Bank Of America has sent me reinstatement calculations (document attached) for my mortgage to prevent foreclosure. I also received a similar letter from B Of A attorneys. I in turn responded by remitting the exact amount requested well within the specified time limit of the letter. To which B Of A cashed the check I sent and applied payment to my outstanding mortgage balance. I have not received any written information from B Of A other than the initial reinstatement so I decided to make the normal mortgage payment about a week prior to its due date of 9 Nov 2011. To date this payment has not been applied to my account. Because of this I called the bank yesterday to determine the status of my account. I was informed that the back was still proceeding with foreclosure. Apparently the bank made a mistake in the amount they initially requested for reinstatement. They now want more money! Also, as an FYI I also filed for loan modification, twice, with them. Due to mistakes made on their end.
Here’s the thing. It isn’t that I don’t have the additional amount of money that they are now requesting. It’s a matter of principle. In the world of business they made me an offer; through the loan reinstatement. I accepted said offer by compliance of their terms by remitting payment within their requested timetable. They accepted the terms of their offer by cashing and then applying payment to my mortgage account. They had plenty of opportunity to mail out a new reinstatement letter and state that they made a mistake as well as to return funds to me; they did neither. I believe that this is a breach of good faith and contract on the part of B Of A. I don’t believe that they have been treating me fairly. My home is almost paid for, 2.7 years remaining on mortgage. I believe that B Of A is targeting me for foreclosure because it’s an opportunity to steal my home from underneath me and make a huge profit in the process.

My mortage was countrywide, which is now Bank for America. I have miss 4 month payment on my loan due to lost of one income. MY house is a co-op apartment with a mortgage payment of $ 1, 088 per month with a maintance fee of $ 1, 060 per. I call Bank of America and stress my situation and ask for help, they denie me serval times and one day i recived a letter my Bank of America for Forbearance for six month. I did not understand what it meant untill, i got a lawer to speak with bank of america on by behalf. My lawer said that he spoke them and they are not willing to help me. Beacuse I did not sign the paper and sent it back to them and that my first payment was due in october 1 2009. Forbearance is a tempory relief, my situation is not temporary it is permanet. Forbearance agreement and repayment plan is not the best intrest for eithe party. Why can Bank of Amercia help modifie my my loan. I am willing to let go of the house, i am better off renting a apartmet. I think Bank of Amercia is the worst bank for helping people stay in there home, why are they giving people a hard time when the goverment help them with tax payer money.

Bank of America has been giving me the run around since August of 2009 about my loan modification, no one seems to know where my papers are or what my status is, after sending them W2, letter of hardship and everything else they needed. Some under writer named Jenny Palmer is suppose to be getting back to me and never does, They have been telling me to call back, once when I called they told me I didn't qualify now it's a new story, can't get any answers from these guys and they are not following any government program for modifications, I need real help is there any real help against BOA?

Bank of America agreed and promised to a loan modification on our home FOUR months ago. We keep making our payments on time---the old higher payment that is---and they will NOT complete the loan paper work. When we call Bank of America we are given the run around---they have not even assigned us a representative for contact purposes! Bank of America is evil!
Bank of America had no problem in accepting the bail-out money from the U.S. government that they used to increase their pay bonuses!
We have been ripped off by this corporation called Bank of America! Now I know it is best to use small regional banks and credit unions---smaller fees, good customer service, and the very same FDIC insurance that big banks boost about.
I may have been a fool once...but never twice. Do the same thing and help your county out by using small local institutions...and not the "big" lying greedy companies.

When I applied for a Bank of America loan modification they told me that I was pre-approved for four months, that the new payments replaced the old payments for the next four months and included all principle and interest.

Now I'm getting bills for the original amount plus late fees, noting the agreed upon payment as a 'partial payment.'

I have been a loan client of Bank of America since 2008 after they absorbed my original loan company, Countrywide Mortgage that my mortgage was with since 2001. I have always had an impeccable payment record and never missed a payment. Since the housing market crisis last year, and as has been the case with many others caught in it, the mortgage on my home has surpassed its current market assessed value.

As a single income mother with 2 young daughters, and due to the loss of child support income, I proactively sought your assistance and applied for a loan modification with Bank of America at the beginning of this year. I had submitted my original application on January 27th, 2010 but sent my February mortgage payment in full which was received on February 5th, 2010. It was not posted until February 19th, however, which apparently made me delinquent. The cancelled check does show it was received the first week of the month, but it was placed in a forbearance account and not entered into the record.

I was informed that I pre-qualified for a loan modification and was placed on a trial plan for a three month period. I went ahead and paid the modified trial payments of 1208.37 for the months of March and April. Not having heard anything about the status of the modification, I contacted your institution on April 15th to inquire. It was at this point I was informed that the application had been denied the previous day, April 14th stating I was not in imminent default. I never received a denial letter and I was advised that, despite all the money sent in during the trial period having been received, my account was now showing as severely delinquent.
I was then told that I would be referred to a different department of Bank of America who would see if I qualified for an alternative program. I was to receive an application packet within 2 weeks. Nothing was ever received. I recontacted Bank of America again and was told that I would receive something within 10 days that the bank was backlogged with applications and they would send it out.
Again, nothing was received.
When I called back, I was now informed that, due to the loss of child support not being considered a qualifying hardship, the timeframe to work out an alternative solution had expired and I was in arrears in the amount of $3800 which would be required immediately to bring the account current. Not to mention I was told to “try to make it a year in the house and I could apply for a mod again at that time”.
I explained that I could not afford this amount which was the reason I attempted to be proactive and contacted you at the beginning of the year in the first place.

