Abella Mayfair 90 sec wrinkle control client manager response

So, I was reading all the complaints about this product and their billing practices. I took the advise of one of the complainants and contacted them immediately to cancel and get a confirmation number. The client manager responded within 10 min of my email and I had a cancellation number immediately. I sent an email back thanking him but suggested that what he responded to me, could be part of the information that is contained in the packaging of the products.
"The products that you ordered are part of the AbellaMayFair Skin Care Products monthly subscription program. You received a 30 day supply of our AbellaMayFair 90 Second Rapid Wrinkle Control under the 14 day trial offer for $4.95 USD and AbellaMayFair Moisturizer under the 16 day trial offer for $4.95 USD for shipping and handling. You are given 14 days to notify us upon signing up for the trial, if you do not wish to continue with the program.

Within the trial period, a customer can opt out of the program and he/she just needs to return the remaining supply of the products for cancellation.

Any customers who chose to continue with the program, on the 14th day, you will be charged for the full cost of the initial bottles and every 30 days thereafter, be shipped another bottle of each product ordered for the same regular price. The prices are as follows:

Abella Mayfair billing practices

offer a free trial sample for shipping of $3.95 - suppose to be a Canadian co. but they charge the $3.95 in USA dollars (whatever the going rate is - today it was around $5 processed to my MasterCard). All looks fine and simple - until you find the list of complaints about the negative option billing. They start sending regular size without your consent, and put large charges through your Visa/Mastercard BEFORE you even receive the "free" trial. Thank you to all of you who took the time to post your experience here. I immediately called them and cancelled my order. Then I called MasterCard, who confirmed that the co. had pre-approved by MasterCard, but the cancellation was also showing a few minutes later. So if you have ordered the free trial, call Abella Mayfair and get a cancellation confirmation #, then call your Visa/Mastercard company and make sure the charge has been reversed.

Abella Mayfair negative option billing

Like every other story here regarding Abella Mayfair, mine begins with a one-time purchase of a wrinkle cream sample.

On November 13, 2016 i purchased a small tube of wrinkle cream online ($3.95 USD) from a Facebook ad for Abella Mayfair using my mobile device (cell phone). I was directed to an e-commerce site where no terms & conditions were given to me and no company website was visible. I never used any Abella Mayfair website to make this transaction and i definitely was not presented with any terms & conditions. I paid for the small tube of wrinkle cream and the transaction was ended immediately.

Three weeks later, the wrinkle cream arrived at my house and so did a moisturizing cream which i did not order. A charge to my card was made for $4.95 USD for this moisturizer.

On subsequent days, additional charges were made to my credit card:

These company names do not read as Abella Mayfair, but by association and by the email admissions of the Abella Mayfair "customer service reps" (i use quotes because they are not really caring about the service they give their customers unless it is theft) they are directly connected to the Abella Mayfair initial transaction i made for $3.95 USD. I tried to contact Abella Mayfair by telephone when i spotted these charges but i could not get through. I called several times on the days they claim to be operational but i was kept on hold for hours.

Abella Mayfair claims their business address in Ontario is p.o. box 500 North York, ON M3J 0J8 although i believe they may be operating out of South Carolina or even overseas in Asia...perhaps the Philippines. Also, they may certainly be associated with Tru Belleza and Lumanelle and possibly others too.

After contacting them by email and receiving a response, i was told i subscribed to a trial offer. I did not. I was told i agreed to their Terms & Conditions. I never did.

To date this still remains unresolved but my bank and Visa Canada and Visa International is now investigating.

I am not sure if this will help anyone, but please be aware that this practice that Abella Mayfair/Tru Belleza/Lumanelle (or whatever name they are using) have of charging your card after you make a purchase is called "Negative Option Billing." In Ontario, Canada, it is illegal and was banned back in 2005. It is also banned in a few states in the US. Does it still happen? Yes. Is it illegal? That depends.

Firstly, you cannot give your credit card or personal information expressly if you are presented with Terms & Conditions and then claim you were cheated or defrauded and expect and easy out. You need to show your credit card company a few things first. For example, here is a link to a Canadian government website that discusses Negative Option Billing:

Note some key things:

A) Consent for New Products or Services

3 (1) Before providing a person with a new primary financial or optional product or service, an institution must first obtain the person’s express consent to do so, either orally or in writing.

