Castaway Pools and Spas installed a pool at my home on 4/5/07. They have never came back to finish the job despite numerous phone calls and letters sent to their office. Their salesman john refuses to answer any phone calls. I would advise anyone in the tristate area to be aware of this company. If this company is hired to install a pool at your home read the contract and beware that the are not responsible for any damage to your home or property. Do not under any circumstances make a payment until they are completely done. They seem friendly but are that lie and deceive the public.

Sorry everyone to hear of the horrible situations these low life scum bags have put you through. I only hope for the best for all of you. I have been in the swimming pool industry as a wholesaler for 18 years and can honestly say your situation is grim. I kick these types of frauds out of my warehouse on a regular basis as I will not contribute to the demise of a family's dream of owning a swimming pool by selling product to them I know was the product of a rip-off scam artist. Castaway has changed suppliers numerous times in just 2 years of being in business because they do not pay their bills... outright steal from suppliers and bounce checks like they are super balls. I have first hand knowledge of how desperate these pieces of S*&# T are. They have no money and no way to purchase supplies and have run up 10's of thousands of dollars in debt and fraudulent checks which means any story you get from John Dalrymple Sr. or Jr. are packs of lies. If your pool is not complete by now... it's safe to say it will never be done... at least by these jokers. I would be more than willing to supply each and everyone of you very specific details of the kind of people they are and their history as well as the numerous supply house phone numbers where they have purchased or trying to purchase product form. I can also recommend very reputable pool companies that you could contact (with my help) in finishing the mess these putz left in your yard. As of 8-3-07 the cell # for John Dalrymple Sr. is 856-466-3939 . But who knows how long that will last... it's probably a throw a way phone or stolen... I suggest calling ASAP.

I everyone - I am also being screwed over by Castatway Pools. The past few months I have made many (unanswered) phone calls and, if I am 'fortunate' to speak to a person I receive lies, deceit and delay tactics.

In the past week I have called and/or written The Daily Journal (856-691-5000), The Courier Post (856-663-6000), Fox News (1-866-978-4232), Fox News Undercover (215-982-5566) The BBB, the NJ Div of Consumer Affairs (800-242-5846) , the NJ Rep for Trilogy Pools - Bill Randle (901-201-7531) and my lawyer. My next step is to notify channels 3, 6, and 10.

In my written correspondence I also included several web sites (including this one) so that the people could see that there was some substantiating evidence of the fraud that is going on, just by the sheer number of complaints on the blogs.

Consumer Affairs (and the papers) suggested that everyone file a claim against Castaway - the more complaints the better. This is a sure fire way to get them (and the others I have mentioned) to respond. I am reaching out to you to please please TAKE ACTION.

Have any of you taken legal action? Made formal complaints? Has anyone been given any insight into where these people are and where our money has gone?

My lawyer said it sounds, to her, like Castaway is just shy of closing their doors. So the time to act is NOW.

Also - yesterday I called Castaway and was told by Bernie that anyone waiting on a Trilogy pool would not be getting one.
Apparently they're not paying their bills with them either. I was also told that since the posting from 'Anonymous' about John's fraud convictions - no one has seen him and that no one has been in the office (other than the people that answer the phones).

First of all, I feel really bad for all of you that had to go through all of this. We know all of these people and they all have a history of doing this to people. (This is a first for Kali).

We have our own pool business and choose not to sell more than 20 to 25 pools a year because we want our customers happy. We have references a mile long. Most of our customers continue to call because they have become friends.

If we can help any of you with information or with the installation of your pools let us know. Just email us, we're not on here to advertise.

OH, by the way people John Sr. and John Jr. don't have the same last name!!! John Jr. has also been in jail in PA too. He did this to a cop in PA and didn't get away with how he does business. Again the Father slipped through the cracks because he doesn't have the same last name.

I'm writing as yet another wholly dissatisfied customer of Castaway Pools & Spa in Vineland, NJ. We entered into our contract in April and thought we did a pretty diligent job of checking these guys out references and all (there were no significant complaints until June and after). To date the pool was installed and the equipment delivered but no electric or concrete work has been performed. We too have experienced the same M.O. with the runaround, misinformation and unreturned phone calls. My question is has anybody had a successful pool installation by Castaway this year? Also, has anybody undertaken finishing the pool themselves or with another contractor? We believe Castaway is clearly in default of the terms of the contract. We have contacted the equipment suppliers and expressed our dissatisfaction. It looks like NJ BBB is in the process of reviewing the various complaints filed against Castaway but given the number of comments and complaints on the various complaint boards it doesn't appear we are going to have our pool completed any time soon if ever. We have enough money held back to allow us to undertake the nuisance and hassle of completing the pool ourselves without taking too bad of a hit in the wallet. Would like to hear from anyone who has finished up their job with another contractor and what the cost was. God Bless the honest people who have undertaken the campaign to inform others of their problems and my regrets to those who are out any money. P.S. It's a shame but the guys who actually showed up to do the installation were hard workers who worked 10-12 hour days. I just hope they got paid!