Instead of working with my situation, I feel I was set up to fail just so your company could foreclose on my property despite all my attempts at wishing to work out an amicable solution. I now have to move my self and my kids all because I attempted to proactively save my house but you didn’t feel I was at risk of hardship nor did you feel my loan was worth modifying to keep my family in our home.
I don’t understand why the trial payments were good enough for the trial period which was put in place to see if I could make the payments, which I could in a timely manner yet I was still denied. Why set up the trial period payments with a borrower if you are just going to deny them at the end of the period. That’s what the program was intended for correct?
The making home affordable plan was designed to help homeowners keep their homes. I also understand that the government helps the mortgage companies who help their clients. I have been making this mortgage payment for over 10 years without 1 late payment ever and when I needed the help you were not there to assist me.
When you have a borrower able to make those trial payments and fulfill the loan obligations on the property it makes no sense that you would deny them and take on a foreclosure. When I entered into this I was not delinquent, my loan was paid on time every month. Once entered into the program I was then delinquent and denied. The modification states that once the trial payments are made that the loan would be modified and the payments would continue at the rate the trial payment was set at, not to mention if your mortgage was over 31 percent of your income you were eligible and my income is 52 percent of my income yet I was denied. I do not understand the practice here.
I will let people know of my experience with your bank not that it will make a difference to your institution but other people need to be aware that you do not help those that actually need it. We will be moving but I just wanted you to know this was one home you could’ve helped save from foreclosure.

I recently applied for a loan modification from Bank of America. My loan was originally from Countrywide and was sub-prime. I followed all their directions and was denied. I qualified under all the programs and now my options are a short sale or turn over my deed but keep making payments according to them. To me it's like making opayments for the Titanic. The house is worth way below the mortgage and due to my ex-husbands neglect while we divorced is far from sellable. Bank of America was given an huge bailout and has the worse record for helping homeowners. We need to ban together and fight back so everyone who has money in Bank of American knows what a horrible bank it is. I would think they would want my $1200 a month instead of foreclosure on a house they will lose a bunch of money.

I have been working with BOA since March 2009 for a loan modification of my mortgage, since Countrywide sold my mortage to them. I have a stack of paperwork that was faxed to them over this period that would make up 2 Honolulu directory phone book. Each time I called them they passed me to a different negotiators and stated that they don't have any papers that I faxed and to faxed them again, mind you this is the 40th time faxing over the same paperwork. In December I notice that my interest statemet was way less than my 2007, only to find out my mortgage payment was put in a misc account. They claim they do that when you are waiting for a loan modification. Can you believe this $16, 000.00 of my money is a misc. account. I immediately threaten them and told them that I was going to report them to the IRS, they were collecting the interest on my money, that same day they applied the $16, 000.00 to my account. Finally in March I spoke to Robert Procell and he said well looking over our paperwork we did qualify for the Loan Modification and that he will sent the paper to us. On April I contacted him, and stated he sent my paperwork to the automated system to approve and I should have gotten the paperwork on March 17, we I still have not received. I then asked if I would also qualify for the National Home Retention Program, and he stated yes. As of today I still have not received any paperwork, every week I call BOA and again ask me to send more paperwork to them. What kind of f*&#$^% games are they playing. Finally my husband and I complained to the CEO of BOA, he then assigned another negotiator, which then passed on to another and another. Now mind you I have being doing this for over a year. Well we are now with another negotiator who is asking us for more paperwork and a monthly expense, she states list everything down, even if you purchase a stick of gum. Well I listed my cigaretts as park of entainment, she then states President Obama won't approve the cigaretts, I asked her if she spoke to him...haha. Why don't you ask him, since he is a smoker. One week later she calls and states that Making Home Affordable program would put us in paying $3900.00 a month, $1300.00 more than what I am paying. I laugh and told her for that kind of money I could live in a mansion on Hawaii's beaches. Ask them for your original deed and closing documents, they don't have it. The federal govement should shut BOA down, they are ripping everyone off, very poor customer service, rude, talk down to you. Just watch the news on the bad things that BOA is doing to everyone. Our mortgage was transferred to Bank Of America, shortly after we entered their loan modification program it has now been a year and a half. We have complied with all the requirements several times I might add. For a year and a half we have gotten no results we hit a brick wall almost every time we called.With only one income in our household for a greater part of being in the program.Two weeks ago I called for status update on our latest submittal in late April they told me it was in the hands of the underwriter and to call back in a week or two to get an update.
Just yesterday I called and got three reasons why we were no longer in the program anymore 1. I declined the reduced rate that we have been waiting a year and half for ? 2. We were 20.00 dollars short on our last payment which automatically takes you out of the program even the customer service agent was baffled by the reason after he read it off his monitor. 3. We opted out of the program I asked when( no reply...I asked by whom (no reply just that there information couldn't be wrong?. Then I am put through to Hailey in the retention department who assures me that if I just resubmit all of our information we would be put in back into the program I asked how long would the process take another year! After getting ripped off for by a loan modification company for2, 500.oo dollars prior entering the Bank of America. We trusted bank of America although my wife had second thoughts I told her after all its Bank of America they have a good reputation and have been around for a while. What will happen to our home now? Thanks to all you companies who walk your talk (right)

