Trying to charge a "Special Assessment"

Got a letter in the mail today from Raintree Vacation Club of which we have been members for 6 years. They are whining about not being able to meet all the "upgrades" their members want, so they now have to charge an $820 "Special Assessment". This company is a joke. Every time we have tried to book a timeshare vacation with them we have either been unable to or have had to jump through major hurdles to do so. Now because they are affliated with RCI, everytime I try to book, they want to push me off onto RCI's resorts, not Raintree's.
I urge all Raintree members to join together and file a class action lawsuit against this scam company.

I have 2 questions:
1. I originally files with the Atty General in Washington State when the first special assessment was sent. The Wa State Atty General said the case was resolved because Raintree withdrew the Assessment and notified the Atty General's office of this.
Are you folks on this complaint board re-filing?

2. I keep getting a new type of notice from this complaint board and I can not tell if the link is legit. It looks like this: Is this a legit link??

Jean Marie H - Looks like they also helped you with your problem with Villas Del Palma. Looks like you have had a run of bad luck. They have surely worked miracles..
Tell us exactly what they did to get you out of 2 contracts in such an easy breezy way. Where and when did you sign your contract with Raintree? Was it a loan obligation - like a bank note? What possessed you to enter a contract with a second timeshare company after your bad experience with Villas Del Palma?
You must be Jean Marie H from Worchester, MA. I see you do a plug on their site. It appears you have enough vacation mishaps to keep Gonzalez and Gonzalez busy for years.

The maintenance fees and lack of service and room availability is ludacris. Not to mention the lack of service from the company when you have a complaint. We have just cancelled our contract and got our down payment refunded thanks to the help of the people at www.timesharescam.com. We feel so good to be free of this burden, and to have had professional help at a reasonable price. Good luck to all of you who are going through this hard fight. We can´t let them keep taking advantage of peoeple like this!

I agree that tit for tat gets you nothing. Many of us have been called names, slammed and insulted and yelled at and then blocked on Googlegroups by Rose, Arlene, Enrico Suave, at their will. It is a public group for all owners but they control it. Odd at best. There is "no management position" for this "legal" issue that we are all personally handling and battling with Raintree. There is not a "we are all in this together" attitude. Anger directed at other owners is not helping the issue. We have not added much to any of this since we were "blocked" at will and not sent a copy the complaint, even though we added info to the complaint.

I strongly suggest you fight your own battle and not rely on anyone else in this group... One of you just might be the next imaginary "bad guy".

It is a contract dispute for each individual owner.

Rose -Tell you what - you don't have any idea what I've done. I'm not working on becoming a martyr. I'm trying to find a solution to a contractual/consumer problem that I have. I've hired an attorney to personally help me with my situation with Raintree. Please Please stop taking everything so personal. I DID TRY TO GET ON THE GOOGLE SITE TO ASSIST. When I tried to get on the site with Arlene I was blocked and reprimanded for I don't even know what. I was told there were traitors on their site. What the he__ is that? Traitors on a google site? All I hear is how you are martyrs and everyone else - that hasn't fallen in line with you - are traitors. Please get some perspective and stop reprimanding people. Other than talking about your hard work tell us exactly what you have done. Has it stopped anything yet? I know you have worked late nights doing something because you say it all the time. You, Jose, Arlene have done miraculous things in the wee hours of the night to solve our problem. Did you use this line on your children? Did it work? It must be true because you say so - and you are telling me to do nothing and suggest nothing because I should have faith that a group of sleep deprived martyrs has helped me with my contract dispute - which is what this is. This isn't a religious experience - it's a contract dispute. Give me a break.

Members, let’s remember that we are all on the same team. It is pointless to antagonize other members and to write to specific members with belittling connotations. This situation is frustrating in itself, but let’s all remember that the guilty eventually fall and when they do, they fall hard.

