Bank of America failure to release lien on car for 7 years

I purchased a car in florida in 2001 with an auto loan from bank of america. I repaid the loan in may 2004. When I recently (June 2011) attempted to sell the car, I discovered that bank of america had not released their lien on the car. The first boa agent I spoke with wanted to charge me $20 for a lien release statement. I declined and called the florida dmv to determine what exactly I needed. They told me that boa needed to release the lien electronically via the fl dmv system.

I then attempted to get back in touch with boa (7/12/2011). After being hung up on multiple times, I finally got through to an agent named diane washington. She initially told me that it would take her a few minutes to put the information into the system. When I pressed her to clarify whether she meant the dmv system, after several rounds of q&a, she said: no, she was just keying in a ticket for someone else to address. When I asked her when I could expect this someone else to actually get onto the fl dmv system and release the lien, she said it would take 7-10 business days. When I told her that was completely unacceptable - they had already had 7 years to release the lien, she said she would put a rush on it and have it resolved within 48 hours.

It was not. I called the fl dmv four business days later (7/18/2011) and was told that boa had not filed the lien release.

I called boa back this morning (7/19) and spoke with an agent named jacob landrum, who said that boa filed the lien release yesterday, though he could not tell me what time it had been filed. He offered no explanation or apology for not meeting their promised turnaround time of 48 hours. I then called the fl dmv back, only to be told that the lien had not yet been released by boa.

I then called boa back and spoke to an agent named kia collins, who was unable to provide any further information. I then requested a supervisor and was put in touch with tonnisha taylor, who told me that diane washington could not have promised me a 48 hour turnaround because their typical turnaround was 7-10 days. I assured ms. Taylor that ms. Washington had and that even ms. Collins had seen the promised 48-hour turnaround in the system. She then said that if ms. Washington had promised me a 48-hour turnaround, she should not have done so.

I then asked ms. Taylor why a two-minute task & ndash; filing the lien release in the fl dmv system & ndash; should take that long to complete and she replied that & ldquo;the agent needed to research the matter before releasing the lien. & rdquo; note that all call center agents and the supervisor had complete access to my repayment date and all other vehicle and loan information they needed. So it is still unclear to me why filing the lien release should even have taken 48 business hours, let alone the 96 business hours that it appears to have taken & hellip; and at this point, I only have boa’s less-than-credible word that they have actually filed the lien release.

I am completely disgusted with boa. Not only have they not been proactive in addressing their 7-year old error (They took my phone numbers but never called back to inform me that the matter was delayed or resolved) , but at each stage, agents have been downright ignorant, made excuses, prevaricated, and simply attempted to get me off the line as quickly as possible without any concern for resolving the problem. Given everything I read about the company and my own past experiences with them, I probably shouldn’t be surprised, but I am & hellip; that a company this unprofessional continues to stay in business.

I am facing exactly the same issue described. They are making me run around and asking me to call different toll free numbers. Did you find the solution on how to deal with this issue. Please let me know. I desperately need some help.

Bank of America mortgage servicing and modification

BAC did not complete the closing of my modification(which was a terrible 1 and 1/2 year process) correctly and now they are trying to foreclose on my mortgage that is currently $67000.00 on a home now valued at $23000.00. I received a statement from BAC in Nov. 2010 stating that my next payment wasn't due until July 2011, I didn't receive any other statements or correspondence from them until Feb. 2011, by certified mail that I was behind on my payments. When I contacted them in Feb. 2011 the associate stated to ignore the letter and that my next payment wasn't due until July 2011. I have been trying since Feb. 2011 to get this worked out without any luck. They call me 8 to 10 times PER DAY from the collection dept. I tell them to look at the notes on my account and that it is under review but still NO ANSWERS. I now am working with the Fannie Mae Mortgage Help Center in Tampa but so far no luck.

Gatorlady79, I hate to be the bearer of bad news but no one should expect a loan modification from Bank of America. It is a trick to make you default and take your home. I know from personal experience. BofA makes much more money foreclosing on you. They could care less if you are dying, got an operation, lost your job or any other unexpected inconvenience that might happen in your life. Do not fall for their traps. This is called F-R-A-U-D! They need to be exterminated like a bad roach infestation that has corrupted this country's economy. They are committing "widespread" fraud. When you "lead" millions of people to believe that you are going to help them and even make them miss payments in order to get a loan modification, that is called fraud: http://en.wikipedia.org/wiki/Fraud.

Bank of America's located in Upstate South Carolina keeps screwing over customers. They show customers no respect. My best friend, and 3 people I'm completing home improvement jobs for, have accounts with Bank of America. Their accounts were transferred to another bank without their permission or knowledge. They received envelopes welcoming them to the new bank, then received new atm cards for the new bank a week later. Bank of America is run by a bunch of nuts, who don't have any idea what customer service means. I banked with them a few years ago, had nothing but problems. I see they have not changed a bit. My best friend spoke with a 3 customer service reps and 2 managers, no one gave any lucid answers.

Bank of America bank did not address fraud issues

n 2008/2009, it was bought to my attention that numerous (13+) unknown internet companies were debiting my checking account (acct 8866). In 2008/2009 my it was bought to my attention that my bank account was being debited by unknown internet companies. I went into a local bank and called #800 to notify the bank of what was going on. The bank manager suggested that I open another account until things were corrected (FEB/MAR 2009). Bank of America did nothing to help me stop these constant debits from happening. They refused to close the account as requested. As a result my new account & savings account were attacked. Funds were taken out of the active accounts to take care of the negative balance in the account with the fraud activity. After, I stopped depositing my payroll deposits, the bank sent my accounts to collections. I was never compensated for the fraud on my account and was hit with outrages fees $1400.00. I paid what I felt was fair $100.00. The second checking account was paid off. My issues is with the outstanding $1300 (paid $100.00) I want this account issue corrected so that I can open another account. I went into a banking center and no one can give me any back history on this account. I had my account with BOA for 10 years. Sadly in my time of need the bank has dropped the ball and forcing me to carry the burden of not being able to open another account. This entire ordeal has been extreamly stressful and time consuming. Not to mention, it is very fustraighting to be told something totally different every time you speak with someone from BOA. I feel BOA dropped the ball with this one & now I am paying the ultimate price for their lack of customer service.

Stay away from Bank of America
save yourself the head ache. BTW i have very little real money maybe they are mad because they realize that its my clients money they are losing because i manage a lot of others money . And i never recommend that they use BOA. would you if they treated you like this . Its outrageous i do not know how in the world they have stayed in business. but it will change i can assure you they have lost all my business and as many of my clients accounts as i can convince to move that may only be a few thousand but then what is a few thousand small real folks that work for their money and a few others that don't but that should not matter the amount my clients have should be of no issue but you can be assure it is well i hope so because over the next few months i will begin closing as many as i can move out my clients funds that are willing.

i used them and have to but only keep like 20 or 50 dollars in my account
i have had many issues all of which i feel are due to their bank rules nothing to do with me they would not deposit a check from the IRS i wanted to deposit to my account. the check was for 1800 i went to a bank down the street they not only took the check and deposited it to the account they asked me if there was anything else they could do to help me ( Centennial ) they were extremely helpful the manager did all i asked and more The manager of the Bank of America branch said she would got to jail for making this deposit what a bunch of CRAP a out and out lie. she Was a Jerk and being totally rude and non helpful I opened the account one day along time ago. I only reopened the account because this same lady told me that she would help me well that proved to be a pack of lies .! as usual BOA do not keep their word the people they hire are rude and the whole banking staff laughs as you leave when they tick off someone I've seen it happen many times the med center branch in little rock Arkansas is the worst bank i have ever had dealings with the bank not only lied to me but has refused to take my money on more then one occasion. i have on each occasion made the deposit to a different bank with out any of the excuses that BOA has made like we can't take that check with out you wife here i took the 70, 000 check and deposited it to The Bank of Little Rock that same day without any issues. NOW at the time i was refused i had been an account holder at BOA for like 10 years but they refused to take my check a check that i had received from a mortgage company with my name and my wires name on it . the Bank of Little Rock only ask to speak with my wife on the phone which i offered to BOA they wanted my sick wife to get out of bed sick and come sign the check in front of them before they would take it . I even said they could put a hold on it till she got better they said NO so i left went to Bank of Little Rock they called my wife and deposited the check . that day
i had access to my money in 3 days i recently went to BOA and they would not again take the above check for 1800 it was from the IRS made out to a client of mine who lived out of the country BOA refused to take the check to make a deposit even thought i have a POA Power of Attorney for both the husband and wife. the bank said they could not take the check this guy had an account with BOA with me as the POA on the account . he has had it for years they now treat folks like jerks i have over 10 mil in over banks but they will never see a dime more then i have to put in there bank ever! if i were to tell any one NOT TO use a bank it would be DO NOT USE Bank of America. period they are rude and will treat you like a jerk .ONLY if you put you 10 mil in their bank do they treat you with even half an ounce of respect the they are so too faced it makes me sick

