Class action lawsuit against aspen dental forming
Within the first 3 days of posting the notice alerting consumers about the formation of a class action lawsuit against aspen dental, there has been an overwhelming response from angry patients wishing to participate in this action.
To answer the question posed by many frustrated patients – yes, aspen has designed its patient service department to effectively diffuse your isolated complaints; this is why you will never successfully receive any justice from aspen dental when presented as an individual complaint. But, aspen cannot evade and will be held accountable to the thousands of angry patients who are collectively unified under this large and comprehensive class action lawsuit.
With the high volume of feedback and interest in participating in this class action lawsuit, we are requesting that in your email you identify your complaint as being in one of the three following categories:
1. Dental malpractice – in which you have been physically injured by their dental “care. ”
2. Consumer fraud – includes cases in which office personnel of aspen dental used high pressure sales tactics designed to take your money with false promises of providing competent dental health care.
3. Combination of malpractice and consumer fraud.

As a new patient, a reasonable person would not expect aspen dental to take unfair advantage of a dental problem – after all, they are considered to be a healthcare facility; however, when you sit down with the office manager to discuss your dental treatment plan it becomes clear that your money, not your health, is aspen's primary objective. The job of the aspen office manager is to force you into accepting the most costly and extensive dental work possible. This is termed “conversion” and is against the law.
To respond to another frequently asked question - yes, aspen dental rewards its employees with financial bonus incentives for exceeding monthly production goals. This bonus system is based upon aspen's internal use of “metrics” which pressures each office to compete against other aspen offices. Unfortunately, since aspen’s management team is composed of individuals whose background is in “consumer retail” – not in healthcare - they operate the dental care facility as a retail business in which you are not viewed as a patient - instead, you are simply a paying customer. Aspen dental’s motto is: “to create a happy, paying patient. ” but, unfortunately once you pay, you quickly discover that you are not happy.
This class action lawsuit will effectively make aspen dental accountable for their acts through the unified and coherent voice of thousands of patients who have been wrongfully injured by aspen dental.

I definitely need someone to contact me also please! Too much to type out everything, & too many pictures also, of their failed care & quality, not to mention the medical problems Im still having from their botched medical procedures & lack of qualified medical personnel to do IVs and other procedures.

I have emailed them over 20 some emails I have left messages I have been calling every week I have documented everything taken so many pictures and I'm still getting put off and my and my time limit I know exactly what they're doing trying to run it out past the time so they don't have to give me my refund. They made the worst dentures ever for me they do not fit they hurt I cannot speak properly I choke I use over a tube of adhesives in less than a week my face is deformed and all I want them to do is either return my money or make me a new set of dentures that actually fit and work that I can actually chew with.

Please can somebody help us with all this?

I want in on this lawsuit , I went in and only had 8 teeth to pull and wanted a set of dentures , i was charged $9,000 . this was ridiculous. and my immediate dentures would not even stay in my mouth

I've attached photos of the dentures I left with. The first Three photos are my previous partial denture size and shape vs. Aspen FUD made over six weeks of appointments. The last picture is my previous FLD (the larger of the Two arches) vs. what is supposed to be a Comfilyte FLD, however the gum thickness is very inconsistent and thicker than my previous basic FLD.

In my opinion, the dentist is inexperienced which is refected in the amount of appointment I've had, the amount of time that has elapsed, and the fit of the dentures at this point. I'm malnourished and well below my BMI weight, I need dentures now! For the reasons stated, I'm requesting I be granted your money back guarantee so I can return to my previous dentist, who can make and seat my dentures this week.

I'm writing a reply to my own comment to add that the complaint above is only part of my complaints to Aspen dental. Aspen advertises their full denture for a lower price online, and in my case they added a throw away codes, FUD 5988, and FLD 5988, stating it was an upgrade, to add over $1000 to make invoice. Last, they granted me their Money Back Guarantee, so I returned the dentures and signed the Money Back Guarantee. Aspen gave me a refund for my upfront payment, sent a claim reversal to my insurance, but weeks afterwards they refiled the claim. I went to a dentist and paid out of pocket to get new dentures the same morning I returned the Aspen denture. That was in November 2023, I knew my insurance would reimburse me once the Aspen reversal was completed. Today is January 8, 2023, and I'm left waiting for Aspen to reverse the second bogas claim, in order to get my refund. The new dentist I went to fitted and made my new dentures in 3 days, and they are beautiful, fit perfectly, and cost a fraction of what Aspen charges.

