. I also included my complaint to ag's office to santander along with everything else. This all took place 3 business days ago. I have received a return receipt from the ag's office but of course no word from santander. I plan on taking this to small claims court in two weeks if I don't get the 'revolving interest' fee removed, the car paid off and the title. I have no doubt I will be ignored by santander until they have to drag their legal department into it and start threatening me with whatever bs they can come up with. I have time on my hands right now and i'm gearing up for a good fight. Wish me luck!

Santander uses a lock box to process their payments. The employees at the lock box process for several businesses.

I think your check may have been encoded for the incorrect amount. Look at the numbers at the bottom towards the right (after your account & check #). The amount that is deducted from your account is determined by what is encoded on the check. I don’t think this is fraud, just a simple mistake.. Human error.

The only thing that puzzles me is that the lock box does not have a procedure/policy for this. They can apply a label like strip over the incorrect amount & encode it again, or you should have been notified. If someone was able to sign off on the mistake, then they certainly could have contacted you.

Santander Consumer USA if this company is offered to you as a lender. run!!!

The original loan for this car was finaced through hsbc with no problems. We were sold to this company and the tale of woe begins.
We got behind on the payments of this car because of circumstances beyond our control.
Santander promised to set up a plan to allow us to make one payment and the rest of the payments would be put on the end of the loan extending the loan by two months.

We kept our end of the bargain and paid the note. Santander reniqued on thier word and now are trying to reposses the car. This company should not be trusted. Their word is no good.

Santander Consumer USA violates rights

My hsbc auto loan was acquired by santander consumer usa when they bought hsbc auto. Since then, after hitting a rough employment patch, santander has been relentless in their pursuit of any delinquency...2 days or 32 days, it doesn't matter. They will call all of your contact numbers (home, cell, work, your spouses work) numerous times per day. Even if you talked to them on monday, letting them know that you don't get paid until friday, they will call you every day multiple times per day until then. When you confront them with this info, by saying "read your system notes," they will tell you "it is an automated system and there is no way they can keep the system from calling."

As an added form of harassment and intimidation they will call your employer and your spouse's employer... And... Let your boss and coworkers know that you are in collections. Even when you call santander and tell them to stop calling you (and your spouse) at work. They will continue to call. Well I finally had it with their disregard of the fair debt collections practices act. So here is what I did:

Filed complaints with the bbb in my area. Btw, the bbb has suspended santander's rating while they are under investigation. And I also filed a complaint with my state's attorneys general office. Everyone here should do the same. And to help you with that here is the fdcpa, so you will know which of your rights are being vilated.

The fair debt collection practices act (fdcpa), 15 u.S. C. § 1692:

Prohibited conduct

The act prohibits certain types of "abusive and deceptive" conduct when attempting to collect debts, including the following:

Hours for phone contact: contacting consumers by telephone outside of the hours of 8:00 a.M. To 9:00 p.M. Local time[3]

Failure to cease communication upon request: communicating with consumers in any way (other than litigation) after receiving written notice that said consumer wishes no further communication or refuses to pay the alleged debt, with certain exceptions, including advising that collection efforts are being terminated or that the collector intends to file a lawsuit or pursue other remedies where permitted[4]

Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously: with intent to annoy, abuse, or harass any person at the called number.[5]

Communicating with consumers at their place of employment after having been advised that this is unacceptable or prohibited by the employer[6]

Contacting consumer known to be represented by an attorney[7]

Communicating with consumer after request for validation has been made: communicating with the consumer or the pursuing collection efforts by the debt collector after receipt of a consumer's written request for verification of a debt made within the 30 day validation period (or for the name and address of the original creditor on a debt) and before thedebt collector mails the consumer the requested verification or original creditor's name and address[8]

Misrepresentation or deceit: misrepresenting the debt or using deception to collect the debt, including a debt collector's misrepresentation that he or she is an attorney or law enforcement officer[9]

Publishing the consumer's name or address on a "bad debt" list[10]

Seeking unjustified amounts, which would include demanding any amounts not permitted under an applicable contract or as provided under applicable law[11]

Threatening arrest or legal action that is either not permitted or not actually contemplated[12]

Abusive or profane language used in the course of communication related to the debt[13]

Communication with third parties: revealing or discussing the nature of debts with third parties (other than the consumer's spouse or attorney) [14]

Contact by embarrassing media, such as communicating with a consumer regarding a debt by post card, or using any language or symbol, other than thedebt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram, except that a debt collector may use his business name if such name does not indicate that he is in the debt collection business [15][16]

Reporting false information on a consumer's credit report or threatening to do so in the process of collection[17]

they are doing this to me now, 56 calls last week, i spoke to them and still the calls are coming some automated some not i have had it, 9 calls a day sometimes, they are violationg me, and they wont stop, ?