Bank of America scheduled payments & manipulated dating

I now have photographic proof (& evidence in print) that BofA alters dates for scheduled payments causing clients to potentially overdraw their funds and BofA then collects a $35 fee every time it happens. Curious if anyone else has reported something similar?
The first time it happened to me I assumed I had made a mistake in the date that I set for the payment. Recently I have gone in prior to the set date (I get paid every other Thursday) and made sure that everything was correct. Several times I have noticed that my scheduled Thursday outgoing payments were all of a sudden set to go out on a Wednesday instead! I am now scheduling major outgoing payments for every other Friday instead but this week it happened again (BofA set the date back one day). I am attaching photos of this recent incidence. An $859 transfer scheduled by me to go out on July 15th was changed by BofA to suddenly go out on the 14th instead.

OK, I've waited for more than 24 hours to try to pay bills online. NOWHERE is there any information about BofA being down for California customers. I think it is newsworthy. I spoke with a rep earlier today and she told me they didn't know when the log-in problems would be corrected. I need to pay bills NOW!

Bank of America fraud and deception

My loan was purchased by BOA from Countrywide.My income was reduced almost 70% from date of loan until present. I applied for a remodification (presidents protection for consumers right) and was told that if I caught payments up, they would remodify the loan under the lower interest rate, presently 5.7%. After payments caught up, they said I made loan 30 days before the elegibility date of the remodification date. Once again I fell behind and applied again and this time I was told that my income was too low to qualify for the new payments.Keep making the original payments $728.00. My ss income is $1000. monthly.
I am now almost 70 years old and everything I have ever worked for is being taken by BOA and I will be on the street. I feel that my tax money was used by BOA to set me out on the street. Thanks Mr. President.
Anyone else want to thank BOA and the UNITED STATES GOVERNMENT?

We did get the modification. All it took was a attorney to send a letter to Bank of America and they said the person that was handling the modification did not sent the documents to the correct department and was fired.

We have been with Bank of America for 20 years and got behind on our payments. We filled out modification forms three times and the last time they said that they could not verify our income. We sent them bank statements and pay stubs but still said they could not verify our income. So i sent them our W'2 and still they could not verify our income. Bank of America does not want to help anyone modify there loans.

I would like to thank BoA in the years I have been a customer they have provided me with superior products and good rates, I guess that is what you get when you pay on time everytime. It is amazing how good a company can be when you live up to deal and expectations you agreed to. I guess your word and honor is a one way street.

Bank of America heartless asset manager - robin ritter setaro

First off, I just want to say i'm homeless because of the heartless acts of robin ritter setaro, an asset manager at bank of america. As we all know, bofa can care less about people and their families and here's the proof. As a first time buyer, I have very limited savings to purchase my first home. I had an offer accepted on a house owned by bank of america, an reo property. The first problem was the property did not appraise for what bank of american listed for. Of course, they are greedy and wanted more money than what the actual values were in that neighborhood. The appraisal was also done by bofa, none the less, this asset manager, who couldn't actually sell real estate her self in the real world, who's dre license is not listed with a real estate broker, but on hold: http://www2. Dre. Ca.Gov/publicasp/pplinfo. Asp?License_id=[protected], set the price and regardless of the appraised value, wanted her made up dollar amount. After a month of going back and forth and after upper management finally approved the lower appraised value, we moved forward to closing. As we were about to close another issue came up, this time permit issues. Long story short, this asset manager, robin ritter setaro, who enjoys her off time relaxing by her swimming pool with her family and dog; trips to disneyland and the beach, enjoys her life on the backs of people who have lost their homes, because of asset managers like her don't care if someone needs to live in a house, felt it was necessary to not move forward, without our offer, unless my husband and I forfeit our $5, 000 deposit and sign it over to her as a penalty. I'm sure this is not legal, is it? Anyway, though we were suppose to close months ago, we had to move out of our apartment, where we lived for 11 years and moved in with my inlaws. It's truly amazing how these asset managers could care less. They only care about the numbers on the paper and not the actual people that wants what she has, a part of the american dream, a place to raise their family. Now I don't know what i'm going to do. I'm sure she sleeps just fine. As long as her christmas lights are on her house, life is fine. For years bofa has made money on this house and the difference for them pulling out on us and leaving us homeless was just a few thousand dollars. I guess robin ritter setaro felt she was making and saving bank of america money by not letting anyone live in this house, which has been vacant for over 1 year. Does anyone know a good real estate lawyer you could refer me to? I need to personally sue robin ritter setaro. It's amazing the incompetent people that bofa hires. They truly hire some heartless individuals. If you ever get robin ritter setaro as your asset manager, I would ask for someone else. Please help me if you can. Thank you very much. Bank of America b of a implementation of the make home affordable program

This is my 4th attempt at getting a mortgage modification from B of A. First they screw and said I did not qualify because I was not behind in mortgage payments. I got behind and the threatened to foreclose and reported me to the credit bureau destroying my not that good credit rating. I no longer have a 401K because I used the money to get my mortgage current. I have gone through an home assistance program but B of A rejected them and said I had to go through them, Bank of America. I sent Bank of America all they asked for TWICE. I just received a letter saying I did not qualify because my housing expense was not over 31% of my gross income. My housing expense is 31% of my net and the expense report I submitted clearly show I do not have money for gas or food after I pay my mortgage let alone support a grandchild I am raising. Bank of America apparently does not want to apply the program in the spirit that our President intended. How do I complain? How do I and consumers apply pressure to Bank of America to do right by their customers? At my wits end. I want to lodge a formal complaint against Bank of America. I got denied 3 times by B of A as they claimmed that I never sent them the paperwork when I actually did. It took 9 months and the help of an HUD agent (I recommend them they are free) to finally get the Home Made Affordable mod approved. It was a constant fight, I had to prove them wrong; saved all paperwork received and submitted and certified all of my mail. Even when I got the HMA modification letter, the bank would still call and send letters saying that I will get foreclosed in ___ days if I didn't pay x amount in ___days. I blew up and told them "How dare you send me a letter telling me you are taking my home away, when in my hand I have a letter saying I got approved for a mod? This is not right, you can't play with peoples life like this" their reply was "The HMA department does not update us immediately on the status of your applic, therefore our records show that you are not current, blah blah." My anxiety level during that time was insane, I didn't know whether they modification was actually true or not because they kepted harassing me. I couldn't believe how unorganized and how much of a bullies these banks are. My advise is to speak to a HUD agent or go through NACA, they offer same day modifications if you visit their Save the Dream tour (check site below to see if they are visiting your city.) I know ppl who have gotten their loan modification resolved through NACA, my advise is to go the first day of the tour to get a number. When they call you to return, return but expect to wait around for 24 hours (if you ask me, it's worth it!)

