Six months ago I contacted a loan modification company, Fortified Financial, to help me with a loan modification as I work full time and cannot spend my days on the phone. They charged my credit card $3000. Four months later they got an "offer" from my mortgage company that was actually higher (about $100) than my current mortgage payment! Despite repeated phone calls to Fortified Financial and many emails, no explanation was given other than, "This has to be a mistake." About a month later, another offer arrived that was exactly the same as the first. That was two months ago. My contract with Fortified Financial specifically states that I will receive my money back if they can't save me at least 10%. I have politely asked for a refund. No response. I've called many people and sent many emails to people in the company and have gotten no response. It would have been easier and quicker myself to deal with the mortgage company. And now it looks like I'll have to sue Fortified Financial, file a formal complaint with the state, call the local news channel complaint watchdog, and contact the Better Business Bureau...as well as modify my own loan. (Sigh) I wish there were more competent and honest people out there.

Yes (UTInvestiGator) just in case you are unable to finish that quote, the quote is “The road to hell is paved with good intentions” oddly enough I think you, your brother, sister and everyone else involved with Fortified SCAM are speedily headed down that path and if you want to help yourself you’ll want to come clean and STOP abusing other families and lives.

Amazingly, though, I think this is the MOST that anyone has heard from Fortified in MONTHS?! Good to know that you and your brother are still around and have not left for the Cayman islands with all our money.

Fortified bankrupt? Hum who didn’t see that coming… by the way in the last two years assuming that you had 1000 clients at $2500 each, that’s 2 ½ MILLION?! How did you guys blow all that? Could it be the big billboard on I15 or the lavish new offices etc? Oh I know, it’s because you had to pay your employees… wink…

And the prophet Isaiah the son of Amoz came to him, and said unto him, Thus saith the LORD, Set thine house in order; for thou shalt die, and not live.” – 2 Kings 20:1 KJV Okay I may have gone too far but before you or I or anyone else meets our maker “maybe” YOU should consider putting YOUR house in order and setting “right” with your fellow men.

As for giving you guys another try for modification? (although it’s under a different name) “A stench by any other name is still a stench”. As for a hotline number… hum I won’t hold my breath for that. Trust me if you had a hotline number to call I’d be the first to call it.

In the end though, "The truth shall set you free". No one is free, however, from the consequences of our actions... you can run from the law but you can't run from God.

It is a little disturbing that people actually think the owners of Fortified cared. They shut down and moved on with out a bit of remorse. I was personally paying my mortgage until I was instructed otherwise by Fortified. It is no wonder that 98% of their clients were not paying their mortgages - Fortified instructed us NOT to. At the time we trusted them -BIG mistake. I'm sorry that things have gotten so ugly and Fortified should get in BIG trouble and honor their guarentee! What did they do with all the money that they were given - cause we sure in the hell have not seen it! It is our money - give it back. They will get their judgement in the end. Hopefully from us (courts) and from GOD.

I have been following these blogs and keeping my finger on the tabs of Fortified Financial for the last year as an investigator and meet with the owners on several occasions. I believe their intention were good and they did help a lot of people, but you know what they say about good intentions. They have closed and are out of business and preparing for bankruptcy, however in their attempt to try and help their clients they have contacted a very reputable organization with a 9 year track record to try and assist old FF clients. My understanding is that an email is being sent to all clients of this notification and should see something shortly.

My understanding is that clients will be given an option to work with this company for a deeply discounted rate of around $200 per month. They are a consumer education and protection company who looks after the best interest of American consumers and have as part of their program a law firm so you know what your rights are regarding your bank. FF mistake was guaranteeing and promising certain outcome and selling people who did not qualify for a LM. No one can guarantee you a particular outcome, if they do, run don't walk as fast as you can. The company that has agreed to come in and help in not a LM company like I said, they are part of a law firm and provide a wide range of financial recovery services. They have been helping consumers raise their credit scores by educating them on the laws and using strategies to lower payments on debts including mortgage payments. My understanding is that past FF clients who still want help will be given explanations of what their options are to save their homes, including having your file emailed to you so you can proceed if you want on your own.