(2) If the consent is provided orally, the institution must provide the person without delay with confirmation in writing of their express consent for the new product or service.

(3) The use by the person of the new product or service, or any product or service related to the new product or service, does not constitute express consent for the purpose of subsection (1).

(4) Any communication from an institution seeking a person’s express consent must be made in language, and presented in a manner, that is clear, simple and not misleading.

B)Disclosure — Optional Products and Services
Manner and Content of Disclosure Statement

4 (1) Any disclosure statement that is required to be provided by an institution under these Regulations must be made in language, and presented in a manner, that is clear, simple and not misleading.

(2) Any disclosure statement that is sent by mail is considered to have been provided on the fifth business day after the postmark date.

5 (1) Before a person provides their express consent to receive an optional product or service from an institution, the institution must provide them, orally or in writing, with an initial disclosure statement that contains the information referred to in paragraphs 6(a) to (d) or a summary of that information.

(2) An institution that provides the initial disclosure statement orally must also, without delay, provide it in writing.

6 Unless it has previously disclosed in writing the information required under this section, an institution that enters into an agreement with a person for an optional product or service must, within 30 days after entering into the agreement, provide the person with a subsequent disclosure statement containing all relevant information about the product or service, including:

(a) a description of the product or service;

(b) the term of the agreement;

(c) the charges for the product or service or the method for determining the charges and an example to illustrate the method;

(d) the conditions under which the person may cancel the product or service;

(e) the date from which the product or service is available for use and, if different, from which charges apply; and

(f) the steps required to use the product or service.

7 Any disclosure statement made in relation to an optional product or service that is provided on an ongoing basis, other than one provided in relation to a credit agreement, must specify that the person may cancel the product or service by notifying the institution that it is to be cancelled, that the cancellation will be effective as of the last day of the billing cycle or 30 days after the notification is received, whichever is earlier, and that on receipt of the notice, the institution must, without delay, refund or credit the person with the amount of any charges paid by the person for any part of the product or service that is unused as of the day the cancellation takes effect, to be calculated in accordance with the formula set out in section 9.

Basically put, if a company does not present you with Terms & Conditions, does not obtain your consent to charge your credit card or to bill you, does not immediately send you confirmation in writing that you have signed up for a membership or subscription or program or contract, does not offer you the end date of the memb/sub/program, does not offer you even an option to opt out, does not remind you to refer to the terms & conditions, then you have no contract with them and their charges to your credit card are fraudulent.

My advice? Seek legal counseling. Know how to talk to your bank, know how to talk to your credit card company and encourage them to pursue these thieves. You are the ambassadors for your bank. You wield credit from them, it would be nice if they protected you instead of the thieves that illegally access that credit. Know what to say and what not to say so you don't look like you actually ever agreed to anything with the thieving companies. If you cannot remember if you were presented with terms & conditions, then you were NOT presented with terms & conditions.

What can you do as well? Write one nice concise blurb about your experience and save that document so you can cut and paste the information easily when filing a complaint.

1) File a complaint with the Better Business Bureau (Canada & USA)
2) File a complaint with the Federal Trade Commission (USA)
3) File a complaint with the Consumer Financial Protection Bureau (USA)
4) File a complaint with the Office of Consumer Affairs (Canada)
5) Speak to the CRA and the IRS about investigating these companies
6) Request from your bank the registered business name(s), registered business address(es) and names of the officers of the company(ies) so you can present them to your lawyer.
6) If your bank does not help you, you can file a formal complaint against them. Yes you can!
7) Contact your local authorities, police, etc.
8) Speak to your MP or political representative.

Abella Mayfair they say it is free and charge you 2 weeks later

This is a scam,

On november 20th, my internet provider (teksavvy) asked me to answered a survey in exchange of free stuff. I answered it and end up with a 260$ monthly subscription. Furthermore, the product they said was 0.00$, they charged it to me two weeks later (the full 260$). This is misrepresentation and it is not legal here. They partially refund me (half pf the amount). Moreover, they initially said I have 30 days to cancel and after they changed it to 14 days and I talked to a different person every email (I talked to at least 6 different person) which I had to explain all over again. I want all my money back and I want people to know to prevent this kind of scam.