I have had all of this happen to me ! I went for Snap on Dentures in May 2022 I had an exam and X-rays with the Dentist and came up with a treatment plan then I met with financing they told me it was $15,067 my portion $8,676 . So I paid my portion and had my teeth extracted about a week later then I had to wait months to get back in for fittings and it was at a fitting and the Dentist was on vacation so the Hygienist was doing the fitting I asked her when do they put the posts in for the Snap one ? She looked at her computer and said I didn't pay for that I said I paid my entire treatment plan before the work started. I asked to have the Dentist call me when she returns. She says with a chuckle that's not going to change anything! I thought to myself she is just a kid the Dentist and I went over this so I wasn't worried. So she didn't call me I made an appt and she comes in looking all sad saying Donna I am so sorry I am so sorry I said ok fix it she said sorry there is nothing more I can do for you! She is standing right in front of me denying me care I said are you going to finish the dentures in my mouth no I am sorry there is nothing more I can do for you! I thought I was being pranked but nope a Healthcare provider denied my care

Here’s another big lawsuit they are committing insurance fraud at my local office one of the new receptionist printed off my data and gave it to me in office, which showed my balance and the codes they used to bill each service to insurance. When I spoke to CIGNA they bill them for services and codes that were completely different. My CIGNA paperwork shows I am responsible for about $2000 and I’ve paid nearly 5000 upfront to Aspen dental insurance fraud is pretty big deal. I haven’t gotten my final set of dentures. I have an appointment and now I’m scared to go because I’m afraid they may hurt me.

I went to Aspen Dental back in February 2023 with a toothache. What I got instead was them telling me I need all my upper teeth pulled and to have a glamorous set of upper dentures because I supposedly had a severe case of paradontal disease. I was surprised but I fell for it because I was in pain. But this isn't even my biggest complaint. Aspen Dental had me sit with a managing financial person in their office while they filled and filed paperwork to get a third party load to pay for the deductibles from my insurance and cost of out of pocket expenses. Now that the procedure has been done I began getting billed when I sat in their office and signed over a third party loan. I keep calling their billing department and no one will answer. In fact, I can't even leave a message. The line just disconnects at their automated system. I try to talk to the dental clinic and they tell me they have no way to contact the billing department. I have called trying to talk to someone in billing for six months now while I get threatened with being placed into collections. This loan I agreed to in Aspen Dental Office was a Sham. They garenteed all expenses would be pain on the loan. I cannot find a single useful person at Aspen Dental to explain to me what they did with the loan I took out for this procedure. None of this nonsense makes any sense. I work in finance and billing. I will not deviate from those flaws in their billing department. I have combed through what they billed me and what they billed my insurance. The only sentiment that's clear in there billing is the loan with no records to itemize other than the amount itself. There's no records showing what they used the loan for. Aspen Dental can continue forward into collections because I will be filing in the class action lawsuit. As for the dentures, they keep dragging out the completions to waste my time because I'm not interested in their gimmicks. I would really like to find a dentist who cares about what I want done. When I ask Aspen to fix a cavity they'd rather throw in states of pardontal clean and leave a tooth to decay. Aspen gives people this sense of false advertising and skimming people for everything they have and then come back to collect more. I wouldn't recommend anyone from my experiences.

I was defrauded by Aspen Dental (Belton, Mo. Location). I paid $3800 for their "Budget Replacement dentures, advertised at $399 per plate) that were remade twice, never fit, hurt my jaw, was bloodied during the process 3 separate times by rough, non-fitting dentures were forced down onto my bare gums, new dentures turned out to be my temporary but was never offered my permanent, I had to dremel on dentures just to be able to wear them, no response from supposed "customer service", I want a refund but no one calls me back. Complaints are stashed away, and never resolved.

How can I join this suit?