Santander Consumer USA harrasment calls they call me 12 times or more a day. i'am not behind in my payments and they still call every day.

I'am being called 10 to 12 times a day. They call me at home and my place of business. I'am not behind in my payments and they do not record the payments. I will call to check when my last payment was made and is my next payment is do. They will say my payment was made on may 11, 2010 and my next payment is do may 12, 2010. So they never have their payments recorded up to date. I want so much for the calling to stop. It is every day and night. Please help me stop the calls. They are receiving thier money each month. Thank you and please help me to stop them. The company was owned by hsbc auto financing and was sold to santander consumer and thats when they started calling.

I have been a customer of Santander since 2008 and the customer service is terrible. They don't keep good records of payments. I have had several payments take a month to post while having to deal with tons of calls a day. Then once I was on hard times and had been given a 2 month extention, GREAT i thought, but they still called everyday because the lady never inputted the agreement. I almost lost my car to repossesion. Santander is aweful...Stay away

Thank you! Santander cost me my job after illegally reposessing my vehicle for... Are you ready? $2.16 yes 216 pennies, wanted 2, 160 to get it back said 21.16 was past due 3 days, $216.00= (9) I had 9 days left befroe the payoff! Due date and the pay off to get the title hsbc still fuc$ has, 121.00. I excerised my rights and challenged the validity of the bebt, never another word from them, was never allowed to get my personal articles out of the car, where? I was never told where it was stored, only a voice on my cell phone, that sounded like the.. Darn it all, the same voice of the 6ft 5in 385 solid muscle tow truck driver who repoed it illegally, and when I stepped outside to present him reciepts to hsbc... 3 of his black inmate typical profiles, greasy, grimey disgusting.. Pepperoni pizza (oh my bad, we all know a pizza can feed a family, strike that) rick james on crack after 2 hour concert look a likes... Hit me with a bar a butt of a handgun, and knocking me out with stench of feet, fart, and butt crack, said dude give it up your car is already gone it is sold... Having distinct marks that only a few would know and the area code, word got back to me where it was parked. Well let me tell you, the driver would of been better off giving a grizzly bear a back rub with a hand full of razor blades crazy glued to the tasmanian devil in a phone booth. Santander Consumer USA excessive calls

I keep getting calls from this company and have repeatedly asked nicely to remove my number from thier calling list. It has been 3 days since I asked to be removed. And I am still rcving calls. The calls have been coming for weeks now everyday, even on sundays. I do not have association with hector lopez or mercedes which is who they are looking for. I have told them very nicely to stop calling the phone they are calling belongs to my 16year old. I just called and spoke with mobroken and he tried to double talk me and say he could not help me because I do not have an account and because I called he did not have the acount associated with my number up so therefore he told me that he could not help me but refused to give me a supervisor. I screamed at him to fxxkxxg give me a supervisor now and he put me on hole. (I am aggraviated and fustrated and fed up with the calls. I do not apologize for my language) he then picked up and did not speak and then I said hello and he proceeded to reroute me to the main system again. I do not appreciate the calls or the treatment. I cannot believe that people are treated this way and I am not even the debetor. I hope this can be resolved

Santander Consumer USA refund

I purchased a vehicle a while back and the loan I guess was bought by santander or my original loan complany was bought out, but I traded my vehicle in after making every payment on time via military allotment. I traded the car in prior to my may 1st payment and got a 15 day payoff of roughly $5800. The dealership estimated my payoff as being $6028 and sent that in. My may 1st payment went in and I was told that I would receive that payment back if the loan was paid off. The loan was payed off and the payment from the dealership posted on may 12th. (according to santander) they posted my may 1st payment and that changed my payoff to $5709.77. I will be getting back $318.40 (my normal payment is $317) so per the customer service reps named chalis and her supervisor perpetua if I had not made my $317 payment on the first then the payoff would have been $5800 and I would have still gotten a $200 refund. But since I make my payments on time I got screwed out of $200. I will never do businees with them again and I will certainly be part of any lawsuit that is brought fourth if I don't file one first.

I would like to join any class action suit brought against SantanderConsumer USA. My loan with Citifiancial was bought by them on Sept 6, 2010 The first I every heard of them was when I got a call that I was behind in my payment even though the payment was sent to Citifi on time. I decided I did not want to do business with this co so I got my bank to refinance this loan and called for a payoff. The payoff was given as 14, 648.00 so that is what the bank sent in a certified check. The acutal payoff was 14, 212.00 I was due a refund of 435.00 but now this low life company has no record of it.
I keep getting the robot response of " IT WILL TAKE 30 TO 45 DAYS" to be sent but guess what even though the bank sent a copy of the certified check to them they say it needs to be researched.
I have a opinion this is a scam co taking our hard earned money to support other projects.