Abella Mayfair free trial for canadian resident

This was a total disappointment. It is a scam and when you fall for it, they keep charging you for the products that you haven't even ordered. We didn't even get a notification for all the unwanted transactions from our credit card which makes it even worse because we lost so much money for so little value of products. Plus the products were not even worth the money and the skin care is not luxurious considering the price for it. They get your card info under the title of "shipping cost" and then they keep charging you. Whatever you do, just do not fill their info form for the "free trial".

Abella Mayfair unauthorized charges on my credit card

4 unauthorized charges on my credit card. I have been out of town my best friend is dying of cancer, my other friend was just operated for breast cancer, my father just finished cancer treatment and my other friend my not see next christmas. I'm on a small disability pension please refund my charge card. I can't take the stress.

I am also one of their victims. you need to call your bank and have your credit card cancelled, then have them send a new credit card to you. I also called Abella Mayfair and said I wanted a refund for the two creams I received, and that I would mail them back. They will not provide a full refund and will keep referring to the terms of use that I agreed to (We all did not agree to anything, its hidden in the small print). The only thing you can get back is $50 US refunded to your credit card, no matter how much you have already been billed. Good luck.

Abella Mayfair scam

I got a free sample. A small sample tube. A month later I got $99 charge on credit card that I used to pay for only shipping cost that they claimed. I called Customer service who told me that the charge is for the sample charge. The sample I only tried and did not like it. If feels thick on skin and I did not see the results the claim the product will offer. I told the representative that I do not like the product and want to ship it back, he said No, you cannot send it back, and offered $50 back. So this sample cream that does not work cost me $50 plus shipping. Beware people. Read more reviews from people ordered already so you do not go through what I went through. Also when you cancel the subscription make sure to get the cancellation number.

Abella Mayfair all products

A scam that is what it is they offer some samples and after a month they charge and overcharge until you get your statement and you see what you pay for. Each product comes in a separate box to make things more interesting.Without informing you they keep sending you the items. The products could be anywhere from a regular cream to a simple lotion fact is nothing works for anything.
They should be sued.

Abella Mayfair cream

I bought a product from this cite : that came in mi e mail or by Facebook. And it was quite clear that i had to pay for the transport on the 20 of Nov. They charged $5.33 for it on my card mc.
Then i had two payments one on the 2 of Nov. $157.66 and one the 20 Nov. At $137.81
I want to cancel the contract with them and don't find how or where.. Please help me to do so and send a complain for their way to make business...

Abella Mayfair free sample

Suite à un sondage de Bell Canada (invitation reçu de Bell Canada dans ma boîte courriel le 31 octobre 2016), j'ai reçu une offre d'échantillons gratuits en ne déboursant que 4, 95$ pour les frais postaux. Or, en plus du montant de 4, 95$, un montant de 563.70$ a été pris sur ma carte de crédit!

En effet, j'ai reçu un premier envoi avec 2 produits. Premièrement, ce n'était pas du tout représentatif de la publicité qui présentait plusieurs produits échantillons (produits de beauté). Je trouvais ça bizarre mais je me suis dit "ce doit être ça..." Deux semaines plus tard, je reçois une deuxième petite boîte avec les deux mêmes produits (que je n'ai pas déballés). Quelques semaines plus tard, je constate, sur mon état de compte de carte de crédit que cette compagnie a pris un montant substantiel de 563, 70$ !

J'ai tout de suite écrit à cette compagnie par courriel et demandé un remboursement. Ils ne veulent pas rembourser si ce n'est qu'un remboursement de 100$ (courtesy refund!). Ils disent qu'il était stipulé dans les termes et conditions que j'acceptais de payer la totalité si je ne retournais pas le produit dans les 14 jours suivant l'achat, et ce à tous les mois! et ils refusent tout retour de produits. Je lis les contrats et je ne me souviens nullement avoir lu cela dans la publicité reçue. Quoi qu'il en soit, je me demande bien qui voudrait recevoir, à tous les mois, les deux mêmes produits au coût de plus de 250$/mois?