In February of 2010 I missed two payments with Bank of America on my mortgage. In April BOA sent me a letter requesting that I chose from the options they provided two help with my situation. I actually selected two options and put my house on the market and try to do a modification on my loan. BOA sent me the necessary paperwork to do fill out for the modification, I set the first group of papers back in May. then in May they requested more info which I returned by June 23, 2010. On July 12 I received a letter from an attorney in Addison, Texas that they had been hired by BOA to put my home on the Auction August 3rd and I would be foreclosed on. At first I thought there was just an error made at BOA and I could make the necessary phone calls to correct it. For the next 3 weeks I would spend approx. 25 hours on the phone with BOA and try to solve it. Many agents would tell me I was still in modification and they would request a urgent stop on the foreclosure. Others would tell me that they did not get the paperwork from me that was Fed-Ex to them and they were foreclosing on me, they would finally find it and then they would try to request a stop. Quite a few had no idea how I ended up in the foreclosure dept. After all said and done no one could help me, I did everything that BOA asked me to do, my modification was never even completed. I lost my home on August 3, after being divorced three years and making payments by myself that totaled over 100, 000. I was going through my 401 and knew I had to make a change. I thought the gov't used our tax dollars to pay the banks to help us out, what a joke. BOA just took the money and they are not helping and doing what they were suppose to do. By the way I am still in modification, I received another letter the other day asking for more information. Someone at the bank told me "BOA had the right to do a foreclosure during a modification if they chose to" so what's the point. If I had known my house was going to go to Auction maybe I would of chosen to pay my mortgage, but I was not given that option. You know what's really sad I know in my heart I did everything that BOA asked and they broke a federal law but there is nothing I can do about it because BOA is to Big. The gov't doesn't care they just get away with it. I feel cheated and lost... Kathy from Texas

I was sent a Mortgage Loan Modification in June. I returned the documents with a cashiers check for the amount noted as my new monthly payment, for the entire term of the loan. No where on any of the pages did it state trial period, temporary payment etc...
My next scheduled payment is due Sept. 1. The payment is $90 more a month than specified on the Modification. They are also now requesting an additional $1, 052 before that date, to keep my payment at the new higher amount. When I called BOA I was told that this was a trial period of 3 months, not for the entire length of the loan. They added to my principle all the past due interest, escrow and an additional $1, 400 for other fees and charges...
I really believe their accounting department needs an overhaul. You can call the same number 3 times to talk to someone different each time and get 3 completely different answers each time you call. I have been trying to deal with these Bank for almost 2 years. Too bad all the money given to these banks weren't given to the American people. We could have paid off our mortgages and we would then have money to spend ...here in America.
I will NEVER deal with Bank of America again by choice. Ever. And I would advise anyone who has a choice in the matter, stay away from BOA. They will charge you for everything they can, legitimate or not.

I have been working with Bank of America for 18 months on loan modification. First of all, they wouldn't even talk to me unless I was behind. I was forced to play their game. I paid them "trial" payments for 11 months, all before they were even due. I finally get a modification package which noone has been able to talk to me about. I was told that was their offer and it was not negotiable. The only thing they addressed was the payment. The principle went up $10, 000.00 and I had a balloon payment at the end of $18, 000.00 The house is barely worth 1/2 of the loan amount and they payment they figured out is still close to50% of my takehome. Hesitantly, I agreed to all their rediculous terms. I figured all that matters was that I could afford the payment and stay in my home. Eventually, the value of the house has to go up again. I started their new increased payments although I never got confirmation from them that they recieved my signed packet back. Here's where I lost it...after making 2 new payments, I get a letter saying I am one month behind. After talking to them, they tell me they applied my first new payment to the principle and if I don't send another payment, I will always be one month behind accruing late fees and hurting my credit. 2 payments is impossible for me to send. For over a year, I wonder...am I keeping this house or loosing it? I'm mentally drained, depressed often and have totally given up complying with their every request. For peace of mind I am ready to let them just take the house back. I can live just as well anywhere else and pay 1/2 what I'm paying here. Time to downsize, live within my means and get some peace into my life. I'm not the first, nor will I be the last to loose in such a big investment. My only regret is that I may not ever save enough for another down on a house and that my kids and grandchildren will not have a place to call their own. God knows I did my best. I'm turning in my keys...

Back in November I went to Bof A to request a loan modification I was declined, I had lost my job and just got a new one, I was delined because I made all of my payments on time. I was told by the agent to stop making my payments and I would receive help. Sure enough, I decided to do this after I depleted my savings.

2 months after missing payments I get an envelope from bofa saying I may qualify for a modification. great. at the time I had a credit score of 800. Okay first they say I am missing information they were kind enough to send me a fed x envelope with a pre paid fedX envelope. I got together all my paperwork and fedX it to the address that was printed on the package. They claimed they never recieved it. I was once again sent an envelope I quickly went out and recopied all my information 45 pages of my life Fed X again. Well guess what they lost that one too. I quickly clled them quite upset demanding to talk to an underwriter. I spoke to someone named Sunny. She was helpful and gave me a fax number to send thsi information to her . great I was told to go down to any Bank of america to fax it in. Bof A could not get it faxed. The following day I called Sunny the underwriter back and she wasn't available I talked to someone else who said that fax number did not exsist. So they gave me 2 other fax numbers. I went back to bank of america and they kindly faxed over to both numbers and gave me receipts showing the fax went thru. I called Sunny to see if she recieved it and she said no, but guess waht she was transferring and someone else is getting my file. okay this is now September. I have been making loan modification payments everymonth. I called back and I was told Yes we have your paperwork. I called every month and it was in process. October 28th I called to make my monthly loan modification and was told that the decison was made I WAS DECLINED! I ask them why, he said I would recieve a letter in by fed X. Sure enough I get a letter today saying I was declined "FOR FAILURE TO SUBMIT ALL PROPER DOCUMENTS"

To whomever this may concern, November 24, 2010

Let me start by telling you a little bit about myself.

My name is Derrick Marquis and I reside in Corona, California. It is here I live with my 16 year old daughter and my loving wife of 19 years. I am 39 years of age. I am a full time employee of 8 years at a company in Irvine where we manufacture precision investment tooling for primarily Aerospace and Medical components. My job title is: Tooling Engineer.