This is absoluteley correct. WE have been struggling as construction business owners and have tried for a year to get help from them. They wouldn't do anything at all as long as we were current, but now that we have exhausted all of our savings, and our much worse off, they have actually filed for foreclosure when we were only a month and a little bit behind. I had been sending them payments in as much as we could to try and get caught up, and found out they were not appying my payments. Even though their REPS who would incessantly call me, said "send in what you can to show good faith" So now that they filed the foreclosure, they won't accept ANY payments, further forcing us to fall behind. We have pleaded to them regarding our situation, we have 6 children who we are trying not to disrupt their lives by losing our home, but they just don't care. IT is partially the Governments fault for setting it up where these banks make more money foreclosing on our homes, thatn by working with us. Way to go OBAMA! LEts make the banks richer and leave millions of families without homes.

You are so right about bank of America. They are liars. The government helped them so that they could help us, but all you get is lies and foreclosures. They really should be investigated for their practices, and made to be accountable to the homeowners that they have hurt.

Bank of America will not release insurance money

Bank of America has taken our Insurance check for damages in the April & May 2011 storms & applied it to our loan payment so one story goes. Another person with BoA says it's in an escrow account, while yet another person says they don't have a clue what I am talking about. The check is $6356. 23 and it is for severe water damage inside the house as well as replacing the roof. We cannot find a company local that will deal with Bank of America & do the repairs we need up front with the "promise" from Bank of America that they will pay the contractors. We are in bankruptcy & BoA is keeping our check according to one person because we are more than 60 days in arrears. I thought we were protected by bankruptcy laws as long as we followed proper procedures. I am writing anyone and everyone about this situation. My loan agreement states that I must keep the house in proper order & all repairs kept up. I cannot do that if the insurance check is being held hostage. I might add that there is mold starting to grow from the water damage and we are having additional damages due to rains since the original claim was made. It appears to me that Bank of America is yet again at fault & not following procedures. Can someone please help me?

Since when does the doorman decide who gets service and who does not. The doorman at this BoA office should be fired immediatley. He would not let me talk to a bank manager because I was an American. Being a foreigner in another country, I did not want to be thought of as causing a problem so I did not make a big deal about it. I thought I was a valued BOA customer and could recieve service at any branch, I guess not. Today I'm calling up there to get things straightened out and hopefully get that doorman put out on the street for good.

Bank of America poor customer service

Bank of America VISA sends out "special offer" checks monthly for balance transfers. I received some in the mail and chose the 0% interest until Sept. 2012, with a service fee of 4%. I wrote one check and it went through with no problems. When I called them to transfer funds to Travelers Insurance to pay my home insurance, they took the info and mailed the check. Travelers changed their mailing address for payments after sending out the bills, so the check was returned to Bank of America VISA. It's hard to believe Travelers would change addresses for receiving payments without giving a forwarding address. VISA sent a letter claiming they tried to contact me (meanwhile I get emails from them all the time) to let me know the address was incorrect. I physically took a check to my insurance agent and paid my homeowners insurance. Today I got a letter from B of A VISA saying I was charged a $35 returned check fee and they had denied the check for being STALE - and it was a replacement check for the one that would have taken another 2 weeks to send back to Travelers. After 4 account managers, I finally was told even if they had sent the same check out themselves, the promotion was from last month so they wouldn't have honored it anyway. What kind of BS is that? If I lose my homeowners due to all the screwups (and no notification from Bank of America), then they can call my home loan due and I lose my house. MAKE SURE YOU READ THE FINE PRINT and don't trust Bank of America's VISA card. It took me 4 account managers to update my phone contact info...DO NOT USE THEIR CREDIT CARD CHECKS! And do not do balance transfers through them over the phone - unless you don't care if your bills are paid or not.

Bank of America charging fees to non customers to cash their own checks

Wow! What an ordeal!I have to warn 'everyone' out there about this Bank of America. I've heard a lot of bad things about them but now I actually experienced how criminal they really are with people. I received a local check through the mail that was from a small job I did and figured I would walk into Bank of America to cash it because I wanted the cash and it was a small amount of money and drawn on 'their bank'. So they wanted 2 forms of ID which is normal...along with my finger-print. I gave them my driver's license and credit card which was a Wells Fargo Credit Card. They saw that I bank with them from the debit card I had also. The first thing I was told to do was to open a BofA account by the manager of the bank inwhich the bank teller called over. (I did not know that they were this desperate for customers), but now I know why. After...and only after I did everything they requested, they said that I would have to be charged $5.00 for this check, which was $40.00. I could not believe this because they made me go through this whole thing and then said that because I'm not a customer (which I initially told them...which is why they wanted my ID, etc), they sprung this fee thing on me.

Bank of America modification process

This BofA mortgage issue started with my inability to pay the property taxes on our house because of severe reduction in wages, I DO take FULL responsibility for the problem but sorting through the solution is the challenging part - (our taxes and insurance were not impounded in an escrow account due to lack of funds on orig. purchase date in 1999 – we have a decent loan at 5.87 fixed APR over 30 years so it was not a ‘bad’ loan problem) and I had missed 3 tax payments as of Jan 2010– I had approached the County of Riverside CA property tax people who indicated that until the 5 year point nothing happens from the state concerning the property – as long as we can be current before the 5 year point then there should be no issues – at this time our mortgage was with Countrywide –
shortly after Bank of America took over Countrywide mortgages we got notified of the following:
Feb 2010, BofA paid a $4988 Riverside county tax bill
March 2010 – got a letter from BofA saying they paid additional house taxes for this past year as well – now all caught up – also they will be paying our insurance as well (their policy, if they pay taxes then they pay insurance also – doesn’t matter that we are completely caught up on insurance…)
March-June: various phone conversation with BofA CR reps concerning payments/options/etc (in April we got loan mod paperwork which was sent back (docs package complete) in late June)
May 2010 – escrow account was reviewed and house payment adjusted – old payment (P&I only) was $2123, new payment with all escrows included and amortized over 7 months (to be clean by year end) is now $3944
June – did not complete new $3944 payment (paid normal $2123 plus paid $1K more attempt but could not swing the $1800 addition to the payment)
Called July 19 – “BofA received mod docs on 7/14 – processing, check back in 30 days”
I was told “we suggest you keep paying what you can during the review process” so I never changed the auto house payment of $2123 from Union bank account
Called Aug 18 – “assigned to underwriting 8/2 but not yet assigned to underwriter, once assigned to underwriter will take 30-45 days, check back in 30 days”
Called Sep 8 – “you can’t be in two programs at once so payment plan set up in June is cancelling due to non-payment, your account shows escalating to ‘trial modification’ (3 month program) – should be assigned to underwriter this week, call back in two weeks”
Called Sep 16 9:46am – “still with underwriting, continue making payments as you are (best you can), your account is now in ‘pre-foreclosure ‘ so you will get a certified letter every 30 days, each time we accept a payment it starts again so your new foreclosure start date is Oct 16”
Called Oct 14 11:04am – “as of 10/13 assigned to underwriter, Dec 13th is expiration on processing (60 days)”
Got a ‘certified letter’ from BAC – announcing “intent to accelerate” loan – meaning foreclosure ‘officially’ started
Oct 21 got a new RMA package from BofA from FedEx – completed and sent back Oct 22
Oct 22nd, got a second ‘new’ RMA package from FedEx – exactly the same as the one from the 21st but different return address – also completed and sent back Oct 26
Called Nov 10 11:26am – “Active review status, no updates at this time, no estimated time frame at this time, check back in two weeks”
Got a call on my cell Nov 29 (from 805/000-0000) – “need a copy of a utility bill faxed a.s.a.p. for loan mod then your loan goes to underwriting for approval”
Faxed water bill on Nov 30 at 8:00am
Called Dec 7 11:15am – “you are in pre-foreclosure status, I show we need a recent util. bill, two months bank statements, two months’ pay stubs or unemployment docs, & 2009 tax returns – note, requesting this program does not guarantee acceptance, if you are not accepted foreclosure has already been started, fax docs to Shatina Allison, 800/658-0395 – her direct# is [protected] Ext 13406”
Left Shatina a VM message Dec 7, 11:35am leaving my cell# asking for a return call.
Got a return call from Shatina Dec 7th 6 pm, water bill will not work – need gas, cable, electric or phone bill
Faxed cable & gas bill on Dec 8th
Dec 13th – Shatina called to request pay stubs/new RMA doc and hardship letter, once received she can send the account to an underwriter – she followed this call up with an email confirming what she needs
Dec 14th – filled out all docs, scanned and emailed to Shatina
Dec 20 8:39am – left voice mail for Shatina
Dec 12 8:41am – talked to Status Dept – no other documents needed at this time – your account is under review – no ETA at this time but it is being processed
Dec 30 3:04pm – talked to Status Dept – account has been forwarded to underwriter Brian Eaton, the last time it shows review activity was 12/24 and this person suggested I also talk to the collection people @ [protected]
Dec 30 3:30pm – talked to Collection Dept – as per them the ‘Notice of Intent to Accelerate’ expired on Oct 16th, loan went into ‘Foreclosure’ status on Nov 8th but no sale date currently listed – payoff to bring the loan current is $10, 509 and payment is now $3455.59 – she cannot give me the underwriters number or email but if needed she can have him email me – he has the ability to stop a sale date if he believes he will be able to process the modification.
Jan 5th 11am, called Status Dept – still in progress, no additional docs needed – once underwriting review is complete hey will contact me
Jan 5th 11:12am, called Collection Dept – verifying amount to bring loan current – “10509 is not correct” more like $3455 x 4 but she will mail me a letter for the 401K people indicating exact amount needed – loan is in foreclosure status but no sale date is listed
Jan 18th 9:16am, called status dept Alexandra, no updates, no docs needed please give it some more time and check back regularly – I asked if a sale date was shown on the account she said ‘not at this time’ –
I then asked a payment question and she said she would have to transfer me to the retention dept, after transfer the next person verified my account info then said my account was being handled by a different dept, she gave me a different number, transferred me then I got cut off – redialed the 800/669-6650 #... got routed back to the status dept, the status person suggested I not put in my account# when asked but just push 0 otherwise I will always come back to status – I tried but by not putting in my account # the system would not forward my call and disconnected my call, I called back & this time inputted my account # - back to status dept… this time the status person could & did help;
Verified: $8561.80 in negative escrow, $13, 965.21 total due including late fees, new payment of $3455.59 includes neg escrow amount, P&I = $2123.63 + new escrow amount once - sale date of Mar 15th just posted… on Mar 1st or 2nd the status dept can request the sale date be delayed if it gets to that point…
If I bring the account up to date using 401k funds then the modification process and foreclosure process both stop…