It became very apparent to me today that Aspen Dental does not care about the patient. What they care about is selling you dentures. I needed my remaining bottom teeth extracted because of abscesses and a recent infection. Also a broken tooth and an exposed root nerve. I am unable to afford the dentures, but they insisted I need to have them for "support" and I wouldn't be able to eat. Which is malarkey, horse feathers! I know better than that. I've had dentures and didn't wear them because they make eating and drinking difficult. But that really is beside the point. Back at my first visit they had me talk to the financing agent there. She showed me how much it would all cost, the extractions and the dentures. I have a dental plan and they disregarded that and was going to charge me much more than I am entitled to pay through Cigna. I didn't pay for anything that day so I could go home and do my budget. I figured out I could afford the extractions but not the dentures. Well I found out from Cigna the extractions were only this amount and not the amount they wanted to charge me. So they did charge me correctly when I came in today. However, they pressure me about the dentures, both the dentist and the finance agent. She actually said, "how are you going to eat with no dentures?" She said it rather rudely. Like she cared and like I didn't know about dentures and eating. I got up and told her I won't be talked to like that and went on to explain to her about others like me who eat just fine without dentures. I need these teeth out of my head. I'm going out to the front now and get my money back. I still have my painful teeth in my mouth. My broken teeth and my exposed root nerve that I thought they'd be kind enough to remove. No, they wanted to guilt trip and pressure me into their dentures, which I already told them, twice today, that I can't afford them. They didn't give me a chance to tell them I'd consider it after the gums have heeled. Nor did they suggest it. No, they wanted to sell me a product I can't afford and I don't need. I am to wait 7-10 business days for my money. $540! I better see it sooner! Thank you for allowing me to vent. The dentist was sweet about pressuring me and the finance agent was nasty and rude.

I would like to join this lawsuit. I’ve spent thousands of dollars out of pocket when I shouldn’t have. The root canal I had done here, they admitted the infection was never cleared originally, so 6 months later I had to have a Retreat done for over 1600, on top of having to get a new crown. Aspen dental Misled me with high-pressure sales tactics in the office. Got me to spend and I’m scene amount of money. They billed my insurance out of net work vs in network and then refused to place the permanent crown in my mouth until I paid them the balance of over $700. This was a complete billing error on their mistake. My temporary crown fell out within a month and they refused to replace it with another temporary until I paid for their billing errors. I went 3-4 months with A sliver of a tooth in the front part of my mouth, It was incredibly embarrassing. It caused me to loose a ton of weight. I was in tremendous pain and very sensitive, In the office showed no care or concern. All they cared about was money.

How can I join this lawsuit. Aspen Dental has overcharged me for poor quality dentures that don't fit and break. I also purchased a warranty for the dentures and it has only been less then a year for my bottom plate and they refuse to honor the warranty and want to charge me $1,680 for a new bottom denture. Hiw can I join the class action lawsuit. I have fraudulent activity on my account. Aspen Dental has recently charged me for services my insurance covered. When I questioned them about my vanished credit on my account they immediately inconvenienced me by changing my appointment time making it appear that I was late and had to reschedule in which I didn't. I have the card given and email to verify my appointment time and they said corporate changed the appointment. When I talked to corporate the representative said they don't make or change appointments. This needs to be looked into. I'm sure I'm not the only one this has happened to.

I also would like to get involved in any class action lawsuit or any open lawsuit against Aspen Dental, I wanted all 4 of my wisdom teeth pulled they did sedation on me and charged me $1400, The morning I went in at 8am filled out a bunch of paperwork before called back, once I got seated in the back the arm pressure band was pinching my skin I asked the assistant to please re adjust the band and she said don't worry you wont feel it in a moment, little did I know I woke up to a bruised lines going across my arm. Its been 2 weeks and just a part of my bottom lip is still fat and numb! . I went back in last week for a check up because the swelling and numbness should have went away by now but she tried to tell me it was only a bruised nerve and that feeling will come back within 6 months like what the hell! However I don't believe her and I feel like I'm never going to get any feeling back in my lip. It wasn't until after I went back for my check up before the receptionist was like oh Yes they have been getting a lot of complaints lately , like now the hell you tell me so ridiculous .. How can I see if I am able to join this lawsuit? I got a treatment plan in August 2022 for new dentures, extractions, immediate dentures, and permanent dentures. Paid $5000.00 for the comfilyte package. They were very rude when extracting, I had got the valium as well to settle nerves. They gave me a total of 5 of them within the hr to put me out. The dentist went in to give shots, I remember only 4 shots and I was tensing up because the shots were in the front of gums, and the dentist told me very mean, I need to stop tensing up or I won't pull your teeth. Then I don't remember anything else, until 12 hrs later I woke up and to make a long story short, was over medicated, my immediate dentures fit at first, top only, would not remake or fix bottom pair, was told to put novacaine on my gums and toughen them up. 3 mos in, only got a soft relign on top immediate denture, still not wearing bottom, don't fit. Go for impressions for permanents, they take my soft relign out and never put back in. Ask them to do that, they tell me I have to make a separate appt for that, so I was mad and left the office with loose fitting top dentures. Next day call to make extra appt for soft relign when try in so block 2 hours for appt. Go in on tryin day, the dentures do not match my other teeth. I yell her to remake them, she gets attitude, and I ask about the soft relign I made appt for, she says we do not have appt for that. I was livid. Left, called later in day, cause I did not have receipts for everything with me, I asked to speak with office manager. They told me that she was with customer. She would call me back. So I called corporate, they got my info, opened a case and said that aspen facility will call you within 24-48 hours. Sure enough got a call, she asked what was wrong? I told her everything. She proceeded to read the notes from dental asst about my tryin appt and said "you told us that you will do a soft relign yourself." I said yes after you would not do one. They told me they only do 1 soft relign per package, I said your asst took it out after impressions! She just kept trying to justify herself. I told her I want my refund. She told me she can only give me 3200.00 and I have to bring in all the dentures I have. I said I paid for the immediates, she said that's the policy. So they will leave me without dentures. Ilthen she was begging me to just finish the tryin process, and if not happy we can talk about refund. I told her fine, I will because what I have to do now is find another dentist that can make me a good pair so I can return these and get money back. I am letting them think I will take the permanents, but throughput the whole process, I have never been treated with such disrespect. The employees there are not nice. Never have I ever been treated like this, they would not fix my immediate top denture, it does not.look like a regular denture. It has a big sticking out piece on the side of denture from my abcess I had, but once I healed, never remade it. Please look at videos and pictures. This is not right. Aspen Dental group is fraudulent & thieves. They owe us money. They billed Care Credit for the entire estimate before they even billed my insurance & refuse to get this straightened out. Keep giving us the runaround. Sent my husband to another aspen dental group who wanted to charge us even more money for his hygiene because they didn't have a hygienist at their site, so he only got one side done & they billed care credit for both sides, so they owe us for half of that charge too. This has been since last September & no refund yet. How can we get the $ that is owed to us?