There are other options other then LM and lets face it people, sometimes it does not make economic sense to save your HOUSE. Your HOUSE is not your HOME, your family makes the home, and if you can't afford the payment, don't blame anyone but yourself. My understanding is that 98% of FF clients were not making payments to their bank while under the care of FF. I look at it like this in a way, if that is the case then for most of you the $2500 too $3500 you paid was the cheapest rent you could have gotten. Still does not make it right if you got promised something like a refund, they should have set enough aside to refund people they could not get modified.

If America is going to turn around it has to start within the walls of our own homes. Like I said, there are other options, Short Sale, Deed in Lieu of Foreclosure and get keys for cash. Maybe its time to rent for a little while, rebuild your credit and see what happens to the market. The owners of FF I know feel bad and it looks like there are some bitter employees, because of bad payroll. My understanding is that this organization has even agreed to move people into the old FF office to still try and accommodate people with face to face help if they need it and they are setting up a hot line to call.

I see this a lot of this unfortunately, companies with good intentions who just could not hold it together. I am hopeful we can all do our part to rebound this country. Again their are options out their to minimize the damages, there is no guarantee that any one thing will work. But if your willing to detach yourself from your HOUSE then sometimes you can see more clearly. Good luck to all the people on this blog.

Our story is like everyone elses! We saved for 5 months to be able to pay the $3500 we gave them. Then the run around. No communicaion, blame it on someone else, need more paperwork etc. Thanks for nothing people. I hope you sleep well at night knowing you took advantage of people who needed your help! Count us in on the law suit!

Thanks Matt for getting a hold of me. I am glad that we are going forward with the class action lawsuit! I can't believe what these people have done to us. Every one needs to contact Matt. I asked the Fortified Salesman Dallas Hunt if he would be willing to testify and he said "No Thanks" - which I understand but hopefully we can get some supoena's to help our case. There are alot of people who can help. Even if you don't want to join we need your help. Contact Matt Luke - He has all the info.

I too have been scammed by Fortified Financial. I started in August of 2009 when I paid $2500 by check for them to get me a modification of my loan. It took months and months with continued submission of updates of pay stubs and util. bills etc. and finally in May of 2010 I was notified by my lender and Fortified that my application had been denied. I tried to get a refund but Fortified said no as they felt they could get me something else through my lender that would help and they needed time to reply. I fought this but finally had to agree to allow them more time to try as it seemed I had no other option. I resubmitted the whole package of application material again, as per their request, and waited for a response. Heard nothing from them for a couple of months despite my repeated attempts to contact them and get an answer. I finally heard from them stating they were continuing to negotiate and they now needed more updates of my pay stubs, util. bills, etc. I finanly called my lender and got through after much time to the department that handles loan modifications and was told by the person their that has access to all the information on my loan and requests and all for modification that they had no contact with Fortified since my denial was given way back in May. I had been totally lied to about Fortified continuing to work with my lender for some other modification help. That was the final straw and I got the forms for taking Fortified to small claims court when I found for the first time this site with all the various complaints against Fortified so I am now wondering if they are even going to be solvent enough to get any money out of at all even if I win at small claims. Should I waste more money and time in filing this or what are my options now. Any comment will be appreicated. Well, I haven't checked back into the post in awhile and it looks like many more people have been hosed. My court date was postponed once again, and that little weasel Dave Moffit was notified by the court and Dave was supposed to notify me and he did not - big surprise. So now we go in next week on the 19th of October at 9:30am. I'll call first this time, but this crap has been going on for over a year now. Fourth District Court 75 E 80N American Fork if anyone wants to come. I'm hoping the judge gives me a choice of 2 to the head and one to the gut and my money back plus sanctions for neglecting to notify me. Just an FYI - Bryan Booth - Dave Moffits attorney has decided to no longer represent him. Hey, he might be a good attorney to use? I'm betting he is owed a bunch of money. I'll pop back in here after court next week with the verdict, but if there is justice on this planet I expect an easy win. If anyone has Mr. Moffits home address it might be humorous to post it everywhere and let karma fall where she may...karma is a beautiful woman that will eventually visit those in need... Hey Dave, if you're are reading this, see you next week you slimy piece of pond [censor]! Sleep well until then...