Jan 25th – called status dept 12:11pm, the gal I spoke to says “ I show we need two months bank statements for your file” – when I inquired about when this was posted to the account she could not tell me (I talked to status dept on 1/18 and no mention of this) and when I asked if anyone was going to contact me to let me know she said “I only take inbound calls” so I asked if there was an outbound call center and she said yes, but she did not know where they were, she only knows her job and that is to take calls 

Jan 25th 12:31 faxed Nov 2010. Dec 2010. Jan 2011 (3 months) bank statements to 888/258-7329
Jan 27th – Status check – talked to Ryan – the bank statement request still ‘open’ but likely being processed if you sent them – takes a few days – no further updates – I asked him to verify the sale date since I had gotten none, then Mar 15th, then Mar 12th in the past – he reviewed three different areas and confirmed no sale date listed anywhere on the account – no notes saying removed sale date but he stated he would not expect any notes to that effect unless it had been formally requested – he doubled checked and shows no sale date at this time
Jan 31, received a FedEx at home from BofA (enclosed letter dated Jan 28th) requesting ‘most recently completed federal tax return’ -
Feb 1st -faxed in all copies at 11:00am, called for status check at 11:24am and was told ‘just waiting for underwriter’ no further documents needed at this time
Feb 9th – I called and stated I am checking status of the modification - “I show your account is in foreclosure at this time, how may I help you?” I show you are 5 payments behind at this point, why are you behind? I am checking status… “Please hold”
She came back and said the account says “we are waiting for some financial docs to be completed by you” I inquired as to what docs because I have been sending stuff every week – she put me on hold while she reviewed the account then came back and told me she was contacting the ‘vendor’ who was in charge of my account – please hold (total hold time approx. 19 minutes)
She came back and said – the reason the tax docs are still ‘pending’ is the copy I faxed previously were not signed – please sign and re-fax a.s.a.p.
Feb 10th 10:10am – refaxed 2010 tax returns with signature (I had ‘re-printed my taxes from TurboTax and yes, they were not signed)
Feb 12th 9:30am – status check call – now I need to fax the following as soon as possible;
2 of my latest pay stubs, a signed IRS form 4506-T (avail on IRS.gov), and a current RMA form page 2

Feb 14th 8am, faxed all of the above forms to [protected] as requested
Feb 21th 9:30am – status check – still in review – I need to download a ‘Dodd Frank Certificate’ and fax it to [protected] & [protected]
There is a sale date on the account of 3/15 and I need to call 14 days prior to request a postponement
Feb 21st 6:05pm, got a call on my cell from Valarie Gonzalez, 888/325-6430 Ext 48866… she is now assigned to my mod and needs Pay stubs, 4506-T IRS form, & 2 months bank statements faxed asap to 866/631-2857 so she can get it to underwriting and postpose the sale date – she works in Simi Valley and is in from 3pm to 11pm PST if I need to contact her
Feb 22nd faxed all docs requested (pay stubs, 4506-T & 2 months bank statements) at 7:20am, (also faxed the Dodd/Frank doc to her & to the number requesting it), I called Valarie at 3:30pm and she stated she had received all the docs requested and had forwarded them to underwriting @ [protected] – I will have to check back in a few weeks, I reminded her that our sale date was in a few weeks so she said maybe check back in a few days – Friday 2/25 would be good, so I called the number immediately and was told underwriting has all the docs they need – call back on Mar 2nd to postpone the sale date
Feb 26th – called for status update – as of 2/24 loan is out of underwriting and with QC – QC has up to 30 days to process but usually much quicker – they will contact you and start a 90 day trial mod – just continue checking in regularly for more info – you will be contacted by the QC people at the conclusion and receive a FedEx package with a trial mod agreement to fill out
Feb 26th, called cust service @ [protected] EXT 808196 to ask about amount to ‘catch up’ loan, and how that amount added up… $17, 228 + Feb payment is behind, current payment is $3455.59 – there is a $8561 neg escrow account that is bumping your payment up – ‘normal’ payment would be $2648 with P&I + tax and ins ($2123 P&I) – so after approx.. $20, 000 (inc late fees and Feb) and the $8K neg escrow I can call cust svc and request loan/escrow be reviewed which he can do on the spot to adjust the payment back to normal
Feb 28th 11:20am – status check – with QC, check back in a couple a days, you can request a sale date postponement on Mar 1st
Mar 1st – reached Daniel at 7:29 (status dept) - he said no additional info needed, MaryAnn is the underwriter assigned to the account at this time, he can request a postponement today since it is 14 days away from sale but it is not guaranteed – your account is with QC at this time – he submitted the sale date postponement email to underwriting (“it should go through since your loan is in QC but don’t quote me on that”) but he could not forward me a copy of the email – just check back in a few days
Mar 1st – 7:42am called BofA office of the CEO [protected]) and asked for a manager to discuss my loan mod
Jason Phipps handled the call at this point – he said he could see the request being filed – he created a file so he could link it to our account and be notified as soon as it was processed – he took my cell and said he would call on Thurs. or Fri (the underwriter & investor have 48-72 hours to address the postponement request) he said that a loan in QC should not have a problem getting a postponement approved – usually a 30 day postponement is the norm – he has only seen 2 or 3 disapproved and they were because of multiple loan mods denials and re-requests – yours should be fine at this point
Mar 2nd, 12:30pm – called status dept, no further docs needed, no change to sale date at this time – 1st thing they post is a note confirming request for postponement and that is not yet on the account
Mar 3rd 7:40am, called status dept, no further docs needed, no change in sale date at this time – still 3/15
Mar 3rd, 4:42pm, called status dept – Desiree said I need to speak to the negotiation dept at this point – my loan has been assigned a negotiator - #800/669-2443 ext #2773 & she transferred me - #2773 was not in so I got forwarded to the next avail. agent – Matt – he stated my loan had been assigned a negotiator on 3/2 & his name is Luke Mai. He is not in so let me try his supervisor Sabina Murshedi, she is on the phone and we tried holding for 8-10 min but still on the phone – Matt took my cell and emailed Luke to call me in the morning – Matt cannot see the sale date listed at this time although he said there is some date of 3/5 listed but that can’t be right – must be a mistake – he said a loan at this stage is pretty much approved and no sale date should be assigned – but QC sometimes takes up to 30 days to review
Mar 4th: called negotiation dept 800/669-2443 ext 2773 8:20am – was told my account is assigned to Luke Mai, let me try his extension… he is not it would you like him to call you back – I left my cell#, sale date of 3/15 is still posted to the account
Mar 4th 9:16am, got a call from Luke Mai, as of the 24th your loan is out of underwriting and assigned to me. I work with the investor team and the QC analyst to get the mod finalized. Your mod is a ‘Making Homes Affordable’ mod which is a US Gov. backed program. If for some reason you do not qualify for a MHA mod then I will work to get an internal mod processed.
I asked him about the sale date and he was submitting for a postponement today – I told him I did this on Monday and he said that is fine, he will follow up with a request of his own – we should know by mid-week next week.