Sixteen years ago when my daughter was born, my wife and I made a decision that it would be better for her to stay home and raise our daughter and I would be the one who brought home the money. We made many sacrifices throughout the years to make that happen. It was and still is a very good investment. Because of our decision my daughter is now a spiritual, responsible straight "A" student with strong morals & focused goals.

As parents who continue to survive so many odds against us, we could not be more proud of those choices that we have made.

Years ago I remember standing on my balcony at an apartment we rented in Huntington Harbor and with tears in my eyes telling myself that one day I'm going to buy a home for my family. This will be a home we can call our own. A piece of the American dream.

Myself coming from a broken family and constantly moving from place to place I never had that security that so many people had growing up. I was dedicated to not allowing that to happen to my family.

For several years we rented a small beach cottage home in Huntington beach just a mile from downtown. At the time my place of employment was only two miles away. This house was just next door to my In-laws whom I adored. We were very fortunate to have lived right next door to family for so many years. It was there my wife's mother Susie (our neighbor) passed away due to complications from Cancer. Not to long after Susan passed we were served a notice that the places were being sold and we had 90 days to move out. This news came very hard to both us and Timothy, Susan's husband. It was at this time in our lives that we decided to purchase a home.

A dear friend who at the time was a real estate agent quickly set the gears in motion. As with most home buyers we looked at a few places in surrounding areas but nothing caught our eye price wise. Knowing that time was of the essence heavy prayers set into place. Our real estate agent found a place in Corona. We got into the car and headed east. With only MLS pictures in our head we pulled up to the property and instantly fell in love. We were proud first time home owners within only a couple weeks of being served the papers at the place in Huntington Beach. It was meant to happen. The power of prayer!

We made a great sacrifice which changed our lives in many ways. Work wasn't 5 minutes away anymore. My daughters school wasn't just down the block. Timothy was 26 miles away not just next door. It was a tough transition but for the better.

Through hard work and dedication I was able to make that dream come true for my family.

We moved in on July 10th 2004.

In the years we have lived here we have spent tens of thousands of dollars on home improvements. All of these improvements were paid for with my earnings. I believe it is the cutest house on in the neighborhood.

Like so many people did when the equity in their home was substantial they took out seconds and bought cars and boats then when the housing market turned they were stuck with huge debt forcing them into foreclosure. In the years living here I have never re-financed even when the market was high. We took on a mortgage we could afford based on my income at the time.

Now, the bad news.

I don't want to bore you with all the details however if all the details are required by "you" the reader I would be more than happy to provide you with that information.

Reminder: All of my testimony from this point on is truthful backed by receipts, documents, dates, times and names of people my wife and I have spoken with.

May, 2009

Work slowed down and I fell behind on my mortgage payment by 2 months. Mind you from July of 2004 thru February of 2009 we never made one mortgage payment late. Being behind we immediately called Bank of America (BOFA) and explained to them our situation. We were told. "We had to be 3 months behind in order to qualify for the Making Home Affordable Program (HAMP)". After we had lapsed into 3 months delinquency I was asked by BOFA to fax them a long list of documents i.e.: 3 months bank statements, 6 months payroll, tax returns, expense breakdown, letter of hardship and so on. Later we were told by BOFA that "We qualified for HAMP" and that our file is currently under review. Note: We were never mailed a HAMP Packet. Two months after faxing BOFA all the documents they requested, we never heard back from them. At this time I was 5 months delinquent. I was receiving foreclosure notices in the mail and one even posted on my door, documents from Recon Trust were showing up in my mailbox and strangers were showing up taking pictures of my home. Perhaps BOFA had their fax machines hooked directly to the shredder.

My wife and I were sick from stress and with BOFA not at all working with us, we had no choice but to hire a company to help us out of our situation.

July, 2009

I did some research and decided to hire Pacific Loan Solutions (PLS) owned and operated by Jeffrey Torrez and Wassam (Sam) Ismail out of Riverside. The attorney on staff was Zachary Gonzalez LLC. I went to their location for a free consultation and they said they specialized in loan modifications, I qualified based on my criteria and they said they would be able to help me with a loan modification. I paid the company $5407.00 to do the work (1.5% of the total amount of the loan to be modified). Strange I thought but desperate. Over the course of several weeks I emailed and faxed them all the information they requested.

Months and months and Trustee sale date postponement after Trustee sale date postponement went by and nothing was happening. I was getting further and further behind on payments. BOFA would not even accept payments at this time until I came up with the full arrears. Months later after hiring PLS I got a one page form letter from BOFA stating *** MODIFICATIONS ARE NOT AN OPTION *** that our loan was non modifiable due to the fact that the investor (Wells Fargo) will not allow it. Did Pacific Loan Solutions know this and not tell me to scam me out of my money? The answer in yes. The company had an "A" rating with the BBB when I hired them and now an "F" rating. PLS shut their doors and Jeffrey, Sam and Zachary disappeared. Once again we were at a complete loss with seemingly nowhere to turn.

July 2010

After several attempts trying to explain to BOFA our situation they still were falling back on the excuse that Wells Fargo does not allow modifications, I was forced to hire another attorney. Through the state bar web site we found a reputable firm, Keefe Roberts & Associates. After a consultation Keefe was convinced that BOFA was up to something strange. We paid Keefe Roberts $2000.00, in which every dime they earned only to have BOFA send a letter to them stating that my loan was non modifiable and it wasn't an option because the investor Wells Fargo doesn't allow modifications. Keefe Roberts was even confused. Keefe and I started talking about different options, i.e.: (Lawsuit against BOFA) not an option as it would cost me ($10, 000.00) or more, Restraining order against the Trustee sale ($2500.00), Chapter 13 ($4000.00) or Short sale, ($1500.00) or of course walk away.