I would like to say that many members have contributed a tremendous amount of time, researching information, contacting agencies and legal entities, and have selflessly devoted their time in forfeiture of personal gain, in order to assist with the enormous effort that has been put forth thus far. This effort has been fruitful so far and the progress made to date is amazing in the fact that we have broken through the barrier with several agencies.

Knowing this, I believe those members who have belittled Rose, should take a step back, and understand that her vivaciousness is astounding and has had an astronomical affect on the success we have realized so far. Those members, who feel the need to attack or degrade Rose, should really either apologize or just quietly become invisible.

Keeping this in mind, I hope that the members on ComplaintsBoard will be posting information that is useful, non-threatening to other members, and will be discreet by means of not providing information to RRI. Why would anybody give a “heads up” to an opposing party they are complaining about or who they are suing”?

Thank you Cheryl for your thoughtful words. There is obviously much to digest before deciding on the appropriate individual course of action. Have you possibly considered consolidating your suggested actions into one post so that other members can use it as a guide? I would consider doing this myself, but don't want to miss out on any points.

another day, another phone call from some telemarketer asking if we want to sell our "RAINTREE" timeshare. We bought aftermarket at the Miners club so they must have gotten our info within the last year or so.

Oh I have to share this with everyone. A message from Rose, again she is at her best...maybe she will start the old "leave me alone I am a 65 year old grandmother". Do not be fooled, this grandmother is a vicious as anyone out there.
Oh and BTW I only highlight these things when Rose either calls people names or comes down on another member posting...what does that tell you.

I don't know about you, but this is a serious situation. we all have a lot to lose. Being nasty as you have been is not helping the situation.
You obviously want just to be mean and nasty and not productive.
we all have been working very hard and have submitted our complaint to the various agencies. Hours and hours of work has gone into this endeavor and it has been down to a few of us doing the work. we sometimes worked into the early hours of the morning and accomplished a 52 page complaint and 400 exhibits. It has gone to various agencies...all the time that all you have done is criticize and throw out your usual sarcasim. You are abviously quite young and don't care about your losses. Some of us don't have that luxury. We have a lot at stake here.
Even more so we have the need to see this management team of Raintree be accountable for their actions...as this will never stop and they will be asking for more money. They are so far in debt..they are trying to save what they have squandered away.

You have picked me to be vindictive too and that is fine...not very productive...and very publically dividing...but I guess serves no purpose other than to boost your ego. I guess that is important to you

It would be nice if you cared about this situation to be productive and proactive. But that is probably too much to ask.

So continue to be your nasty self and let's see how that helps you get out of paying the SA fee or now as they are calling it the "new membership fee"

The alternative is to be productive an offer to help in any way that Arlene and Jose need.

The best to you whichever way you choose.

It seems that you have soooo much information...yet have never offered to help many of the times that Arlene and Jose have asked for people to come forward.
They have worked so hard on this and yet you "with all your knowledge" have not contacted them personally to help.
Wonder why?
By the way...I am and have been paid in full for many years...
I am not a disgruntled idiot as you have said and far beyond 6th grade.
Now who is doing the name calling.
You go on and on and on and on...but never offer a solution. You can site all the legal ways things are done and all agencies that should regulate these situations, but HAVE YOU PERSONALLY contacted anyone on behalf of the group. You have a lot of energy spouting off on the situation of the world economy and the good things of European countries and so on and so on...
Let's stick to the problem at hand...
First you are NEVER going to get TRANSPARENCY from Raintree. It is not in their best interest. And further more you will NEVER get into their FINANCIALS. So to continue to go in that direction is futile.
MANY have already received the "Special Assessment" now in the form as Beth said...of a "new Memebership fee" ..
they say it will be a new membership fee as it will be a one time only fee...NOT TO BE BELIEVED...it will happen again and again...if we give in to it now.

They are also "illegally" saying that if you do not pay this "membership fee" you will not be permitted to use any facility. Why do you think they put it into the wording "membership Fee"
Why don't you have your "contacts " look into that situation. Come back with a solution not a disortation on the wording.