I told her I have it in my hand dated 3/10 shipped overnight – she put me on hold for 5 min and came back with the letter – she reviewed my gross income and expenses – reviewed the house expenses and she concurred that with the house, the second & HOA fees we have a payment of $3803 which is 40.8% & that as a percent of gross income is more than the min of 31% - she is filing an appeal letter in the morning and will re-contact me on Tues the 22nd – I discussed the need for a reinstatement letter in case we need it as a backup plan – she reviewed the account and currently shows $20861 due in back payments & $8561 in neg escrow – she needs to research to see if the neg escrow can be included in the reinstatement amount – she will process a.s.a.p. but at the very least will update me on 2/22

April 12th 8:12am, left Sabina (714/577-1791) a VM – checking on status
April 12th 11.10am, got a return call from Marlene Estrada – advising that ‘Making Home Affordable’ appeal had been denied due to income to house payment debit ratio being less than 31% (the minimum) when Sabina and I had done the math and came up with 40.3 % which is why we submitted the appeal – Marlene is requesting actual figures used since all they had listed was an income (gross) of $9271 and ‘after not considering the HOA fees’ (which according to the MHA docs they are supposed to consider) the percentage is less than 31% - she will see if she can process something ‘in house’ and request further info from MHA and she will contact me next week
April 15th – got a FedEx letter from Marlene with a blank ‘Making Homes Affordable’ RMA form, a blank ‘Personal Budget’ worksheet, and a request (again…) for two pay stubs, two recent bank statements, a letter of explanation, a recent utility bill, a list of expenses and HOA proof…
April 19th – 9:02am – LM for Marlene
April 19th - 9:49am – Marlene called back – no new info – she has not heard any explanation from MHA as far as how their math shows less the 31% - we reviewed the numbers again and she is understanding but is NOT a mover / shaker by any stretch – she will attempt to re-contact the MHA people for further explanation and/or details – sale date is still 5/16 but she can request another extension
April 21st 8:38am – called Customer Service dept to get reinstatement figures – got a fax for reinstatement totaling $28, 836 but this does not include escrow – then transferred to escrow (800/669-6607) who told me neg escrow is currently $10, 958 and she will fax a statement but this figure cannot be included in reinstatement letter (even though it was included last time… Mar 22nd)
April 25th – 8:31am - Called cust serv. to attempt to get a reinstatement figure/letter including the neg. escrow amount of $10, 958.29 – cust serv could not help me and transferred me to the foreclosure dept – held for 2 min then call dropped
April 25th – 8:40am – called collection dept to ask the same as above – automatically forwarded to modification dept – modification dept can only ask for a reinstatement letter, they cannot include the neg. escrow amount – she said the escrow people may be able to do that – she transferred me to escrow dept – the escrow people say they can only send me an escrow printout – they have nothing to do with foreclosure...

April 25th – 8:55am – faxed 401K Hardship Withdrawal application paperwork – called to verify that it had been received – 5 days to process check, they will overnight it to me, I talked to my local Wells Fargo branch (where I have an account… and my 401K is with Wells Fargo Retirement Services) and they will not put a hold on it so for a small fee I can overnight ‘certified funds’ to the BofA people and be DONE!

April 26th (ok, decided maybe not done… I will try a call or two to the MHA people on a contact phone number listed on the decline letter) 8:15am – called 888/325-5399 – which turns out is actually BofA modification dept – talked to Claudia who while reviewing my account the phone call dropped?... called back and got Jasmine who reviewed the information & we discussed the denial letter stating that we were less than the 31% min so did not qualify when in fact the math (using their numbers as stated in the letter) and said that she can see the orig. appeal which was approved on April 1st (due to housing cost equaling 37%) but then denied on April 7th but no reason indicated
April 27th 7:50pm, called modification number (same as above) and spoke to Matt, Matt said he can see the MHA appeal was submitted on the 26th and no update yet, try back on Friday – sale date of 5/16 and we can submit for a sale date extension 14 days prior so 5/2 we want to request that extension.
April 29th, 7:38pm - Called modification number again – no update at this time I should try back on Monday May 2nd
May 2nd 4:07pm, called Larry @ modification assistance (888/325-5399) – no update on the appeal notated at this time on the account – it still shows we are reviewing other in-house bank modification options for you – BofA is experiencing some computer software issues in our appeals area so this could be affecting your appeal – I would check back on Thursday or Friday
May 3rd 9:25am called Marlene for status check on appeal from MHA – someone picked up but nobody there – faint voices in background – redialed: talked to Marlene, she has not heard back from MHA concerning explanation of the denial – she is re-escalating the MHA request and submitting for an extension on the sale date (it is obvious that the notes she is reviewing have noting in them concerning the appeal that the cust svc people submitted for me last Mon/Tues – they must have multiple files for me)
May 3rd 1:38pm called ‘modification assistance’ one more time (Marlene, with all her good intentions, sounds like she is ‘out to lunch’…. so I wanted a second opinion) – this gal I got was pretty spot on but said the following:
A) They (BofA) now have a “sale date extension team” & their job is to automatically process sale date extension requests on behalf of the homeowners if the account appears to warrant it – the downside is that the extensions cannot be manually processed until within 3 days (just to catch cases that slipped though)
B) My account shows that I had already talked to Marlene today and she was escalating the appeal concerns – multiple people submitting for these will complicate and slow down the process
C) She said that the appeal will probably take a few more days to process
D) She also confirmed that the reinstatement amount expires on 5/5 and if the check shows up after that it would likely be returned because it would be a few dollars short which would not be good – and she confirmed that the reinstatement amount of $28, 836 includes the neg. escrow amount (it includes 8 payments of $3455 of which approx. $1200 is escrow monies) so after paying that $28K amount our escrow account would have a few hundred left negative.. which would be ‘normal’
E) Lastly she suggested NOT waiting til’ 5/4 to overnight the reinstatement amount just in case – she suggested today would be way better to send it so… I had a ‘cashier’s check’ cut to BofA and overnighted (UPS #XXXXXXXXXXXXXXXX) to the BofA address indicated on the reinstatement fax (shipped on 5/3 to LA BAC address - )

Done – one year after starting this process……. and sadly, I still have no answer why MHA denied me (see March 11th above) based on the fact that the math indicating why we were denied (in the denial letter no less) did NOT equal the amount that would have given them cause to deny – whatever … done – paid my $30, 000 from 401K retirement in order to keep the house – the “Making Homes Affordable” program is NOT user friendly, BofA is out of control on stringing people along through this process – I take full responsibility for getting us into this mess but… I really feel for people without the resources to be able to fix the problem themselves because it seems virtually impossible to rely on ANY government program as it applies to housing/loan assistance if you put the bank in as a middleman….

