Bogus collection agency
LIE #1. I received a call stating that I needed to address a summons for an old debt. The courts don't call you when you are going to be summoned they just summon you with papers.
LIE #2. Threatens to send the Sheriff's Office. Yeah, police and law officials don't go after payday loans, cell phone bills and old credit card debt. You cannot go to jail for owing money unless it's for child support, bad checks and embezzlement.
LIE #3. You are ruining your credit. The damage is done and the debts they are calling you on are not actionable and the statue of limitations has expired. You can no longer be sued or have people trying to collect on your old dead debt.
The people who I spoke to from APS were hilarious. This has to be some of the most ignorant, rude and inarticulate people in the collection agency business. They are definitely hiring people from the bottom of the barrel and possibly under the barrel.

These scam artist do not pay on the dead debt, they pocket 100% of any money that people send. They only allow people to pay over the phone which is a huge red flag that it is a scam.
Tried to scam me into paying for the loan I've never took
I recently received phone call from the company Affinity Processing Solutions, and the representative started to threaten me and told that I hadn’t paid the percentages of my loan. But I made all the payments on time, and I never delayed any payments. She refused to accept my explanations and told me to pay or they would call the police. I wonder if there are other people, who had the same experience. Can you provide any good piece of advice?
I hoped you stopped payment on the check. This is a predatory collection agency. Your debt was probably dead which means the statute of limitations had expired and the debt can no longer be sued for nor collection of any money. You cannot go to jail over past debt unless it is due to back child support or passing bad checks. You can be sued in court for bad debt but you cannot go to jail. When the collection agency calls you and threatens to summons you with papers and or the Sheriff's Office call their bluff and tell them to go ahead with their plan. Sit back and watch then become very agitated ignorant and rude.

Your debt was probably dead meaning the statue of limitations has expired and you can't be sued or have someone attempt to collect money. If someone threatens to serve you with papers on a debt call their bluff and tell them to go ahead and send the sheriff, then sit back and listen to how ignorant and crazy they become.
You will never go to jail for owing money unless it's because of child support or passing bad checks. You can be sued in court.
I just got called by them and I'm wondering if I should cancel my payment. said I owned for past payday loan back in 2006. That I owe 750 and what could I pay today - I said 300 and they took it.. said I was about to be served w/ papers. - I'm thinking I'm calling bank to stop payment.

A little more insight into debt collections...A debt collector can still try to collect a bad debt, even if the statute of limitations (for legal actions) has run out. They just can't bring any from of legal action against you. The bad debt can not be placed back onto your credit report once the 7 year reporting period has passed. That being said, making a payment to the debt collector will reset the clock on both limitations. Not worth paying the old debt if it already fell off your credit report and has passed the statute. Keep in mind that, in most cases, at this late stage, the collector is collecting for themselves, not the original creditor...A debt buyer will ALWAYS try to get you to pay over the phone. Why? Because most debt buyers have no legal right to demand a penny from the 'debtor' they are trying to collect from. The debt buyer bought the 'balance owed' from the creditor. They did not buy the contract that created the debt. You never agreed to pay the debt buyer anything. Therefore, they can ask you to pay them, but you have no legal obligation to do so. When asked to validate their claim that you owe them money, they can not. The reason they try to get you to make a payment over the phone. By making the payment, you've created a binding contract with the debt buyer where one didn't exist before. What I've just explained is why it is so important to demand that the debt buyer prove their claim before paying them a cent.