Je n'ai jamais accepté de recevoir quoi que ce soit de cette compagnie si ce n'est les échantillons dont il était question dans cette publicité déloyale ni autorisé quelques montants que ce soit si ce n'est le 4, 95$.

Je désire entamer les démarches nécessaires afin de me faire rembourser la totalité des montants pris sur ma carte de crédit. Tout cela me cause bien des soucis! Je manque de mots pour qualifier ce genre de pratique!

Abella Mayfair wrinkle cream

Not only is this a huge scam, it is just the same cream as I have purchased in the past to "eliminate" wrinkles. Let'a face it, unless we go under the knife or get injections and fillers, there is NO CREAM out there that is going to take our wrinkles away! Regardless of your opinion on that, stay away from this company. They are incredibly sneaky and deceitful. They did not tell me I had 14 days, they told me I had 30 days. If you do not phone, cancel, send the order back( at your cost) you will be charged 89.00 US per month. ( they will offer it to you at the bargain price of 39US, then drop it down to 19US. though, if you are interested) I was not. BEWARE!

Abella Mayfair wrinkle cream and all of the others!!

I have sent multiple emails! I have called and spoken to multiple reps! I called the same day that i ordered my "free trial" and was told that unless i cancelled my subscription. That i would be charged every month for more cream! I cancelled! Yet i have bred charged 4 times! I am a single mother of 4 children! My daughters father is dead and i do not receive child support from my boys father! I can not work and have zero income! I want every dime of my money back or i will be taking this scam company to court!

On November 2nd, 2016, while online with shaw cable, it popped this free sample ad for customer. I ordered one for my wife. Then they called and required for shipment charge of US$ 3.95. I hesitatingly agreed. Then the sales lady said I have to call back in 14 days after I received the sample to cancel if I don't want any more product. I immediately said no, and I would not call back in 14 days after the shipment. She said I can't. Then I said I cancelled the order and did not want to sample any more.

However, they kept sending me the sample and also charged my account. I neglected it and thought I just lost the shipment charge. But to my surprise, another month later, I noticed all these charges in my master card. $154 on Nov 16, & $136 on Dec 4. They said that they just sent another product and charged the full price of the sample.

The company is a total rip-off, a scam.

I ordered Abella Mayfair beauty
product, I thought
I pay for the shipping
I ended up payin 89$ and 99$ this survey was using BEL Canada
Howe can we file a class action law suit against this company!
These product are very low quality!
I called the company they are willing refund 100us$ what about the rest there are other charges on my credit card from this company it is still not clear what are this charges!

I would love to feel a class action lawsuit against Abella Mayfair. I was just scammed out of 700.00. Just emailed them this morning and they offered me 70.00.
There are so many people affected by this company that a class action lawsuit would shut them down.

Abella Mayfair free products

This is a scam, I ordered on november 1st, 2016 2 free trial products (Wrinkle control/day and night cream) and paid two shipping fees. I have never been told that I will be charged automatically later on every month for purchasing their products. I found today that I have been charged a number of times for a total amount of about $550 canadian dollars.

The charges were on november 19th (140.10 cad and 148.72 cad) and on december 5 ($122.75 cad) , december 10th (144.87 cad).

I searched online and found the same stories. Today I cancelled my credit card.

Abella Mayfair wrinkle cream

Order what i believe was a sample tube of wrinkle cream. Thought i try it and see if it worked. Here is how it works when you order.
You are not getting a sample cream your actually signing up for their product. You have 14 days to cancel other wise they automaticlly enroll you and start shipping you the products at the full $100.00 price every month.
The sample product showed up 12 days after i placed my order. Two days later they billed me $135.00. I haven't even taken the product out of the box yet. If you have a good product you do not have to deceive people into buying it. If you are a honest and fair company you do not have to mislead your customers in what is truly going on. The practises of this companies enrolment are very deceiving and misleading. As far as the product goes could not tell you they have alienated me so much i did not try it

En vérifiant mon compte Visa, j'ai constaté que vous m'aviez facturé 136, 86$ le 6 décembre 2016. Je ne désire pas recevoir ces produits ni d'autres de votre part et demande à être remboursé en totalité du montant de 136, 86$.

