The Bank of America is making new headway in the area of ripping off its' customers. Not only do they purposely clear and post deposits and withdrawals in a manner to overdraw your account they do it in a fashion to specifically charge the most in fee. This has happened to me on several occasions where if given a timeline it would have been fine but using their method cost me hundreds. On top of this when closing the account they took a check that had cleared and bounced it. This left my account open causing chaos to my bill pay. What is crazy is they let me close the account with the amount of the check in it but then said that the money left hadn't cleared yet. It makes no sense how they come to that conclusion but they were able to get 35 last dollars out of me. Please consider other banks as this is one of a hundreds horror stories I have heard about them.

Fixed Rate Option at Bank of America unilaterally breached
in Home Equity Line, without notice.

The Equity Maximizer loan is a Bank of Am. line of credit with a variable rate which can be converted to fixed rate at any time
(supposedly). That is the marketing. That is the disclosure form explanation. These provisions are in the loan contract.

Exception? Any time your line of credit is in "suspension". Can BOA suspend at any time it wishes? Legally, NO. Does BOA
suspend transactions on Equity Line accounts in order to deny the consumer the Fixed Rate Option in order to lock them in on a variable rate + interest only repayment plan - YES. Do consumers have a right to refuse payment? YES. This is a breach of contract by Bank of America. On the other hand, if BOA can refuse the fixed rate option whenever it decides to "suspend" an account, then the consumer does not have the contract provided right to Fix the Rate AT ANY TIME as marketed by BOA account reps. This is misrepresentation, which can lead to the contract being found void under applicable State Law in the jurisdiction in which your home is or loan was taken out.

Bank of America blocked my line of credit without notifying me. They claim they sent a letter and that it was due to devaluation of my home. I do not trust BOA. They post payments incorrectly and customer service is not too good.

I have a similar experience with BoA. It started in Dec. I had an automatic debit for my mortgage and the bank did not credit my account with my direct deposit on time(I noticed this on the last day of Nov. and called BoA; the person who answered told me to cancel the automatic payment and pay it manually after the deposit cleared. I did that and then the bank paid it again, overdrawing my account. The bank then refused to help me get the money back, saying it was my fault, even though I did what they told me to do. I had similar experiences in Jan. and Feb. Two days ago, they changed the times some of my debits to my account (including some already paid) so they could charge me overdraft fees. They said that I hadn't made a deposit in time, even though the debit (which still hasn't been paid-still hasn't been presented to the bank) came in the same day as the deposit. Their policy is as long as credits exceed debits at 5 pm, you are okay. I have been with them for many years-more than 15, maybe 20- but I'm done now.

Oh yeah. I'm hearing the same tune! I had BOA for years with no problems, then in one years, I ended up paying them HUNDREDS of dollars because of their "changes in policy".

Holding direct deposits, changing things that have been cleared and paid days before to unpaid and then bouncing them, changing cleared deposits to uncleared so that more debits will bounce...

Oh yeah, I've heard this song before. I changed banks a couple of years ago. I got tired of being robbed by BOA.

At least the worst my current bank does is clear everything as it comes in. If I make a debit at 5:00 and a deposti at 5:15, the debit will go through first and vice versa.

Two lessons learned: DON'T TRUST BANK OF AMERICA and make sure you have the funds available before making the purchase!

Well, I certainly feel as though I've been robbed.
I am a single mom living check to check but have managed to survive this drowning economy with my head above the water...at least until now. I have no idea what I'm going to do at this point.
I had always paid my rent and two bills owed via bill pay. They had always sent checks out. In recent months, bill pays to one company kept processing a few days ahead of time and the funds were not there so they charged me an overdraft fee. They were kind enough to reverse the fees (happened 3 times), since they said "we mail checks and they should not be allowed to cash them until the date on the check" which was the date I requested on the bill pays.

My last direct deposit was not as much as I thought it would be so I quickly tried to cancel my rent check...but it had already been sent. I called my landlord and explained the situation and she agreed to hold onto the check until the rest of the funds could be made available. In the mean time, I had processed a couple of small payments...credit card payments, some food, and i rented a movie.
Imagine my shock and surprise when my card was declined at the grocery store for a $6.00 charge. I thought...omg, my landlord cashed the check...and sure enough the funds were gone from my acct when i checked. But my landlord says "no i have it right here". I call the bank and am told "We changed our policies and are sending cashier checks now".