The sad situation is that you will never see that money, and pray that you receive your title. Santander is going to come up with something else; something to the effects of tacking on a balloon payment that you owe, and threatening to take your vehicle.

Santander Consumer USA harassment, threats & overcharging

My husband I purchased a 2006 ford f-150 in july 2008. Our first 3 payments were made via western union, to united auto credit - who was our original loan holder - and in december 2008 we began having all our payments ach'd out of our bank account. Our may 2010 payment was drafted out of our account on may 6th and on may 10th we received a letter in the mail indicating that our auto loan had been purchased by santander effective may 9th. On may 13th, my husband received a phone call from santander on his desk phone at work. The woman was very rude and informed my husband (in no uncertain terms) that our may payment was late. He told her that no the payment had been drafted out of our account on the 6th and it went to uac - as it was 3 days prior to them purchasing our auto loan. She told my husband that he was lying - we did not make our payment and he needed to pay it then. He told her no, he was not making a double payment and he'd fax her the proof. On may 14th, he received another phone call - same manner as before - telling him they were on the way to repo our truck as we were late on our may payment for our 1994 ford escort. He told the girl that we did not own a ford escort, that our may payment on our truck was made & he had faxed them the proof that morning. She stated he was lying, he needed to make the payment and that was it. He told her no and hung up. On may 17th he received another phone call telling him they were on the way to repo our truck as we were past due on may's payment. He told her the whole story from the previous week, and then she changed it to the february 2010 payment. He said we also made that payment and he'd fax her the information the next day. I called santander on the evening of may 20th and spoke with shawna. She said the account was past due on our ford escort. I told her we did not, nor have we ever owned a ford escort, we owned a ford f-150 pickup truck and that was the loan they purchased from uac. She stated we were late on may, I told her we were not, we faxed the paperwork showing that the payment was made. She then changed it to february 2010 - stating we needed to pay that payment. I told her no - we also made that payment and we were not going to double pay on payments we made, had proof we made and that were drafted out of our bank account. I told her I wanted to speak to a supervisor. She put me on hold and when she came back on she said that "he had stepped out of the building". I asked for his name - she provided me the name of kievan. I asked for a last name and she refused to give it to me, stating she would have him call me. As of today - june 3rd - he still has not called. They have however, continued to phone my husband telling him our may payment, then our february payment, and now that we've faxed them proof on both of those - our first payment was never made! He has asked to speak to a supervisor - and is told he stepped out. I have spoken with uac who stated every one of our payments was made, before they were due, on time, like clockwork - and not to accept what santander is saying. Our credit union is going to refinance our vehicle - and now we are having to pay over $500 in interest & penalties in addition to the payment they are stating we never made from the start - because the payoff amount they provided our credit union is higher than what it should be. I have filed a report with the bbb and that is still pending. I am sick and tired of the harassment from santander, and now am looking to hire an attorney to sue them for all the crap they are putting us through. Every bit of proof we give them is dismissed and then they come up with some other stupid bs story about a different payment. No supervisor is ever in the building. They can hardly speak english! They can't get their books straight on what vehicle we own - and now they are saying the ssn associated with our loan isn't my husbands - so if it's not my husbands social - who owns our vehicle? Something needs to be done with this company. When I filed my report with the bbb, I looked at santanders track records - in the 3 years they've been in business they've had over a 1000 complaints - most seem to be related to being told payments were not made! If that's the case then santander is ripping people off. I am not going to stand for this!

I have recently aquired santander consumer also, used to have hsbc and gmac on my 2005 HD was not told my loann was being picked up by this new company.In july about the 5th or 6th recieved a coupon in the mail to miss july's payment and they would just add it to the last bill! Well I always pay my payment before the due date and b of a had already had it in process of paying the payment so I called and talked to a rep of santander and asked if they coud stop my payment for that month. The lady was really nice went away for a while came back and told me that they couldnt so I told her I would call my bank and see if they could cancel my payment and they couldnt so called back santander talked to the same lady and explained the situation she then talked to her supervisor and told me just send in the coupn with my monthly statement and they will credit july's payment to august.I wrote down the ladies name and she gave me her direct line but now I moved and cant find the name but they record all conversations so now they say I'm late and the coupon was only a 1 time deal they have all my payment history from the others and see that its allways on time so now i'm paying a late fee and my balance jumped up 200 dollars and have talked to many of the reps and no one can help they say "SORRY SIR THAT WAS A 1 TIME SPECIAL"so now i'm almost 30 days late and am very pissed! Tis company sux and I do not and will not reccommend their business to anyone...

