Never came back to finish the job!

Castaway Pools and Spas installed a pool at my home on 4/5/07. They have never came back to finish the job despite numerous phone calls and letters sent to their office. Their salesman john refuses to answer any phone calls. I would advise anyone in the tristate area to be aware of this company. If this company is hired to install a pool at your home read the contract and beware that the are not responsible for any damage to your home or property. Do not under any circumstances make a payment until they are completely done. They seem friendly but are that lie and deceive the public.

I am young, I have a lot of years left in me. This issue will not rest till I am dead or in prison for life! The authorities who collects a handsome paycheck are doing absolutely nothing. They are just riding this through to show they have something on their plates.

Every blue moon they call to give a status report..."we are working on it". The FBI is to busy searching fucking shoes at the airports. Local police are all caught up on my dog taking a dump in the side of the road. AG's, both PA and NJ are to busy having promotion parties to give a fuck.

If I walked into someones home and stole money, I'd be in jail.

More info, apparently action against Kalai both as himself, and DBA Kalai Excavation. Looks like this just happened a few weeks ago.

"Wage & Hour Violations". I wonder what he was doing that got him this.

I feel like such a sucker. I signed with "Castaway" pools 1/13/08. They were supposed to start our pool last week. Surprise they didnt and they stopped taking my calls. John Sr. called me Monday and said they will hopefully start next Tuesday 6/17. Im scared to death now and want to try and get my $5, 500 diposit back. What should I do???

I guess you have basically two choices. Either you let it ride and hope that they install your pool, or you stop everything and try to get your money back. I would probably recommend consulting with a lawyer to see how that might go. I am not a lawyer. I don't play one on TV either. If it was me, after all I've been through, I would do my best to make sure that I wasn't the one to breach the contract. Stay on top of them. Drive down to the showroom when you know they will be there and try to get a something written and signed by BOTH parties (you and them) regarding the start date.

It is unfortunate that you didn't consult the Better Business Bureau records, hopefully the 26 unresolved complaints would be enough to scare anyone and everyone away.

I think the track record of everyone on here is that if they owe you a refund, or more pool stuff after you have paid them, you are out of luck. You might have a better chance of getting the pool installed than squeezing the $5500 out of them. I absolutely would NOT give them another dime until the pool is in the hole at my house...and then I would NOT give them what the contract says, figure out what they have left to do for you, and keep that back, dole it out bit by bit.

Also make sure that the work is satisfactory before you pay them. I would contact another pool installer and have them inspect the work after it was done (but before you pay them), it might cost you a little but for me this would be money well spent. My pool is level at the ends but dips in the middle, and the floor is not level either.

Im really SICK!
We are calling our lawyer 1st thing in the morning. Our contract reads (Install 2-3 weeks from contract date or permit dates) We signed the contract on 1/13/08 and have had the permits for 7 weeks. We virbally agreed with John Jr. to start the 1st week in June. (We ended up doing the permits ourselves.)
Do you think I should call John Sr. back and tell him my concerns? He told me to call this Friday 6/13/08 and he would let me know when the install will take place.

I wish too that I saw this board sooner. I actually found it on error and I have been so lucky to have delt with only honest good people.

Thought I'd mention when I called Monday 6/9/08. The person who answered the phone said "Liesure Pools"???

I think John Sr. already knows your concerns since he probably read them right here on this internet board. Talk to your attorney, and definitely call back when he said to and find out what is what.

If it was me, if I didn't find out something on Friday, I'd be down there on Saturday morning finding out what's what in person.

The permit thing is a question for your lawyer, I think.

Sorry, Michele not to pick on you, but how can anyone sign up with these guys when its so simple to go to bbb.org and do a search on Castaway in NJ? If there was one complaint there in '06 when I signed up, I would not have gone with them. A Castaway Pools search on Google, this complaint board is the 3rd item, the new name, Castaway Fiberglass Pools, its 8th?

Geto ut NOW !!! I'n my opinion you are in a difficult position. I suggest you work with your lawyer to get out of the contract if any way possible . I believe by law Castaway is required to have a start date specified on the contract...and if it's not specified this may be your way out of the contract. Regardless, I beleive you will be out of your $5500 deposit. Even if you take them to court and win a judgement chances are you will never see your money. You are better off getting out of the contract and hiring a new pool company to install your pool. Castaway has run up so much debt that no supplier will seel them product unless it's 100% cash only...and even then most suppliers won;t deal with them at all. They have screwed so many subcontractors that none will work for them...so they are left to hiring inexperinced, lousy subs...that will create so many problems it'll end up costing you more to fix than what your total pool contract is worth. And once Castaway starts a job no other pool company will ever walk on your property...they are so bad no one wants to get involved in anything they start. I would suggest you call John Sr. and tell them not to come on your property and that you are retaining legal service to get out of the contract. You are welcome to e-mail me direclty and I can give you much more information to validate the the problems of Castaway .

Well theres not much I can do now, I signed the contract in January and I still have hopes I will have a pool within the next few weeks. My kids will be devistated if we dont get a pool this summer and theres no way Ill be able to find another contractor in such short notice during a heat wave, ect. I dont want to get a pool and close it all in the same month.
I think theres still a good chance Ill be posting back next month that I had a positive experience.

Did anyone here have New Jersey One Call come out and mark the property prior to Castaway digging on their property? I think it's a crime to dig without calling.