I went to bunco tonight and 3 out of 12 people have lost their homes because of fortified financial. I have come to terms that i may never get my money back but I definately think we need to do something. crimal charges etc. This is crazy. Where do we turn and how do we start a class action lawsuit? It is apperant none of us have any money - do you think there is an honest lawyer who will take our case and get paid after we win? Please email me and let get the ball rolling - I'm done - Fortified Financial just keeps adding people to their scam.

I have 4 properties contracted since Feb 2010, and after countless voice mails, emails, and phone calls -- nothing. I finally scheduled a meeting with Jill Hallows and Virginia Burr in August to complain that nothing had happened since Feb. They were very pleasant for over an hour and promised me they would follow up with regular phone calls and emails to keep me posted. Nothing. I now find out in Oct from two of the banks that the only correspondence they have heard from Fortified is an authorization form received back in Apr. None of my financials were received, no documents, no phone calls to negotiate a modification -- nothing! Basically nothing has happened but the cashing of my check. I am now taking over my own modification and will pursue them in small claims court for a refund, although that sounds like a waste of time from what all of you are saying. I am all about a class action suit - not only for monitary damages (there doesn't appear to be any money), but for criminal charges. David Moffit and Jill Hallows need to be stopped, and taught a lesson!

I, like many others and even more who have not posted or said anything are completely dissatisfied and furious with Fortified. I am going on TWO years with them. I was one of their first client back in January of 2009 before they spent all their money on nice leather sofas and nice offices. They have not only botched and ruined my chances for a fair mod but they have ruined my neighbors and 4 others who I referred to Fortified thinking that Fortified could do something. ALL of us have gone nowhere with them and some have already lost their homes. I won't go through my torture and nightmare with them (it would take an entire page and then some). Let me just have the BBB say it, as of Aug 2010

I am working with fortified right now. The lady I am working with told me that they changed their internal processes and that's why it's been taking them longer to work on my case. The employees used to be paid by salary, now she says they get paid by project. If the employees (loan processors) get the modification done, then they get paid, if not.. then they don't. She mentioned that many people left the company because of this change. Do anyone knows anything about this? I am wondering if she is just saying this to cover their terrible work done.

I have had a ton of experience with Fortified. I tried to do a modification with them but since decided to work with a reputable company. Fortified is being run into the ground by Jill Hallows and she is destroying the loan modification industry with her lying, deception and unlawful practices. I have talked with several people and they have all said that Fortified never returns their phone calls and won't honor their money back garantee. In fact, Fortified has lost many of their good employees because they are so dishonest, bounced a ton of checks and have lost a lot of homes due to their disorganization. Don't trust these guys! My advice is to find someone honest to help you...

For all of us victims of the bounced checks please file a police report so legal actions can be taken against them. Also beware of them trying to set up another loan modification processing company that Jill will own. The reason Fortified failed was the processeing department. Another name they are trying is Fortified Academy owned by Scott Moffitt which is Dave's brother. City of St George turned the electric off at the St George office for Non-Payment!

We went through Fortified. What a big mistake. We had several processors, and no one ever knew anything. When I requested our refund, we were told you would have it in 30 days or less. Low and behold no refund. I had several e-mail correspondance with Lei. Yes you are intitled to a refund. We just ask for patience. My patience ran out. We sued them in August, and they tried to tell us we did not meet their agreement. Fortunately, I kept everything. The judge ruled in our favor, and the office manager in St George Ut. office told us to file garnishment papers against them. We did and got a response from the Zions Bank. ACCOUNT CLOSED... Fortified and its owner David Moffit is stealing from its clients. Our daughter's inlaws hired them. There house went in to forcloseure. Fortified said they would take care of it. Guess what their house was sold out from underneath them, as they did not follow up. STAY AWAY FROM FORTIFIED, I AM FILING A COMPLAINT WITH THE STATE ATTORNEY GENRALS OFFICE.