Don't get me wrong, Keefe Roberts is a good fair attorney but why is BOFA making me go through this nightmare? You would think BOFA would like to start getting payments from me?

My wife and I decided that we want to save our home and a chapter 13 seemed to be the best way out of this mess so we took that course. I put Keefe on the shelf and went after Zachary in hopes to get my money back so I could pay Keefe for the chapter 13 fees.

August 2010

A friend of mine and I found where Zachary Gonzalez (former PLS attorney) was practicing and confronted him in a public arena demanding my money back. He refused to refund me stating he simply did not have it, and an argument ensued. Police were even called. Finally Zachary offered to provide me the services for a Chapter 13 and court representation free of charge. I scheduled an appointment with him and the contract was agreed upon. The contract stated that Zachary Gonzalez would perform the services required for a chapter 13 free of charge. I contacted Springboard and paid the $45.00 fee to complete the online certificate course for pre-petition counseling for chapter 13. I wrote him a check for the amount of $274.00 for a chapter 13 court filing fee. Relieved I waited patiently to hear back from him.

Well that's just great now I have to call Keefe Roberts and tell him, "you know Zachary, that guy who stole fifty four hundred bucks from me, well now he's going to represent us in court". After notifying Keefe about what had happened I had a sense of relief that Zachary would make good on his promise and maybe things were starting to look up for us. Rightfully so Keefe probably thought we were nuts, however I had no choice and I did not have $4000.00 to pay Keefe for a chapter 13.

A couple of weeks went by and I had not heard back from Zachary so I decided to leave work early and go down to his office in Riverside. The secretary of the building told me she had not seen or heard from him for a couple of weeks and a lot of people were coming in asking the same question. Weak in the knees and a stomach ache I went home and later on found out he was disbarred. Evil forces are working against us once again.

Soon after, the court dismissed the case because of non activity. Thanks Zachary oh and thanks BOFA!

Now without an attorney to represent me in court and the lack of knowledge and paperwork it took to represent myself in court and the fact that 95% of all chapter 13 cases that are self represented are denied by the courts I turned back to Keefe Roberts. I wrote another check to Keefe for the amount of $2000.00 in which he continued to try and get BOFA to modify our loan to no avail.

At this time Keefe Roberts wanted to continue on with a chapter 13 but without BOFA Working with us by modifying my loan and adding my arrears to the back of the loan it seems to heavy of a burden for me.

Keep in mind by this time I am $9726.00 plus numerous days off work trying to get BOFA to modify my loan when all BOFA needed to do was help me out with my mortgage back in May of 2009. $9726.00 is 6 months of my mortgage payments to BOFA!

Why didn't BOFA tell me that modifications were NOT an option up front. Instead they lead me on for months and months allowing me to believe something was happening when actually nothing was happening. If I would have known up front that modifications on my loan were NOT an option (which I don't believe this as being true) then I could have taken a different course which would have landed me in a much better situation now.

A simple one page form letter from BOFA stating modifications are not an option is simply not enough information for me or my attorney for that matter. I thought that BOFA by law was suppose to work with the buyer by modifying their loan (if necessary) providing they have income. Wait according to BOFA you don't even need to have an income for them to work with you. Sure my hours got cut for a while but I never lost my job!

My wife and I even spoke with a HUD counselor who said she would take our information and give it to BOFA and that she would get back with us. We never heard from that lady again.

Of course this letter is an abridged version and I left out many small details, but in a nutshell you get the idea. Over the course of the last 18 months of hell starting back in February, 2009 I have learned a lot about a lot of things that most people should never have to know in their lifetime. I understand that it was I who fell behind on my mortgage payments back in February of last year but I never thought it would come to this. Further more I thought that's what the HAMP program was all about, Making Home Affordable Program? I am a hard working middle class American who does not rely on free government handouts to get from day to day like some people do. It was my understanding the Federal Government bailed out BOFA and set up laws forcing BOFA to use the money to help folks like myself. I was never offered that opportunity. All I ever wanted was to get back on track and current on my mortgage and to build up that sense of security I had before this nightmare occurred. It seems to me BOFA wants my home because they have no desire to work with me and start receiving payments?

I will not give my home to BOFA without a fight.

Well, once again, here we sit with a December 2nd trustee sale date looming over us and again at a complete loss with seemingly nowhere to turn.

Do I pay more of my hard earned money to high priced attorneys or would Bank of America rather have it?

Bank of america has been misleading me. I have a rental property that needs to be modified. They had approved it twice with another Arm Loan. I did not accept it. They also gave me 3 month trial last June 2010. After that They did not give my loan. Then they said it is not my primary residence, then all of a sudden I felt misled. They first tell me to go on default to modify loan to modify it. Then they say it is not my primary reisdence, after approving loan mod twice in the past. I am deserving of the modification because I did not get a loan I agreed to. the Broker Scott Nueberger disappeared into thin air and did not give me all of my loan docs.. I explained all this. They do not let me talk to the negotiator, or anything and now they said even after 3 month trial they that I paid on time they still did not give it to me. They lied misled me and I have ruined my credit over this.. I think they want me to foreclose for thier tax right off. Also my primary residence, I had to hire an attorney because of the run a round and lies. We need to cooperate with one another and the greed of the lenders is out of control! Tell Obama to stop giving them tax right off so they loan mofidfy everything..

my sick and elderly neighbors tried for a loan midification on their home for over a year. as of two days from now they will be thrown out of their home with all their belongings. boa strung them along for over a year, telling them they need more info, they are working on the loan, etc. they were told not to make house payments or they would not qualify. as of 3 days ago, their home was sold at auction. he is 75 years old with congestive heart disease and copd. she suffers with ms. how can this happen in this country? my heart is breaking for them and the scariest thing is that this could happen to any one of us. when will our government wake up and do something to stop this bloodletting by these banks?

