Cheating people out of their homes!

Homecomings Financial seems to be in the 'business' of CHEATING people OUT of their homes based on everything I've seen written online... Scared me so much a couple of weeks age that I posted my complaint on a class action site and now have a law firm in NY interested in a class action suit against Homecomings. They are GREAT people at the law firm helping me personally so I won't (hopefully) lose my home to this FRAUDULENT company.

If any of you out there have any suggestions for help or know anyone who has/had problems with Homecomings. PLEASE have them post and/or email me ASAP, The law firm, Wolf Popper, NY is looking into CLASS ACTION SUIT against Homecomings Financial. You may contact me by using the rebuttal box below.

A CLASS ACTION SUIT will bring JUSTICE for those of us devastated by this company's underhanded fraudulent practices!! Thanks for any help!!

Homecomings Financial is corrupt and incompetent and they are taking my house. They opened an escrow acct without my knowledge, misapplied $4000 worth of payments, posted one of my payments to someone else's account, and continue to try to draft a bank account I closed months ago. I literally had $1400 disappear. I found out 6 weeks later it wasn’t even posted to my account, although it was taken out of my bank account. They paid my property tax 2 years in a row without telling me, so I paid it twice. And they began foreclosure proceedings against me as a result of the 10+ mistakes they made on my account. None of this was my fault. Their customer service reps are rude, ignorant and mean. They contradict each other. And their statements and notices are impossible to read. I didn’t find out for 6 months that my property tax was paid twice! I looked on Better Business Bureau and HC has 300+ complaints. Every time I call them I get a different story. I need to get legal help, and I'll make a BBB complaint. But even if I can get them to fix this mess, I'll never get back my good credit and all of the time (100 hours so far) it has cost me. I have spent 40+ hours on it this month alone and I still can’t figure out this mess. It has impacted my productivity at work, damaged my credit, and might cost me up to $5000 if I don’t get help, and might even cost me my home. This is my first home, and thanks to Homecomings it has been a miserable experience.

I would defiantly be interested in a class action lawsuit. We have had them since jan 2005. Nothing but trouble. Lost payments (more than once) late fee associated with that. My guess it they conveniently misplace a payment long enough for it to affect your credit so you can't refinance with anyone else because a late payment shows on your account. Even if no class action can be filed. Can't someone federally go in and audit them and individual personal accounts? Does anyone know of a third party you can hire to go over your individual account and audit? There have been nothing but miserable experiences in dealing with them.

This company is definitely shady! I have been arguing with them over the validity of them paying taxes BEFORE the literal payment was due to the county I reside in for weeks now. They started foreclosure procedures against us, but we settled the outstanding balance, including the lawyer fees. However, this slick and evil company now states that we owe for our 2007 property taxes and that we have to establish an escrow account with them. SHADY! SHADY! SHADY! We have contacted them several times for a letter to signify that we have stopped the foreclosure and that we have become current to no avail. We are definitely interested in the class action suit. Our complaint mirrors most of the others. We were forced to accept this company after 4 months with the previous lender. I detest this company and pray that justice is served against them swiftly!

I am in the same boat. My story is so long I honestly do not have the time or patience to write it all out. One thing is sure though, I believe, and this is a suspicion only, that all the customer service calls get routed to India and only then do they get sent to the United States if the reps in India cannot help the call. This is frustrating because apart from the fact that there is a major language barrier, the reps there do not know what they are doing and they misrepresent the company's policies and promise what ultimately the company will not backup. I once called and those morons had me on hold for 2 hours on and off. The last time she put me on hold I was on for 30 minutes straight and when she came back online she hung up. I was so upset that I called back and I was so abusive (getting names this time) that they simply did not want to deal with me so they transferred me to the "department" who dealt with my account. Minutes later a lady by the name of Debbie Wilson went on the line and was very respectful and nice. She spoke perfect American English, unlike the others that were either John, Jared, annie, ellen etc... There was even a voice which sounded the exact same. This person called herself Annie, June, Dawn and Ellen but it was the same person due to the certain way she pronounced certain words. They legally owe me money and I cannot seem to collect it. If anyone is doing a class action suit please e-mail me, I am in.