I feel for you, We are about 15 days late on our payment, We both lost our jobs and are barely scraping by. Santander calls start at 8:00 am. They usually call 10 to 15 times a day. The calls usually run till 9:00 pm. Half the time the calls are coming from the middle east and I can olny understand about every 5th word they are jabbering at me. This can't be legal can it? I mean calling 10-15 times a day?

please let me know how or if you get hings worked out. My husband and I are in the process of paying off a vehicle loan (which they aquired from Citifinancial). Depending on who you talk to in customer service we keep getting different payoff amounts. All of which do not match our records. They are trying to collect approximately $2, 000 more than our records indicate. Any help on how to deal with this so called company would be great! Just want to pay this car off and be done with them, but do NOT and CAN NOT afford to give our hard earned money away, due to incorrect record keeping or SCAMMING!

Regarding Santander Consumer, you are not dealing with a normal company. They are in the business of scamming. They are awful. Please get your ammunition together by filing complaints with State and Federal agencies, before it is all over with, you would have wished that you have.

They will come and take your vehicle without warning, letter or anything. I am fighting these clowns as we speak.

Santander Consumer USA horrible website and it management

The best way to express my complaint and to key in as to what has happened is to repaste my email responses to santander. I filed and made a case number to bbb (better business b.)

In my oppinion, santander is doing unlawful and very bad business practices with their customers. It appears that they are guilty of doing this same thing over and over again to many other customers. I refuse to allow santander to pull this unlawful thing on me. I have been a very very good customer to them and have never been late on any payments, not even one payment. I have never had not one late fee or late payment fee. For all reasons, I have been a customer that anyone would want to have. Someone who pays his bills on time.

Santander has not been able to help me resolve the problems with their online website payments. My account is currently up to date and I am not behind on any payments... Yet they treat me as if I have not even been a customer. Here are my statements below dealing with this company as sent via emails. —

"why is it that your company has deleted my account. I can't even log in anymore? Your website says when go to"forgot password"your system says no email address is found? No password found. It is like your company has completely deleted my account from the system. I have never changed my user name or password recently and I can't even log in anymore. What happened to my acount? Why can't I log in. Your computer system won't even let me reset my account with a new password or username. No one online with your customer service can even help me. Why? Where is your it department? Why can't they get this fixed so that I can get online and look at my account? I have been a customer for 3-1/2 years and have never been late on a payment and your company is telling me that there is no way to get this fixed? Wrong answer! Please fix this account so that I can log back in and see my account information and pay my bill.

This was my responce back to santander unacceptable, my account has been in your system for 3-1/2 years. If you look up my account information you will see that I have been making each and every one of my payments from day one through your website. I have never ever been late on a payment... I have your physical papers in my hand that you mail to me that shows the above statement is true. I recently just made the payment to this account over the automated phone system.. And your automated phone system shows and confirms that my account is indeed active and in your system. Therefore, you are either lying to me.. Or you simply do not understand how to run a proper online server. Your company has been flagged online by many complaints from other customers on being a fraud company is how they deal with customer online payments. I am going to report your company to the better business bureau if you do not fix this problem. I shouldn't have to go back online and relog into your account"as if" I never ever had an account with you from day one. Why can't your company simply fix that website so that I can relog into my original account. Is your company really a legiment company.. Because other customers have said that after paying for 3-4 years.. That there payments are not even reported to credit agencies as good payments, but rather hurts their credit. I will be making note of how you have delt with me as someone that has been a very very good customer to your company... And I will research to see if your company is a fraud company. I want this company to fix the way they deal with their customers. Very bad way to have a customer for 3-1/2 years that has never been late on a payment.. And then they just seem to delete them from their database online so their customers have no records... Good thing I kept all my paper statements.. And I have requested that santander send me an itemized payment paper statement in my mail.

I refuse to allow your company to do something fraud to me. I have been making payments on this car and have never been late. Get your company and your website fixed and I better not hear anything about repossession when I have never been late on a payment... It appears that your company has actually repossed peoples cars that have never even been late on a payment.. In addition, your company is to send me an itemized print out.. Paper statement of all my payments from day one. Keep in mind that I already have the physical papers you send to me each month. But here is the deal.. Your company can not simply delete a customer records online and think that they can get away with it. I still have written documents that show I have been making payments on time.