I think that we should all band together and hire an attorney and go after David Moffit for fraud. I want my money back, my peice of mind back - I'm already losing my house thanks to them. What is David Moffit losing? His business - maybe because he didn't do what he said he was going to do - thats not good enough for me - Why isn't he losing his house like the rest of us? Maybe he should be put in jail for what he has done to us! I will definately fax my complaint over to the department of real estate ASAP! We need to stick together on this one. For those of us who are now losing our homes - we need our money back so we can afford a deposit and first months rent. I am so sorry for anyone who has to go through this.

I just called the Division of Real Estate and they suggested that I fax my complaint to [protected] with a detailed letter and any supporting documents. I mentioned this website and told the person I was speaking with that I was shocked about all the complaints I am reading about which are similar to mine. I hope Fortified can be stopped before they take any more money from people who are already facing financial hardships. Taken Advantage of ...Again

I too have apparently been scammed by Fortified Financial (office out of Lehi). I was referred to them by a former employee who gave her work that this was a legit company. I originally made contact with their office in April and gave them a personal check in the amouth of $1250.00. They gave the promise/guarantee that if after looking at my application they could not help me drop my house payment through a remodification they would not even cash my check. Well, they immediately cashed my check. As of today's date not one thing has been done to get me into a lower house payment. I have repeatedly tried contacting their office and management by phone and by email and get no response. I have repeatedly complained about not being able to contact anyone, lack of communication and not being happy with their promised service. I have received one rejection letter from my lender and one offer of a higher payment than it is now. At one point I was left a message by an employee at Fortified stating that my house was going to auction the next day, which was absolutely not true... which put me through an unbelievable amount of stress and caused me to miss work. I have put my faith in this company that they have been working on my behalf with my lender and now I believe that the whole thing has been a lie. I had not heard anything from the company since August 6th (when I had to update my information with the for the 3rd or 4th time) so I tried calling... no answer. Tried email... no response. Then, out of the blue, I received an email from someone at the company that I have never heard of stating that I had voided the contract with them by not paying the 2nd half of the payment I owed them in the amount of $1250.00. I had not paid that 2nd amount since they had not done anything to help me.. it was never brought up again until the email. The email also stated that my file had been put on hold and would not be reinstated without another payment from me... among other things. I contacted their office yesterday and finally after calling and calling got through to a real person who put me in contact with the person who I had received the email from. We had quite a few words about the email, none of which were nice from me. She told me I was not entitled a refund and that my file was on hold. When I threatened to contact the better Business Bureau her tune changed a little bit and promised that she would immediately get with her supervisor and talk about my file and have that supervisor call me back. She also told me that if I did not hear back from anyone by this morning to call her back. Well, surprise surprise no one contacted me. This morning I have called every number I could find for their office in Lehi and all of them are "no longer in service". I cannot believe any of this... the stress of facing foreclosure is bad enough alone, but now to think I am also out of $1250.00 that I could not afford to be out in the first place, just makes me sick! I have contacted the Federal Trade Commission and was also told to contact the Consumer Protection Office at [protected]. Everyone, if you have had any problems with this company at all... contact everyone you can about them!

i am a former employee of Fortified at the St Geroge office.(as much as I hate to admit it ) As clients, i hope you understand that there were many employees who were on your side and fighting tooth and nail with corporate for the modifications and refunds you deserve. There were alot of us who got wind of what was happening and walked as soon as we realized what we were a part of. I can tell you that if you were working with the St. George office and you are looking for info on fortified I am MORE than willing to talk to you. Not only are they denying refunds, but they were bouncing pay roll checks and then buying brand new BMWs. mysteriousjohndoe27@gmail.com if there is anything I can do to help. Everyone that has had a problem with Fortified Financial needs to complain to the Federal Trade Commission. There number is [protected]. If they get enough complaints similar in nature they can file a class action law suit on our behalves. Please call them!

