Good day,

The business name complaining about – Harcourts Olympic – Rentals. Telephone number [protected] – Owner Carlos Moreira [protected].

In March 2012 I entered into a rental agreement with Harcourts Olympic – Rentalsdotcom. When I moved in there were a number of things which weren’t up to scratch on the property including that we moved in and the place was dark because there was no globes. I phoned the agency and I was told that the inspection would be done later and I was sent a snag list which I had to fill out. I filled out the snag list with all the items which I found such as globes which were missing, and soap dishes which weren’t there etc…. I detailed all these items on the snag list which I subsequently faxed to the rental agency to the administrator – Pamela Mtwiza. I phoned as a follow up and she indicated that she had received it.

On the 26th March 2012 I made a payment for the rental amount and she notified me that I had shortpayed, I made the payment and I asked her how far she is in getting the items which I had highlighted on the snag list which I had sent her – (I still have the email trail), she sent me a response back telling me that she would refer the matter to the business owner as he deals with all issues related to maintenance. On the 29th March 2012 I followed up with her to find out which items would be fixed and which ones wouldn’t (still relating to the snag list) and she said that she didn’t know.

The business owner – Carlos Moreira came around to the property to do an inspection and on his inspection sheet he noted only the maintenance issues which talk to the broken hinges etc, we indicated to him at the time that the snag list had an extensive list of consumables which were wrong with the property such as globes missing – he indicated that as long as the snag list is with Pamela that’s fine.

Two years later into 2014 – In April I notified the rental agency that I would be moving out as of 1st June. I got charged an amount which relates to same items which I had highlighted in my snag list with the company. They had lost the snag list according to the administration Pamela Mtwiza and they had no option but to charge me for the consumables which were all related to snag list already sent. Because I had faxed the list to them, I had no way to counter this, however my emails following up with them indicate that they did in fact receive it as I am referring to it and Pamela acknowledges it in our communication. I have photos of the globes which I took in the same year, yet even with all of this, they have chosen to uphold their position of charging me for it.

I have tried speaking to them to get a satisfactory outcome and I sent an email disputing the amounts I was being charged, the answer was, because I don’t have the snag list, I am liable for the consumables. Furthermore I was contested the carpet which they indicated that after 2yrs it had become dirty, I had no problem with that except I have a receipt which proves that the carpet was cleaned in October 2013 and the fact that the carpet is dirty would be accurate but not to the level where I would have to be charged for it, as it is dust and just front dirt which could be on the carpet, nothing that cannot be swept and cleaned.

I find this grossly unfair and unjustifiable, the fact that they misplaced the snag list cannot be my fault when I have done everything according to the product, I almost feel that because they have actually lost the form, they are almost telling me to f off and that they don’t care.

I would like to have this complaint investigated as I don’t think that I have been treated fairly as a consumer.
My name is Amanda Mvinjelwa and I was renting unit E41