I have been looking for someone to help me with BAC and their stone walling. I have been in limbo for 2 years now. And BAC ruined my credit.

It started when I asked NACA to help me in Sept of 2009. I never heard anything from NACA, after a few months I called BAC and they told me NACA had me on a hold with them for a loan Mod. I emailed NACA several times and no-one could find any info on me. So out of the blue I get called from Affordable Finance LLC out of New Jersy saying they could help me. 3000.00 and they could get me the loan mod. Well to make a long story shorter a little, I did the paper work for them, paid them, one and a half years later I found out the lawyer I was working with was replace by another one, and I had to fill out ANOTHER Power of Attorney paper for the new guy. I filed a complaint with the New Jersy ATT Gen, after several months they told me I was SOL on that gettin my money back. I have tried to work with BAC on my own to get the Loan Mod. Gave them the papers 2X and finally was told We make too much money. I live on Social Security Disability (BIG MONEY HUH?) My wife makes 9.50./hr. I have a interest only loan, I owe 121, 000.00 on the loan. I was with Countrywide but got bought out by BAC. Ever since I have been in hell. They have ruined my credit, I have made EVERY single payment but BAC says I am thousands of dollars behind in payments. I have the canceled checks to prove this. I can't get BAC to make my credit current and post my payments on their accounts. My money seems to be dissapering over there.
I want to file suit against BAC. I don't know who to get help from. Or even what to do. Can you gide me to someone that could help me?

I have triefor almost two years to obtain a loan modification from Bank of America. My situation is tha same as millions of consumers Bank o f America is unwilling to process me for modification. If anyone wamts to contact me I would be willing to form a class action lawsuit for unethical practices. I need help together we can accomplish what we can't seperately.

Let me first state that Bank of America is the lowest form of life and that I never wanted them as my Mortgage company, they just happened to take over when Countrywide went out.It took them 7 months to make a descision on my loan modification and then turn me down.In that 7 months they kept losing paperwork and I had to keep faxing them 2 times a week.It cost me over $50 to do that.I appealed it and they turned me down right away, they offered no other help.It is actually the investors who are the biggest ### on the face of the earth.I have talked to many people and all I hear them say is that BOA is the worst bank to deal with.I THINK THEY SHOULD BE INVESTIGATED FOR FRAUD, FOR LYING, (which they did to me), FOR NOT USING OBAMA'S MODIFICATION PLAN THE CORRECT WAY, IF I COULD I WOULD GET A PROTEST STARTED TO GET THEM OF THE FACE OF THE EARTH.I HOPE THE INVESTORS ROT IN HELL!

I am so frustrated with Bank of America. I am not a good record keeper nor do I write the names down of the people I talk to. I am kicking myself on a daily basis because of this. In the summmer of 2009 I got behind by one payment on my mortgage. I got scared because $750.00 isn't easy to make up so I called Bank of America to find out what I should do. The man I talked to told me that my best bet would be to go into a forebearance. I didn't know what that was, and he told my I would have a reduced payment of 404.11 a month for 6 months and that someone would call me from the company to go over my options. I specifically asked him if this would come back to bite me in the butt in the end, and he said absolutely not. Needless to say at the end of that period no one called so I contiued to make those payments. About a month after that I got a foreclosure letter with a notation that I owed over $2000 and I have not been able to recover from that ever since. I would love to file a class action lawsuit against them, but I don't know how.

Since March 2010 I been dealing with a rate modification. I have been calling for status almost every three weeks. They have requested the same documents over and over again because they are due... Now I have been told that the same was denied for lack of documentation. I made an appeal and the same was denied. They put me on a regular Bank of American loan modification but has been told that I do not qualify for any modification on my loan because I do not file tax return. They did not requested from me a tax return copy when I apply and was approved for the mortgage loan back in 2000 and later on my rate modification on 2008. I have never paid late since 2000 and they put me on a trial period since July 2010 paying my mortgage and the escrow amount, which I did not paid it with my mortage because I did it at the end of the year. Is that so, that you have to have a tax return filed in order to be approved a loan modification?

I filed a loan modification request 2009 with my lender BANK OF AMERICA . Have submitted all the requirements and asking me the same documents many times. Called thier customer service a lot of times but they just keep on transfering me from one department to another and took me even hours without answers in my questions. It took more tha a year until they guy who handle my request told me that I need to file another application because my request is too old already. I file second request to thier other office but when I called them, thier records doesn't reconcile for they still looking for the first loan which they said it was denied because of lack of financial documents. But some BA staff which I talk to regarding my second request said still in process and ask them If I need to submit some requirements but said no. Have no clear response and answer from them or they just ignore or don't want to process my request. One guy called me and suggest me if I can do double job to coupe up with my mortgage payment but I will if he give me a second job, He even advice me to let somebody rent the room of my condo but I said I have only one room. What a nonsense advice from a Bank of America staff. WHy they just process my loan modification request wherein I am suppose to be intittled too. Now they said they will process the foreclosure of my house. BANK OF AMERICA is not soo cooperative with thier customers because I beleive they just want to foreclose your house to get more money from you.

On July27, 2009, I applied for a loan of modification with Bank of America. After a long nine months wait period, I received a loan modification which required me to pay much more than my previous payment. I rejected it. After I resubmitted the application again and again and all the run around, on April8, 2011, BAC wrongfully denied my qualification by accusing me that I am not an owner occupant. Even though, I proved it that I reside in the property, BAC
turn around and denied me again. They tried to push me to their short sale or Forclosure program so that they can make more money from detress homeowners like myself. Thank.