Did they think of notifying us? The man on the phone says "We dont have to"

5 piddly little charges that were made all end up with overdraft fees of $35 each...all of which would have been covered had they not suddenly done 'cashier's checks' without warning...or if they would have put the smaller piddly charges through first instead of last. I am told if i get the 'cashier check' back from my landlord and redeposit it, then they will discuss reversing my fees.
I get the check back and surprise, NOWHERE on the check does it say 'cashiers check". But oh well, whatever. I take it to the bank manager as I am told and he tells me that I should take the time to read my statements...which i dont get mind you, since they encourage online banking and such. But that's ok...i get that, my fault...whatever... but I am returning it and would like to get at least some of those charges reversed.
The manager says he refused to reverse any of them because i had already had a few reversals! OMG !!! they were reversed because the bank sent out checks that cashed earlier then the date on the check!!! IT WAS THEIR FAULT and yet he refuses to reverse any of my fees because I'd already had the 'courtesy' of reversing the fees in the past! I could not believe it. I kept trying to tell him that those fees were reversed due to bank errors but he wouldnt even LOOK at the computer to see what I was saying was true. Needless to say, I closed my account.

To make matters worse, out of all the piddly little charges they decided to return the very one that would cost me the most money. A credit card payment...which has now cost me 125 dollars in fees for being returned.

How is a single mother who lives paycheck to paycheck ever going to overcome this? Thanks to bank of america I am now out $400 in fees and late charges...$400 is like, 45 dollars less than what i made on today's TWO WEEK paycheck!

And to make matters worse, I had just gotten preapproval to buy a home...nothing fancy, but enough for my family to live comfortably. Thanks to this, I've been declined. I wont be able to be approved for another 5 years. Bank of america cost me $400 in fees, cost me my house...my dream! That can never be repaid. And if something doesnt happen to fall in my lap, they'll cost me the roof over my head.

Please...unless you are filthy rich, stay away from bank of america. They do not care about their customers and they change their policies so often that it causes so many problems to so many people. They charge overdrafts for PENDING charges that havent even posted to your account yet. So if some company out there accidentally types in the wrong amount (100.00 if the . is forgotten easily becomes 10000.00) and you dont have it in your account...you're charged an overdraft fee, even though that amount will never actuall post. I pray that no one else has to suffer what they've inflicted upon me.

I posted about three months ago about my experience with BoA. I just want to update. After my previous post, I went in to the branch in Braemar Village Plaza, Bristow, Va. I asked to speak to the manager and after a minute, I was shown to her office. I explained what I wanted, and after she looked up my account, she started smiling and said that the bank would never take back the charges. After a little more back and forth, I said that I was going to take the bank to small claims court. She said to go ahead and started laughing(apparently she likes to take advantage of her customers). Then she started screaming to get out of her office.
Today I got a letter from BoA saying that if I didn't give them money within 30 days, they would close my account and report me to ChexSystems(the pet credit-reporting agency for the banking industry) as being "unsatisfactory handling" of my account. The letter also said that the bank would refer my account to a collection agency. I called and once again explained why I didn't owe the bank anything(in fact, the bank owes me money). The "customer service representative" said there was nothing he could do, and when I asked to speak to his supervisor, he hung up on me.
Maybe they are upset that congress has banned what they are doing now(when congress passed the morgage bill, they included a provision that says banks can only charge late fees when there is not enough money in the account when the check/debit is presented, not when it is done). This is going to cost the bank more than the amount in my account($39) no matter what happens when we go to court. Oh, well, guess this is why they lost so much money in the morgage business-no business sense.
I'll post again after we go to court.

I want you to know that you should pay attention to the Bank of America and its derogatory treatment of disabled customers that recieve Social Security Benefits. You may also want to know that they are fleecing college students' into "free checking" accounts offering unsecured lines of credit of which their customer service department has negligent training and predatory practices, upto and including chicanery by branch managers' and employees', ignoring their customers' not following the FDCPA and laws concerning the regulation of collections.

Disabled Amereicans' and college students' should not be singeled out by this bank. I have lost all faith in commerical banks' because of the way Kenneth Lewis treats customers'. Its like the, "bear sh*t in the buckwheat!"
Harrasement is inexcuseable by any average citizen why should Kenneth Lewis and his staff be excused?

Bank of America is the worst bank ever. It should be called "FEE OF AMERICA". You get fees for everything. I called to stop an automatic payment and they charge me $45 dollars ...Also my CASH deposits have been held bank for 2 business days making my account over draft. After complaning to themt hat the cash deposit is available thay day they tell me they can withhold anything they wish to. WORST CUSTOMER SERVICE...
