I am a victim of bogus pre-launch scam. The following firm

Earthsellers
G/18, B/18, Morya Estate,
Opp. Infinity mall,
New link road, Andheri (W),
Mumbai - 4000 53, India.

has been selling land on their mountainheights project near Pali, MH project on complete false pretences. I booked two residential bungalow plots in 2007/2008. I paid circa Rs 68, 000 as booking amount. They issues me receipts for it. They also said that they have Non agriculture certificate for this land and offered phase wise payment scheme tied in with progress on the project.

Till date there has been no developments like electricity, water, plotting, road or hedging on this land. Moreover, we came to know that the land does not belong to this company and they have been misleading clients. They are refusing to give refunds and in some instances cheques issued have bounced.

I wish to seek help against these fraudsters because they are hardcore scammers and will always find ways to rob people of hard earned money.

Thanks for your comments above. I have got a mail from Earthsellers lawyer telling me that they have issued me a post dated cheque for a date that is 28 months after my cancellation. Hence, I should not be posting these messages on complaints website. A number of people have contacted me telling me that their cheques have bounced. Earthseller is not honouring cheques issued.

I think, it's hurting them and this is exactly what I want :-) I am based in UK and I am also trying to get this company black listed by companyhouse here. Let's try to form a forum and get them to refund our money.

We have the same story to share, we had invested in Mountain Heights way back in 2008 and within 1-2 years we saw that there wasn't any progress obvious reason they didn't have the required permissions and internal dis-agreements between the joint partners and hence things were stalled. Since we had paid quite some amount we were advised to move to another project, which we did out of no choice and got it registered but that project was another fraud. No development absolutely nothing that has been done in that project. And to top it all they were asking for more money for taxes and some development when we questioned them recently, they bluffed so well that the project is doing fabulous and bungalows are being developed and to support it they sent photos. Those photos were from the time when they had duped us in it. That time they were marking plots and had some 10-15 people working on it so they showed those pics to us claiming work is in full swing, little did they know that one can find out the date and time the image is clicked from the image properties . Also they weren't aware of the fact that I had been to that site very recently and had seen with my own eyes that there isn't anything much left...their company board was all broken and in a rusted state with weeds growing everywhere, no sign of any demarcation, no sign of any development. They are big cheats! Beware!

there is a guy name sohan singh kataria working with earthsellers, he cheated me too in the pretext of selling property. Does anyone know about him?

Has anyone had a break through on this...please do share your details for a joint action on this..its long time we waited and I think we are hinding...these people have opened a new office at a different location in Malad and doing their usual "Business". [protected]

I booked a plot in MountainsHeight and the company EARTHSELLERS advised me to switch to their other project GreeneBells because there was some dispute with earlier project. I was having no way other than switching as I already made a hefty almost 70-80% of total payment.

Though I already completed the Registration process and 7/12 but there is ABSOLUTELY no progress into the GreeneBells project. At the time of registration they were saying that project will be completed nearabout 14th of August, 2009. Dont know how many other customers are facing this probles. I feel we all should come together and lodge a fradulent complaint againt them at Mumbai.

Looks like i have the very same story to tell as yours,

I too invested into the "Mountains Height" project and there is no progress in that till Jan 2010. Also I heard from the Real Estate Agent through which i invested into Mountains Height that there is some dispute among the joint venture partners. Therefore its not sure when they will come to agreeable agreement and the project is on hold since last few months rather almost couple of years now.

I can understnad the pain you must be going as I too passed through it. One suggestion, ask the person throgh whom you invested into the project what can be done. My advise to you is to switch to any other project they have with good development. I did the same thing but still i doubt whether I will be able to sale that plot at what rate? I knew it that they are still selling the platos at the almost same rate as TWO years before. God know what the heck they doing with our money? There is absolute no development after this much time, really we all customers should get united and lodge complaint againt the EARTHSELLERS.

Please try to gather all the cutomers at one common place (online) where we can come-up with some ideas.

I too been a victio of the Earthsellers I book a plot into the Mountains Height project. But the project is not progresssing at all. I heared from my agent through whom i invested with them, that they have some dispute with the land owner. They do not own the land, they just developing it.

My advise to you too is plz inquire if they can switch your amout to any other projectcs they have in well developed condition and then quit from them by selling it at whatever rate you can. I did the switch but still waiting to sell it after two years since i paid the whole amout they are asking to buy it at just Rs.25/- per squre feet, what a growth? That too not sure whether they will pay it or not, but i had a conversation with my agent and he offered this rate!