As I said before...rather than your disortations about the European countries wonderful infrastructures and all ...stick to the problem at hand and find Solutions...

RAINTREE IS NOT LISTENING AND THEY REALLY COULD CARE LESS...THEY HAVE MADE MONEY ON SELLING OUR INFORMATION AND THEY WANT TO MAKE MONEY ON RESELLING OUR MEMBERSHIPS.

If you care at all about this situation...you need to let arlene and Jose know what you can do and contribute to the immediate cause.

FYI: Raintree recently sent me an email informing me that a new "Membership Fee" (apparently issued in place of the Special Assessment) is due in February 2010. This is on top of my Maintenance Fee, due in March 2010. They are the exact same amount. So the dreaded Special Assessment - oops, I mean "membership fee" is out there. Maybe not for all of us yet, but it's coming.

IF Raintree eventually sends out this new demand for fees you can also and should make a complaint to your AG and also, if your purchase was in Mexico, go to the Procuraduria Federal del Consumidor (profeco). Mexico has had consumer protections implemented since 1976 - which should cover most of the people who purchased inside Mexico. We should probably all complain to Profeco. Also make a complaint to the Mexican Embassy inside the US and inside your state or region. Where you would go for a Visa. I know my Consulates is in downtown KC and in NY on E. 39th Street. If you live in Texas there are consulate offices everywhere. Make sure, though, that you send an original to them and duplicates to the main Embassy within the US. At some point they will be forced ( by numbers) to do something.

Mexico is eager to keep business - and Timeshare are big business but these are the channels we all need to take. If there are enough complaints they will be forced to do something.

Perhaps each of you should keep a diary of what you have done individually. We could start an e-mail/fax campaign where each of us sends complaints to certain places at a set time. This way - no one gives up their individual power - and has control of their own complaint and it will still give us the strength of numbers. I assume we should also get the contact information for the US State Dept. I will get this info and post it after the Holiday. In the meantime - have a lovely holiday and don't let any of this garbags spoil your time with family/friends. Cheryl

Rose - Raintree needs to understand that this isn't just a group of disgruntled idiots name calling. The petty sniping at each other on this and other sites is discouraging. The beauty of the American legal process used to be its transparency. Now everyone (members) are ganging up in little closed off groups. (like 6th grade) We are all scared of spies within sites like this is some sort of Hollywood thriller. You need to know that the groups will be sabotaged by someone close in its ranks. They will undo themselves if they aren't open and transparent. When bondsmen want to find someone they always look for disgruntled girlfriends/boyfriends/grandmothers/parents. Regulatory agencies didn't discover Bernie Madoff's investment gamble - Bernie's sons turned him in. We didn't dig Saddam out of a hole based on our weapon systems or military genius. One of Saddam's wives (who has one of his living sons) is living in England today after she divulged his location as part of a deal. The people at the top of Raintree & subsidiaries know this because many of them were very prominent lawyers. The law, the courts, regulatory agencies, statutes, etc. isn't something hazy or confusing - it is quite clear - and has been clarified throughout the years through consumer protections. We, as consumers, within the US are protected by these. The Consumer Protection is there for us even if the contract is vague. Contracts are vague to protect the interest of business and Consumer Protection is clear to protect the interest of the consumer. These do not just protect us during good times but eventually even in hard times. This is the test of our legal and regulatory structure. Does it still work during extraordinary times? I personally believe most systems works best when transparent.

Also if these groups are all LLC's most of the club's finances including expenses, etc. are immortalized in schedules on their individual income taxes. Let's use Mr. Bech. If RRI is an LLC the earnings, etc. are on his individual income taxes - and not on a separate Corporate return. This is important. When we ask to see the finances of RRI are probably, in essence, asking to see his individual tax return. We need to be clear about what we are asking for.