How do I become part of this lawsuit? I went and had teeth removed and an immediate denture placed. With in the first week I was having issues with the denture being too big(due to how the impression was done) and went in a week ago because the Denture is way to wide and there is a 1/4” gap around the top that lets in anything I eat or drink. That is causing me to have to clean and reapply adhesive 3 or more times a day. The over use of the adhesive is starting to make me feel sick. My dentist knows this and my final denture was to be here tomorrow. But it’s not. He is at his other office 3 hrs away. The girl who answers the phone said they could have the denture at another office and hour away if I could drive there. I told her I couldn’t and asked why it isn’t being sent to my office. She said because there is not a dr here. (He is 3hrs away) and is normally here Monday- Weds. So now I am stuck with this top denture that is too big and the extra use of adhesive is making me sick. So they are not keeping to there satisfaction statement they have you listen too everytime you call! Even knowing that my situation is causing me to feel sick and them knowing what the health consequences are to swallowing excess adhesive they are in no hurry to help me and to correct the issue that actually was caused by the girls who did my first impressions wrong.

I went there in Houston on dacoma was told they took my insurance wanted my teeth replaced or repaired was told they finance filled out papers started process had all my teeth at the top pulled got. replacements went back got the bottom teeth pulled got two cleanings I don't know why was told I needed it when I went back the receptionist told me I had to pay 640 on that day I told her I didn't have was getting fitted for bottom teeth the manager came in looking mad and stood there while they was working on mouth when I was through she came and took me to her desk telling me I needed to pay my balance I told her nobody informed me of that before hand and to use my insurance very rude I have not went back and snap finance is already taking payments from my check twice a month on fixed income very disappointed

They wanted my tooth pulled out too saying if filling is not possibly done due to the location. however i left them and found another dentist elsewhere who saved my tooth and got the filling done.

Can anyone help me get in touch with the people filing this lawsuit? My initial visit was supposed the be $19. That's what aspen dental adveritsed and that is the price they charged me on my first bill. I recieved a new bill in the mail for a lot more then the $19. I called the office manager and dentist said they would not honor the original bill or the advertised price. I don't think they should be allowed to change the price after they perform the service and you pay them for it.

Would anyone be able to give me the email to contact them to get included in this lawsuit? They really did my mom wrong from her having the dental implants installed and it getting infected and them not prescribing her antibiotics til several calls. Her chin has pus oozing from it when poked.

I need to know how to get in on this because they royally screwed me. Not only did they not make the teeth correct but did not tell me that the payment plan I was put on was a damn credit card. It ended up being sent to collections which I paid off but it has screwed my credit more than you can imagine. It is the only bad thing on there but it dropped it from 698 to 530. The need to be held accountable.