If I were you I would contact the Federal Trade Commission on them they could care less about the (BBB). They have had over 1043 complaints to the (BBB) over the last 3 years and all the (BBB) has done is remove their rating through them while they investigate. Enough complaints to the FTC and they will be investigated! I have had my share of crooked dealings from them and yes I have contacted the FTC on them!

Santander Consumer USA illegal collections practice/ incompetence

Santander purchased my loan (and the entire book of business) from hsbc auto finance in march of 2010.in the first month, during the transition from hsbc to santander, the payment I made via online billpay was credited to some other account. They contacted me that month saying I was over 30 days late and that they would report it on my credit, I faxed them a copy of the cashed check and follwed up with them the next day, I was told that during the transition it would be at least 3 weeks before anyone would have the time to look into it. To make a long story short, over the next 2 months, I faxed proof of payment 3 times, emailed it once, spoke to collection agents and supervisors galore.

This company has more separate collections departments than carter has liver pills, as evidenced by the myriad area codes lighting up my cell on a daily basis. Not one talks to the other or puts any notes on your account stating the proof of payment has been sent. I even had one call where the agent actually told me that they had received proof of payment, but they couldn't find where it had been credited and had the gall to request that I re-submit payment and told me that it was up to me to dispute the 3 months of bad credit reports with the credit bureau. This was after I sent proof by certified mail, and also request in writing that they cease communications.

Since informing them in writing to stop calling and resubmitting proof of the invalidity of their claim of non-payment, I have been harassed nearly every day, several times per day, both at work and at home. I only had 1 year left on the loan. Now I can't even trade this vehicle in at a decent interest rate, to get away from these people, because they are ruining my credit due to their incompetent handling of a check that clearly had my name and account # printed on it.

If you go to buy a car and the dealer comes back with santander or drive financial as the financier of the loan, run away!

UPDATE: I contacted the Legal staff from Sokolove Law Firm. They took my information. I told them that I have posted all of the information on this complaint board, spoke with various Federal Government Agencies, and my Congressman regarding Santander's illegal practices. To no avail, nothing was done. I have "mountains" of paperwork to back up my claim, and was reluctant to hand them over to Sokolove. They told me it wasn't necessary, and they would send me over a contract for me to sign allowing them to represent me. I told them that I never thought that I would live to see this day that something would be done, and I thanked them over and over for doing this! Santander would have to finally pay me for the illegal repossession, the nine months that I spent renting a car. I kind of left it alone, because I now have a newer car financed by Capital One Auto Financing. As the good bible says, "You Reap What You Sow."

I have complaints filed with Texas BBB, Consumer Affairs, Texas Attorney General and the Ohio Attorney General. If there's someone else that I can complain to, I will. My loan matured on 7/11 and I even made an extra payment to cover any "unknowns". Now they are harassing me saying that I still owe 2800.00. How does that happen after I've made 73 payment on a 72 month loan! Scam artist and I get the feeling my loan will never be paid off! A different person calls everyday to see what someone else might have told me. I asked for a breakdown on the amount still owed and they say they don't have that information and can't get it to me. I could look on their website, but since I don't technically have a loan with them anymore, I can't log on to their site. Imagine that. They will screw you anyway they can and you will be in debt to them FOREVER! If anyone has any other ideas on how to resolve this .. please let me know!

FYI,

If you call one of Santanders 888 or 800 numbers, even if you block the number with *67 they can still get it on their caller ID because they are paying for the call. then they will harass the hell out of you on that phone no matter who it belongs to so call one of the 214 numbers and block it.

You are not dealing with a normal consumer loan company. It's like this company is operating from a "back door operation". Please get your ducks in a row, and start filing complaints with the State and Federal consumer protection agencies...The more the merrier...

One person states I am paid up and the next day there is someone else calling saying no I owe thousands of dollars in late fees that have incurred. I am like which is it. I also read them my contract over the phone which was signed at the purchase of my auto and they hung up on me after reading that I have a ten day grace period. Then they called back and I told them the same thing and she said no cause of interest I have to pay the penalties. This company should be shut down and put out of business in my opinion.

Santander Consumer USA late fees

My original car loan was with hsbc they sold my loan to santander consumer 3 months ago, I have never been late with my payments, since santander took over they have charged me late fees, first of all they changed my due date from the 4th to the 2nd of the month, I mail my paymets on the 1st of every month, I have a 10 day grace period which means I have until the 12th, they are posting my payments on or around the 9th of the month and charging me a late fee when I am still within my grace period. This is outrageous. I called them and they told me they would have to request my account to be audited before they would remove the late fees. This is a shady company that is taking advantage of people to make money. I am writing to the better business bureau.