My mortgage loan was sold to Homecomings Financial in July of 2005. Since then I have noticed that my billing statements received from Homecomings Financial do not reflect the payments that I have been making. When I call to question my statements and where my payments are being applied, they have no explanation. They have advised that they would research the situation and respond within so many days. I have never received a response from them regarding the investigation of where my payments are being applied. I have tried to call since and requested to speak with a supervisor or someone in charge. However, they act as though they are going to get a supervisor on the line to help and then the call is disconnected. This incident has happened many times. Please help smb!

1. Pay your mortgage on time. It's due the 1st of every month for everyone.
2. Nobody adjusted the rate without your permission. You signed an ARM disclosure. Don't be stupid.
3. You gave your loan officer and his company permission to sell your loan by signing a Transfer of Servicing Disclosure.
4. Read and understand what you sign. If you don't then you are not ready for the responsibility of homeownership.

Some of you have had genuine issues and that's unfortunate. Whereas the majority of everyone else here should read items 1-4.

Listen Joe Public. I'm not sure if you work for HomeSuckings or not. Obviously you have not had to deal with their ineptness. If you read the complaints about these bloodsuckers, you will see that a lot of the issues people have are with the lack of customer service, poor accounting and downright screwing over account holders. I too went thru the hellish nightmare with these jokers. The insurance scam, the lost payments, bogus late charges, and plain ole fashion rudeness. If not for the fact that they were servicing my loan, I would NEVER deal with them. I finally gave up and cut my losses. It was a hard thing to do, but after reading the postings on a number of web sites it made easy. Once I saw that fighting with them was pointless, I packed up and moved. They ram-rodded me out of 10 years of equity in my home. So don’t sit there and tell me that following your 4 simple rules will keep everyone happy. My nightmare is over and I will be much more careful in the future and to you Joe Public I sure hope nothing bad ever happens to you because I too can make a list to point out where YOU screwed up.

I am stuck with homecomings financial by default. I was sucked into refinancing my low interest rate by Oakstreet mortgage for a lower one. They put me on a 2yr ARM and said I could refinance again when the 2 years was up. Well, they forgot the part of telling me that they sell the mortgages pretty much as soon as the paperwork is final with the customer. They sold it to Homecomings. I just thought well, I will refinance with them in two years. Come to find out they don't finance manufactured homes... so why the heck did they buy my mortgage?? I am stuck now. Since the time I originally got the mortgage my family has had a rough time financially. We lost my husbands income due to an injury and our credit has gone down the drain. No one else will touch us now. I am stuck with this ARM increasing every 6 months... I guess it will cap off at 14%. I went from paying 580.00 a month and now I am paying 975.00. The sad thing is I only owe 80,000 on my house and it is well worth more than that to give it up. I am interested in putting an end to these companies that take advantage of consumers. Why can't we trust people? and what did we do to deserve this.

Homecomings financial CEO must be Satan. With that said. I have been fighting with Homecomings for 3+ years now. I was making my payments to Homecomings via Western Union. Homecomings weren’t accepting the payments. The only reason I discovered this was through Western Union contacting me about refunding these payments. I contacted Homecomings about this matter. They informed me that they had started foreclosure on my home. I contacted a bankruptcy attorney and filed a chapter 13 bankruptcy. This legally stopped the foreclosure and protected my under the bankruptcy filing. After filing my bankruptcy; Homecomings sold by house at foreclosure anyway. The funny thing was that on my bankruptcy hearing. Homecomings sent a representative to the hearing. Why would you sent a rep to a hearing on a mortgage you no longer owned. According to Homecomings, J P Chase Morgan owned my house. Another strange practice by Homecomings was after several calls they kept stating they didn’t hold my mortgage. They had been accepting payments from the trustee. I contacted J P Chase Morgan they stated they didn’t own my house either. Yet own the property tax they are listed as the deed holder.

Now, in two years of bankruptcy I have paid off all my debts except my mortgage. Some how my mortgage balance has increased. My house payment is now $0.07 shy of double my payment from three years ago. I started to process of a quick claim deed for my house. Homecomings is now trying to charge me the legal fee for correcting their mistake. I want to dismiss my bankruptcy considering everyone is paid 100% in full. I just afraid that without the trustee’s protection. Homecoming will invite a new problem(s).

I am in Illinois and have a home loan with Homecomings Finance. My Husband died in April of this year, and payments were made to date. I had 4 months of waiting for any kind of money to come in. I made what payments I could, but it seemed the more I payed the more I owed the next month. I am in need of a Lawyer, can anyone out there help me?