Hi there. I have been working with Bank of America for 2.5 years now to try to obtain a loan modification. I have heard every stall tactic, lie, been told countless documents were lost, incomplete, outdated, hung up on, I have not been contacted by my single point of contact for six plus months after filing numerous complaints with Bank of America and I could go on all day. We were a Countrywide loan, did a refinance back in November 2005 to an adjustable interest only with a pre-payment penalty for five plus years and have experienced substantial loss of income and medical hardship and like I said have been working with B of A for 2.5 years and gotten absolutely nowhere fast except 15 payments behind and now we are in foreclosure with no sale date and the bank has a hold on our account per Rincon Trust and they are waiting for instructions from the bank on how to proceed. We have a forensic loan audit that I submitted to B of A and all kinds of other documented issues with this whole loan modification process to the CEO/President's office who has assigned me to an advocate who is researching everything. I have filed complaints with my state's Attorney General's office (AZ), helpmewithmybank.gov and various other entities to try to assist me to get a loan modification. I have been told so many different lies by Bank of America and do not know what to believe anymore. We thought we were in underwriting for a modification for in house review after being denied for Hamp (no reason for denial known per the CEO's office), but we just found out from a local B of A branch worker that our scanned file is a complete mess and they believe it will be kicked out by the underwriter whenever they decide to look at it which according to this branch worker it should have been touched within three days, yet it has been almost 30 and it is still sitting in this person's queue. We want to save this house, we are really upside down in it of course, but just are requesting a low monthly payment we can afford. Principle reduction would be great, but we would be happy just extending the loan from 25 years to 40 with a fixed low interest rate and a low monthly payment we can afford. I have even emailed to the investor Bank of New York Mellon who emailed me back and said they are only the trustee whatever that means and to contact BAC. A new Deed of Trust was also just recorded at my county recorder's office on March 2nd, yet nobody at Bank of America knows about it when I call to ask. MERS was also corrected recently as well. Is there anything else I can do to get this resolved and stop the games over at Bank of America? Is there anyone else I can file a complaint with or contact that might be able to assist me? This has become a full time job for me here trying to save this home. Please help! Anything I can do I will try. How about the news? Is bad publicity any help? We were just told we were put on a list for someone to call us about this global department of justice settlement and they will get back to us in 60 days, but I am not so sure we have 60 days to waste here. Help please!

I am in desperate need of getting help with my home I don't want to lose my house. I have been working with Bank of America for over a year with my loan modification and have not been able to get any help I keep getting transferred around to different people, because they tell me that my income on my tax returns is complicated I have sent Bank of America every single peace of document they have requested, my home had a sale date on May 08, 2012 at 9:00 A.M. I was told by my the negotiator, Stacey Reed not to worry that she had requested a postponement date but she was unable to give me confirmation of the postponement until one day before the sale date, On the morning of my sale May 08, 2012 I called the negotiator at 7:15 A.M. and she informed me that the investor had decline my postponement that she was sorry but my house was going to sale I was livid and started screaming on the phone telling her how can you tell me this the same date of my home going to sale that their is nothing you can do to stop my sale, she said she was sorry, I asked her to please let me talk to a supervisor she said NO, no one else can do anything I insisted to be transferred to a supervisor and when she did transfer me all I got was a voice mail, I was forced to run to the bankruptcy court to file for bankruptcy to save my home which was something I did not want to do because bankruptcy affects my business. I have continued to call Bank of America to work out a plan to modify my loan and I am unable to get any help I just keep been told that the investor which is Freddie Mac is not willing to work with me I have emailed Freddie Mac as well to file a complaint and open up an investigation as to why Bank of America is telling me that there is nothing they can do to help me out when clearly I have followed all procedures that they have requested . I strongly believe that Bank of America is neglecting to have someone that fully understands how to read corporate taxes review my case so they can fully understand where my income is coming from. I've have even gone as far as sending my negotiator a letter explaining to them how to read my income taxes and figure out my income. I am requesting that I be given the opportunity to speak to someone that can actually take the time to carefully review my case and tell me what are my options which I strongly believe no one has taken the time to provide any assistance and they just simply don't want to work with my case because my file is to complicated. I don't want to lose my home I am desperately asking for help . I will do what ever I need to do to keep my home even if it means getting a second job to qualify if, that is the reason because according to Bank of America they do not know... She (Stacey Reed) said the investor Freddie Mac is not willing to work with me but, no one seems to know why? This is simply not an acceptable answer after I've done everything and submitted everything that they've asked me for. On June 14, 2012 I suffered a mild stroke which paralyzed one side of my face this entire frustrating situation has me sick to my stomach in trying to have someone please help me out. I have been going thru a loan modification with Bank of America for about a year. I finally got my loan modification paperwork yesterday and I am extremely disappointed and frustrated. I have emailed and called James Sauer numerous times and he has not gotten back to me. My interest rate stayed the same, my monthly mortgage amount was raised, and I have to pay back the HUD and Bank of America liens at the end of my loan. What is the point in the loan modification? I am dealing with the same issue... now only 3 months into the process but they keep losing documents, will not change my number in the system and when they do I get 15 calls a day... I am so sick of dealing with them. I am ready to walk away from my house just to screw them over (and myself) but we can not afford the house anymore and need help and no one is willing to help and no one can talk to you. I am working with a lady whos second language is english and makes things even more frustrating. I am just so ready to be done! They are a crappy company and I was so excited when they where going to sell my mortgage to a new company but no I am stuck!

