This is a scam operation run by Lee Schneider of SameDayBath. He keeps changing names from Everest Management Solutions to National Foreclosure Solutions to NFS to NFSAmerica to Foreclosure Defense Solutions trying to stay one step ahead of his creditors, clients and the law.People who sent him money have had their homes go into foreclosure and some homes have even been sold. One of his salesmen was arrested and others have been questioned by the authorities, but somehow this crook manages to stay out of jail. He has taken out hundreds of thousands of dollars of client money that these poor people think is sitting in an attorney escrow account and used it to support his extravigent lifestyle. There is more about him on Merchant Circle, [redacted], and scam.com

Is there any attorney's willing to litigate a "Class Action Law Suit" against Lee Schneider and FDS? Please come forward!

There have been enough legitimate complaints against this company that would warrant it!

Fact, NOT ONE PERSON, NOT ONE SINGLE CASE, has come forward, to FDS's defense stating that Lee Schneider of FDS, has even produced a successful loan modification on their behalf...not one..

nylb143d,

If you were dealing with the attorney Craig Heller, then you may wish to contact him. We processed for Mr. Heller, but no longer do business with him. The nature of the employee you named is clerical.

How does it come as a surprise that we’d do business with another attorney if Mr. Heller was preoccupied?

We have not been contacted as the result of any complaints.

Clarence,

The people as you’ve described are in a precarious legal and personal position. Having been unable or unwilling to pay their mortgage, and stood to lose their homes and many thousands more in financial losses. You can choose to negotiate a modification with the lender yourself, but why would you want to?

It is a complex and involved process, and does require the expertise of an attorney since they (lenders) would most certainly file legal action against you for delinquency. A borrower signs a contract with a lender. If that contract is broken due to non-payment, you stand to lose your home so lenders can recoup the losses.

Since it is a complex process, sometimes things don’t go smooth. Lenders can be non-responsive, as can borrowers. Paperwork may contradict claims made by the borrowers, or vice versa, further complicating the situation. Financial data (such as bank statements) can get stale, and require resubmission. Ultimately, your contract with the lender and their willingness to negotiate will determine the outcome of the loan modification process.

There are risks and rewards, like in everything else in the world. For every negative complaint, there are twenty customers we’ve served that saved hundreds, if not thousands of dollars per month. More importantly, they saved themselves from the emotional pain, costs, and headaches of foreclosure.

We feel that this is a valuable service that requires many hours of processing and follow-up. Our fee is a fair exchange of value for this service.

Sincerely,
LJS

Matthew,

We provided the prescribed services, but you only paid a small portion of your fee for them.

I will again apologize for Mr. Russo’s temperament; it seems both of you were being unreasonable with each other. He is no longer with the firm.

I am also a victim of this scam. It originally went by the name of Law Offices of Craig Heller, all the emails were from the FDS group. Now it has changed names to a different Attorney. I was guaranteed to be approved for a modification otherwise our money back. we were recently denied and now I cant even get a return call. Interesting Craig Heller is actually being sentenced this month for real estate fraud he was charged by the Nassau County DA's office and pled guilty. I am filing a complaint with the Suffolk County DA's office to investigate all the companies, names they have gone under and their employees. I was dealing with a Gail Seimer.

Another typical lie from the "actual" author of that post/statment SCOTT RUSSO himself...

There was never a loan modification, only "Theft by deception" by F.D.S.

SCOTT RUSSO's ironic title for F.D.S.
"Client Services / Quality Control Manager"

Mr. Russo is intentionally rude and completley incompetent...

*UPDATE
to date, not one phone call returned, or email from LEE SCHNEIDER.

Latest email from SCOTT RUSSO:

Not my company. Has nothing to do with me

Scott Russo Only works here and by the way Matthew E. Balistreri has gotten 2 modifications and was unable to comply (pay the bank) so he is blaming the company that got him his modification while only being paid 1/3 of the fee because he failed to pay his balance. just like he failed to pay his mortgage