I am in desperate need of help for my father. He is 74 and looking to lose the home he built. Homecomings made him believe he had a fixed rate mortgage and now all of a sudden, he has an adjustable rate and in October may no longer be able to keep his home. What do we need to do?

Oh My Gosh!

I HATE Homecomings. When my mortgage was bought by Homecomings, I never received anything. No letter, no phone call. Somehow I was just supposed to know this occurred and send my payments to the right company.

By the time I made my first payment, I knew I was in for a nightmare. I never got a statement telling my due date, amount due or any phone numbers to contact with questions. When it was time to mail my second payment, I had no clue who to send it to. I called the 800 number from the website. I got so many "push 1 for" "push 3 for"... by the time I got to where I thought I needed to be, I got disconnected. Three times I tried this and got disconnected.

I tried to pay online, and the system kept denying access.

Back in June, I was making a payment (after several disconnections). Once I made it to the "Pay by Check" prompt, a voice said their system was down then hung up on me. I finally got a live person on the phone and said he could assist with my payment, but he would charge extra. Extra? Because YOUR system isn't working, I am penalized?

Last month I tried to pay my bill, and found out my payments were increased by 50%! Thanks for the warning and explanation on that one!

Homecomings is the worst mortgage company I have ever dealt with. After dealing with with company for 6 years, never missing a payment, I recently became very ill and was fired from my job. It took 7 months before i was able to get any form of disability while trying to care for my 4 children, ages 3-11. While dealing with this, Homecomings, promised to work with me, then refused to accept partial payments and started to foreclose on the house. In the meantime, a representative from Homecomings, came to my home with a local realtor a offered me $2,000.00 cash to leave the house. The house is worth $210,000.00.

They then have offered on numerous occasions to re-do my loan, only to renig saying, "We don't have loan programs for disabled people." Homecomings sucks and their loss mitigation department is a joke. They actually want to foreclose. Homecomings also has a division called the HOPE program. This division is supposed to help customers of Homecomings who may run into tough times. Another jokes on the customer. This was invented to make homecomings look good. How sad.

WOW! This is too much to stomach. I too have a loan that was sold to Homecomings. My issues began after I had surgery in 2006. I called Homecomings to make them aware my recovery was taking a month longer than anticipated by my doctor. During this time I could not work and my sick time, vacatio time and comp time had all been exhausted. Basically, I had no income for 30 days!! I was asking for assistance with making my payments or trying to find solutions. The rep said,"well there's nothing we can do right now, your payments are not behind YET!!" I started getting phone calls about my payment being late, although it was not. I called back on Day 31, had the same conversation with someone else. Let's just say it's been a year and I am still getting phone calls after setting up a repayment plan ( that I was told did not exist). Now I have an escrow account that I did not have originally. Seems like Homecomings decided to pay my property taxes and open an escrow account causing my payments to soar higher.

UUUUgh! This is getting crazier by the minute. I am so stressed I cannot eat, I have constant muscle spasms and trouble sleeping. Just when I thought it could not get worse I missed making a payment by a day and now I have to pay more money to restart the repayment plan again.

Is anybody, other than those of us suffering, looking at this pattern? Is there anybody that has had any success with law suits or challenging Homecomings? I live in Georgia so let me know what's being done or who I go to. I refuse to roll over and let this slimy company, with its rude employees have my house.

Forclosure - Short Sale
Last year I falled behind 2 payments on my Mortgage September and October by that time I was on desabilyty, losse my tenants on June, I called Homecomings to explain my situation, they ask me when I will be able to make those payments( those 2 months only) I gave them a date, they said ok....
The date was February 15 of 2007, Home comings returned my monthly mortgage ( month), send me a lawyer letter with a lot more charges and foreclosure procedure.
I called them again about a short sale they said again no problem, since them I have two offers, on the first one buyer's walked away because it took so long to get an anwser from Homecomings, the second buyer are generous waiting for us but they are running out of patience, the worse is not me or my lawyer can get to talk with Homecomings, we been waiting to hear from them for the past 21/2 months and nothing.
Now I have a Sheriff sale on 10/09/2007 because their lawyer don't stop tryng to take over the house, and Homecomigs do not anwser our petition of Short sale.
