Never came back to finish the job!

Castaway Pools and Spas installed a pool at my home on 4/5/07. They have never came back to finish the job despite numerous phone calls and letters sent to their office. Their salesman john refuses to answer any phone calls. I would advise anyone in the tristate area to be aware of this company. If this company is hired to install a pool at your home read the contract and beware that the are not responsible for any damage to your home or property. Do not under any circumstances make a payment until they are completely done. They seem friendly but are that lie and deceive the public.

Hey John Sr, am I causing your family problems, good! Cause I did not deal with Kalai, I dealt strictly with your son, John arrested 6 times Dalrymple. He screwed me and my family, so I'm gonna give it right back to yours, only lawfully, which is more than you can say. And in the end, its going to hurt more than what you gave to me.

I agree greg w .I only dealt with john .I never knew about kalie until they put my poool in .He always said it was his company. If john has nothing to hide why did he not answer my phone calls?
why did'nt he leave kalie.What about all that bull about him leaving the company last summer?Was he just hideing until the smoke cleared? Are you SURE you have purchased a Dolphin Pool recently ? Could you possibly be mistaken...maybe you went to the wrong Fiberglass shop by mistake. HHHMMM...let's see...contracting for a Dolphin Pool...and installing a different manufactured product without proper work order change authorization signed by both parties on said contract sounds to me like a clear case of fraud and disception. I'm sure in a court of law you would be convicted of many violations according to the consumer fraud protection act in N.J. Does anyone know if the Castaway contracts specificly state a start date ? If not, that would be good information to know...cus' by law THERE MUST BE A WRITTEN START DATE ON ALL CONTRACTS !!! Otherwise a consumer could potentially be entitled to 3 times the total job cost if brought before a judge. Just hear say...I'm not a lawyer...could the SASSIFIED customer/lawyer from a few pots back shed some light on this for all of us. I am correct in that you had GOTTEN your Dolphin pool...yes? There are so many of us that have joined forces together that there is no lie you can tell a customer that we can't refute in a matter of minutes with simply a couple e-mails and phone calls. So...once again...ARE YOU POSITIVE...100 % that you purchased that Dolphin Industries Pool. If not...than I suggest you back down immediately.Anyone need to speak to Dolphin industries for any reason? Contact Chris Langella from this board...I would almost bet he has the direct #'s to reach the owner of Dolphin.

oooopppsss...I stand corrected. Not only is Castaway required by law to have a start date on their contracts...they must also specify a completion date...and if a consumer feels wronged in any way by the contractor they have the right to sue for 3 times the damages incurred by the contractor . Also...I have confirmed through a legal source of mine...that if a contract in N.J. does not specify BOTH a start date and a COMPLETION date...the consumer can be released from the contract without penalty.
So if there is anyone out there that wishes to get out from the Castaway nightmare...simply look at your contract...I would bet there is not a start or completion date that has both Castaway and the consumer signatures on it...ya see...it has to be initialized by both parties to be binding. So, John Sr. I wouldn't attempt to forge the sigs on or alter the contract in anyway like you tried to do w/ Lesley Mcgiboney.
Oh...did you forget about Lesley? She was the nice lady you were going to put your pool inside the concrete pool that was already in the yard. Yes, ...she was the one that you screamed at over the phone telling her the contract price was for 19, 000...not 14, 000...which she had on the permit you submitted. Remember...that was the customer that I personally spoke with and told her you tried to scam dolphin Pools . Remember...you said that Tony owed you money for a pool that you paid too much money for...and that Toney was going to pay for Lesley's equipment. Oh...that's right...it was not you that paid Dolphin...it was Lesley that paid Dolphin directly...but by more than what the pool really cost. if you don't remember that...just go to page 4 of this post...it's about 1/2 way down.

So...John Sr..I would back down if I were you...I will provide them with all the legal info I can dig up...

FYI
A contract that states a start date of 2-3 weeks from permit date does not constitute an official START DATE. It must be a specified month/day/year for it to be legal. Same goes for the completition date. Otherwise contract is null and void.
Also, Failing to call for a mark out by utility company prior to excavation can result in a fine as much as $10, 000. This is the responsibility of the excavator. No getting out of this one John sr.
You royally screwed up...and it's going to cost you...BIG TIME !!!

Greg W. if you had a copy of a contract written in January on the old company name even though John claims to not be the same company, would that help you prove these guys are the same as before on Wednesday in court? If so contact me...might be able to help.

Hello everyone went to court today for castaway pools and spas however, they decided not to show up again so the judge ruled in my favor to levy there assets. They are trying to say that there under new ownership fyi all they did was put the same bussiness in johns girlfriends/baby's mothers name which at the time the bussiness was castaway pools and spa she was listed on documention as one of the owners. I have been dealing with this situation for 2 years i have never in my life experience anything like this. Feel free to email and i we keep you up to date along with my new Greg.

Not by Castaway... Teresa, John Jr. John Sr. have done nothing but lie, steal and cheat. Of course they refuse to give back my $5500 depoist. Some how they feel intitled to my hard earned money.
So YES it has been nothing but a Nightmare NEGATIVE experience with these low life cons.

My lawyer will deal with them now and Ive moved on to an amazing pool company who had my Dolphin Fiberglass pool installed/complete in 4 business days, Correctly.