I too have been involved with Bank of America trying to get a loan mod since the passing of my husband and the loss of income. August 2011. This is an outrage that they are able to get away with what they are doing to people . The same story they lose files or the underwriters can't view the files or oh the fax # wasn't working at the time you faxed your documents. I also have been involved with the hope team who supposedly works on my behalf to help thru the process. The only thing they're able to do is get a person to answer the phone and then spit out the same bs over and over again. Your acct. is currently in the final decision process. Then the next time you call it is back in review. The government agency that supports his program should do something about this. I would hire a lawyer but I don't have enough money. Wilma

Now, at least 1x a month I get a letter from BOA telling me that the Note has been sold and not to make any payment until I get information about new lien holder. Well, it was sold by BOA to BOA and am not supposed to pay until I get a letter from new company!

I was promised PMI removal and that it was a perk BOA offered all their customers. they just keep throwing the Loan Disclosure in my face now and it contradicts itself. It has been 7 months and now I am forced to re-finance at another bank to get rid of it. Nasty people, all liars. They are a good fit to be with that company becuase they are ALL LIARS and cheats. I dont know how they can sleep at night.

I have done some more researching since posting my complaint approx. one month ago and I hope this will benefit all of you who may be searching for some help after undergoing the same type of issues that I have with Bank of America, or for others...different banks! THIS SITE EXPLAINS THAT THERE ARE PEOPLE OUT THERE THAT ARE USING THIS LAWSUIT TO SCAM OTHERS! IT ALSO LISTS THE WEBSITES & LINKS THAT ARE ASSOCIATED WITH THOSE SCAMS! Mandelman interviewed attorney Kramer himself, & he said, "I will not take on a new client unless I have a licensed attorney speak with the prospective client..." Attorney Kramer also said, "I have recently hired a compliance attorney. He is currently hiring & training a staff of lawyers to call all new prospective clients!" The gentleman that had called me, who claimed to be working for attorneys Kramer & Kaslow, said he was an intake specialist! He told me that he had gotten the attorneys approval to add me to the lawsuit & the next thing would be a $5, 000 retainer fee! I was unable to come up with that amount of money, of course, and once I told this intake specialist this news...I have no longer heard from him! :) SURPRISE! Huh!? Please, BE CAREFUL! John Wright is right. I applied for a loan modification in June, 2010. I was 2 mos. behind on my mortgage because of a recurring 6 mo. per yr. layoff as a City of Chicago truck driver. For 10 mos. and hundreds of pages of faxed documents, no one from bank of america ever contacted me. I contacted them monthly when I made my payments, and was always told that more documents were needed. Finally, after almost a year, I was contacted by a facillitator to complete the paperwork and get it to someone who would decide my fate. I explained to her that bank of america was full of it, and that after a year of not being contacted by them, I felt that this was just another stall tactic, and I hoped that this conv. was recorded. I was resigned to the fact that bank of america had no intention of helping me or anyone else. After 2 mos and more documents I was sent a FedEx package stating that I was denied Because my payment of $1000.00 a mo. was not more than 31% of my mortgage. I laughed, and called my facillitator at the bank and asked her how did the bank not know that my payment amount was $1300.00 a mo.? I told her that to me it was a joke, and another stall tactic. She calculated the percentage with the correct payment amount and found that my payment was MORE than 31% of my income. She said she did not know how that happened, but she would re-submit with the correct calculations and I should be approved. Two weeks later I was sent a FedEx packet that simply stated that I was not eligible. No reason, just that I was not eligible. bank of america is a joke, but our Gov. officials are even more so. How can they continue to fund these banks, with taxpayer dollars, when it takes them 13 or 14 mos. to turn EVERYBODY down? I watched C-Span with a senate committee interviewing the ceo of boa on their performance in completing loan modifications in a timely manner. The ceo stated that most mods were completed in 60-90 days, at which the gallery full of homeowners who were either denied or waiting for over a year, erupted in loud protests to the testimony and were escorted out by the sgt. of arms. It was a joke. There is no oversight. We are at the mercy of these swindlers. The gov should have administered these mods with the bailout money they gave these banks who caused these problems in the first place. How do you reward the crooks, and punish the victims? Damn bac and the peoploe who have given them carte blanche. P.B.

I am having a similar situation with my elderly parents. They have never been late and due to their age they are not required to file a tax return. I contacted the IRS and they sent us a document, with all the appropriate information highlighted to send to BOA explaining in detail why they were not required by the IRS to file. It did not help.
We have been trying to get a modification since Jan 2010 with BOA and it has been a nightmare. BOA needs to train their employees to properly follow the quidelines that the government has set out for these modification programs. Since Jan of 2010 my parents have been forced to apply 4 times now as they keep losing the packets. As we find this out and reapply the quidelines of the program keep changing. The Making Home Affordable and the Modification program are different. Fannie Mae requires that the homeowner be over 60 days late to qualify for the Modification program. That is what the corporate contact I have just told me in a phone call. I have spent hundreds of hours in phone calls and emails trying to get satisfaction on this situation. My parents were embarassed to let me know they had taken out a loan about 2004 to redo their kitchen, drawing out equity in their house that they had at that time. The loan is an ARM. They are not in default yet but are facing eminent default and still BOA says they can not help. I was told to reapply to the Making Home Affordable program again. This will be the 5th time we have sent complete packets with all required documentation to them and even after I now only contact the corporate office, not the general phone number for BOA. They are imbeciles, I know more about the program then they do at this point. I will be contacting the appropriate Attorney Generals office regarding this charade they are pulling and I hope they get in trouble.
I also want to add that I assisted my brother with his Modification thru Wells Fargo and it was done in three months and another family member completed a modification thru Chase in 5 months with no problems or issues. This just shows how incompetent BOA is.