I was not in pain until I went there, broke front teeth was embarrassed trying to get them fixed,I work overnights my appointment was at 7am at noon they came to me with proposed treatment I was so sleepy from being up 24 hours, the roped me into care credit 5 thousand dollars, billed my insurance for the wrong teeth, they did a crown that immediately fell off on a tooth insurance stated was missing or previously removed...please help I need my front teeth and they are demanding more money above the 5 thousand.

They want cash every visit. Hundreds of dollars

I'm sure I qualify for this as I've spent $10,000 for two tops and a partial bottom. I was charged for a cleaning that never happened. My dentures don't fit well and look at me funny when I say I have problems with them.

I'm still waiting for my compensation from a deep cleaning, I never needed. They're still telling people their teeth will fall out if they don't get it done. (When all they need is a regular cleaning.) I talked to the owner and she wouldn't even look at me. She stared straight down at the ground. Can't get more guilty than that.

Same. I am fuming about it at this point. I am so angry I trusted them and was put in a position like that and forced to take out a loan w/care credit to have it done. Feel like a fool for not questioning it and/or walking out. So so very angry.

How do I get my 70 year old father on this lawsuit? He went in to get 6 teeth pulled & they gave him a temporary bridge.

They were only going to charge him $600 out of pocket but he's now gotten statements from Aspen Dental & the medical credit card place they had him agree to for closer to $3,000. This is absurd as there isn't even an appointment made for getting his "permanent" bridge.

Please let me know what I need to do to get him on this?

The similar thing happened to me and they charged my insurance for dentures I never received and a debt collector is after me for over $3,000. I'm in Missouri but if you get answers please let me know

I was charged $1,997 for just upper dentures I paid $1,000 cash the first day the next time I went in I paid $250 then I paid $300 then I paid $200. When I went back in the balance they gave me was not the difference between $1,997 and the $1,750 I had paid they were missing the $300 payment I went to the car and got the receipt and gave it to the receptionist that had originally took the payment she took it back said she had to talk to the office manager came back and said it would be taken care of. The next time I called to make an appointment the 300 still had not been adjusted when I called to talk to the regional manager or the acting regional manager and I faxed a copy of all my receipts showing proof of payment and the $300 receipt showed somebody else's name on it they put it on somebody else's account this was on September 21st. I then received a letter through FedEx from Aspen Dental that I was a risk management. So I've paid $1,750 for dentures that don't fit because I still need a final lining and I still don't know if they've put the $300 on my account so apparently if they make a mistake and you complain you're a risk management and they will not complete the work.

wow , now that is fraud did they put the payment on someones bill they knew, i had 3 teeth pulled at once back 10 yrs ago when i had ins. but my payment out of pocket was over 1000, i had to go through care credit and after aweek of having the top dentures the front tooth broke off! i told them i wanted a new set as it never looked right never happened since then 3 teeth have come out so aggravating and now they tell me i need new dentures and charged me 185.00 for the tooth that came out last summer only to have it come out again i refused to pay them just to put the same tooth back in. i did pay the 185.00 but it happened 2 more times all within a year. I also gave they got 1500. from my ins. and billed me 1500.

I've been in pain ever since I went there to have a filling that fell out replaced and crowned. She drilled purposely close to the nerve (I had the old filling fall out several months before and decided maybe I should get a new filling and crown to save the tooth).

Prior to this I had no pain. In pain ever since. They really want that insurance money in every column and the full amount of the loan you're forced to take out. She did that purpose to force me into a root canal. I want to sue them badly; the pain has forced my blood pleasure up to dangerously high levels. Over two months now. I want to sue her and the company for this.

An ex-friend of mine was a dentist, he told me all his tricks to keep people coming back Does anyone know where to start a lawsuit at?

Had the last 6 teeth left in my mouth pulled by Aspen and had dentures put right in top and bottom. Went back in the next day and they took my dentures out to check out my mouth and adjust the dentures, dentist said there was a small chip of tooth left behind and would work it's way out itself, so took it at face value. Well that day things started to hurt so I took out my dentures and what I saw inside my mouth was a mess , it looked like big pieces of my gums where missing all the way to the to the top of the gums with what looks like pieces of sharp bone going the full length and multiple tooth chips left behind! Called Aspen and told them I can't put my new teeth in with out pain and they where floating in my mouth, so they got me in . Went my appointment the next day and the dentist looked in my mouth quickly and was insisting on put my dentures in, I refused and told them if they did I would not be able to eat at all with the dentures in or out, so they sent me home and told me to come back for my 3 week check-up (about 1 more week before I go back). Don't know what I can do and don't want to be left without teeth, please, please, I need help, what should be done?