May 4th, 10:47am: Got confirmation email from UPS that over-night letter was received at BAC office and signed for by Aldaz – I will follow up in a few hours to verify it is being processed
May 4th 1:54pm – no update, call back tomorrow and the check should have been processed
May 5th 10:12 am - check has not posted, I was advised to call the bank that issued the check to see if it had been cashed (Wells Fargo) – so I did and the check had not yet been cashed – I called BofA back and this person said it takes at least 48 hours to process but will be stamped with the proper arrival date “don’t worry”
May 5th 1:18pm – no update ‘sir, it takes a while to process the back payments and credit the check to the right accounts’…. So during this ‘processing’ nobody notes the account that the check has been received? ‘no they do not’ - nice
May 5th 4:12p, – no update, check still not posted, spoke to Tiffney [protected] ext 8502) who seemed sort-of knowledgeable and concerned & she said she would continue checking on the account and notify me as soon as the payment posts – she actually left me a VM at 6:59pm (end of her shift) to say the payment had not yet posted
May 6th 10:42am – Tiffney called to say that the check did post to the account this morning and it would take approx.. 48 hours to process and clear the account – she said the escrow account review will happen automatically and my new payment with P&I and escrow should be $2600.37 and will be due June 1st
May 7th – 9:44am – called cust svc line of 800/669-6607 – anything I ask for on the automated attendant says ‘I am sorry I cannot help you let me get you someone who can help’ – then after a 2 min hold I get dropped – this happened 4 times before I switched to 866/422-5871who then told me the payment had not yet been processed – call back on Mon or Tues
May 9th 11:07am, called cust service 866/767-4104: payment not yet fully processed, account is still with negotiator Marlene but when asked about the approx... $8500 paid and not credited to the account (Oct, Nov Dec & Jan payments of $2124 totaling $8496 – paid after foreclosure started and posted to a ‘partial’ or ‘holding’ account) she asked that an account history be faxed to me – she also said I can get account history info on-line but when I went on-line the account is still in the ‘information blocked due to non-payment’ mode so I cannot access it – once I have the history I can follow-up with ‘payment research’ dept [protected]) – then she transferred call to foreclosure dept – I left VM message for Marlene
May 10th 9:36am – Marlene called to say the account now shows ‘0’ so that means everything has been processed and will no longer be assigned to her – she is still looking into the MHA decline and has escalated the question twice – she will still call me if she gets an answer – otherwise my contact should be cust. service @ 866/767-4104 – Marlene says she show payment should be P&I of $2123.63 with escrow amount of $1331.97 but I can request a review from the cust svc people now that the account is caught up. Marlene also said the sale date is one off the account at this time.
May 10th 9:51am – called cust svc 866/767-4104 and they told me my account was assigned to a different dept and transferred me – this person looked into my account and said my account is assigned to Raquel at Fannie Mai 877/430-3404 and I should talk to them – I called Fannie Mai and she said my account shows assigned to a negotiator Marlene and I should contact here – I expressed concern that this was my 4th person to talk to today and Marlene had already said she was not my contact – Raquel took down all my info and emailed her supervisor to try to sort this out – I should be getting a call within 24 hours from her supervisor. –
May 10th 10:41am – called trustee sale hotline 800/281-8219 for TS# [protected] – sale date is May 16th at 10:00am and now has an opening bid listed at $221, 500….
May 10th 10:45am – called Marlene back at 877/430-1431 ext 14117, left VM message concerning sale date info and multiple rerouting of any calls I make to the cust svc dept.
May 10th 10:51am – called cust service at 800/669-6607, Laquenita cannot help me but will get me to someone who can…. 7 min hold…. Got April on the line from Tennessee who knew her stuff… finally…. - she says reinstatement could take as long as 60 days to get completely sorted out as far as payment postings, etc. – she shows no sale date listed on the account at this time – she suggests that I fax in an ‘op-out’ letter to 800/520-5019 so the mod process will stop and my on-line access will be reestablished – the account is coded in a way that blocks some applications within BofA.
She transferred me to Janna from MHA decline dept – Janna reviewed the account info and the decline info - $3455.59 house payment with P&I&escrow with gross income of $9316.22 = 37.1% ? she did not understand it and transferred me to a supervisor
Next I got Craig (MHA supervisor) who did the math and agreed – we have an issue here – he is resubmitting to the review team & will contact me on Friday the 13th to advise – note: Craig is in a ‘call out only’ office so I cannot contact him – I gave him my cell # so I had no chance of missing him
Friday came and went…….. no contact
Thurs May 19th…. No contact
Tues May 25th… still no contact
Tuesday May 25th, 11:22am, called cust service to inquire about my payment amount & date – on Sat I received my first mortgage bill from BofA in 5 months or so – it states payment is $3455.59 but I had been told since reinstatement check included all the neg. escrow the payment would change to $2600.37 (see May 6th.. above) - cust service can’t help me because my account is assigned to the cust assistance team – let me transfer you…. Cust assistance team said my account is assigned to negotiator Marlene so she is the only one who can discuss the loan with me – I said the last time I spoke to Marlene she stated she was no longer assigned to my loan sine the reinstatement check had been processed. He said he could not help but he could email her and her boss to contact me immediately – whatever…
Tuesday May 25th, 11:48am, called cust service back and told them not to transfer me to cust assistance or to Marlene – just tell me what my payment is please – she said it looks to be $2687.44. I said my bill indicated differently and she said cust assistance or Marlene would be the only ones to tell me exactly what the payment is…. And she suggested I pay what is on the bill 
Tuesday May 25 2:44pm, Marlene called; she has no idea what my payment is – she can reach out to escrow and call me back on Wed. to give me an exact number
Never heard from Marlene…..
Thursday June 8th, called customer service to verify payment amount and was told I need to speak to Marlene for info on this account – I explained that Marlene 1st does not have a clue what my payment is and 2nd, she won’t call me back- after a 5 min hold I was told my payment is $2687.44 - so I paid $2700 via Union Bank electronically sent on 6/8 (payment is due on the 1st and late on the 16th)
Tuesday June 14th, got a FedEx letter from BofA modification dept denying my appeal for the Making Homes Affordable program dated June 13th? – I called customer service to verify payment was received and posted to my account properly, the gal I got on the phone cannot talk to to me about my account – I have to speak to my negotiator – who she says someone named Sara (I have lost count but approx.. my 5th negotiator during this process… 2 of which, including Sara, I have never heard of or from…) so she sends Sara an IM but Sara does not respond so all she can do is email Sara and have Sara call me – what is my best contact number?... this is almost funny…. So I kinda go off on this poor gal saying I just want to know 1) did my payment post to the account and 2) what is the exact $$ amount of my monthly payment and 3) how can I get these BofA MHA denial letters to stop?
She somehow looks up the account and says my payment is $3455.59 (per the ‘payment coupon’ screen) and she shows my $2700 payment being received on the 13th but it has posted to a ‘partial payment’ account pending receipt of the other $755.59 (which is due by the 16th or late charges will apply…. Nice!) – she transfers me to her supervisor Adam: Adam verifies her $$ information and says I really should have gotten a payment coupon cause he can see it in the system – he has no idea why anyone would have told me $2687.44 because the payment is clearly $3455.59, my escrow account was reviewed on May 16th following the reinstatement – the escrow changed the payment to $2688 but not til’ July 1, the June payment is still the $3455.59 figure so I am behind by the $755.59 amount – he will also forward an email to MHA to stop sending FedEx denial letters if possible.
Wed. June 15th 2:45pm, I called Cust Svc to pay the $755.59 via debit card – I explained to the gal that my payment was a little messed up due to confusion on BofA’s part concerning my payment amount – so I had paid $2700 but apparently was a bit short – she pulled up the account and she said yes a bit short but only by $58.97 – my payment for June was $2758.97 and I paid $2700 so yes it was in a partial account but waiting for the $58… I asked her to double check since I have gotten many different versions of the payment and she stated that she always looks on the ‘back’ escrow screen which is the real info – she said the front screen on BofA’s software shows $3455.59 and the coupon page shows $3455.59 but the escrow screen (what she calls the ‘real’ screen) shows $2758.97 for June, $2687.70 for July – the payment, as per her info, will continue to decrease slightly each month for 9 months and then should stabilize at $2679.51 (there is a small neg escrow being paid off for 9 months)…
She did say she will take the $755 payment if I would like but $58 is all that is required – I did not have a check with me (they cannot do a debit card transaction) and I still have Thursday to pay so I will call back in the morning with a routing # and ac# to make the $58.97 payment