Absolutely, the Kali's are in control of the checkbook. They have changed suppliers many times because they don't pay their bills or bounce checks. I'm sure they'll start proceedings soon also. (I would hope)

People fall for the glitz and glamor of the guys with the big stores and quote they have "over a million dollars of equipment". That's all well and good if you actually pay for it and don't screw honest people in the process.

Again we have nothing but compassion for all of you that have nothing to show for your money.

We too have had nothing but trouble, since the check was handed over on March 28th. I have kept phone records, temperature and weather charts. There is no reason for the complete runaround that we have gotten, besides the shitty work. The pool installation went fine, those guys were here for 14 hours one day, they check was handed over and let the BS begin. It is not like we live in another state, we are within minutes of the store, (where we were flim flamed) at least once a day the trucks pass by our home, never to stop in.
The filter has not worked right since it was up and running. I contacted Hayward, because I could not get any satisfaction from them, Hayward said that something inside is cracked and that is why sand keep shooting back into the pool. Still they do not come out and fix the problem. But the best is yet to come, we have a $30,000 investment, when all said and done, and we CANNOT swim in the pool! The building inspector gave us a BIG red sticker, closing the pool of any further use! We may also have to have all the concrete ripped up, so that the inspector can see the work under it. Who will pay for this? Our well has run dry! The permits were submitted by an electrician, and a different electrician (BUTCHER-RANDY!) did the work. Castaway was notified in May that the permit was no good and it is now August and we are now finding this out. I have had many sleepless and crying nights, family arguments over this entire thing. It makes me sick to my stomach, how these bold face liars and flim flam you, a hard working person, and do nothing in return. We did our homework and these guys all checked out. John Jr, only talked bad about WaterWorld Pools, how they don't serve what they sell and have a bad rep??? Wow, you followed in their footsteps. A new name for the Company should be "CAST YOUR MONEY AWAY, POOLS AND SPAS" Our money and service was castaway, just like so many of you out there. Something has to be done, before they go belly up and we are left out in the cold.

I spoke to someone at cast away pools today.They are aware of this web site so they know people are trying to do something to get the word out. Everyone should call john's probation officer,their local police department, camden county prosecutor office (856-225-8400)or any law enforcement office. I think the bbb, consumer affairs,or any other place like that does not have any real power. Yesterday I called an attorney that handles class action law. Hopefully he can find something or direct me to someone who can. Do not give up we have nothing to lose we all have already lost. Make calls do not stop making noise someone has to get somewhere with this. All we need is one person who believes in or problems. Maybe then we can get justice. Open your phone book to the government section and start calling. There has to be someone who can help. Anyone who would be interested in a class action law suit email me. I am curious to see what people are thinking about.

Does anyone have a relative or friend that is a lawyer or in law enforcement or an elected to a government office? If you do start making calls JOHN if your reading this why don't you come out of hiding and deal with your problems. You are the one who is calling the shots while and midge are just your pawns who are going down with you. Call me you have my #.

as far a Kalai, being involved, they must be, because the paychecks come from them. John said that he was the owner and had over a million dollars of machines. He is not the owner, on the BBB web site it lists William Kalai. Just more lies to sell you snake oil! We may not be as bad off as some of the other people, but, every customer should be treated as if they were their only customer. As far as law suites, From another web site, a lawyer told that person, you can only sue for what you didn't get??? I guess that they know this and this is how they get around things. You know the last little bit of money owed at the end, is probably nothing to them or it is added already into the cost of the pool.

FYI- Castaway Pools is under new management! We just took a road trip down there (all of 6 minutes away) No one was in! Can you believe that???? I told the girl she better get someone, because we were not leaving, until we talked to someone.

Same BS! Nothing came out of our talk.

As far as the Building Insp., our concrete around the pool has to be torn up! No if ands and butts about it. You have to choices, I can pass you or fail you... and you failed! Who is going to pay for the concrete plus the removal? We are out of funds! Castaway or POOLS, SPAS & BEYOND doesn't care. The new guy doesn't care either. He will take care of it. It has been since 8/3 and nothing was done on their end. I contacted the electrical contractor and he got the permit all squared away. As for the filter- Oh, I sent a guy out the next day and in return I told him that I called 2-3 times a day, since last tuesday, to let him know the filter was still shooting out dirt. Hayward gave me a list of service reps, non of which wants to work on a Castaway pool. Finally, BUDD"S POOLS, will be here on Tuesday, at our expense.

Something has to be done, we have to band together and pull all of our resources to see what justice can be served. Maybe a news crew, investigators or something. They are setting up shop in another state and will start ripping people off there.