Abella Mayfair beauty products 90 second anti wrinkle serum and moisturizer

I live in riverview nb. I clicked on a facebook ad on oct 30, 2016 offering a free sample of the 90 second rapid wrinkle and moisturizer, with angelina jolie's photo. Just pay the shipping fee of $4.95. So I entered my information to the screen and agreed to be billed the above shipping cost plus exchange rate. Before being able to exit cite and submit my order, the site took me to several other pages offering discounts on other products which then prompted me to answer yes or no. I distinctly remember clearly notifying the company that I was not interested in any other products or an annual subscription. They billed my visa. I later received a canada post email saying products were shipped and I would receive the products a few days later.
On october 30th, skinhealth london charged my visa $155.50 ($112.94 usd) on november 1st, clearskin swindon billed my visa $139.87 (101.64 usd)

Three weeks later I received two more packages from canada post which I did not order. It was only then that I checked my visa statement and discovered the unauthorized charges to my account.
I attempted to contact the company to arrange return of the shipment without success. There are now two more withdrawals from my visa account:
November 17th, from skinhealth london in the amount of $157.06
(112.94 usd) and another on november 19th from clearskin swindon for $125.09 (89.95 usd)
Unauthorized debits:
$312.56 skinhealth london
$264.96. Clearskin swindon
$577.52. Total

I will be taking this to my visa company and disputing any charges that they process to my card. This company needs to be held accountable for these shady practices!

Abella Mayfair online ad not the same as company

I live in Campbell River, BC. I clicked on a Facebook ad on Oct 30, 2016 offering a free sample of the 90 second rapid wrinkle, with Angelina Jolie's photo. Just pay the shipping fee of $4.95. So I entered my information to the screen and tried to use a pay as you go credit card with $5 left on it. The screen said this kind of cc is not accepted. Suddenly my phone rings and the company called the number I put on the screen. They said I was on their website for the skincare and do I have another cc. So I gave them my m/c debit. The saleslady said did I want to get the Maximum Moisture also, for $3.95? I said yes. She did not describe the product line, or anything about the sample being a trial offer, or the funds being USD. Neither did the "order confirmation" sent to my email. It doesn't even say the company's name, just how to contact them.
When my 2 very small bottles came in the mail a few days later, they were in the same box, although I paid separate shipping charges. There was no invoice inside and the insert encouraged me to buy their products. 14 days later I had 2 charges of $111.94USD and $100.74USD. I called the number on the confirmation, which was different from the one on the website referenced on my bank statement. The website didn't even say Abella Mayfair was the product, only the details of the promotion I was seeing for the first time.
They said I agreed to the terms and conditions and I said I had not, as the person on the phone who took my cc did not ask me to agree to anything but a shipping fee. I said I can send them back unused and they said I could not after 14 days. So they offered a refund of $80(USD) and then said my "subscription" will be cancelled. I did not accept at first, wanting to know what the terms were, and was advised it was $89 for one bottle and $99 for the other. Reference #ECCD5F7AAA. I had assumed that the charge would be for the next month's bottles, however, was informed I was now paying for the product I already had. The additional 12% I was charged was for "sales tax", and to what government she did not specify. When I called again to dispute the charges I was told that my refund meant there was nothing she could do for me. My bank said they could not help either. If there is ever a group lawsuit in Canada, I authorize the complaints board to provide my information. Meanwhile, I will continue to voice my complaints.
I believe all charges are unauthorized except the shipping fees I agreed to on the phone, and it must be illegal not to identify your company.

Victoria BC - I have also fallen prey to this scam. I thought I had only requested the "free trial of the wrinkle control cream" but they sent skin cream along with it and even though they came together in one box I my credit card was debited with two separate changes. This was only the beginning of the nightmare. I emailed and said I did not order the cream and would like a refund on the shipping. I didn't hear back immediately but when I checked my credit card statement on Feb 6 I found I had been charged $134.22. I emailed and said that I was returning both items unopened and used. This was when I was told I was enrolled in their monthly renewal program and because the trial period was up I could no longer cancel the order and get a refund. I pointed out that as I had not used the items I had not participated in the trial. To no avail. I emailed them requesting a cancellation. On Feb 9 I got two of the following emails "Thank you for using Abella Mayfair products. This email is to inform you that your subscription status has been recently updated and any ongoing or all future charges have been cancelled as per your request" One order # was dated 6 February and the other February 8. Today I checked my MC statement to find another debit of $121.55 dated 8 February. My frantic emails today received the following response "You cancelled your subscription on 02/09/2017 and cancellation only applies to future charges/shipments." Not sure what my next step is but I hope this is a warning to others - I sure wish I had seen this site before I responded to their offer. It seems this is the way they make their money - not from their products.