I am really happy I read these comments. My family has just recently become delinquent with our home and thought it would be a good idea to get a loan modification. I googled modifications Utah and added my phone info to their website. A few hours later someone contacted me and asked that we meet with their company later that week. After meeting with Fortified Financial we felt good but still had a bad feeling about it. My parents suggested I look Fortified up on the internet to see if any comments have been made regarding their business. Sure enough, here I am feeling even more scared than after meeting with them. Luckily, I have not paid them any money or signed any documents yet. I better just back out now before I lose my money and my house.

They appealed the judgment that they lost in small claims court and then they put in a motion to postpone. It gives them an extra month. It is just one more scam to add to their lack of integrity. There seriously out to be a way to bring criminal charges against them rather than just the civil suits they are getting hit with. There should be jail time. Fraud. That is a criminal charge. What does it mean that they put in a defense motion? They aren't honoring anyone's money back guarentee. We to are losing our house - thanks to them! I can't believe that they can even look at themselves in the mirror. Where is the integrity? From what I understand - the company is not doing well and they put most of the people on commision and most of them walked out - I also understand that they are not giving out refunds as we can all see. When they finally decided to respond to the BBB this is all that they wrote: "Ms Adamson informed us that she was also filing a small claims suit. We are willing to go to court because of the work that was performed on Ms. Adamson's behalf. We are able to prove the extent of the work performed on her file. It is unfortunate that her home will go to foreclosure but she should have accepted her modification terms. We feel that we would have been able to assist Ms, Adamson but she chose to request a refund despite all of the work performed on her behalf thus also pulling her file. We have closed her file and will not issue a refund for this file. " The sad thing is in the contract it is a satisfaction guarentee not a "how much work" we have put into this guarentee. I can't believe these people. Please contact me - I am pretty sure we are going to have to go bigger than small claims! Oh and I did accept my modification terms that later got denied - in the prior response Fortified said "We believe that our goal is to reach a successful outcome for each client which we did for the Adamsons (demonstrated by the accepting of the terms)but we cannot and will not refund the funds paid for the work performed." In my opinion these statements contradict themselves?

They have put in a defense motion and delayed my court date to 9/16/10. As if that is going to help them. It's pretty cut and dry. Just ask the last judge.

Fortified messed me and my family over. Promised to get me loan modifications on 2 homes or my money back. By the time Fortified finally contacted the 2nd Mortgage company the loan was already sent to collections (4 months later!). And now the collections wont deal on a short sale and now we face forclosure. Don't ever do a loan modification, EVER! The banks aren't willing to help and the loan mod companies just want your money. (Hope Fortified can feel good about messing over a family with a 5 year old that needs a Heart Transplant...Jerks...).

I talked to Gephardt. Pretty much a [censored]. They want something that is totally a slam dunk with an easy payback where they can look like a hero. He told me that the fact that they are appealing it meant that they thought they had a good case and that was enough doubt for him.

Oh man! I wish that I could be there. We are going out of town that day. I hope everything goes well for you. I think that would should hire a lawyer - does anyone know a good one? One that is not shady? I think we are all tired of working with shady people. We are losing our house - thanks to Fortified! Have they honored their refund policy for anyone? I think we need to get together and stop them from doing this to anyone else. Has anyone thought about Get Gephardt? Class Action Lawsuit? Let me know if anyone has any ideas on where to go from here. ElmoSunset - Have you contacted the media about your case? Let me know if there is anything we can do to help - I'm filing small claims sometime this week- just got Fortified's response from the BBB. They are incredibly ridiculous.

Anyone that wants to can show up 11:30 am at the Orem court on Friday the 13th of August. That's when I'll be having my trial de novo since they appealed their loss. Bring a reporter or 2, lunch, popcorn, maybe some billboards showing your love and respect for how well they have treated everyone.
I think if everyone got together we could do a class action lawsuit complete with punitive damages and attorneys fees included.