When we went there at 5 pm, there is a sign out front- UNDER NEW MANAGEMENT! Also, there are new store signs- POOLS< SPAS & BEYOND

Everyone... make no mistake about the NEW MANAGEMENT SIGN AND THE NEW COMPANY NAME. John Sr. tried to purchase product from my warehouse (i am every large supplier of pool supplies in N.J./PA./N.Y.) under the name Pools and Spas Beyond. And of course he never said what his last name is. Sound familiar? Just like all other scams John Sr. And Jr. have run. He tried to say Dolphin Industries owed him a credit for a pool John Sr. purchased and that my company was to invoice Dolphin's account. Guess what...? After speaking w/ the owner of Dolphin it turns out the check payment was written to Dolphin by a homeowner in Clayon , N.J.(probably someone on this posting) for more than what the Fiberglass pool cost. John Sr. was trying to steal the difference. Safe to assume this homeowner wrote the check to Dolphin because there was no way they were giving these scumbags anymore money. Once again another low life scam. However my company refused to supply any product to John Sr... we are well aware of the condition of Castaway and all their fraudulent practices . Do not give any more money to anyone affiliated with Castaway... it will be flushed away. They have absolutely no way of purchasing product or supplies... and have run up so much debt and bounced checks they are trying to scrape up as much as they can to leave town. There is no way they have any intention of finishing any projects. Keep your hard earned money for the professional company you will need to hire to complete your project ,because there is no way Castaway... Pools and Spas Beyond... John Dalrymple Jr./ Sr... Denny... William Kalai... Midge Kalai or anyone else associated with these lower than pond scum pieces of Sh#$%t can do at this point. Their ship has sunk. Call all T.V Stations... Does anyone have any info on the concrete scam artists? KJK Dave Kemenash??? There is nothing in the phone books or online for these clowns. They poured our concrete without passing the electrical inspections on the word of John Jr-and we all know how is words can be trusted. Anyway, if they poured the concrete (which is a mess, in itself) they should be responsible for the rip up and replacement.
Please respond or email me any info, phone number or address. We never got any receipt for the work or the extra $1500 we paid for extra cement.

Still curious if any of the people who posted complaints earlier ever had their pool installations completed by Castaway or if they had other contractors complete them. We understand there is an electrician with a valid electrical contractors lic., operating out of Metuchen NJ, still completing electrical work for Castaway customers. However, it appears they are insisting on payment directly from the Customer for the amount of the electrical allowance quoted in the contract. For those who want to remain anonymous, please e-mail me through the Complaint Board and let me know if you have made any progress in getting your pool completed. If Castaway is no longer operating, is there any way to confirm this through the NJ DCA? Thanks.

A google search for "David Kemenash" turns up some interesting things. A guy named David Kemenash was incarcerated in the 1990's at the Federal Corrections Facility on Fort Dix for "bank fraud and bribery".

Does anyone know if it is the same guy who is doing concrete for Castaway?

On June 9, 1995, Midlantic Bank, the predecessor bank of plaintiff PNC Bank (the Bank), filed a complaint seeking a money judgment on a promissory note executed by defendant David Kemenash (Kemenash). The complaint also sought a judgment for payment of the Bank's share of a restitution order entered in United States District Court as part of the sentence imposed on Kemenash for bank fraud and bribery. On June 15, 1995, Kemenash was personally served with the summons and complaint at the federal corrections facility at Fort Dix. Defendant filed no answer. The court entered a default, and eventually a default judgment in the amount of $3,954,912.71 plus interest against Kemenash.

Sometime after Kemenash's release from prison, the Bank commenced efforts to collect its judgment. On May 10, 1999, Kemenash filed a motion to vacate the default judgment. He asserted that he had no recollection of being served with the summons and complaint in 1995, was unaware of the judgment until "in the Fall of 1998, the Bank suddenly began pursuing [him] on account of this Default Judgment...," had never had an opportunity "to vindicate [his] claims against the Bank," and the Bank had failed to file an affidavit of non-military service when it applied for the default judgment.

Dave, thank you, if you can straighten out this mess. Our pool was installed without the permits! John wrote another RUBBER check to the Buena Vista Township. Our pool was put in 3/26/07. Today, I get a call from the township that my check bounced! I said for what, the only permit we had was for a pool, that was installed 3/26/07. Castaway pools took care of the permits, not us. The date of the check was 4/25/07, a month after the pool was dropped. Check with you township, so you don't get a bomb dropped on you.

As for John, may you rot in HELL!!!! Maybe you should watch your back, one day, someone may not be as nice. You know that we are the ASSHOLES as you put it, to your men and sub contractors. I know all about the comments. The only thing is there seems to be calling the wrong people that, look in the mirror. How can you sleep at night, ripping so many people off. Did you even turn our money in to the company or did you pocket it??? You tell so many lies, you believe them yourself.
