In regards to IC Systems... they are a punch of idiots... They DO NOT OWN the rights to any account, no one has any "out-standing" balances with organization like these firms...
These organizations are phishing companies, they buy lists from large credit institutions, they trade these lists as if they are Gold. Because they make money of these lists. Whatever account that or did not exists is long-gone. Whatever financial institute held it, or services it, has long gone written-off that account.
Financial institutions don't have time to screw around with out-standing accounts that are just worth a couple hundred dollars. They don't have the time nor the man power to track down every account holder, they bank on those people who pay their bill on time, and pay those outrageous interest and sub-prime rates that every one payes on and the poor do.
They are formbidden by law to "'buy" accounts, and take ownership of such delinquent accounts. Just has any attorney who deals in such matters, if he says otherwise, he is lying. Ask him, which law gives him the authority to do so, and he won't be able to tell you. There is no such law. There is no contract that give then the authority, and that so-call "agreement form" you sign, when you signed up for the credit card, is NOT a contract.
You never got a copy of it, because it never existed.
So these companies, call people to scare them into paying these bogus claims. This is what is call "legal fiction", they can not own the accounts, so therefore you can't owe them.
They have convinced everyone into believeing that if you don't pay these accounts, that it will screwup your credit history, well guess what its already screwed up, and everyone is powerless to do anything about it. They already know, that, attorneys know that, you have to spend alot of money to get it corrected. And, most people, which is 99.999999%, don't have the resources to spend money to fight these bogus charges. But they already know that, and so do attorneys.
If that attorney you speak says otherwise, threaten him to file a complaint/grivance against him, with his malpractice insurance carrier. You can get the list from any insurance agent, there are only 9 companies, agents hate them also.
They have to legally represent the company, and in Texas you can challege it with a TRCP Rule-12 challenge. It may be a federal statute also, they have to have been retained by the corporation, who issued/serviced account, to be legally represented in ANY LEGAL matter, before a court of law.
Guess what, this and all matters envolving any debt collector that calls you on the phone, has never stepped in court. Nor does any court papers, ruling, motions, or orders exist.
If they legally represent a company or financial institution, they have to legal CONTACT YOU IN WRITING AND PROVIDE YOU A COPY OF ANY COURT MOTIONS, THAT HAVE BEEN FILED AGAINST YOU.
So that you can rebutte the claim, or get an attorney.
That is why they call people on the phone to harass them. They have NOT legal leverage, so all they can use is threats, and harassment, and they annoy people to death.
Next time they call your family, has them to record the call, take notes, document when they called,
who you spoke to, time and date, after you get tired of talking to them, at least wait 1 or 2 minutes. Excuse yourself, say I have to put the phone down to answer the phone, then walk away and continue with you business...
They will eventually hangup, and give up after 2 or 3 calls. They are trained ASSHOLES, I spoke with two of them today at 3:12pm 12-13-07.
I yelled at them at the top of my lung, and cursed them out. I yelled that them with every kind of profanity I could think of. And I don't even have an account with them. They are trying to get my sister or my brother in-law about some BS outstanding account from like 6 years ago. I never give
them my name, I tell them that I am Alexander Haig, you know the secretary of state under Ronald Reagon, they will never get a dime.
And they don't even know they are talking to an alias...either...

I always tell them that this land line they are calling, belongs to Alex Haig, and not my sisters, "I don't know her, I'm not even related to her, how could I know her" I say to them everytime...
I always give them the run around. And if they do contact you with a letter, ask for the attorney
who represents the company, IN WRITTING. Ask for his bar number, and tell them that you want copies of ALL WRITTEN documents that support their claim, and if that they don't provide them, that you will file a bar complaint with their malpractice insurance carrier. You'll never hear from them again.
As far as getting your credit cleared, you can always try sending the credit reporting companies a letter, stating that you identity has be stolen, and that you don't know anything about any outstanding account. You just envoked a new law, that protects you against Identity theft. This is also legal fiction, but its not something that will count against you in any legal proceeding, especially since you haven't even gotten to one yet, nor has your husband.
Its not a white lie, its just another legal maneuver you can use against them, after you have submitted your correspondence with the debt collector.
