Next Level Concrete No warraty coverage and refusing to meet

Let me tell you about my experience with Trevor Eastman and his company – Next Level Concrete. Last year (2014), we contracted him to remove our old driveway and re-pour a new one with an add-on to make it wider. After digging up our old one, we waited approximately 5 weeks to do the re-pour. This seemed a little long to us, but that is how he has you trapped. The drainage on our property was (I thought) poor on the city curb, so I had the city inspectors come out, to which they said it was moving the water away, which is considered acceptable. When Trevor came to quote us, he said he thought the drainage was the original issue . He re-assured us many times that with his heavy duty rebar and compacted base that the would be “no way that it would crack”. Through the winter months, I started to notice some cracking, so decided to tell him about it. When I first contacted him MARCH 9 of this year, I was told that he would be out of the country and would call me in the beginning of April. Months went by, and I kept emailing him about my cracking and also that he had left cement splattered on my garage door from the year before. He still refused to meet about these issues and said, without even looking, that is all the city’s fault. I had my councilor and another city rep again say there is nothing wrong with the city curb drainage. Trevor has said that he begs to differ with the city, without first looking at it and will not stand behind his warranty. Apparently he has more knowledge than the city’s drainage dept. He still refuses to meet and now has driven by to have a look, and says it is not his problem. I do not think that 7 months in an appropriate time for cement to crack. Especially considering we had one of the mildest winters, that I can remember. The fact that he would not answer my calls or meet, does seem a bit shady. He would only email .Also one piece actually broke off when a person walked on it while pushing a lawnmower. I told him about this, to which he replied “it is not that bad, either take it out or just leave it”. Lately he has offered to clean the door, but the rest apparently is our problem. Never once did he say during his quote that the cement would not even make a year, and stated that he would stand behind his warranty, although he has never had to because of the workmanship? I do not think this is the way a business should be run, and warranty means nothing if you “skirt” the issue . Next Level Concrete bad job and scam

Bad experience with next level concrete, I have hire Trevor he is the owner of Next level concrete to do my drive way. he came and do the estimate I have told him that i only want one price only. so he came to my new place and do the estimated he told us that would be $19, 500 for the whole job we negotiated with him to pay cash can he lower the price a bit . He said he is an honest canadian he only taking cheque forthe tax purpose so we agree to that and we sign the contract with him. then come to the time sign contract he make up whole punch of agreement that he only take cash and bank draft only because he can't cash the cheque they will hold too long. I was refuse to sign but my husband said ok to him we will go on with it. on the contract he want us to pay him every day as he go according to him he call it is (phase) first day he start at 9:Am by noon he already asking for the first payment we gave him $4000 bank draft which he only pour the road crush. second day he came and only do rebar again he asking another $4000 which is he call phase 2 we gave him another payment then he call me and told that we short of road crush we need to pay extra $600 to get that done i was mad and refuse i told him that is his respondsible he do the quote and that is on the contract. he said if I don't want to pay extra he will stop the work. my husband know that we will loose the money anyway if we refuse so he agree to pay him anothe $500 that it. phase 3 early morning he ask my husband have to pay him $900 for the edge concrete. they meet up and he took the money then he told my husband that we have to pay him extra $1800 he is under estimated if we don't pay he stop the project. again we feel something is not right he take advantage of us easy going with him, but this time we said no he up set and took eveything and walk away with out finishing the job. he is a scam he can't even cash cheque with the bank and done such a bad job on my drive way wich is only done a quater and took my money walk away with out feeling guilty total I loss $9400 to this scam. I have all my neighbour witness . I just want to warning people out there should watch out for this contractor.

We can not understand the above complaint but this is what actually happened. Next Level Concrete and Amanda and Dong Nguyen made several contracts for a total of $19, 500(includes GST) for 1, 460 sq. feet of stamped concrete with elaborate stamped borders. This price works out to $13.35 a square foot. We were provided with a drawing approved by their developer and perhaps the city to basically fill their entire front yard with concrete. All was going fine until the client requested a fairly substantial departure from the original design and size. We notified them we would do it but any increase in size would be billed as an extra based upon the above price per square foot. They agreed on this and we reconstructed our forms to the new design that increased the size about 250 square feet. We requested more money to buy more road crush as we did not have enough. They paid us $250 more which did not cover the material and labour costs associated with the expansion. Upon getting paid in full for the work completed as per contract we then asked for them to sign off on the additional size. They said they were not interested in paying more. We replied we were sticking to the signed agreement for the supply, place and finish of a total of 1460 square feet so what area should we exclude when we pour. Mr. Dong Ngyuen went bananas and called in another contractor to get a quote. We decide to immediately clean up and leave the property. It should be noted other relevant details that concerned us about doing business further with this client were the following:
1) We were offered cash deposit up front without a desire to write legal contracts.
2) Mr. Dong Nguyen was told to take a large pile of construction garbage off his neighbours property.
3) Mr. Dong Nguyen broke the top off the water valve in his driveway and did not call in the city to repair it. He decided to duct tape the top back on. We were concerned we could be blamed for breaking it and subsequently fines thousands of dollars.
4) We were forced to make a radical change to an approved plan by the developer and perhaps the city so we were not prepared to proceed without protecting ourselves with a signed waiver taking responsibility.

We are including a few links to the design on the lot plan sent to us by the client and a picture of the site when we left.

On a final note it is frustrating to have to respond to such an ungrounded and garbled complaint seeking only to damage our reputation. We are very proud of our work and we offer reasonable prices and there are legal avenues such as small claims court or at least the local BBB to take such matters. In discussion with our legal counsel we will be seeking damages of $25, 000 in provincial court this May, 2012.