I too was nearly scammed but fortunately saw these posts and others so I immediately sent them an email saying in no circumstances was I authorizing them to deduct payments from my credit card account, now or in the future and that I had a screen shot of everything and would send it to the credit card company to support a refund. They actually acknowledged and responded saying my automatic monthly renewal had been cancelled. News to me that I had one. Looks like I might have got off lightly compared to others. I think we have to pressure the credit card companies to not allow these scammers to use their retail services and that has to come from us their customers. My "free" product arrived yesterday. Look at the size of the box to the product. I'm not sure I even want to try it anymore, who knows what it might do to my skin. Good luck to everyone getting their money refunded. Share as much as you can in Facebook so others are not caught up in this.

Be careful...unless you return the sample shown here (which according to them, is not yours, its a free trial for 14 days) unopened you will still be billed the $99 USD which they claim is the cost for the sample. These people are CRIMINAL!

I live in the Comox Valley and the above scam happened to me as well! I cannot believe this... Was asked to pay for shipping of $ 5.95. for free sample. I was a bit skeptical as when I purchased it took me through a whole bunch of pages with different offers, which I clicked NO. I was so shocked when my Credit Card bill arrived. 1 charge of $ 5.42, another one of $ 6.80, then another one of $ 155.04, and another of $ 138.64 and $ 119.04 on my next bill, that is still coming, also I have another charge on my bill, something that I did not order for the amount of $ 64.51. Capital One mentioned, that it might be from same company, just under different name. When I phoned Capital One to ask, whether they can stop payments on whatever is going on here, these are things I did not order. They were not able to help me, except issue me a new card and cancel the old one immediately... I have not had an income for 3.5 years. This is devastating to me. Contacted the company and of course they said I did not read the terms of condition. I was adamant, that the only thing I signed up for was the $ 5.95. I was told, that I had two weeks to return the product or cancel my order, which was a 0, 5 oz of some tiny tube and a 1 oz. cream. I cannot believe this is happening to me, and by the looks of it other people. The credit card company was not able to help me. and the company is impossible to deal with, well it's a scam.. Unbelievable! I really cannot believe this has happened to me. where does one turn to to complain? The RCMP? How do we as consumers protect ourselves? I do remember the saying: LET THE BUYER BEWARE. I guess joke is on me this time around...UNBELIEVABLE!

Abella Mayfair misleading 'offer' of sample and bullying tactics

I did an online survey after a purchase I made and the "gift" for having done the survey was a free sample of wrinkle cream. The screens that took me through the ordering of the sample (which I agreed to pay shipping for of ($4.95) did not mention anything about a subscription. I realized the same day (today) that I had been duped when they added a 2nd product which I DID NOT order and charged me shipping on that as well. The same day I contacted them to let them know to cancel the order and not to ship. After an email thread with 6+ iterations, I have been told that I will have to send the product back and then they can start the process of cancelling my subscription. I advised them that I will be refusing delivery of any package from their company. During this exchange the rep told me that he could lower the price from $99 to $39 for me to "save me the hassle and cost of having to return the product". Then in a subsequent email it went from $39 to $19! I will be taking this to my Visa company and disputing any charges that they process to my card. This company needs to be held accountable for these shady practices!

You were lucky that yours went down to $ 19.00. I have been charged almost $ 600.00.. I tried to reason with my credit card company, that I did not agree to the above, the only thing I agreed to was to pay for shipping $ 5.95. They said there is nothing they can do for me. I told them that I will be going back to visa...Just signed up for Costco Membership, and this is the Credit Card they offered. I cannot be stuck with $ 600.00. I haven't had an income in 3.5 years. This is impossible .. That to do? I just think this is unbelievable. Where does one turn to for help and to complain. The company is impossible to deal with, well they are scam artists.