Thur. June 16th 11:53am - Called cust svc (800/669-6607) – 1st gal could not view notes on my account (she was in collections despite me calling cust svc? So she transferred me to cust svc – they can see more info on the account from their end…) – direct cust svc# 866/767-4104 is the number she recommends for cust svc – she will transfer me…
I then got Tamera… gave her my loan # and soc sec# - she is not one of the quick ones sadly… loan # took three tries and last 4 of my soc. Took two tries… then she wanted to transfer me to ‘someone who can help’ but I told not to transfer me – I just want to pay $58.97 to my account via the phone… she put me on hold to get the ‘partial payment’ status released…
So Tamera came back on the line after 20 min… my June payment has now been released from ‘partial payment’ status and I don’t owe anything more for June 2011. My new payment inc P&I and escrow is $2679.83 and she will send a July payment coupon out right now- she can be reached at 800/669-6607 ext 9406 and she apologizes for the confusion – not every rep knows where to look for the payment info… so I passed on my concern that over the past 30 days I have spoken to 6 or so different people all of whom had different payments listed for me ranging from $3455 to her which was the lowest – she assured me that June was paid and no late charges would be applied for June and she assured me that Julys payment was in fact $2679.83… we will see…

Bank of America loan modification error

Last year I asked Bank of America for a loan modification for my house that locates at 4706 harwich street Orlando FL.32808. On June 12 2010 I received a letter from Bank of America that my loan modification was approved signed the paper notarize and return before June 25 2010. I notarized and returned all document to Bank of America. According to Bank of America my modification starts on August 1 2010 amount of $804.33. Ever since I have been paying that amount to Bank of America. Last December I called Bank of America because they keep sending me the same amount of payment that Iused to pay prior to my loan modification. I was told not to worry is because they did enter my amoun of modification yet it will be changed a soon as the information enter in the system. Ihave been calling for almost a year about the same issue. Lastmonth I went to refinance my car I was told that Bank of America send me to credit bureau because I have not pay my mortgage. I called bank of America and speak to different opeopl but I didtalk to a supervisor Bradly at ext 8608 he told me that he will take care of the issues and then let me know. When I heard nothing from him and I called him he stated that " they are working on it. That was 4 months ago. theis the number that I have for the Bank. [protected] my account [protected]. I don't know what to do and I don't have enough money to hire a lawyer therefore I come to you Todd to help me out if you can Your regard will be appreciated.

I don't want to sue them...but I was really upset, as stated in letter. Like Rodney Dangerfilde, all I want is a little respect...I always liked BAC... this crap pushed me over the edge.

Thank you for your comments, however they were acting against the law- companies are not allowed to constantly call you day in and day out 2-3 times a day. If their procedures can't consider the customer...what kind of company is that? Furthermore, this is a new practice because I've had a loan with them for many years and have always paid at the same time. Now suddenly they started calling like crazy. I will move my loan and I suggest this to the others being harassed. I did do a search on the web for complaints when this started, and I found others with the same problem; after years of business with BAC and paying at the same time...suddenly these calls have started. This is how it goes: payment due on 1st with 15 day grace period. After grace period, payment is considered late and fees apply. OK. Now I always make payment within grace period, and did this month too! But now after years of paying in grace period, they've started this new stuff? I am disabled and don't sleep well at night. During the day sometimes I can catch a cat nap...but BAC put a stop to this with their abusive calling practices. Check the laws.. this does fall under PHONE HARASSMENT by bill collectors. Law regarding debt collection:

What Collectors Must Not Do: debt collectors also are obligated to refrain from any type of harassment, abuse, or deliberate misleading of debtors.

The following types of harassment / abuse are illegal:
Calling a debtor or his or her family repeatedly with the intent to annoy or irritate.
..There it is...per State Law. Thank you.

Bank of America Home Loans

First of all I am never late on my payments I pay on the 15th of every month. Bank of America gives you a grace period of up to the 16th of every month for your mortgage payments. This year 2013 whenever the 2nd of each month comes and they see that we have not made any payments yet they start calling. They will start calling at 8 AM in the morning waking my baby up and as soon as they get someone on the line they will ask for the last 4 digits of my social security. They will call everyday many times throughout the day up to the 15th when I finally pay, my hubby’s salary is bi-weekly so we have to wait for the first paycheck to put together the mortgage.

On the weekends since they figured out that more family members are at home they call more often, starting at 8AM, waking up my baby and just one Saturday morning alone we received 7 calls. Not counting the hang ups when the machine answers the call. And this is purely harassment especially when I am not even late on my payment not even once for the past 6 years.

Two weeks out of every month my baby wakes up from constant ringing of the phone, I work but my Mom helps me with the baby so she lets the machine pick up the calls. The calls startle my baby and he becomes stressed out and would cry for a long period each time. The call also starts arguments from my husband because he is thinking I probably did not pay the mortgage on time and I become defensive because of all my frustration.

I have repeatedly explained my situation with Bank of America representative and yet nothing was done. I numerously asked them to notate the account regarding my situations but the calls still keeps on coming. I have dealt with representatives who are rude, others sympathetic but the calls still keep on coming. There was one representative who assured me that the calls will stop only to get more calls. They all say the same thing that there is nothing they can do for me. I’ve asked for supervisor and yet not one ever called me back.

Bank of America is harassing me, making my life miserable. The situation is ridiculous because I am not even late on any payments and yet they torture my whole family 2 weeks out of every month. I have gone online and saw blogs from people with the same frustration and experience from Bank of America. I think it’s time we fight back and let them pay for what they are doing. A class action lawsuit for millions of dollars is always the solution to fight off big companies that harass their customers.

Bank of America does the same thing to me. If you don't pay exactly on the 1st of the month... they start to robo call you 8-16 times a day until you do ... and then they will continue after you do as their process requires them to then confirm your ID and that you still occupy the property.

I have NO problem paying my mortgage... but like any smart consumer ... I will delay for the entire grace period to let my money earn interest for me as long as I can. I KNOW BofA does the same with their own money management.

Anyway... I filed a complaint with the FTC using the governments website:

This is a complaint that follows one we are filing with Federal LE. We are senior citizens in Sacramento and for the last EIGHT months have been harassed by (1) Bank of America (2) Call Centers for Bank of America (3) Titanium Solutions o/b/o Bank of America and (4) others acting on behalf of Bank of America, who REFUSE to identify their organizations.

They (BofA, Call Centers, Titanium) call our landline private phone number, asking for a KIRK SIKLIN or Thicklin (sic). They refuse to spell the last name, hang up on us when we ask for the correct spelling.

They (all numbers listed below) have refused to remove our phone number from their call list, claiming they don't have it. When we ask how did they call us, they claim it is a robocall. We were given the number to a Bank of America rep, who refused to remove our phone number, without getting other private information.

When we actually do take these harassing phone calls in person, we are asked our name, telephone number and address. We refuse to give this to them, as this is private, they tell us they won't stop calling us until they get our private information.

We believe they are part of an identity fraud/mortgage scam/loan fraud/short sale scam scheme that goes way beyond what the Feds are bearing down on BofA. We believe they are trying to scam financial information of people who have intact financial backgrounds.

We have received over TWO THOUSAND phone calls, robocalls, and others from BofA/Titanium/other repro short sale intermediaries for BofA between March 2012 todate:

This week, they have passed our phone number to KRAFT REAL ESTATE phone number [protected].

The KRAFT employee (female)who left two messages indicated she was an agent for Kraft, and was working on a LOAN MODIFICATION for KIRK SICKLIN or THICKLIN.

