Ion Labs, Inc. of Clearwater Florida agreed to manufacture 16, 000 bottles of a private label liquid energy supplement for me in the fall of 2009. They researched the formula and handled the whole process of formula development, bottle selection, seal selection, sealing, packaging, and shipping. The product arrived with defective seals. Each bottle had a defective seal, making the whole shipment unusable. I asked them to replace the product. They refused and said they would only "rebottle" the liquid, if I would pay for new bottles and pay to ship the product back and forth (again)to the lab. I said that was unacceptable because I had no part in damaging the product and therefore should not have to pay more money to fix their mistakes. I instead requested a refund before we could move forward. They refused to give me a refund. I found legal advice. The lawyer pushed to get them to refund my money, but they refused. They sent a letter that says it is not their fault, as a custom manufacturing lab, that they messed up, but instead that it is my fault for their mistake. I do not have the means to take them to court (lawyer fees alone would be upwards of $5-10, 000). Also, due to their lack of response and unwillingness to refund or replace the product (free of charge), I was forced to close my business and seek employment elsewhere. I have plenty of documents including video/pictures/testimonials of the damaged products and all email exchanges between myself and Ion Labs, Inc. that I can provide upon request. I am only 24 years old and I cannot allow this lab to steal $18, 400 from me. It is literally giving me a heart attack.

Sorry to hear about your difficulty. I am not a lawyer, but I am a quality professional with >20 years experience. This may simply be a case of getting in over your head and you may have to chalk this up to inexperience...but without more information, it is hard to tell. For example, did you have a contract with the manufacturer that included quality requirements and how legal disputes would be resolved? Did you provide them with written specifications that they did not meet? Had they agreed to these specifications?