We spoke to her today, and asked how how she got our phone number which is unlisted, that we are not KIRK SICKLIN. She said she got it from a Kraft RE sheet she was working off.

She said she would note this is not the correct number and we told her (because this has gone to Federal LE) she needs to do better than note it, to call the head of Kraft RE, since they will now be involved.

We had told her Kraft RE has a good reputation in Sacramento and would hate to see them drawn into an investigation and she needed to talk to the head of Kraft RE.

She then stated she never indicated this was for Kraft, she was working with TITANIUM SOLUTIONS. She repeated she was not working for Kraft. (Her caller ID indicate Kraft RE.)We admonished her calls were monitored, she had left voicemails indicating such, including the deadline for the loan mod was today, and so we told her we can prove she was lying. She then hung up on us.

This is more than just phone harassment, this is part of a bigger mortgage loan/short sale scam.

We have, and have had nothing to do with Bank of America, we have no contracts with Bank of America or any of their affiliates, legal entities or associates or vendors or subcontractors, because they are always in the media, discovered to be disreputable, shady, criminal-minded scamsters.

Our private phone number has been private for YEARS, until we gave it out to do a lot of volunteer work PRO BONO with (omitted) in Sacramento - around the same time this Bank of America phone nightmare began.

RESOLUTION:
We would like to seek financial damages from BofA, we want Titanium added to the investigations into BofA, and would like a judge to order them to pay $1, 000 per harassing phone call.

Fortunately, I actualy did have the loan peole fax me an exception, so I have that in my possesion, plus the names of all the collectors that have called. TGhat coupled with the fact that my loan has NEVER been late, gives me one hell of a good position.

I too have been getting phone calls every day saying my payment is late when that is not the case. True, I only paid principle and interest, but I had a tax bill due and got BAC's permission to withhold the impound. Since then they have called every single day. My wife is upset, and I made the 4th phone call today and spoke to the 6th person. I finally got upset enough to tell them, after being informed that the calls will persisit until the impound is paid, that it is harassment and I want it stopped or I will seek a law suit. I don't think the collections department understands they are tromping on rights. They will when they get civil suit papers.

Bank of America short sale decline

This is the letter I received from my real estate agent after 3months of working on our short sale:
I finally was able to speak with the negotiator regarding the investor's decline of the short sale. She received the same information that you and I did regarding the reason for the denial. She did, however, look through the information that she had from the investor's file notes and communicated the following to me:
The sale price of the home was a good price set (she said the BPO came in at $175K and the offer of $180K was fair and right in the ballpark).
Because of your high FICO scores and the lack of default on your mortgage the investor may have declined the short sale because of apparent availability to pay. (Even though your hardship was thoroughly explained by you in your letter, and by myself and the negotiator in our communications to the investor.)
Because the investor is asking for more of a contribution, I asked what is it that they want?! The negotiator said that with the short sale the loss to the investor would be approximately $149K. She said that typically they want to recoup 10% of the loss. To satisfy this it would mean approximately a $15K contribution on your part. She said that since they are asking for the contribution this would be more readily considered if this were a cash contribution rather than part in a promissory note. We were not given a counter-offer, so other than that information she could not tell me what amount the investor is looking for.
This is the negotiator's interpretation of the file and her best evaluation of the situation. Because Bank of America does not own the loan and Freddie Mac does, her position is merely an information processor/communicator and not a decision maker. Therefore, she and Bank of America have limited knowledge of the information regarding the decision.
In addition, because the file was declined and a counter offer was not presented, the file has been closed and the short sale would have to be re-initiated in order to continue. I know you are about fed up with this system and I understand if you are not willing to pursue, but if you did choose to continue, the negotiator assures me that since our initial submitting of the short sale their process has improved and stricter deadlines have been implemented so it would go quicker.
Because the file has been closed, the negotiator we have been working with can not do much for us any longer, other than supplying the information that she shared with me today. Called to get information why I do not qualify for the HAMP loan modification
Barbara said my Loan Modification was declined
I asked Why? What specific reason or reasons?
Barbara said I should receive a letter that will tell me the reasons.
I told Barbara I received a letter this morning and it did not give a specific reason or reasons.
She said “if you would look at the bottom of the letter it says they were unable to create an affordable payment equal to 31% of my income”
I asked what figures were used by the underwriter for my income
She said “it says you have zero income”
I asked her why would it say I have no income?
She asked if I provided all the documents showing my income. I told her I submitted bank statements, tax returns, profit & loss statements. I submitted all the documents that were required.
I asked her to check in my files to see if she can see any documents relating to income, reluctantly she looks.
Barbara said she can see in my files the 2 profit and loss statements, my bank statements and tax returns.
I said ok, now you just asked if I submitted those documents and you can see them in my files, why would the underwriter say I have no income?
I told her this does not make sense.
I asked her for the underwriters name, she said she cannot give me that information.
I asked who can I talk to regarding this issue.
She said I can fax all documents again relating to my income and once that is received they can file an appeal.
Or I can start over and apply for the HAMP modification again.
To make sure I was understanding what she was telling me I said “ I need to start all over again and resubmit the 50 plus pages to them again”
She said that is correct. I said you just told me you can see the information in my files and yet I must resubmit everything all over again.
She said there is no guarantee that I would get the modification if I appeal or re-apply for the program
Barbara confirmed again that she does see the profit & loss statements that are through 3/31/11, bank statements from November 2010 through March 2011, tax returns for 2009 & 2010.
I will need to resubmit all of them again. But they need to be more up to date.
After they receive the “current” information they can file for an appeal.
Barbara would not give me any names or numbers of anyone at Bank of America that I could talk to regarding my application.

Bank of America definitely needs their feet held to the fire, in order to get a loan modification completed. We have been handling cases v. Bank of America for many years. They rotate all loan modification requests throughout their massive collection departments. They will take advantage of you if you represent yourself. However, they also realize that they are bench marked for 125 million dollars in legal fees moving into 2012. You must level the playing field with Bank of America in order to avoid the "Loan Mod Runaround". Applied pressure through imminent BK or litigation are the only methods that work with B of A. We are in the same boat. Told to call HUD which we did and turned all paperwork into to counselor who told us they have a direct portal to the bank. A month later, no word on where it stands and we can't get any answers from either BofA or loan counselors. BofA shows nothing in their files and counselors are not returning our calls. We are now 2 months behind and not sure where to go from here. I hope things work out for you, and us.

Bank of America what a bunch of crooks

I am writing to empathize with all who have posted here before me about the ridiculous amount of money that BofA charges for overdraft fees and how they go about racking up fees to prey on those customers that sometimes 'forget'. We are are human and sometimes 'forgetting' just happens. I have never seen such abusive tactics by a bank in all of my adult life! My worst experience with overdraft fees was last summer when I had mistakenly gone over my limit on my balance with my debit card. Again . . . it was a mistake! I was unaware that i had overdrafted and had made a series of small purchases over a 5 day period before I caught my mistake. I had purchased about $180 during that 5 days in everyday purchases for things like a cup of coffee, lunch, small purchase at hardware store, gas, etc. All in all there were 27 transactions in that 5 day period. Well it was much to my shock when I checked my online account and had saw that I was charged $945 in overdraft fees for spending $180! I realize that we are all responsible for our own account balances but as I mentioned . . . it was a mistake! You can tell by my small purchases that it was not intentional! Why would I intentionally buy a $2.00 cup of coffee knowing that I would get slammed for $35 as an overdraft fee!? I wouldn't . . . because it was a mistake! I immediately went to my B of A branch and explained what had occurred. They gave me the typical canned answer that there was nothing that they could do about . . . and they were really sorry . . and that they truly value my business! What a load of crap! Well I got stuck paying all of those fees and it felt like I was robbed by my own bank! Tell me how that is just and reasonable! I have since opened a new account with a different bank that doesn't allow your debit card to ever go into an overdraft status. They just simply decline you. How easy is that!? I'll take a 'decline' for a cup of coffee any day as opposed to an 'overdraft'! What a bunch of crooks!
